Reiber and Mary L. Reiber of Lincoln, CA. 72 FR 58335–36 (October 15, 2007). The complaint alleges violations of section 337 in the importation into the United States, the sale for importation, and the sale within the United States after importation of certain hard disk drives, components thereof, and products containing the same by reason of infringement of certain claims of U.S. Patent Nos. 6,354,479; 6,651,864; and 6,935,548. The complaint named five respondents: Western Digital Corporation of Lake Forest, CA; Seagate Technology of Scotts Valley, CA; Toshiba American Information Systems, Inc. of Irvine, CA; Hewlett-Packard Company of Palo Alto, CA; and Dell Inc. of Round Rock, TX. The complaint further alleged that an industry in the United States exists as required by subsection (a)(2) of section 337. On April 30, 2008, Complainants filed a motion to terminate the investigation based on withdrawal of the complaint. The Commission Investigative Attorney filed a response in support of Complainants’ motion on May 12, 2008. Also on May 12, 2008, Respondents filed a joint response to Complainants’ motion in which they opposed termination of the investigation until pending motions regarding summary determination, attorneys fees, and sanctions, filed May 5, 2008, have been ruled upon. On May 13, 2008, the ALJ issued the subject ID granting Complainants’ motion to terminate the investigation based on withdrawal of the complaint, pursuant to Commission Rule 210.21(a)(1). No petitions for review of the ID were filed. The Commission has determined not to review the subject ID. AGENCY: SUMMARY: The Commission hereby gives notice of the scheduling of the final phase of countervailing duty investigation No. 701–TA–451 (Final) under section 705(b) of the Tariff Act of 1930 (19 U.S.C. 1671d(b)) (the Act) and the final phase of antidumping investigation Nos. 731–TA–1126–1127 (Final) under section 735(b) of the Act (19 U.S.C. 1673d(b)) to determine whether an industry in the United States is materially injured or threatened with material injury, or the establishment of an industry in the United States is materially retarded, by reason of subsidized imports from China and less-than-fair-value imports from China and Germany of certain lightweight thermal paper, provided for in subheadings 4811.90.80 and 4811.90.90 of the Harmonized Tariff Schedule of the United States.1 For further information concerning the conduct of this phase of the investigations, hearing procedures, and rules of general application, consult the Commission’s Rules of Practice and Procedure, part 201, subparts A through 1 For purposes of these investigations, the Department of Commerce has defined the subject merchandise as ‘‘thermal paper with a basis weight of 70 grams per square meter (‘‘g/m2’’) (with a tolerance of ± 4.0 g/m2) or less; irrespective of dimensions; with or without a base coat on one or both sides; with thermal active coating(s) on one or both sides that is a mixture of the dye and the developer that react and form an image when heat is applied; with or without a top coat; and without an adhesive backing. The merchandise subject to these investigations is provided for in the Harmonized Tariff Schedule of the United States (‘‘HTSUS’’) under subheadings 4811.90.8040, 4811.90.9090, 3703.10.60, 4811.59.20, 4820.10.20, and 4823.40.00.
