Notice of Intent To Prepare an Environmental Assessment for the Proposed Borrego Pipeline in Webb County, Texas

Borrego Crossing Pipeline, LLC (Borrego) has applied to the U.S. Department of State (Department) for a Presidential Permit authorizing the construction, connection, operation, and maintenance of facilities at the border of the United States for the export of refined petroleum products from the United States to markets in northern Mexico (Borrego Pipeline). The Department receives and considers applications for Presidential Permits for such energy-related pipelines pursuant to authority delegated to it by the President under E.O. 13337 of April 30, 2004 (69 FR 25299), as amended. To issue a Permit, the Department must find that issuance would serve the national interest. With respect to the application submitted by Borrego, the Department is issuing this Notice of Intent (NOI) to inform the public that it will prepare an Environmental Assessment (EA) consistent with the National Environmental Policy Act of 1969 (NEPA) (as implemented by the Council on Environmental Quality Regulations found at 40 CFR parts 1500-1508) to evaluate the potential impacts of the Borrego Pipeline to inform the national interest determination. This NOI informs the public about the proposed project and solicits participation and comments from interested federal, tribal, state, and local government entities as well as the public to help inform the scope and content of the EA.
Amendment to the International Traffic in Arms Regulations: Revision of U.S. Munitions List Category XII

As part of the President's Export Control Reform effort, the Department of State amends the International Traffic in Arms Regulations (ITAR) by revising Category XII (fire control, laser, imaging, and guidance equipment) of the U.S. Munitions List (USML) to remove certain items from control on the USML and to describe more precisely the articles continuing to warrant control on the USML. The Department also amends USML Categories VIII, XIII, and XV to reflect that items previously described in those Categories are now controlled under the revised Category XII or Commerce Control List. Further, the Department revises USML Category XI to move items to the CCL as a result of changes to related control in USML Category XII.

In accordance with the Federal Advisory Committee Act (FACA), the PEPFAR Scientific Advisory Board (hereinafter referred to as ``the Board'') will meet on Tuesday, November 1, 2016 at 1800 G St. NW., Suite 10300, Washington DC 20006. The meeting will last from 8:30 a.m. until approximately 5:30 p.m. and is open to the public. The meeting will be hosted by the Office of the U.S. Global AIDS Coordinator and Health Diplomacy, and led by Ambassador Deborah Birx, who leads implementation of the President's Emergency Plan for AIDS Relief (PEPFAR), and the Board Chair, Dr. Carlos del Rio. The Board serves the Global AIDS Coordinator in a solely advisory capacity concerning scientific, implementation, and policy issues related to the global response to HIV/AIDS. These issues will be of concern as they influence the priorities and direction of PEPFAR evaluation and research, the content of national and international strategies and implementation, and the role of PEPFAR in international discourse regarding an appropriate and resourced response. Topics for the meeting will include follow-up discussions of previous Board recommendations on financing and economics, and tuberculosis-HIV co- infection; updates on PEPFAR 3.0 programmatic activities in a number of areas including pre-exposure prophylaxis in pregnant and breastfeeding women; HPV testing in people living with HIV; voluntary medical male circumcision; and financing, data usage and increasing civil society engagement in PEPFAR processes and decisions. This rule amends a regulation that establishes the different types of passports issued by the Department of State. A definition for special issuance passports is added. Amendments establish a new service passport, which may be approved for certain non-personal services contractors who travel abroad in support of and pursuant to a contract with the U.S. government, and make corresponding changes regarding official and diplomatic passports. The service passport will demonstrate a contractual relationship between the bearer's employer and the U.S. government as the reason for travel, thereby continuing to demonstrate the individual's support function on behalf of the U.S. government, but nevertheless signaling a more attenuated relationship with the U.S. government than that enjoyed by direct hire employees. The U.S. government incurs significant additional cost annually in delays and fees because foreign governments do not recognize contractors as doing work for the U.S. government. By more clearly demonstrating the attenuated relationship, the Department will eliminate such waste. The regulation is amended to establish the validity of the new service passport and clarify the grounds for invalidity of a special issuance passport.

Notice is hereby given that the Department of State (DOS) has received an application from Borrego Crossing Pipeline, LLC (``Borrego'') for a Presidential Permit authorizing the construction, connection, operation, and maintenance of pipeline facilities for the export of refined petroleum products. If the application is approved, the proposed pipeline facilities will transport refined products, including gasoline, ultra-low-sulfur diesel (``ULSD''), and jet fuel across the U.S.-Mexican border under the Rio Grande River. Minimum pipeline depth under the river bed will be 45 feet, and minimum pipeline depth under the river surface at the river banks will be 65 feet. The ultimate parent corporation of Borrego is Howard Midstream Energy Partners, LLC (``HEP''). Under E.O. 13337, the Secretary of State is designated and empowered to receive all applications for Presidential Permits for the construction, connection, operation, or maintenance, at the borders of the United States, of facilities for the exportation or importation of liquid petroleum, petroleum products, or other nongaseous fuels to or from a foreign country. The Department of State has the responsibility to determine whether issuance of a new Presidential Permit for construction, connection, operation, and maintenance of the proposed Borrego pipeline border facilities would serve the U.S. national interest. The Department will conduct an environmental review consistent with the National Environmental Policy Act of 1969. The Department will provide more information on the review process in a future Federal Register notice. The Department of State (``State Department'') hereby gives notice that, on September 7, 2016, it received an application from the Texas Department of Transportation (TXDOT) for an Amended Presidential Permit to construct a second bridge structure for southbound traffic on the U.S.-Mexico border at Presidio, Texas and Ojinaga, Chihuahua, Mexico. The State Department issued the original Presidential Permit to Presidio County on July 2, 1976, and an Amended Presidential Permit to TXDOT on May 4, 1982. The application may be found at: http:// www.state.gov/documents/organization/261891.pdf. The State Department's review of this application is based upon Executive Order 11423 of August 16, 1968, as amended. As provided in E.O. 11423, the State Department is circulating this application to relevant federal agencies for review and comment. Under E.O. 11423, the Department has the responsibility to determine, taking into account views from these agencies and other stakeholders, whether issuing an Amended Presidential Permit to TXDOT to construct a second bridge structure for southbound traffic would serve the national interest. That determination process involves consideration of many factors, including foreign policy; environmental, cultural, and economic impacts; compliance with applicable law and regulations; and other issues. The Bureau of South and Central Asian Affairs (SCA) of the U.S. Department of State (Department) requests proposals from private U.S. individuals, firms, associations and organizations (for-profit or non-profit) for the design, development, installation, operation (including managing sponsorship donations and sponsorship fulfillment), and final disposition of a U.S. Pavilion at the International Exposition Astana Expo 2017, whose theme is ``Future Energy.'' The Department will issue a ``letter of intent'' to the selected proposer authorizing that entity to proceed with all fundraising necessary to complete the USA Pavilion project. Note that all prospective donors must be vetted with the Department for potential conflicts of interest. The Department is not authorized to provide federal funding for any aspect of the U.S. Pavilion at Astana Expo 2017. The successful proposer will be responsible for all costs associated with all aspects of the U.S. Pavilion as well as all support for the U.S. Commissioner General. The successful proposer will consult closely with and follow the direction of Department officials and the U.S. Commissioner General with respect to Pavilion content and programming. Proposals from non- U.S. citizens or non-U.S.-owned firms or organizations shall be deemed ineligible for consideration.
