Meeting of the U.S.-Chile Environment Affairs Council
The Department of State and the Office of the United States Trade Representative (USTR) are providing notice that, as set forth in Chapter 19 (Environment) of the U.S.-Chile Free Trade Agreement (FTA), the tow governments intend to hold the second meeting of the Environment Affairs Council (the ``Council'') in Washington, DC on October 24, 2005. U.S. Deputy Assistant Secretary Claudia McMurray and Chilean Under Secretary Rodrigo Egana will jointly chair the Council meeting. The purpose of this meeting is detailed below under SUPPLEMENTARY INFORMATION. In this notice, the Department of state and USTR are requesting: (1) Written comments from the public regarding agenda items for the Council meeting; (2) written comments regarding the implementation of the eight cooperative projects listed in Annex 19.3 of Chapter 19 (Environment) of the FTA, particularly Reducing Mining Pollution and Sharing Private Sector Expertise (in the initial implementation stages); (3) written comments regarding implementation of Chapter 19's framework for public participation; and (4) written suggestions for future bilateral environmental cooperation between the United States and the Republic of Chile. New Passport Amendment Policy
This rule amends the passport regulations to abolish the U.S. passport amendment process, except for the convenience of the U.S. Government, and broadens the reasons for issuing a replacement passport at no additional cost to the applicant. The rule also adds unpaid fees as a ground for invalidating a passport.

Renewal of the Charter of the Advisory Committee on Cultural Diplomacy
The Department of State announces that the charter of the Advisory Committee on Cultural Diplomacy has been renewed for an additional two-year period, to expire on August 31, 2007. The Department of State announces that the charter of the Advisory Committee on Cultural Diplomacy, established under Public Law 107-228, section 224, has been renewed for an additional two-year period. The charter will now expire on August 31, 2007. The Advisory Committee on Cultural Diplomacy was established to ``advise the Secretary on programs and policies to advance the use of cultural diplomacy in United States foreign policy.''

Visas: Treaty Trader, Treaty Investor, or Treaty Alien in a Specialty Occupation
This rule expands the definition of treaty trader and treaty investor contained at 22 CFR 41.51 to include a new nonimmigrant category (E-3) for nonimmigrant treaty aliens coming to the United States solely to perform services in a specialty occupation. It also reorganizes existing regulatory language pertaining to treaty traders and treaty investors to make this information clearer and easier to read.
Documents Required for Travel Within the Western Hemisphere
Under the Immigration and Nationality Act (INA), nonimmigrant aliens and United States citizens are generally required to present passports to enter the United States. The Secretary of Homeland Security and the Secretary of State have the joint authority to waive this requirement for nonimmigrant aliens under certain circumstances and the Secretary of State has the authority to make exceptions to the requirement for United States citizens. In accordance with those authorities, current regulations permit United States citizens and nonimmigrant aliens from Canada, Bermuda and Mexico to enter the United States from certain Western Hemisphere countries without presenting a passport. On December 17, 2004, the President signed the Intelligence Reform and Terrorism Prevention Act of 2004 (IRTPA). Section 7209 of this statute limits the Secretaries' discretion to waive or to make exceptions to the passport requirements under the INA and expressly provides that, by January 1, 2008, United States citizens and nonimmigrant aliens may enter the United States only with passports or such alternatives as the Secretary of Homeland Security may designate as satisfactorily establishing identity and citizenship. In the future, as a result of the implementation of the new statute, travel to the United States by United States citizens and others from the Western Hemisphere will require a passport or acceptable alternative documents in circumstances where travel was previously permitted without such documents. Section 7209 directs that the Secretary of Homeland Security, in consultation with the Secretary of State, develop and implement a plan relating to the new requirements ``as expeditiously as possible.'' The statute provides that this plan shall be implemented no later than January 1, 2008. The Secretary of Homeland Security, in consultation with the Secretary of State, will be deciding how to implement the new law. This Advance Notice of Proposed Rulemaking announces the rulemakings that are expected to implement the new law, invites comments on the possible means of implementation and specifically invites comments on the documents other than passports that should be accepted under section 7209 as sufficient to establish citizenship and identity.
