Fixed and Moving Safety Zone; Around the USACE Bank Grading Units, Mat Sinking Unit, and the M/V Harrison and M/V William James
The Coast Guard is establishing a temporary fixed and moving safety zone for all waters within 100 yards of the US Army Corps of Engineers (USACE) Bank Grading Units, Mat Sinking Unit and M/V Harrison and M/V William James while operating on the Mississippi River. This safety zone is needed to protect vessels and mariners from the safety hazards associated with bank grading and mat sinking operations performed by the USACE. Entry into this zone is prohibited unless specifically authorized by the cognizant Captain of the Port (COTP) (COTP Lower Mississippi River for MM 303.0 to MM 869.0 or COTP Ohio Valley MM 869.0 to MM 958.0) or a designated representative.
Drawbridge Operation Regulation; Atlantic Intracoastal Waterway (AIWW), Newport River, Morehead City, NC
The Coast Guard is temporarily changing the operating schedule that governs the Carolina Coastal Railroad Bridge, at AIWW mile 203.8, across Newport River in Morehead City, NC. This bridge is presently maintained in the open position except when closure is necessary for train crossings. This change would allow the bridge to remain closed at night so that necessary repairs may be made while still providing for the reasonable needs of navigation.
Drawbridge Operation Regulations; Old River, Orwood, CA
The Coast Guard is canceling the temporary deviation concerning the Burlington Northern & Santa Fe Railroad (BNSF) Drawbridge across Old River, mile 10.4, at Orwood, CA. This cancellation was requested by the bridge owner due to their inability to operate the BNSF Middle River drawbridge as an alternative path for navigation.

Safety Zone, Seafair Blue Angels Air Show Performance, Seattle, WA
The U.S. Coast Guard is proposing to amend the Seafair Blue Angels Air Show Performance safety zone on the waters of Lake Washington, Seattle, WA. This action is necessary to safeguard participants and spectators from the safety hazards associated with the Seafair Blue Angels Air Show Performance, which include low flying high speed aircraft, and will do so by prohibiting entry into the safety zone unless authorized by the Captain of the Port (COTP), Puget Sound or a Designated Representative.
Safety Zone; Oregon City Bridge Grand Opening Fireworks Display; Willamette River, Oregon City, OR
The Coast Guard is establishing a safety zone on the Willamette River between the Oregon City Bridge and the Interstate 205 Bridge on October 13, 2012 from 7:30 p.m. (P.D.T.) to 9 p.m. (P.D.T.). This safety zone is necessary to ensure the safety of the maritime public during a fireworks display, and will do so by prohibiting unauthorized persons and vessels from entering the safety zone unless authorized by the Sector Columbia River Captain of the Port (COTP) or his designated representative.
Safety Zone; 2012 Head of the South Regatta, Savannah River, Augusta, GA
The Coast Guard is establishing a temporary safety zone on the Savannah River in Augusta, Georgia, during the 2012 Head of the South Regatta, which will consist of a series of rowing races. The 2012 Head of the South Regatta is scheduled to take place on Friday, November 9, 2012 and Saturday, November 10, 2012. The temporary safety zone is necessary for the safety of race participants, participant vessels, spectators, and the general public during the event. Persons and vessels are prohibited from entering, transiting through, anchoring in, or remaining within the safety zone unless authorized by the Captain of the Port Savannah or a designated representative.
Inland Waterways Navigation Regulations
This rule redefines the geographical points described in our regulations, which demarcate an area of the Detroit River in which certain vessels are restricted to speeds not greater than 12 statute miles per hour.
Policy Letters on the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978
The Coast Guard announces the availability of three policy letters providing guidance to vessels and mariners subject to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended (STCW). These letters provide guidance on: The hours of rest requirements of the 2010 amendments to the STCW Convention and Code; issuance of endorsements and approval of training for Vessel Personnel with Designated Security Duties (VPDSD) and vessel personnel requiring security awareness training; and issuance of other endorsements and approval of other training to meet the 2010 amendments. These letters are necessary to provide guidance to affected parties until regulations implementing amendments to the STCW are promulgated.
