Defense Federal Acquisition Regulation Supplement; Technical Amendments
DoD is making amendments to the Defense Federal Acquisition Regulation Supplement (DFARS) in order to make editorial changes.
Secretarial Authorization for a Member of the Department of the Navy to Serve on the Board of Directors, Navy-Marine Corps Relief Society
In accordance with 10 U.S.C. 1033, the Secretary of the Navy, with the concurrence of the Department of Defense General Counsel, has authorized Vice Admiral W.D. French, Commander, Navy Installations Command, to serve without compensation on the Board of Directors of the Navy-Marine Corps Relief Society. Authorization to serve on the Board of Directors has been made for the purpose of providing oversight and advice to, and coordination with, the Navy-Marine Corps Relief Society. Participation of the above official in the activities of the Society will not extend to participation in day-to-day operations.
Meeting of the U.S. Naval Academy Board of Visitors
The U.S. Naval Academy Board of Visitors will meet to make such inquiry, as the Board shall deem necessary, into the state of morale and discipline, the curriculum, instruction, physical equipment, fiscal affairs, and academic methods of the Naval Academy. The executive session of this meeting from 11:00 a.m. to 12:00 p.m. on June 11, 2012, will include discussions of disciplinary matters, law enforcement investigations into allegations of criminal activity, and personnel issues at the Naval Academy, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy. For this reason, the executive session of this meeting will be closed to the public.

Information on Surplus Land at a Military Installation Designated for Disposal: Fort Tilden U.S. Army Reserve Center, New York
This amended notice provides information on withdrawal of surplus property at Fort Tilden U.S. Army Reserve Center, New York, New York. This notice amends the Notice published in the Federal Register on May 9, 2006 (71 FR 26930).
Proposed Reductions in Levels of Service at Locks and Dams on the Ouachita and Black Rivers
It is proposed that the hours of availability at Jonesville and Columbia Locks on the Ouachita and Black Rivers will be reduced from the current schedule of 24 hours per day, 7 days per week, 365 days per year to 18 hours per day, separated into two 9 hour periods, 5 a.m. to 2 p.m., and 5 p.m. to 2 a.m., 7 days per week, 365 days per year. It is also proposed that the hours of availability at Felsenthal and H.K. Thatcher Locks on the Ouachita and Black Rivers will be reduced from the current schedule of 24 hours per day, 7 days per week, 365 days per year to 16 hours per day, separated into two 8 hour periods, 5 a.m. to 1 p.m., and 5 p.m. to 1 a.m., 7 days per week, 365 days per year. Constrained funding and fiscal deficit have led to reduced operation and maintenance funding on the Ouachita/Black Waterway. The intended effect is to provide lock availability that matches existing lock usage and to help ensure that minimal dredging needs will be met. Pool levels will not be affected by change of operating hours.
Air University Board of Visitors Meeting
Under the provisions of the Federal Advisory Committee Act of 1972 (5 U.S.C., Appendix, as amended), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.150, the Department of Defense announces that the Air University Board of Visitors' meeting will take place on Tuesday, 24 July 2012, from 1:30p.m. to approximately 4 p.m. The meeting will be a conference call meeting. The purpose and agenda of this meeting is to provide independent advice and recommendations on matters pertaining to the educational policies and programs of Air University and for the AFIT Subcommittee to discuss their recent subcommittee meeting. Information Collection Requirement; Defense Federal Acquisition Regulation Supplement; Government Property
In compliance with section 3506(c)(2)(A) of the Paperwork Reduction Act of 1995 (44 U.S.C. chapter 35), DoD announces the proposed extension of a public information collection requirement and seeks public comment on the provisions thereof. DoD invites comments on: (a) Whether the proposed collection of information is necessary for the proper performance of the functions of DoD, including whether the information will have practical utility; (b) the accuracy of the estimate of the burden of the proposed information collection; (c) ways to enhance the quality, utility, and clarity of the information to be collected; and (d) ways to minimize the burden of the information collection on respondents, including the use of automated collection techniques or other forms of information technology. The Office of Management and Budget (OMB) has approved this information collection for use through November 30, 2012. DoD proposes that OMB extend its approval for use for three additional years beyond the current expiration date.
Notice To Extend Public Comment Period for United States Air Force F-35A Operational Basing Environmental Impact Statement
The U.S. Air Force is issuing this notice to advise the public of an extension to the public comment period. The initial Notice of Availability published in the Federal Register on April 13, 2012 (Vol. 77, No. 72/Notices/22315) requested public comments no later than June 4, 2012. The Air Force has extended the deadline for submitting public comments to June 20, 2012. All substantive comments on the Draft EIS received during the public comment period will be considered in the preparation of the Final EIS.

