Information Collection; Foreign Travel Proposal
In accordance with the Paperwork Reduction Act of 1995, the Forest Service is seeking comments from all interested individuals and organizations on the new information collection, Foreign Travel Proposal.
Guarantee Fee Rates for Guaranteed Loans for Fiscal Year 2008; Maximum Portion of Guarantee Authority Available for Fiscal Year 2008; Annual Renewal Fee for Fiscal Year 2008
As set forth in 7 CFR 4279.107(b) and 4280.126(c), Rural Development (the Agency) has the authority to charge an annual renewal fee for loans made under the Business and Industry (B&I) Guaranteed Loan Program and the Renewable Energy and Energy Efficiency Improvements (9006) Guaranteed Loan Program. Pursuant to that authority, the Agency is establishing the renewal fee rate at one- fourth of 1 percent for the B&I Guaranteed Loan Program and one-fourth of 1 percent for the 9006 Guaranteed Loan Program. These rates will apply to all loans obligated in fiscal year (FY) 2008 that are made under the cited programs. As established in 7 CFR 4279.107 and 4280.126, the amount of the fee on each guaranteed loan will be determined by multiplying the fee rate by the outstanding principal loan balance as of December 31, multiplied by the percent of guarantee. As set forth in 7 CFR 4280.126(a), each fiscal year the Agency shall establish the initial guarantee fee rate for loans made under the 9006 Guaranteed Loan Program. Pursuant to that authority, the Agency is establishing the initial guarantee fee rate at 1 percent for loans made in FY 2008. As set forth in 7 CFR 4279.107(a) and 4279.119(b)(4), each fiscal year the Agency shall establish a limit on the maximum portion of B&I guarantee authority available for that fiscal year that may be used to guarantee loans with a B&I guarantee fee of 1 percent or guaranteed loans with a guarantee percentage exceeding 80 percent. Allowing the guarantee fee to be reduced to 1 percent or exceeding the 80 percent guarantee on certain B&I guaranteed loans that meet the conditions set forth in 7 CFR 4279.107 and 4279.119 will increase the Agency's ability to focus guarantee assistance on projects which the Agency has found particularly meritorious. For 1 percent fees, the borrower's business supports value-added agriculture and results in farmers benefiting financially, or such projects are high impact as defined in 7 CFR 4279.155(b)(5) and located in rural communities that remain persistently poor, which experience long-term population decline and job deterioration, are experiencing trauma as a result of natural disaster, or are experiencing fundamental structural changes in its economic base. For guaranteed loans exceeding 80 percent, such projects must be a high-priority project in accordance with 7 CFR 4279.155. Not more than 12 percent of the Agency's quarterly apportioned B&I guarantee authority will be reserved for loan requests with a guarantee fee of 1 percent, and not more than 15 percent of the Agency's quarterly apportioned guarantee authority will be reserved for guaranteed loan requests with a guaranteed percentage exceeding 80 percent. Once the respective quarterly limits are reached, all additional loans for that quarter will be at the standard fee and guarantee limits in 7 CFR part 4279. As an exception to this paragraph and for the purposes of this notice, loans developed by the North American Development Bank (NADBank) Community Adjustment and Investment Program (CAIP) will not count against the 15 percent limit. Up to 50 percent of CAIP loans may have a guaranteed percentage exceeding 80 percent. The funding authority for CAIP loans is not derived carryover or recovered funding authority of the B&I Guaranteed Loan Program.
Regulatory Streamlining of the Farm Service Agency's Direct Farm Loan Programs; Correction
This document contains corrections to the final rule titled ``Regulatory Streamlining of the Farm Service Agency's Direct Farm Loan Programs'' that was published November 8, 2007. The Agency is correcting the order of two forms in the appendices and inserting the date of ``12-31-07'' on form FSA-2512 in the upper left corner.
National Organic Program (NOP); Sunset Review (2008)
Sunset of the exempted or prohibited use of substances under the National Organic Program (NOP) is required by the Organic Foods Production Act of 1990 (OFPA). This ANPR announces the sunset of 11 exempted substances and 1 prohibited substance added to the National List on November 3 and 4, 2003. This ANPR establishes November 3, 2008, as the date by which the sunset review and renewal process must be concluded. This advance notice of proposed rule-making (ANPR) also begins the public comment process on whether the identified existing exemptions or prohibitions should be continued. Finally, this ANPR discusses how the NOP will manage the sunset review and renewal process.
Direction for Processing Interstate Natural Gas Pipeline Proposals on National Forest System Lands
The Forest Service is amending its Forest Service Manual chapter 2720, to incorporate without change, an interim directive to guide its employees in processing proposals for interstate natural gas pipeline projects. This amendment is designed to update existing direction in the Forest Service Manual chapter 2720, consistent with a May 2002 interagency agreement between the Department of Agriculture and the Federal Energy Regulatory Commission. The agreement establishes procedures for responding to and processing applications for interstate natural gas pipeline projects when the Federal Energy Regulatory Commission will be the lead agency in conducting the required environmental and historic preservation reviews.
Almonds Grown in California; Recommended Decision on Proposed Amendment of Marketing Order No. 981
This is a recommended decision regarding proposed amendments to Marketing Order No. 981 (order), which regulates the handling of almonds grown in California. Two amendments were proposed by the Almond Board of California (Board), which is responsible for local administration of the order. These proposed amendments would: authorize the establishment of specific outgoing quality requirements for different markets; and authorize the establishment of container marking and labeling requirements. The proposals are intended to provide additional flexibility in administering the quality control provisions of the order and provide the industry with additional tools to aid in the marketing of almonds. This recommended decision invites written exceptions on the proposed amendments.