Regulated Navigation Area; Columbus Day Weekend, Biscayne Bay, Miami, FL
The Coast Guard is amending the Columbus Day weekend regulated navigation area on Biscayne Bay in Miami, Florida. The amended regulated navigation area alters the boundaries of the area and expands the enforcement period. These regulations are necessary to protect the public during Columbus Day weekend; a period that has historically had a significant concentration of persons and vessels on the waters of Biscayne Bay. To ensure the public's safety, all vessels within the regulated navigation area are: Required to transit the regulated navigation area at no more than 15 knots; subject to control by the Coast Guard; and required to follow the instructions of all law enforcement vessels in the area.
Safety Zone; Wounded Warriors Benefit, Lake Erie, Huron, OH
The Coast Guard is establishing a temporary safety zone on the waters of Lake Erie, East Huron, Ohio. This regulation is intended to restrict vessels from portions of Lake Erie during the Wounded Warriors Benefit. This safety zone is necessary to protect spectators and vessels from the hazards associated with launched pumpkins.
Dynamic Positioning Operations Guidance for Vessels Other Than Mobile Offshore Drilling Units Operating on the U.S. Outer Continental Shelf
On May 4, 2012 the Coast Guard published a notice of recommended interim voluntary guidance titled ``Mobile Offshore Drilling Unit Dynamic Positioning Guidance''. The notice recommended owners and operators of Mobile Offshore Drilling Units (MODUs) follow Marine Technology Society (MTS) Dynamic Positioning (DP) operations guidance for MODUs. The Coast Guard is now also recommending owners and operators of all vessels other than MODUs conducting Outer Continental Shelf (OCS) activities on the U.S. OCS follow the appropriate MTS DP operations guidance for these vessels. In particular, the Coast Guard recommends owners and operators of these vessels operate within an Activity Specific Operating Guideline for each activity and operate with its Critical Activity Mode of Operation when that activity is critical.
Commercial Fishing Safety Advisory Committee; Meeting
The Commercial Fishing Safety Advisory Committee (CFSAC) will meet in Washington, DC to discuss various issues relating to safety in the commercial fishing industry. This meeting will be open to the public.
Facility Security Officer Training Requirements
The Coast Guard announces a public meeting to receive comments on the development of a Facility Security Officer training program, with the primary focus on developing the curriculum for such a program. Section 821 of the Coast Guard Authorization Act of 2010 (Pub. L. 111- 281) requires the Secretary of Homeland Security to establish comprehensive FSO training requirements, and to coordinate with the Maritime Administrator of the Department of Transportation in developing the FSO training curriculum. The purpose of the public meeting is to obtain public comment on a draft model FSO training course and other elements of the FSO training program.
National Boating Safety Advisory Council
The National Boating Safety Advisory Council (NBSAC) and three of its subcommittees will meet on November 9-11, 2012, in Watsonville, CA, to discuss issues relating to recreational boating safety. The meetings will be open to the public.
Safety Zone; Rio Vista Bass Derby Fireworks, Sacramento River, Rio Vista, CA
The Coast Guard will enforce the safety zone for the Rio Vista Bass Derby Fireworks in the Captain of the Port, San Francisco area of responsibility during the dates and times noted below. This action is necessary to protect life and property of the maritime public from the hazards associated with the fireworks display. During the enforcement period, unauthorized persons or vessels are prohibited from entering into, transiting through, or anchoring in the safety zone, unless authorized by the Patrol Commander (PATCOM).

The Coast Guard is establishing a safety zone on the navigable waters of Mission Bay in support of the Sea World San Diego Fireworks. The Coast Guard is establishing a temporary safety zone in the navigable waters of the San Francisco Bay in vicinity of San Francisco West Yacht Harbor Light 2, approximately 1,250 yards east of Anita Rock in San Francisco Bay, in support of the 2012 America's Cup World Series sailing events. This safety zone is established to ensure the safety of mariners and spectators from the dangers of vessel collision associated with high-speed race finishes that will occur in vicinity of San Francisco West Yacht Harbor Light 2. Unauthorized persons or vessels are prohibited from entering into, transiting through, or remaining in the safety zone without permission of the Captain of the Port or their designated representative.
Safety Zone, Coast Guard Exercise Area, Hood Canal, WA
The U.S. Coast Guard is proposing to establish a safety zone around vessels involved in Coast Guard training exercises in Hood Canal, WA. A safety zone is necessary to ensure the safety of the maritime public during these exercises, which involve fast moving surface vessels, smoke machines, pyrotechnics, and other elements which could create safety concerns for waterway users. This safety zone would ensure the safety of the maritime public by prohibiting any person or vessel from entering or remaining in the safety zone unless authorized by the Captain of the Port (COTP) or a Designated Representative.
