Endangered and Threatened Wildlife and Plants; Annual Notice of Findings on Resubmitted Petitions for Foreign Species; Annual Description of Progress on Listing Actions

In this review, we announce our annual petition findings for foreign species, as required under section 4(b)(3)(C)(i) of the Endangered Species Act of 1973, as amended. When, in response to a petition, we find that listing a species is warranted but precluded, we must complete a new status review each year until we publish a proposed rule or make a determination that listing is not warranted. These subsequent status reviews and the accompanying 12-month findings are referred to as ``resubmitted'' petition findings. Information contained in this review describes our status review of 56 foreign taxa that were the subjects of previous warranted-but- precluded findings. Based on our review, we find that 50 species continue to warrant listing, but that their listing remains precluded by higher-priority listing actions (see Table 1). For six species previously found to be warranted but precluded, listing is now warranted. We will promptly publish a listing proposal for those six species. With this review, we are requesting additional status information for the 50 species that remain warranted-but-precluded by higher priority listing actions. We will consider this information in preparing listing documents and future resubmitted petition findings. This information will also help us to monitor the status of the taxa and in conserving them.

The Bureau of Land Management (BLM) has examined and determined that 50 acres of public land (2 parcels) located in Grand County, Utah are suitable for disposal by direct (non-competitive) sale to the Palladium Foundation LLC, the adjacent landowner, at no less than the appraised fair market value, pursuant to Sections 203 and 209 of the Federal Land Policy and Management Act of 1976, as amended. The parcels are isolated from other public lands by adjacent private land and topography and are difficult to manage as part of the public lands. It has been determined that resource values will not be affected by the disposal of the two parcels as mitigated in the patent. The non- competitive sale is justified by lack of physical access to the lands by anyone other than the adjacent landowner. Disposal of the parcels will resolve historic use of the lands for livestock grazing and hay production which have been authorized by BLM under land use permit UTU- 64085 since 1989. The permit will be terminated at the time of sale.

This notice consolidates and clarifies current stay limits on occupancy and/or property on public lands managed by the Bureau of Land Management (BLM) in Montana, North Dakota and South Dakota. Existing limits vary among field offices and states. This notice will establish stay limits on all public lands managed by the BLM as required by 43 CFR 8365 1-2. The proposed stay limits are necessary to protect the natural resources, provide public health, and to provide orderly, equal and consistent use for the public. These proposed stay limits will supersede all existing camping stay limits for BLM administered public lands in Montana, North Dakota & South Dakota published previously.
Upper Rio Grande Basin Water Operations Review

Pursuant to the National Environmental Policy Act of 1969 (as amended), the Bureau of Reclamation (Reclamation), with and on behalf of other joint-lead agencies [U.S. Army Corps of Engineers (Corps), Department of Defense; and the New Mexico Interstate Stream Commission (Commission), State of New Mexico], has prepared and made available to the public a final environmental impact statement (FEIS) to assess the consequences of proposed changes to water operations in the Rio Grande basin above Fort Quitman, Texas. The FEIS is programmatic and is not intended to authorize specific projects in the upper Rio Grande system. It is anticipated that a plan for water operations at existing Reclamation and Corps facilities will be developed. The FEIS presents alternatives with respect to water operations and evaluates the potential effects of each alternative on environmental, hydrologic, cultural, and socioeconomic resources, and Indian Trust Assets, including any potential disproportionate effects on minority or low income communities (environmental justice). The FEIS also evaluates the effects of alternatives on the State of New Mexico's ability to meet its obligations associated with the Rio Grande Compact. Some of the alternatives considered include changing the channel capacity criteria at Albuquerque, storage or non-storage of Rio Grande water in authorized San Juan-Chama space in Abiquiu Reservoir, and possible future resumption of operations of the currently unfunctional Low Flow Conveyance Channel. A draft environmental impact statement (DEIS) was filed with the Environmental Protection Agency on January 20, 2006, and a Notice of Availability for the DEIS was published in the Federal Register on that same date. The original 60-day review and comment period for the DEIS was extended an additional 30 days to April 20, 2006, with publication of a Notice of Extension in the Federal Register on March 24, 2006. During the comment period, one public meeting was held in Colorado, one public meeting was held in Texas, and six public meetings were held in New Mexico. All comments received on the DEIS were carefully reviewed and considered in preparing the FEIS. Where appropriate, revisions were made to the document in response to specific comments. The comments and responses, together with the FEIS, will be considered in determining whether or not to implement the proposed action.

