On May 18, 2023, the U.S. Department of Housing and Urban Development (HUD) and U.S. Department of Agriculture (USDA) published in the Federal Register a notice of preliminary determination entitled ``Adoption of Energy Efficiency Standards for New Construction of HUD- and USDA-Financed Housing: Preliminary Determination and of Comment,'' announcing the two agencies' joint preliminary determination, as required under section 481(d)(1) of the Energy Independence and Security Act of 2007 (EISA), that adoption of the 2021 IECC and ASHRAE 90.1-2019 code standards will not negatively affect the affordability and availability of housing for new construction of HUD and USDA housing covered by EISA and seeking public comment on the preliminary determination. The preliminary determination is the first step to ultimately requiring compliance with these standards in HUD and USDA housing covered by EISA. The notice provided for a 60-day comment period, which would have ended July 17, 2023. HUD has determined that a 21-day extension of the comment period, until August 7, 2023, is appropriate. This extension will allow interested persons additional time to analyze the preliminary determination and prepare their comments.

This notice serves as a complementary document to the Economic Growth Regulatory Relief and Consumer Protection Act: Implementation of National Standards for the Physical Inspection of Real Estate (NSPIRE) rule published May 11, 2023. The NSPIRE rule provides that HUD will publish in the Federal Register the NSPIRE inspection standards and scoring methodology to assess the overall condition, health, and safety of properties and units assisted or insured by HUD. The NSPIRE Standards were published for public comment on June 17, 2022 and posted as final on June 22, 2023. On March 28, 2023, HUD published a proposed scoring methodology for public comment. HUD establishes with this notice the NSPIRE physical inspection scoring and ranking methodology to implement HUD's NSPIRE rule for Public Housing and Multifamily Housing programs, including Section 8 Project-Based Rental Assistance (PBRA) and other Multifamily assisted housing, Section 202/811 programs, and HUD-insured Multifamily as described in the NSPIRE rule. The scoring methodology converts observed defects into a numerical score and sets a threshold for HUD to perform additional administrative oversight by establishing a level for when a property fails an inspection (less than 60 points) and when an enforcement referral is automatic or required (less than or equal to 30 points).

The United States Housing Act of 1937 (USHA) requires the Secretary to publish FMRs periodically, but not less than annually, adjusted to be effective on October 1 of each year. The primary uses of FMRs are to determine payment standards for the Housing Choice Voucher (HCV) program, to determine initial renewal rents for some expiring project-based Section 8 contracts, and to serve as rent ceilings for rental units in both the HOME Investment Partnerships Program and the Emergency Solutions Grants Program and a primary rent standard option for the Housing for Opportunities for Persons With AIDS (HOPWA) program. HUD also uses FMRs in the calculation of maximum award amounts for Continuum of Care grantees and in the calculation of flat rents for Public Housing units. To better determine payment standards and related parameters for HUD programs, HUD proposes changes in how FMRs are calculated in this notice and seeks public comment on the proposed changes. In accordance with the Build America, Buy America Act (BABA), this notice advises that HUD is extending the previously issued public interest, general applicability waiver for an additional period of one year to the Buy America Domestic Content Procurement Preference (``Buy America Preference,'' or ``BAP'') as applied to Federal Financial Assistance (``FFA'') provided to Tribes, Tribally Designated Housing Entities (``TDHE''s), and other Tribal Entities (hereinafter collectively ``Tribal Recipients'').

In March 2023, HUD allocated more than $3 billion in Community Development Block Grant Disaster Recovery (CDBG-DR) funds appropriated by the Continuing Appropriations Act, 2023 and the Department of Housing and Urban Development Appropriations Act, 2023 for major disasters occurring in 2022. This Allocation Announcement Notice identifies grant requirements for these funds, including requirements in HUD's CDBG-DR Consolidated Notice (``Consolidated Notice'') found in Appendix B, and a limited number of amendments to the Consolidated Notice that apply to CDBG-DR grants for disasters occurring in 2020, 2021, and 2022. The Consolidated Notice, as amended by this Allocation Announcement Notice, includes waivers and alternative requirements, relevant regulatory requirements, the grant award process, criteria for action plan approval, and eligible disaster recovery activities.
Adoption of Energy Efficiency Standards for New Construction of HUD- and USDA-Financed Housing: Preliminary Determination and Solicitation of Comment

The Energy Independence and Security Act of 2007 (EISA) establishes procedures for the U.S. Department of Housing and Urban Development (HUD) and the U.S. Department of Agriculture (USDA) to adopt periodic revisions to the International Energy Conservation Code (IECC) and to ANSI/ASHRAE/IES Standard 90.1: Energy Standard for Buildings, Except Low-Rise Residential Buildings (ASHRAE 90.1), subject to a determination by HUD and USDA that the revised codes do not negatively affect the availability or affordability of new construction of single and multifamily housing covered by EISA, and a determination by the Secretary of Energy that the revised codes ``would improve energy efficiency.'' This Notice announces the preliminary determination of HUD and USDA, as required under section 481(d)(1) of EISA, that the 2021 IECC and ASHRAE 90.1-2019 will not negatively affect the affordability and availability of housing covered by EISA. In making this preliminary determination, the first step to ultimately requiring compliance with these standards in HUD and USDA housing covered by EISA, this Notice relies on several studies that show that these codes are cost effective in that the incremental cost of the additional efficiency measures pays for themselves with energy cost savings on a life-cycle basis.