Drawbridge Operation Regulation; Delaware River, Between Burlington, NJ and Bristol, PA
The Commander, Fifth Coast Guard District, has issued a temporary deviation from the regulations governing the operation of the Burlington-Bristol Bridge on Route 413, across the Delaware River, at mile 117.8, between Burlington, NJ and Bristol, PA. This deviation restricts the operation of the draw span in order to facilitate the adjustment of the operating lift cables.

The Coast Guard is establishing a temporary safety zone on the Niagara River, Lewiston, NY. This safety zone is intended to restrict vessels from a portion of the Lower Niagara River during the Battle of Queenston Heights Bicentennial historical reenactment and fireworks display. This temporary safety zone is necessary to protect spectators and vessels from the hazards associated with a historical reenactment and fireworks display.
Special Local Regulations; Red Bull Flugtag Miami, Biscayne Bay; Miami, FL
The Coast Guard is establishing a special local regulation on the waters of Biscayne Bay, east of Bayfront Park, in Miami, Florida during the Red Bull Flugtag. The Red Bull Flugtag is scheduled to take place on Saturday, November 3, 2012. The event consists of 30 participants launching self-propelled flying machines from a 30ft ramp to the water below. 150 spectator vessels are expected to attend the event. The special local regulation is necessary to provide for the safety of the participants, participant vessels, and general public on the navigable waters of the United States during the event. The special local regulation will encompass the following two areas: An event area, where non-participant vessels are prohibited from entering, transiting through, anchoring in, or remaining within; and a spectator area, where all vessels are permitted to anchor.
Safety Zone; Research Vessel SIKULIAQ Launch, Marinette, WI
The Coast Guard is establishing a temporary safety zone on the Menominee River in Marinette Wisconsin. This zone is intended to restrict vessels from a portion of Menominee River during the launching of the Research vessel SIKULIAQ, on October 13th, 2012. This temporary safety zone is necessary to protect the surrounding public and vessels from the hazards associated with the launching of this 261 foot, research vessel.
Safety Zone; DeStefano Wedding Fireworks Display, Patchogue Bay, Patchogue, NY
The Coast Guard is establishing a temporary safety zone on the navigable waters of Patchogue Bay, in Patchogue, NY for the DeStefano family wedding fireworks display. This action is necessary to provide for the safety of life on navigable waters during the event. Entering into, transiting through, remaining, anchoring or mooring within this regulated area is prohibited unless authorized by the Captain of the Port (COTP) Sector Long Island Sound.
Adding International Energy Efficiency (IEE) Certificate to List of Certificates a Recognized Classification Society May Issue
The Coast Guard proposes to amend its Vessel Inspection Alternatives regulations to add the International Energy Efficiency (IEE) Certificate to the list of certificates that a recognized classification society may issue on behalf of the Coast Guard. We make this proposal because Annex VI of the International Convention for the Prevention of Pollution by Ships, 1973, as modified by the Protocol of 1978, has been amended to address energy efficiency for ships, and these amendments call for the issuance of IEE Certificates starting January 1, 2013. This proposed rule would enable recognized classification societies to apply to the Coast Guard to issue IEE Certificates to vessel owners and help to ensure that the demand for IEE Certificates is met.
Anchorages; Captain of the Port Puget Sound Zone, WA
The Coast Guard proposes to make five general anchorage areas smaller. It also proposes administrative changes that would rename 33 CFR 110.230, reorganize it by incorporating 33 CFR 110.229, and modify the descriptions of four general anchorages. These changes will clarify to the general public the boundaries and requirements of anchorages, and enhance safety by ensuring good order and predictability within the anchorages of the Captain of the Port (COTP) Puget Sound zone.
