Availability of FSIS Guideline for Industry Response to Customer Complaints
The Food Safety and Inspection Service (FSIS) is announcing the availability of and requesting comments on a guideline to assist the meat and poultry industry develop written programs for responding to consumer complaints about adulterated or misbranded meat and poultry products. FSIS developed this guideline in response to an increase in the number of recalls of meat and poultry products contaminated with foreign materials.
Federal Milk Marketing Orders-Amending the Class I Skim Milk Price Formula
This final rule amends the Class I skim milk price formula for milk pooled under Federal milk marketing orders (FMMO) as required by the Agriculture Improvement Act of 2018 (2018 Farm Bill). Under the amended price formula, the Class I skim milk price will be the simple average of the monthly advanced pricing factors for Class III and Class IV skim milk, plus $0.74 per cwt, plus the applicable adjusted Class I differential. Prior to this amendment, the Class I skim milk price was the higher of the two advanced pricing factors, plus the applicable adjusted Class I differential.
Christmas Tree Promotion Research, and Information Order; Referendum
This document directs that a referendum be conducted among eligible producers and importers of Christmas trees to determine whether they favor continuance of the Agricultural Marketing Service's (AMS) regulations regarding a national Christmas tree research and promotion program.
Review of USDA Natural Resources Conservation Service National Conservation Practice Standards
The Agriculture Improvement Act of 2018 (2018 Farm Bill) amended the Food Security Act of 1985, to require an expedited review of conservation practice standards, including engineering design specifications, that were in effect on December 19, 2018. NRCS will evaluate opportunities to increase flexibility in the conservation practice standards in a manner that ensures equivalent natural resource benefits. This notice announces that NRCS will be reviewing the national conservation practice standards in the National Handbook of Conservation Practices and is requesting comments from the public about how to improve the conservation practice standards.

This rule modifies regulations and standards issued pursuant to the Agricultural Marketing Act of 1946 by removing references to power of attorney. Further, this rule modifies language to ensure consistency between the regulations and standards for fresh and processed fruits and vegetables. Power of Attorney is an outdated, cumbersome tool that increases the cost and record retention requirements for stakeholders when conducting business. We are making these changes to eliminate these requirements. This will allow us to provide services to our customers faster and without the financial and record retention burden. The functions of the Power of Attorney are currently done by a Supervisor or ``inspector in charge''.
Pecans Grown in the States of Alabama, Arkansas, Arizona, California, Florida, Georgia, Kansas, Louisiana, Missouri, Mississippi, North Carolina, New Mexico, Oklahoma, South Carolina, and Texas; Revision of Reporting Requirements
This rule revises the reporting requirements under the Federal marketing order for pecans. The revised reporting requirements will enable the American Pecan Council (Council) to collect information from handlers on the average handler price paid and the average shelled pecan yield. The Council will use this information to provide important statistical reports to the industry and meet requirements under the marketing order.
Administrative Changes to the Regulations Governing the National Veterinary Accreditation Program
We are proposing to amend the regulations governing the National Veterinary Accreditation Program by clarifying the veterinary programs for which accredited veterinarians are authorized to perform duties under the Animal Health Protection Act. We are also proposing to add or revise certain definitions and terms used in the regulations. The changes we propose would update the program regulations.

