The Department of the Navy is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (Admiralty and Maritime Law) has determined that USS DEWEY (DDG 105) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

A notice of availability (NOA) was published by the U.S. Environmental Protection Agency in the Federal Register (73 FR 79473) on December 29, 2008, for the Northwest Training Range Complex (NWTRC) Draft Environmental Impact Statement/Overseas Environmental Impact Statement (EIS/OEIS). A notice of public hearing dates and locations was published in the Federal Register (73 FR 79856) on December 30, 2008. This notice announces an additional public hearing in Oregon and extension of the public comment period until March 11, 2009. The comment period was previously extended from February 11, 2009 to February 18, 2009 [notice published February 11, 2009 (74 FR 6859); amended NOA published February 13, 2009 (74 FR 7230)]. Dates and Addresses: A public hearing has been scheduled for February 26, 2009, at the Tillamook County Fairgrounds Auditorium, 4603 East 3rd Street, Tillamook, Oregon, to receive oral and written comments on the Draft EIS/OEIS. The meeting will start with an open house session from 5 p.m. to 7 p.m., followed by a presentation and formal public comment period from 7 p.m. to 8:30 p.m. The open house session will allow interested individuals to review information presented in the Draft EIS/OEIS. Navy representatives will be available during the open house session to clarify information related to the Draft EIS/OEIS.

The CNO Executive Panel will report on the findings and recommendations to the Chief of Naval Operations of the Subcommittee on Naval Support to the Global War on Terror (GWOT). The executive session of this meeting will include discussions of the Navy force structure to support Global War or Terrorism/Irregular Warfare (IW); Navy strategies to implement current/future GWOT tasking; Navy strategies to support Combatant Commanders; and a conclusion/summary on the discussion. The executive session of this meeting will be closed to the public.

The U.S. Naval Academy Board of Visitors will meet to make such inquiry, as the Board shall deem necessary into the state of morale and discipline, the curriculum, instruction, physical equipment, fiscal affairs, and academic methods of the Naval Academy. The executive session of this meeting will include discussions of the personnel issues at the Naval Academy, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy. The executive session of this meeting will be closed to the public. The discussion of such information would be exempt from public disclosure as set forth in section 552b(c)(5), (6), and (7) of title 5, United States Code. The CNO Executive Panel will report on the findings and recommendations of the Northeast Asia Subcommittee to the Chief of Naval Operations. The meeting will consist of presentations, briefs, and discussions of the following topics that have been classified at the SECRET Level: Current and future Navy strategy; plans, and policies in support of U.S. deterrence planning crisis management and conflict escalation and control in Northeast Asia. The executive session of this meeting will be closed to the public. The discussion of such information would be exempt from public disclosure as set forth in section 552b(c)(5), (6), and (7) of title 5, United States Code. For this reason, the executive session of this meeting will be closed to the public.

The Department of the Navy gives notice of its intent to grant NextGen Containers LLC a revocable, nonassignable, partially exclusive license, with exclusive field of use in containerization of energetics (systems containing explosives, propellants, ignitors, ammunition, and their ingredients), medical materials and devices, and non-exclusive rights in all other fields of use, in the United States to practice the Government-owned inventions, U.S. Patent 7,156,249 entitled ``Container and related methods''; U.S. Patent Application Serial No. 11/387,084 entitled ``Shipping and Storage System''; U.S. Patent Application Serial No. 11/ 387,082 entitled ``Interlocking Pallets, and Shipping and Storage Systems Employing the Same''; and U.S. Patent Application Serial No. 11/387,081 entitled ``Automatically Interlocking Pallets, and Shipping and Storage Systems Employing the Same.''

The Department of the Navy (Navy), after carefully weighing the operational and environmental consequences of the proposed action, announces its decision to upgrade carrier berthing (Berth LIMA) at Naval Air Station (NAS) North Island to comply with current nuclear- powered aircraft carrier (CVN) facility requirements. The minor infrastructure improvements include construction of: A fender system, mooring bollards, security building, and antiterrorism (AT)/force protection (FP) improvements, as well as the installation of information systems, electrical and mechanical utility upgrades, paving, drainage, and site improvements. In addition, the Navy announces its intent to implement additional vehicular traffic mitigation measures to address new facts and circumstances relevant to traffic. Although the 2008 Traffic Study included in the 2008 Final Supplemental Environmental Impact Statement (SEIS) shows that direct traffic impacts have not changed significantly since they were studied in the 1999 Final Environmental Impact Statement (FEIS), additional traffic mitigation measures minimize the cumulative effects of vehicular traffic when three homeported aircraft carriers are simultaneously in port.