Safety Zone, Brandon Road Lock and Dam to Lake Michigan Including Des Plaines River, Chicago Sanitary and Ship Canal, Chicago River, and Calumet-Saganashkee Channel, Chicago, IL
The Coast Guard will enforce a segment of the Safety Zone; Brandon Road Lock and Dam to Lake Michigan including Des Plaines River, Chicago Sanitary and Ship Canal, Chicago River, Calumet-Saganashkee Channel on all waters of the Chicago Sanitary and Ship Canal from Mile Marker 296.1 to Mile Marker 296.7 at various times from October 8, 2012 through October 12, 2012. This action is necessary to protect the waterways, waterway users, and vessels from hazards associated with the Army Corp of Engineers' barge safety testing operations. During any of the below listed enforcement periods, entry into, transiting, mooring, laying-up or anchoring within the enforced area of this safety zone by any person or vessel is prohibited unless authorized by the Captain of the Port, Sector Lake Michigan, or his or her designated representative.
Safety Zone; Submarine Cable Installation Project; Chicago River, Chicago, IL
The Coast Guard is establishing a temporary safety zone on the Chicago River near Chicago, Illinois. This zone is intended to restrict vessels from a portion of the Chicago River due to the installation of submarine cables in the vicinity of both the West Adams Street and West Jackson Boulevard bridges. This temporary safety zone is necessary to protect the surrounding public and vessels from the hazards associated with the installation of submarine cables in the vicinity of both the West Adams Street and West Jackson Boulevard bridges.
Special Local Regulations for Marine Events; San Francisco Bay Navy Fleet Week Parade of Ships and Blue Angels Demonstration, San Francisco Bay, CA
The Coast Guard will enforce the special local regulations in the navigable waters of San Francisco Bay for the annual U.S. Navy and City of San Francisco sponsored Fleet Week Parade of Navy Ships, Blue Angels Flight Demonstrations, Ship Tours, and America's Cup World Series regattas to be held from October 4, 2012 through October 7, 2012. This action is necessary to ensure the safety of event participants and spectators. During the enforcement period, no persons or vessels may enter the regulated area without permission of the Captain of the Port (COTP) or her designated representative.
Special Load Line Exemption for the Gulf of Mexico: Petition for Rulemaking
The Coast Guard announces the availability of a petition for rulemaking, and requests public comment accordingly. The petition was submitted by a river barge operator, who requests that the Coast Guard establish a special load line exemption on the Gulf of Mexico. The requested exemption would allow non-load line river barges to transit along the west coast of Florida, en route to/from Tampa Bay.
Shipping and Transportation; Technical, Organizational, and Conforming Amendments
This final rule makes non-substantive changes throughout Titles 46 and 49 of the Code of Federal Regulations. The purpose of this rule is to make conforming amendments and technical corrections to Coast Guard shipping and transportation regulations. This rule will have no substantive effect on the regulated public. These changes are provided to coincide with the annual recodification of Titles 46 and 49 on October 1, 2012.
Special Local Regulation Clearwater Super Boat National Championship Race, Gulf of Mexico; Clearwater, FL
The Coast Guard is establishing special local regulations on the waters of the Gulf of Mexico in the vicinity of Clearwater, Florida during the Clearwater Super Boat National Championship Race. The race is scheduled to take place on Sunday, September 30, 2012 from 10 a.m. to 4 p.m. Approximately 35 boats ranging in length from 24 feet to 50 feet traveling at speeds in excess of 100 miles per hour are expected to participate. Additionally, it is anticipated that 400 spectators will be present along the race course. The special local regulation is necessary to protect the safety of race participants, participant vessels, spectators, and the general public on the navigable waters of the United States during the event. The special local regulation will temporarily restrict vessel traffic in the waters of the Gulf of Mexico in the vicinity of Clearwater, Florida. The special local regulation will establish the following three areas: a race area, where all persons and vessels, except those persons and vessels participating in the high speed boat races, are prohibited from entering, transiting through, anchoring in, or remaining within; a buffer zone around the race area, where all persons and vessels, except those persons and vessels enforcing the buffer zone, are prohibited from entering, transiting through, anchoring in, or remaining within; and a spectator area, where all vessels must be anchored or operate at No Wake Speed.
Safety Zone; Fireworks Event in Captain of the Port New York Zone
The Coast Guard will enforce a safety zone in the Captain of the Port New York Zone on the specified date and time. This action is necessary to ensure the safety of vessels and spectators from hazards associated with fireworks displays. During the enforcement period, no person or vessel may enter the safety zone without permission of the Captain of the Port (COTP).