Defense Federal Acquisition Regulation Supplement; Utilization of Domestic Photovoltaic Devices (DFARS Case 2011-D046)
DoD is adopting as final, with change, an interim rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement a section of the National Defense Authorization Act for Fiscal Year 2011. The section provides that photovoltaic devices to be utilized in performance of any covered contract shall comply with the Buy American statute, subject to the exceptions provided in the Trade Agreements Act of 1979 or otherwise provided by law.

DoD is issuing an interim rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement requirements of the Treaty Between the Government of the United States of America and the Government of the United Kingdom of Great Britain and Northern Ireland Concerning Defense Trade Cooperation (the Treaty) and the Security Cooperation Act of 2010 regarding export control regulations between the United States and the United Kingdom. The Treaty and statute establish an Approved Community that includes members of the U.S. Government and the government of the United Kingdom.

Renewal of Department of Defense Federal Advisory Committees
Under the provisions of 10 U.S.C. 1074g(c), the Federal Advisory Committee Act of 1972 (5 U.S.C. Appendix), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b), and 41 CFR 102-3.50(a), the Department of Defense gives notice that it is renewing the charter for the Uniform Formulary Beneficiary Advisory Panel (hereafter referred to as ``the Panel''). The Panel is a non-discretionary federal advisory committee that shall provide the Secretary of Defense through the Under Secretary of Defense for Personnel and Readiness, the Assistant Secretary of Defense for Health Affairs, and the Director, TRICARE Management Activity, independent advice and recommendations on development of the uniform formulary. The Secretary of Defense shall consider the comments of the Panel before implementing the uniform formulary or implementing changes to the uniform formulary. The Panel shall report to the Secretary of Defense through the Under Secretary of Defense for Personnel and Readiness, the Assistant Secretary of Defense for Health Affairs, and the Director, TRICARE Management Activity. The Under Secretary of Defense for Personnel and Readiness or designated representative, may act upon the Panel's advice and recommendations. The Panel, pursuant to 10 U.S.C. 1074g(c)(2), shall be comprised of no more than 15 members. The Panel shall include members that represent: a. Non-governmental organizations and associations that represent the views and interests of a large number of eligible covered beneficiaries; b. Contractors responsible for the TRICARE retail pharmacy program; c. Contractors responsible for the national mail-order pharmacy program; and d. TRICARE network providers. Panel members, who are not full-time or permanent part-time Federal officers or employees, shall be appointed to serve as experts and consultants under the authority of 5 U.S.C. 3109 and shall serve as special government employees. All Panel members shall be appointed by the Secretary of Defense and their appointments shall be renewed on an annual basis. The Panel membership shall select the Panel's Chairperson from the total membership. With the exception of travel and per diem for official Panel related travel, Panel members shall serve without compensation. The Secretary of Defense may approve the appointment of Panel members for one to four year terms of service; however, no member, unless authorized by the Secretary of Defense, may serve more than two consecutive terms of service. This same term of service limitation also applies to any DoD authorized subcommittees. Each Panel member is appointed to provide advice on behalf of the government on the basis of his or her best judgment without representing any particular point of view and in a manner that is free from conflict of interest. The Department, when necessary, and consistent with the Panel's mission and DoD policies and procedures, may establish subcommittees to support the Panel. Establishment of subcommittees will be based upon a written determination, to include terms of reference, by the Secretary of Defense, the Deputy Secretary of Defense or the Panel's sponsor. Such subcommittees shall not work independently of the chartered Panel, and shall report all their recommendations and advice to the Panel for full deliberation and discussion. Subcommittees have no authority to make decisions on behalf of the chartered Panel; nor can any subcommittee or its members update or report directly to the DoD or any Federal officers or employees. All subcommittee members shall be appointed in the same manner as the Panel members; that is, the Secretary of Defense shall appoint subcommittee members even if the member in question is already a Panel member. Subcommittee members, with the approval of the Secretary of Defense, may serve a term of service on the subcommittee of one to four years. Subcommittee members, if not full-time or part-time government employees, shall be appointed to serve as experts and consultants under the authority of 5 U.S.C. 3109, and shall serve as special government employees, whose appointments must be renewed by the Secretary of Defense on an annual basis. With the exception of travel and per diem for official Panel related travel, subcommittee members shall serve without compensation. All subcommittees operate under the provisions of FACA, the Government in the Sunshine Act, governing Federal statutes and regulations, and governing DoD policies/procedures.