The Bureau of Land Management has received a petition/ application from the United States Fish and Wildlife Service requesting that the Secretary of the Interior withdraw for a 50-year term 328.70 acres of public land from surface entry, and transfer administrative jurisdiction to the Secretary of the Interior, acting through the United States Fish and Wildlife Service, to protect and manage migratory bird and threatened and endangered species habitat. The land is located within the exterior boundaries of the Green Bay Islands National Wildlife Refuge System and was reserved for lighthouse purposes by Executive Orders dated December 11, 1848, and May 28, 1858. These orders will not be disturbed by the proposed withdrawal. This land presently is under the administrative jurisdiction of the United States Coast Guard, which recognizes that wildlife refuge management will make better use of the land than its current outdated use for lighthouse purposes. This notice provides an opportunity to comment on the proposed withdrawal and to request a public meeting.

We are removing five required amendments to the Pennsylvania regulatory program (the ``Pennsylvania program'') regulations under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act) related to alternative reclamation plans; alternative postmining land use determinations; and bond forfeiture sites where reclamation is unreasonable, unnecessary, or impossible. Pennsylvania revised its program to be consistent with the corresponding Federal regulations and SMCRA. We are also approving two of four additional requested changes (not required) to the Pennsylvania program. Pennsylvania revised its program at its own initiative to clarify ambiguities and initiate changes in its fee collection calculations. The two approved changes are in regard to a typographical reference error and the evaluation of bond forfeiture sites. We are deferring our decision on two changes in regard to the discontinuation of a $100 per acre reclamation fee.

This final rule requires lessees of Federal oil and gas leases in the OCS to provide information on how they will conduct their proposed activities in a manner consistent with provisions of the Endangered Species Act (ESA) and the Marine Mammal Protection Act (MMPA). It identifies environmental, monitoring, and mitigation information that lessees must submit with plans for exploration and development and production. This final rulemaking specifies what information the MMS needs to ensure compliance with the OCSLA, the ESA, and the MMPA. The final rule will help assure that lessees conduct their activities in a manner consistent with the provisions of the ESA and the MMPA.

In total, approximately 2,052 acres (ac) (830 hectares (ha)) fall within the boundaries of the critical habitat designation for C. hydrophilum var. hydrophilum in Solano County, California, and approximately 2,276 ac (921 ha) for C. mollis ssp. mollis in Contra Costa, Napa, and Solano Counties, California. Due to overlap of some units, the total area of critical habitat designation for both subspecies is 2,621 ac (1,061 ha).

Pursuant to the National Environmental Policy Act (Pub. L. 91-190) and the Wild and Scenic Rivers Act (Pub. L. 90-542), the National Park Service is initiating public scoping for the conservation planning and environmental impact analysis process for a Merced Wild and Scenic River Comprehensive Management Plan (MRP) and Environmental Impact Statement (EIS) in Yosemite National Park. The MRP/EIS will be a comprehensive document that guides future management of the Merced River corridor, and will comply with all applicable legal requirements. The purpose of this scoping outreach is to solicit early public comments about issues and concerns that should be addressed in the plan, including a suitable range of alternatives, appropriate mitigation measures, and the nature and extent of potential environmental impacts. Background: In 1987, Congress designated 122 miles of the Merced River and its South Fork as Wild and Scenic, including the 81 miles within Yosemite National Park and the El Portal Administrative Site. The National Park Service (NPS) completed the Merced Wild and Scenic River Comprehensive Management Plan/Final Environmental Impact Statement in August, 2000. Soon after, two citizen's groups filed suit in the U.S. District Court for the Eastern District of California. This initiated a series of court proceedings that culminated in a 2006 District Court decision that invalidated the park's revised 2005 plan, the Merced Wild and Scenic River Revised Comprehensive Management Plan/ Supplemental Environmental Impact Statement. Subsequently, the court ordered the NPS to prepare a new comprehensive management plan. On January 9, 2007, the NPS proposed a 33-month timeline to the court for the preparation of the new MRP/EIS, which would result in a Record of Decision on September 30, 2009. Scoping and Public Meetings: The participation of interested individuals and organizations is important to the conservation planning and environmental impact analysis process. During the scoping phase, the public is invited to share ideas and concerns that should be considered in development of the draft MRP. Yosemite National Park will consult tribal, federal, state, and local governments, and will receive public input during an extended period concluding 60 days from the date of publication of this Notice in the Federal Register. The scoping period will be publicized via the internet, direct mailings, and press releases distributed to local and regional media. Dates, times, specific locations, and additional information will be available in regional and local news sources, and updates will be available at https://www.nps.gov/yose/planning/.