Safety Zone, Changes to Original Rule; Boston Harbor's Rock Removal Project, Boston Inner Harbor, Boston, MA
The Coast Guard is establishing three temporary safety zones within Sector Boston's Captain of the Port (COTP) Zone for the drilling, blasting, and dredging operation on the navigable waters of Boston Inner Harbor, in the main ship channel near Castle Island. These temporary safety zones are necessary to enhance navigation, vessel safety, marine environmental protection, and provide for the safety of life on the navigable waters during the drilling, blasting and dredging operations in support of the U.S. Army Corps of Engineers rock removal project. Entering into, transiting through, mooring or anchoring within these safety zones is prohibited unless authorized by the COTP or the designated on-scene representative.
Hull Identification Numbers for Recreational Vessels
The Coast Guard announces that it is requesting public comments regarding the existing regulatory requirement to indicate a boat's model year as part of the 12-character Hull Identification Number (HIN). Under current regulations in 33 CFR part 181, the HIN must consist of 12 characters, the last two of which indicate the boat's model year. This notice requests public comments on whether we should continue to require model year as part of the HIN or change the regulatory definition of ``model year.''
Finding of Equivalence; Alternate Pressure Relief Valve Settings on Certain Vessels Carrying Liquefied Gases in Bulk
The Coast Guard announces the availability of CG-ENG Policy Letter 04-12, ``Alternative Pressure Relief Valve Settings on Vessels Carrying Liquefied Gases in Bulk in Independent Type B and Type C Tanks.'' Existing Coast Guard regulations regarding the allowable stress factors for type B and type C independent cargo tanks are more stringent than the International Maritime Organization (IMO) standards for such cargo tanks. Materials, manufacturing, and inspections have advanced since the Coast Guard first promulgated regulations on allowable stress factors on May 3, 1979. CG-ENG Policy Letter 04-12 establishes that for certain type B and type C independent cargo tanks that are designed and manufactured using advanced techniques, the IMO standards for allowable stress factors provide a level of safety protection equivalent to the standards in 46 CFR 154.447 and 46 CFR 154.450.

Drawbridge Operation Regulations; James River, Newport News, VA
The Coast Guard has issued a temporary deviation from the operating schedule that governs the US 17/258 Bridge across the James River, mile 5.0, at Newport News, VA. The deviation is necessary to facilitate the structural repairs of the bridge. This deviation allows the bridge to remain closed on weekends during the repairs and requires two-hour advanced notice for bridge openings.

Notice of Arrival on the Outer Continental Shelf
The United States Coast Guard is soliciting public comment on proposed changes to the computer application for electronic Notice of Arrival (NOA) on the Outer Continental Shelf (OCS). The Coast Guard NOA-OCS program currently requires NOA information for those vessels, facilities, and Mobile Offshore Drilling Units (MODUs) operating on the OCS. This information is currently being collected via the National Vessel Movement Center (NVMC) electronic Notice of Arrival and Departure (e-NOAD) process. The Coast Guard is continually seeking to improve the e-NOAD process and form to make it as user friendly as possible. Public comment is necessary in order to assist the Coast Guard with assessing which requirements may be addressed in future guidance or regulations to improve the e-NOAD application.

The Coast Guard is removing the existing drawbridge operation regulation for the Union Pacific railroad swing bridge over Grosse Tete Bayou, mile 14.7, Iberville Parish, Louisiana. This bridge has been modified from a swing bridge to a fixed bridge and the current special operating regulation is no longer applicable or necessary.
Safety Zone, Atlantic Intracoastal Waterway; Emerald Isle, NC
The Coast Guard proposes to extend a temporary safety zone on the waters of the Atlantic Intracoastal Waterway at Emerald Isle, North Carolina. The safety zone is necessary to provide for the safety of mariners on navigable waters during maintenance of the NC 58 Fixed Bridge crossing the Atlantic Intracoastal Waterway, mile 226, at Emerald Isle, North Carolina. The safety zone extension would temporarily restrict vessel movement within the designated area starting on December 12, 2012 through February 14, 2013.
Drawbridge Operation Regulation; Black Warrior River, AL
The Coast Guard is adding a special operating regulation governing the Alabama Gulf Coast Railroad (AGR) vertical lift span (Yo- Yo) bridge across the Black Warrior River, mile 219.0, at Demopolis, AL. The bridge is operated automatically and currently remains in the open-to-navigation position and only lowers for the passage of trains. This rule proposes to codify the current operating schedule of the bridge as a special operating regulation.