Notice of Availability of Record of Decision for TRIDENT Support Facilities Explosives Handling Wharf at Naval Base Kitsap at Bangor, Kitsap County, WA
The United States Department of the Navy (DoN), after carefully weighing the operational and environmental consequences of the proposed action, announces its decision to construct and operate an Explosives Handling Wharf (EHW-2) adjacent to the existing Explosives Handling Wharf in Hood Canal on the waterfront of Naval Base Kitsap (NBK) at Bangor, WA. The DoN has decided to implement the preferred alternative, Alternative 1, Combined Trestle, Large Pile Wharf, as described in the TRIDENT Support Facilities EHW-2 Final Environmental Impact Statement (FEIS) dated March 2012. Alternative 1 is also the Environmentally Preferable Alternative and will fully meet the DoN's purpose and need to support future program requirements for TRIDENT submarines homeported at NBK at Bangor, Washington, and the TRIDENT II (D5) Strategic Weapons System. This decision will allow the DoN to continue support of TRIDENT Program operational requirements through 2042.

The Release of the Draft Environmental Impact Statement and the Announcement of a Public Hearing for the Figure Eight Island Inlet and Shoreline Management Project, on Figure Eight Island, New Hanover County, NC
The U.S. Army Corps of Engineers (COE), Wilmington District, Wilmington Regulatory Field Office has received a request for Department of the Army authorization, pursuant to Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act, from Figure Eight Beach Homeowners' Association (HOA) to install a terminal groin structure along Rich Inlet and to conduct a supplemental beach nourishment on approximately 2.0 miles of oceanfront beach and 1,800 linear feet of back barrier shoreline to protect residential homes and infrastructures along the central and northern sections of Figure Eight Island. The terminal groin structure will be placed perpendicular on the northern tip of the island along the shoulder of Rich Inlet; and the proposed source of the material for the nourishment will be dredged from Nixon Channel, a back barrier channel. In case the quantity of material from Nixon Channel is not sufficient, material pumped from (3) nearby upland disposal islands will be used to supplement the nourishment needs. The majority of the material will be disposed within the fillet area, or down shore, of the groin. Pending storm events and shoreline changes, maintenance, or periodic nourishment, of the beach is proposed a maximum of once every five years. Nixon Channel and the upland disposal islands are the proposed material sources for the periodic maintenance, or renourishment, events.

DoD, GSA, and NASA are proposing to amend the Federal Acquisition Regulation (FAR) to remove references to specific paragraphs in an accounting standard that were deleted in the Financial Accounting Standards Board's (FASB's) Accounting Standards Codification (ASC) of Generally Accepted Accounting Principles (GAAP). The immediate and delayed recognition procedures for the initial application transition obligation in paragraphs 111, 112, and 113, respectively, of superseded Financial Accounting Standard (FAS) 106, are obsolete and no longer exist in the authoritative GAAP (the ASC). DoD, GSA, and NASA, therefore, propose replacing the current references with replacement criteria for determining the allowability of the transition obligation, when converting from pay-as-you-go accounting for postretirement benefits (PRBs) to an accrual method of accounting for the purposes of government contract cost accounting.

