Homeowners participating in the program must also receive housing counseling and the confirmation that the counseling has been performed must be documented.

On March 8, 2006, HUD published its Fiscal Year (FY) 2006 SuperNOFA (SuperNOFA), for HUD's Discretionary Grant Programs. This document modifies the HSIAC Program. The notice published today announces that ``Construction, renovation, expansion of an institution's own facilities'' is an eligible activity. As a result, HUD is reopening the competition for available funds. The application deadline date is now June 29, 2006. Applicants who have already submitted applications may submit new and complete applications to reflect this change. These changes do not affect the application package for the HSIAC Program NOFA on Grants.gov.

On March 8, 2006, HUD published its Fiscal Year (FY) 2006 SuperNOFA (SuperNOFA), for HUD's Discretionary Grant Programs. This document makes corrections to the Resident Opportunity and Self- Sufficiency (ROSS) Elderly/Persons with Disabilities Program, ROSS Family and Homeownership Program, the Public Housing Neighborhood Networks, and the Public and Indian Housing Family Self-Sufficiency Program Coordinators Under Resident Opportunities and Self-Sufficiency (Public Housing Family Self-Sufficiency) Program. The technical correction published today announces the addition of funds available for the above listed NOFAs for FY2006 from previously unobligated FY2004 and FY2005 funds. As a result of this additional funding, today's notice also increases the maximum grant amount available for ROSS Elderly/Persons with Disabilities, ROSS Family and Homeownership, and Public Housing Neighborhood Networks programs. Today's notice also makes a number other minor clarifications and corrections to these programs as published in the March 8, 2006, SuperNOFA. These changes affect the NOFAs listed and the corresponding Instruction Downloads on Grants.gov, but do not affect the application packages.
Prohibition on Use of Community Development Block Grant Assistance for Job-Pirating Activities

On December 23, 2005, HUD published an interim rule implementing certain statutory changes by revising HUD's regulations for the Community Development Block Grant (CDBG) program. Specifically, the interim rule prohibited state and local governments from using CDBG funds for ``job-pirating'' activities that are likely to result in significant job loss. The rule also applied to section 108 loan guarantees and the use of Brownfields Economic Development Initiative and Economic Development Initiative funds with section 108 loan guarantees and CDBG funding. This final rule follows publication of the December 23, 2005, interim rule, and makes no changes at this final rule stage.
Community Development Block Grant Program; Revision of CDBG Eligibility and National Objective Regulations

This final rule revises the Community Development Block Grant (CDBG) program regulations to clarify the eligibility of brownfields cleanup, development, or redevelopment within existing program eligibility categories. In addition, this final rule makes changes to CDBG national objectives that relate to brownfields and clarifies regulatory language. The final rule expands the ``slums or blight'' national objective criteria to include known and suspected environmental contamination, as well as economic disinvestment, as blighting influences. The rule also expands the definition of ``clearance'' to include remediation of known or suspected environmental contamination. The rule requires grantees to establish definitions of blighting influences and to retain records to support those definitions. In addition, an area slums or blight designation is required to be redetermined every 10 years for continued qualification. The regulatory amendments include the abatement of asbestos hazards and lead-based paint hazard evaluation and reduction as eligible rehabilitation activities. The final rule eliminates duplicative text concerning the treatment of lead-based paint hazards. Finally, the final rule requires that acquisition or relocation, if undertaken to address slums or blight on a spot basis, must be followed by other eligible activities that eliminate specific conditions of blight or physical decay. The final rule follows publication of a July 9, 2004, proposed rule and takes into consideration the public comments received on the proposed rule. On October 22, 1996, the Department published an interim rule, ``Community Development Block Grant Program for States; Community Revitalization Strategy Requirements and Miscellaneous Technical Amendments.'' This rule also makes final, with no changes, the provisions of that rule, which have been in effect for states on an interim basis since November 21, 1996.

Approval of Condominiums in Puerto Rico on Evidence of Presentment of Legal Documents

This proposed rule amends the Department's regulations to provide that the date of recordation for purposes of obtaining Federal Housing Administration (FHA) approval of a condominium development in the Commonwealth of Puerto Rico for mortgage insurance under the section 234(c) program is the date the condominium legal documents are presented to the Commonwealth Office of the Property Registry. This proposed rule would enable parties to obtain mortgage insurance upon presentment of legal documents, whether the condominium regime is under construction, proposed for construction, or was established by conversion. Instituting a single standard for approval of mortgage insurance will result in a reduction in risk, time and cost for developers and help to increase FHA activity and homeownership opportunities in Puerto Rico.
Emergency Capital Repair Grants for Multifamily Housing Projects Designated for Occupancy by the Elderly

This notice announces the availability of approximately $30 million in grant funds to make emergency capital repairs to eligible multifamily projects owned by private nonprofit entities that are designated for occupancy by elderly tenants. The capital repair needs must relate to items that present an immediate threat to the health, safety, and quality of life of the tenants. The intent of these grants is to provide one-time assistance for emergency items that could not be absorbed within the project's operating budget and other project resources, and where the tenants' continued occupancy in the immediate near future would be jeopardized by a delay in initiating the proposed cure. The notice provides instructions for owners of multifamily projects to request funding and instructions for the HUD field offices to process requests.

Today HUD is republishing the supplement to the SuperNOFA, in its entirety, making clarifications and corrections. HUD is revising the application submission date for the HOPE VI Main Street Grant Program. The application submission date will be July 11, 2006. HUD is also republishing the Supplement due to incorrect formatting of various sections and a misstatement of the estimated date of award found in the HOPE VI Main Street Grant Program. This republication will facilitate applicant understanding of what needs to be included in their applications as well as avoid applicant confusion.

This notice provides information to public housing agencies (PHAs) and members of the public about HUD's process for issuing scores under the Financial Condition Indicator of the Public Housing Assessment System (PHAS). This notice includes revised threshold values and associated points/scores for the expense management component of the Financial Condition Indicator based on available data for PHAs with fiscal years ending March 31, 2004, June 30, 2004, September 30, 2004, and December 31, 2004. The data analyzed is based on generally accepted accounting principles (GAAP) information submitted by PHAs as part of the financial data schedule submission.
