Notice of Submission of Proposed Information Collection to OMB; Emergency Comment Request; Section 8 Random Digit Dialing Fair Marketing Rent Surveys
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for emergency review and approval, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. These surveys provide HUD with a way to estimate Section 8 Fair Market Rents (FMRs) in areas not covered by the American Community Survey annual reports and in areas where FMRs are believed to be incorrect. The affected public would be those renters random selected to be surveyed and Section 8 voucher holders. The change in this request from what has been approved is to include the use of cell phones, mail surveys and web-based surveys. The burden on the respondent and on those contacted but screened out is to less than in the previous requests because fewer surveys are being conducted. Minor changes have been made to the survey instrument to make it clearer .

On April 8, 2011, HUD posted the Notice of Funding Availability (NOFA) for the Fiscal Year (FY) 2011 Asthma Interventions in Public and Assisted Multifamily Housing Program to Grants.gov (FR- 5500-N-06). The NOFA announced the availability of information on applicant eligibility, submission deadlines, funding criteria, and other requirements for HUD's FY 2011 Asthma Interventions in Public and Assisted Multifamily Housing Program. The posted NOFA indicated the total amount of funding available was subject to enactment of HUD appropriations. On May 12, 2011, HUD posted an amendment to the NOFA which provided the funding available as a result of enactment of the HUD appropriations Act, the Department of Defense and Full-Year Continuing Appropriations Act, 2011, Public Law 112-10, approved April 15, 2011, and other technical corrections. Based on the enactment of the FY 2011 HUD appropriations, approximately $2 million is available for the Asthma Interventions in Public and Assisted Multifamily Housing Program. The notice also amended the deadline date for applications as a result of the technical corrections. The new deadline date for this NOFA is 11:59:59 p.m. June 14, 2011. The purpose of the Asthma Interventions in Public and Assisted Multifamily Housing program is to fund demonstration projects to improve asthma control among children and others currently residing in Federally assisted multifamily housing developments that are administered by local public housing authorities (i.e., public housing) as well as privately owned multifamily housing that is subsidized by HUD (e.g., Project-based Section 8, section 202, and section 811 housing). On May 10, 2011, HUD posted an amendment to the NOFA which provided the funding available as a result of enactment of the HUD appropriations Act, the Department of Defense and Full-Year Continuing Appropriations Act, 2011, Public Law 112-10, approved April 15, 2011, and other technical Corrections. Based on the enactment of the FY2011 HUD appropriations, approximately $95.5 million is available for the programs in this NOFA. Of this amount, approximately $47.5 million is available for the Lead-Based Paint Hazard Control Program and $48 million for the Lead Hazard Reduction Demonstration Grant Program. The notice also amended the deadline date for applications and made other technical corrections to the NOFA. As a result of these technical corrections, the new deadline date for this NOFA is 11:59:59 p.m. June 10, 2011. The purpose of the Lead-Based Paint Hazard Control Grant Program and the Lead Hazard Reduction Demonstration Grant Program is to assist states, Native American Tribes, cities, counties/parishes, or other units of local government in undertaking comprehensive programs to identify and control lead-based paint hazards in eligible privately owned rental or owner-occupied housing with the exception that the Lead Hazard Reduction Demonstration Grant Program is targeted to urban jurisdictions with the greatest lead-based paint hazard control needs. Notice of Submission of Proposed Information Collection to OMB Continuation of Interest Reduction Payments After Refinancing Section 236 Projects
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. Owners of Section 236 projects may submit information to HUD to request continuation of interest reduction payments after refinancing. As part of these refinancing transactions, HUD requires the execution of interest Reduction Payment Agreements and Use Agreements. HUD uses the information to ensure that projects are maintained as low-income housing resources.