Renewal of Department of Defense Federal Advisory Committees
Under the provisions of 10 U.S.C. 2166(e), the Federal Advisory Committee Act of 1972 (5 U.S.C. Appendix), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b), and 41 CFR 102-3.50(a), the Department of Defense gives notice that it is renewing the charter for the Missouri River (North Dakota) Task Force (hereafter referred to as ``the Task Force''). The Task Force shall provide independent advice and recommendations on plans and projects to reduce siltation of the Missouri River in the State of North Dakota, as described in this notice and in Section 705 of Title VII, the Missouri River Protection and Improvement Act of 2000, Public Law 106-541. The Task Force shall provide independent advice and recommendations to the Secretary of the Army on plans and projects to reduce siltation of the Missouri River in the State of North Dakota and to meet the objectives of the Pick-Sloan Program. Specifically, the Task Force shall: Prepare and approve, by a majority of the members, a plan for the use of the funds made available under Public Law 106-541, to promote conservation practices in the Missouri River watershed, control and remove the sediment from the Missouri River, protect recreation on the Missouri River from sedimentation, and protect Indian and non- Indian historical and cultural sites along the Missouri River from erosion; develop and recommend to the Secretary of the Army for implementation critical restoration projects meeting the goals of the plan; and determine if these projects primarily benefit the Federal Government. The Task Force shall report to the Secretary of the Army and the U.S. Army Corps of Engineers. As prescribed by Public Law 106-541, the Task Force shall be composed of not more than twenty members. Specifically, the Task Force membership shall be composed of: The Secretary of the Army or designee, who shall serve as the Chairperson; the Secretary of Agriculture or designee; the Secretary of Energy or designee; the Secretary of the Interior or designee; and The Trust. The Trust is composed of sixteen members to be appointed by the Secretary of the Army, including: Twelve members recommended by the Governor of North Dakota that represent equally the various interest of the public. Included in these twelve members, there shall be recommendations of representatives of the North Dakota Department of Health, the North Dakota Parks and Recreation Department, the North Dakota Department of Game and Fish, the North Dakota State Water Commission, the North Dakota Indian Affairs Commission, agricultural groups, environmental or conservation groups, the hydroelectric power industry, recreation user groups, local governments, and other appropriate interests. The Trust also shall include one member recommended by each of the four Indian Tribes in the State of North Dakota. These individuals recommended for The Trust shall be appointed by the Secretary of the Army as representative members to the Task Force. All Task Force members shall be appointed for two-year terms and generally will serve no more than four years total on the Task Force, or as determined by the Secretary of the Army or designee. In addition, all Task Force members shall, with the exception of travel and per diem for official travel, serve without compensation. This same term of service limitation also applies to any DoD authorized subcommittees. With DoD approval, the Task Force is authorized to establish subcommittees, as necessary and consistent with its mission. These subcommittees or working groups shall operate under the provisions of the FACA, the Government in the Sunshine Act, and other appropriate Federal statutes and regulations. Such subcommittees or working groups shall not work independently of the chartered Task Force, and shall report all their recommendations and advice to the Task Force for full deliberation and discussion. Subcommittees or working groups have no authority to make decisions on behalf of the chartered Task Force; nor can they report directly to the Department of Defense or any Federal officers or employees. All subcommittees operate under the provisions of FACA, the Government in the Sunshine Act of 1976 (5 U.S.C. Sec. 552b), governing Federal statutes and regulations, and governing DoD policies/ procedures.

Federal Acquisition Regulation; Prohibition on Contracting With Inverted Domestic Corporations
DoD, GSA, and NASA are issuing an interim rule amending the Federal Acquisition Regulation (FAR) to implement a section of the Consolidated Appropriations Act, 2012, that prohibits the award of contracts using appropriated funds to any foreign incorporated entity that is treated as an inverted domestic corporation or to any subsidiary of such entity.

Publication of the Final National Wetland Plant List
The U.S. Army Corps of Engineers (Corps), as part of an interagency effort with the U.S. Environmental Protection Agency (EPA), the U.S. Fish and Wildlife Service (FWS) and the U.S. Department of Agriculture Natural Resources Conservation Service (NRCS), is announcing the availability of the final 2012 National Wetland Plant List (NWPL). The NWPL is used to determine whether the hydrophytic vegetation parameter is met when conducting wetland determinations under the Clean Water Act and the Wetland Conservation Provisions of the Food Security Act. Other applications of the list include wetland restoration, establishment, and enhancement projects. The list will become effective on June 1, 2012 and will be used in any wetland delineation performed after this date. Delineations received prior to this date may still use the 1988 list, or you may chose to use the 2012 list. Prior to the effective date, please reference which list was used on any wetland delineation/determination forms.
