Nondiscrimination on the Basis of Disability: Updates to HUD's Section 504 Regulations
This advanced notice of proposed rulemaking (ANPRM) seeks the public's input on changes that the Department of Housing and Urban Development (HUD or the Department) is considering to its implementing regulations for Section 504 of the Rehabilitation Act of 1973 (Section 504) for federally assisted and HUD conducted programs and activities. Section 504 prohibits discrimination on the basis of disability in all programs and activities receiving Federal financial assistance and in programs and activities conducted by executive agencies. After this ANPRM is published, the Department intends to draft a Notice of a Proposed Rulemaking (NPRM) that would propose the adoption of an updated Federal accessibility standard for purposes of compliance with HUD's Section 504 regulations. In addition, the Department intends for this NPRM to propose revisions to HUD's Section 504 regulations to clarify recipients' obligations, including how to account for advances in accessible design, information and communication technology, and assistive technologies that have become available since HUD's Section 504 regulations were originally published in 1988.
Extension of Public Interest, General Applicability Waiver of Build America, Buy America Provisions as Applied to Tribal Recipients of HUD Federal Financial Assistance: Extension of Public Comment Period
On April 7, 2023, HUD posted on its website for public comment an extension to its previously issued public interest, general applicability waiver for the Buy America Domestic Content Procurement Preference (``Buy America Preference,'' or ``BAP'') as applied to Federal Financial Assistance (``FFA'') provided to Tribes, Tribally Designated Housing Entities (``TDHE''s), and other Tribal Entities (hereinafter collectively ``Tribal Recipients''). Specifically, HUD's notice proposed that the waiver continue for an additional one-year period. The notice also established an April 24, 2023, deadline for public comment. The notice was also published in the Federal Register on April 12, 2023. Through today's notice, HUD announces that it is extending the public comment period on its ``Extension of Public Interest, General Applicability Waiver of Build America, Buy America Provisions as Applied to Tribal Recipients of HUD Federal Financial Assistance'' to May 8, 2023.
Notice of Change to an Expenditure Deadline Under the CARES Act for Community Development Block Grant Program Coronavirus Response Grants
On August 20, 2020, HUD issued a notice providing for the program rules, statutory and regulatory waivers, and alternative requirements applicable to supplemental Community Development Block Grant (CDBG) funds made available to prevent, prepare for, and respond to coronavirus (CDBG-CV funds) and to annual formula CDBG grants awarded in fiscal years 2019 and 2020. This notice describes a change to one of the regulatory waivers and alternative requirements applicable to the CDBG-CV funds. The change removes the requirement that eighty percent of a grant must be expended within three years of grant agreement execution. Except as otherwise described in this notice, the August 2020 Notice, the CARES Act, and the statutory and regulatory provisions governing the CDBG program continue to apply to CDBG-CV funds.

Section 8 Housing Assistance Payments Program-Fiscal Year (FY) 2023 Inflation Factors for Public Housing Agency (PHA) Renewal Funding
This notice establishes Renewal Funding Inflation Factors (RFIFs) to adjust Fiscal Year (FY) 2023 renewal funding for the Housing Choice Voucher (HCV) Program of each public housing agency (PHA), as required by the Consolidated Appropriations Act, 2023. The notice apportions the expected percent change in national Per Unit Cost (PUC) for the HCV program, 9.60 percent, to each PHA based on the change in Fair Market Rents (FMRs) for their operating area to produce the FY 2023 RFIFs. HUD's FY 2023 methodology is the same as that which was used in FY 2022.

Affirmatively Furthering Fair Housing; Extension of Comment Period
On February 9, 2023, HUD published in the Federal Register a notice of proposed rulemaking entitled ``Affirmatively Furthering Fair Housing'', proposing to implement the obligation to affirmatively further the purposes and policies of the Fair Housing Act, which is title VIII of the Civil Rights Act of 1968, with respect to certain recipients of HUD funds. The proposed rule provided for a 60-day comment period, which would have ended April 10, 2023. HUD has determined that a 14-day extension of the comment period, until April 24, 2023, is appropriate. This extension will allow interested persons additional time to analyze the proposal and prepare their comments.