HUD announces the availability on its Web site of the applicant information, submission deadlines, funding criteria, and other requirements for HUD's FY2011 Section 4 Capacity Building for Community Development and Affordable Housing Grants. Specifically, this NOFA announces the availability of approximately $49.9 million is made available under the Department of Defense and Full-Year Continuing Appropriations Act, 2011, Public Law 112-10, approved April 15, 2011. Of these funds at least $5 million shall be made available for rural capacity building activities. Purpose: Through funding of national intermediaries, the Section 4 Capacity Building program enhances the capacity and ability of community development corporations (CDCs) and community housing development organizations (CHDOs) to carry out community development and affordable housing activities that benefit low-income families. Background: The competition is limited to the organizations identified in the Department of Defense and Full-Year Continuing Appropriations Act, 2011. Public Law 112-10, approved April 15, 2011. The purpose of the program is to provide technical assistance to one or more entities to develop a course on Fair Housing Testing, and to conduct technical assistance to promote a greater and more consistent use of Testing Methodologies among FHIP organizations. Testing represents the most effective investigative tool in uncovering and corroborating claims of unlawful discrimination. Improving the quality and consistency of testing used by FHIP organizations will increase the persuasiveness and acceptance of tests in litigation. Notice of Availability of the Final Environmental Impact Statement for the Yesler Terrace Redevelopment Project
The Department of Housing and Urban Development (HUD) gives notice to the public, agencies, and Indian Tribes that the Seattle Housing Authority and the City of Seattle Human Services Department (Community Development Block Grant Administration Unit) have prepared a Final Environmental Impact Statement (FEIS) for the Yesler Terrace Redevelopment Project, located in the City of Seattle, King County, Washington. The project proponent is the Seattle Housing Authority (SHA). The FEIS is a joint National Environmental Policy Act (NEPA) and Washington State Environmental Policy Act (SEPA) document. The proposed action is subject to compliance with NEPA because funds from the public housing programs under Title I of the United States Housing Act of 1937 (HOPE VI, Capital Funds, Demolition/Disposition) will be used for this project (24 CFR 58.1(b)(6)(i)). This notice is given in accordance with Council on Environmental Quality regulations at 40 CFR parts 1500-1508, and with state and local SEPA regulations. The City of Seattle Human Services Department (City HSD) and SHA, acting jointly as lead agencies, have prepared the FEIS under the authority of the City HSD as the Responsible Entity for compliance with NEPA in accordance with 42 U.S.C. 1437x and HUD regulations at 24 CFR 58.4, and under SHA's role as SEPA lead agency. SEPA Compliance and Action: The FEIS satisfies requirements of SEPA (RCW 43.21C and WAC 197-11), which requires that all state and local government agencies consider the environmental impacts of projects before acting on those projects. Under SEPA, it is anticipated that the SHA Board of Commissioners will adopt a resolution approving a Development Plan for Yesler Terrace, and adopting the FEIS for SEPA purposes. Section 8 Housing Assistance Payments Program-Renewal Funding Annual Adjustment Factors, Fiscal Year 2011
The Consolidated Appropriations Act, 2010, directs Public and Indian Housing to ``provide renewal funding for each Public Housing Agency (PHA) based on Voucher Management System (VMS) leasing and cost data for the most recent Federal fiscal year and by applying the most recent Annual Adjustment Factors as established by the Secretary.'' The Department of Defense and Full-Year Continuing Appropriations Act, 2011, continues this requirement. This Notice announces Renewal Funding AAFs in response to that directive which was first applicable when FY2010 Renewal Funding AAFs were published. Consumer Price Index (CPI) data, similar to those used for ``Contract Rent AAFs'', are used, but semi-annual CPI data replaces annual CPI data. This makes the Renewal Funding AAFs six months more current than the CPI data used to derive Contract Rent AAFs. These CPI are the most current data available and reflect the economic circumstances most relevant to the Housing Choice Voucher (HCV) program in 2011 and the assumptions of the 2011 budget. Like the Contract Rent AAFs, these factors are based on a formula using residential rent and utility cost changes. Buy American Exceptions Under the American Recovery and Reinvestment Act of 2009
In accordance with the American Recovery and Reinvestment Act of 2009 (Pub. L. 111-05, approved February 17, 2009) (Recovery Act), and implementing guidance of the Office of Management and Budget (OMB), this notice advises that certain exceptions to the Buy American requirement of the Recovery Act have been determined applicable for work using Capital Fund Recovery Formula and Competition (CFRFC) grant funds. Specifically, exceptions were granted to the Denver Housing Authority for the purchase and installation of Underwriter Laboratory- listed (UL-Listed) drop in anchor materials for the Osage Apartments project, the Luzerne County Housing Authority of Luzerne County, PA, for the purchase and installation of through-the-wall air-conditioning units for the Frank Crossin Towers project, and to the Dakota County Community Development Agency of Dakota County, MN, for the purchase and installation of a ductless split air conditioning unit at the Colleen Loney Manor project.

