Defense Federal Acquisition Regulation Supplement: Covered Defense Telecommunications Equipment or Services (DFARS Case 2018-D022)
DoD is issuing an interim rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement sections of the National Defense Authorization Acts for Fiscal Years 2018 and 2019 related to the procurement of covered telecommunications equipment or services. Specifically, the rule prohibits the procurement of any equipment, system, or service to carry out the DoD nuclear deterrence or homeland defense missions that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as a critical technology as a part of any system. Covered telecommunications equipment or services includes telecommunications equipment or services from certain Chinese entities, including their subsidiaries and affiliates, and from any other entities that the Secretary of Defense reasonably believes to be owned or controlled by or otherwise connected to, the government of the People's Republic of China or the Russian Federation.

DoD is issuing a final rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to establish a DoD contractor purchasing system review dollar threshold that provides a regulatory basis for allowing DoD personnel to support other essential priorities and missions of greater contractual risk, while reducing regulatory impact on contractors.

Commissary Credit and Debit Card User Fee
This rule implements Section 621 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 expanding patronage for commissary, exchange, and revenue-generating morale, welfare, and recreation (MWR) facilities. As part of DOD's implementation the Department is required to collect a user fee when these new populations utilize a credit or debit card that creates a cost to the Department of the Treasury for processing these transactions. As it related to this Section, such costs are only generated by credit or debit card transactions at Defense Commissary Agency (DeCA) facilities.

Intent To Prepare a Draft Feasibility Report and Environmental Impact Statement for the Buffalo Bayou and Tributaries, Texas Resiliency Study
Pursuant to the National Environmental Policy Act of 1969 (NEPA), as amended, the U.S. Army Corps of Engineers, Galveston District (USACE) intends to prepare an Environmental Impact Statement (EIS) for the Buffalo Bayou and Tributaries, Texas Resiliency Study (BBTRS). The study will identify and evaluate the feasibility of reducing flood risks on Buffalo Bayou in Harris and Fort Bend Counties, Texas. The study will also complete a Dam Safety Modification Study (DSMS) on the Addicks and Barker Dams. This notice announces USACE's intent to determine the scope of the issues to be addressed and identify the significant issues related to a proposed action.

This agenda announces the proposed regulatory actions the Council plans for the next 12 months and those completed since the fall 2018 edition. This agenda was developed under the guidelines of Executive Orders (E.O.) 12866 ``Regulatory Planning and Review,'' as amended, Executive Order 13771 ``Reducing Regulation and Controlling Regulatory Costs,'' and Executive Order 13563 ``Improving Regulation and Regulatory Review.'' The purpose in publishing this agenda is to allow interested persons an opportunity to participate in the rulemaking process. Members of the public may submit comments on individual proposed and interim final rulemakings at www.regulations.gov during the comment period that follows publication in the Federal Register. Improving Government Regulations; Unified Agenda of Federal Regulatory and Deregulatory Actions
This agenda announces the proposed regulatory actions the Department of Defense (DOD) plans for the next 12 months and those completed since the spring 2019 agenda. It was developed under the guidelines of Executive Order 12866 ``Regulatory Planning and Review,'' Executive Order 13771 ``Reducing Regulation and Controlling Regulatory Costs,'' and Executive Order 13563 ``Improving Regulation and Regulatory Review.'' This Agenda documents DOD's work under Executive Order 13777 ``Enforcing the Regulatory Reform Agenda,'' and many regulatory actions support the recommendations of the DoD Regulatory Reform Task Force (as indicated in the individual rule abstracts). Members of the public may submit comments on individual proposed and interim final rulemakings at www.regulations.gov during the comment period that follows publication in the Federal Register. This agenda updates the report published on May 22, 2019, and includes regulations expected to be issued and under review over the next 12 months. The next agenda will publish in the spring of 2020. Because publication in the Federal Register is mandated for the regulatory flexibility agendas required by the Regulatory Flexibility Act (5 U.S.C. 602), the Department of Defense's printed agenda entries include only: (1) Rules that are in the Agency's regulatory flexibility agenda, in accordance with the Regulatory Flexibility Act, because they are likely to have a significant economic impact on a substantial number of small entities; and (2) Any rules that the Agency has identified for periodic review under section 610 of the Regulatory Flexibility Act. Department of Defense Military Family Readiness Council; Notice of Federal Advisory Committee Meeting; Cancellation
On December 2, 2019, the DoD published a notice that announced the next meeting of the Department of Defense Military Family Readiness Council, which was to take place on Tuesday, December 17, 2019 from 10:00 a.m. to 12:00 p.m. DoD is publishing this notice to announce that this Federal Advisory Committee meeting has been cancelled and will be re-scheduled at a later date.
Environmental Analysis of Army Actions
The Department of the Army is revising its procedures for implementing the National Environmental Policy Act of 1969 (NEPA) and the Council on Environmental Quality (CEQ) NEPA regulations. These proposed revisions clarify and update the regulation, incorporate current Army NEPA procedures and practices, and revise and add categorical exclusions (CXs), reduce paperwork and delays, and promote better decisions consistent with national environmental policy set forth in NEPA.