Amendments to the Pale Cyst Nematode Regulations
We are proposing to amend the domestic quarantine regulations for pale cyst nematode by adding procedures that would allow persons to review and comment on the protocols for regulating and deregulating quarantine and associated areas. As part of this proposal, we are making the protocols publicly available. We are proposing these actions in response to a court order requiring the Animal and Plant Health Inspection Service to facilitate public input into the development of protocols for deregulating fields for pale cyst nematode. The changes we propose would make the protocols more accessible and give persons the opportunity to comment on their development.
Reauthorization of Dairy Forward Pricing Program
This final rule reauthorizes the Dairy Forward Pricing Program (DFPP) in accordance with the Agriculture Improvement Act of 2018 (2018 Farm Bill). Establishing new contracts under the DFPP has been prohibited since the expiration of the program on September 30, 2018. The 2018 Farm Bill reauthorized the program to allow handlers to enter into new contracts until September 30, 2023. Any forward contract entered prior to the September 30, 2023, deadline is subject to a September 30, 2026, expiration date.
Notice of Continued Suspension of Supervision Fee Assessment Under the United States Grain Standards Act (USGSA)
The Department of Agriculture (USDA), Agricultural Marketing Service (AMS) has determined the suspension of the assessment of fees for supervision of official inspection and weighing services performed by delegated States and/or designated agencies under the United States Grain Standards Act (USGSA) will continue through December 31, 2020.
Hiring Flexibility Under Professional Standards
This final rule adds four flexibilities to the hiring standards for new school nutrition program directors in small local educational agencies (LEAs) and new State directors of school nutrition programs under the Professional Standards regulations for the National School Lunch Program and School Breakfast Program. First, to address hiring challenges faced by small LEAs, which are those with 2,499 or fewer students, this rule requires relevant food service experience rather than school nutrition program experience for new school nutrition program directors. Second, it provides State agencies with discretion to consider documented volunteer or unpaid work as relevant experience for new school nutrition program directors in LEAs with 2,499 or fewer students. Third, it gives State agencies discretion to accept less than the required years of food service experience when an applicant for a new director position in an LEA with fewer than 500 students has the minimum required education. Lastly, this rule adds flexibility to the hiring standards for State directors of school nutrition programs by allowing State agencies to consider applicants with either a bachelor's or advanced degree in specified fields. These changes are expected to expand the pool of candidates qualified to serve as leaders in the school nutrition programs while continuing to ensure that school nutrition professionals are able to perform their duties effectively and efficiently.

Shasta-Trinity National Forest; California; Lower McCloud Fuels Management Project
The Shasta-Trinity National Forest is withdrawing the Notice of Intent (NOI) to prepare an Environmental Impact Statement (EIS) for the Lower McCloud Fuels Management Project. The original NOI was published in the Federal Register on March 22, 2016. No significant issues were identified during this scoping period or any other opportunity to comment. Upon further evaluation, it also appears that there are no potential significant impacts to the human environment associated with the project. As a result, the Forest is withdrawing its intent to prepare an EIS and is now preparing an Environmental Assessment (EA). All comments previously received regarding this project will be retained and considered in the development of the EA. If it is determined that the project may have significant impacts, the EIS process will be reinitiated and a NOI will be published.
Idaho Panhandle Resource Advisory Committee
The Idaho Panhandle Resource Advisory Committee (RAC) will meet in Coeur d'Alene, Idaho. The committee is authorized under the Secure Rural Schools and Community Self-Determination Act (the Act) and operates in compliance with the Federal Advisory Committee Act. The purpose of the committee is to improve collaborative relationships and to provide advice and recommendations to the Forest Service concerning projects and funding consistent with Title II of the Act. Klamath National Forest; California; Elk Creek Watershed Project
The Klamath National Forest is withdrawing the Notice of Intent (NOI) to prepare an Environmental Impact Statement for the Elk Creek Watershed Project. The original NOI was published in the Federal Register on October 2, 2017. The project is being canceled and will be combined with a new project for which an Environmental Assessment will be prepared.
Cardinal-Hickory Creek 345-kv Transmission Line Project
The Rural Utilities Service (RUS), an agency of the United States Department of Agriculture, published a notice of availability, public meetings, and Section 106 notification on December 7, 2018 (83 FR 63149) Federal Register for the Cardinal-Hickory Creek 345-kV Transmission Line Project Draft Environmental Impact Statement (EIS). Meetings were scheduled for January 2019 and the public review period was to conclude on February 5, 2019. On February 12, 2019 (84 FR 3412), RUS published a notice announcing an extension of the public comment period to April 1, 2019 due to the lapse in federal funding. Previously cancelled Draft EIS public comment meetings in January 2019 are rescheduled for six days in March.