The competitive application Project Budget Summary is used by HOPWA competitive grants applicants to identify funding requests by eligible activity and to show how these resources will be used over the three grant periodthis form also includes the accompanying program certifications. HOPWA formula and competitive grantees are required to submit annual performance reports that enables an assessment of grantee progress towards implementing the HOPWA housing stability annual performance outcome measure while measuring project success against planned and actual accomplishments.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The County Data Record Project will acquire, assemble, standardize and summarize Parcel data from 127 countries and 27 corresponding states that have received HUD funding. Parcel data is geographically referenced information about the ownership, rights and interests of land parcels and HUD is specifically interested in parcel data related to tax assessment, property sale, easement, lien, land use and condition.
Notice of Submission of Proposed Information Collection to OMB; Public Housing Physical Needs Assessment
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. PHAs will complete a PNA once every 5 years, will update the PNA annually, and will submit information electronically to HUD. The information is used by PHAs as a strategic and capital planning tool. The information uploaded to HUD will be used for aggregation of an estimate of the capital needs across the Public Housing portfolio and evaluation of the impact of the Capital Fund in meeting the physical needs based upon review of the annual updates.
Notice of Submission of Proposed Information Collection to OMB; Public Housing Assessment System (PHAS) Memorandum of Agreement (MOA), MOA Monthly Report, and Improvement Plan (IP)
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. A Public Housing Agency (PHA) which is designated Troubled or substandard under the Public Housing Assessment System (PHAS) must enter into a Memorandum of Agreement (MOA) with HUD to outline its planned improvements. Similarly, a PHA which is a standard performer, but receives a total PHAS score between 70% and 60% must submit an Improvement Plan (IP). These plans are designed to address deficiencies in a PHA's operations found through the PHAS assessment process (management, financial, physical, or resident related) and any other deficiencies identified by HUD through independent assessments or other methods.
HUD Multifamily Rental Projects: Regulatory Revisions
This rule amends certain Federal Housing Administration (FHA) regulations to update these regulations to reflect current HUD policy in the area of multifamily rental projects. On November 12, 2010, HUD published proposed regulations to remove outdated regulatory language and policies and to reflect proposed changes in FHA's multifamily rental project closing documents, issued for comment in January 2010, and again in December 2010. The issuance of revised multifamily rental project closing documents for public comment and corresponding regulatory changes first commenced in 2004, but was not completed. This final rule follows the November 12, 2010 proposed rule, and takes into consideration public comments received on the November 2010 proposed rule, as well as certain comments received on HUD's issuance of further revised multifamily rental project closing documents made available for public comment by notice published on December 22, 2010. Neither the closing documents issued for comment in January 2010 and December 2010, nor this final rule include changes affecting closing documents or regulations for healthcare facilities, nursing homes, intermediate care facilities, board and care homes, and assisted living facilities.
HUD Multifamily Rental Project Closing Documents: Notice Announcing Final Approved Documents and Assignment of OMB Control Number
This notice announces that the multifamily rental project closing documents have completed the notice and comment processes and review by the Office of Management and Budget (OMB) as required by the Paperwork Reduction Act, and that OMB has assigned a control number to the documents. The final versions of the documents can be found on HUD's Web site at https://www.hud.gov/offices/hsg/mfh/ mfhclosingdocuments.cfm. Additionally, this notice highlights some of the changes made by HUD to the documents based upon its review of the comments submitted in response to a December 22, 2010 notice.