The National Urban and Community Forestry Advisory Council (NUCFAC) will meet in Washington, DC. The purpose of the meeting is to discuss emerging issues in urban and community forestry and introduce the new ``Council'' members.
Single Family Housing Loans, Payment Assistance
This Final Rule implements a change in the regulations for the Rural Housing Service (RHS) 502 Direct Single Family Housing Loans by amending the formula that calculates payment assistance for which a borrower qualifies. This action is being taken to improve the distribution of program benefits, simplify the application process and improve customer service. This Final Rule follows the publication of the Proposed Rule on February 17, 2006, and takes into consideration the public comments received in response to the Proposed Rule.
Subsistence Management Regulations for Public Lands in Alaska, Subpart C and Subpart D-2007-08 Subsistence Taking of Wildlife Regulations; 2007-08 Subsistence Taking of Fish on the Kenai Peninsula Regulations
This final rule establishes regulations for seasons, harvest limits, methods, and means related to taking of wildlife for subsistence uses in Alaska during the 2007-08 regulatory year. The rulemaking is necessary because the regulations governing the subsistence harvest of wildlife in Alaska are subject to an annual public review cycle. This rulemaking replaces the wildlife regulations that expired on June 30, 2007. This rule also amends the regulations that establish which Alaska residents are eligible to take specific species for subsistence uses. In addition, this rule revises the regulations for fishing seasons, harvest limits, methods and means related to taking of fish on the Kenai Peninsula for subsistence uses during the 2007-08 regulatory year. This rule also amends the customary and traditional use determinations of the Federal Subsistence Board.
Information Collection Activity; Comment Request
In accordance with the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35, as amended), the Rural Utilities Service, an agency delivering the United States Department of Agriculture's (USDA) Rural Development Utilities Programs, hereinafter referred to as Rural Development and/or Agency, invites comments on this information collection for which the Agency intends to request approval from the Office of Management and Budget (OMB).
Roadless Area Conservation; National Forest System Lands in Colorado
The Forest Service, U.S. Department of Agriculture, is initiating a public rulemaking process to address the management of roadless areas on National Forest System lands within the State of Colorado. This rulemaking is the result of a petition submitted by Governor Bill Ritter on behalf of the State of Colorado pursuant to 7 CFR 1.28, reviewed and recommended by the Department's Roadless Area Conservation National Advisory Committee, and accepted by the Secretary. The State requests specific regulatory protections with certain management flexibility for the approximately four million acres of affected lands. The Forest Service will prepare an environmental impact statement to analyze and disclose potential environmental consequences associated with this rulemaking.
Roadless Area Conservation National Advisory Committee
The Roadless Area Conservation National Advisory Committee will meet in Washington, DC. The purpose of the meeting is to discuss the proposed rule for the management of roadless areas on National Forest System lands in the State of Idaho and to discuss other related roadless area matters.
Grand Mesa, Uncompahgre and Gunnison National Forests; CO; Establishment of Fees for Forest Cabin Rental Program
The Grand Mesa, Uncompahgre and Gunnison (GMUG) National Forests proposes to begin charging fees for the overnight rental of several cabins including 3 cabins at the Cold Springs Adminstrative Site; 2 cabins at the Mesa Lakes Administrative Site and single cabins at 25 Mesa, Silesca, and Jackson Administrative Sites. Public rentals of Forest Service cabins in other parts of Colorado is very popular and shows that the public appreciates and enjoys the use and availability of historic rental cabins. Funds from the rentals will be used for the continued operation and maintenance of the rental cabins. The Cold Springs Adminstrative Site is located in T 51N, R16, Section 29 and the Mesa Lakes Administrative Site is located in T11S, R96W, Section 34 on the Grand Valley Ranger District. The 25 Mesa Cabin is located in T49N, R13W, Section 6, the Silesca Cabin is located in T47N, R11W, Section 18, and the Jackson Cabin is located in T46N, R6W, Section 28; all three are located on the Ouray Ranger District.
Viruses, Serums, Toxins, and Analogous Products; Standard Requirements for Live Vaccines
We are amending the Virus-Serum-Toxin Act regulations for certain live bacterial and viral vaccines by removing the requirement to retest the Master Seeds for immunogenicity 3 years after the initial qualifying immunogenicity test. In addition, we are amending the requirement concerning mouse safety tests prescribed for a biological product recommended for animals other than poultry. These changes update the standard requirements by eliminating unnecessary testing of Master Seed bacteria and viruses and other forms of bulk or completed biological product.
2005-2007 Livestock Compensation and Catfish Grant Programs
This rule establishes the Farm Service Agency (FSA) regulations for the 2007 Emergency Agricultural Assistance. The rule implements legislation that provides funds for agricultural disaster aid for eligible producers, specifically the continuation of the Livestock Compensation Program (LCP) and the Catfish Grant Program (CGP). The programs will provide financial assistance to eligible livestock and catfish producers in counties designated as a major disaster or emergency by the President or those declared a natural disaster by the Secretary of Agriculture. Counties designated disasters by the President may be eligible even though agricultural loss was not covered by the designation if there has been an FSA Administrator's Physical Loss Notice covering such losses. The natural disaster declarations by the Secretary or designations by the President must have been issued between January 1, 2005, and February 28, 2007; that is after January 1, 2005, and before February 28, 2007. Counties contiguous to such counties will also be eligible. These programs are designed to provide financial assistance to producers who suffered feed losses due to natural disasters in the eligible counties.
Emergency Agricultural Assistance, 2007; Crop Disaster and Livestock Indemnity Programs
This rule establishes the Farm Service Agency (FSA) regulations for the 2007 Emergency Agricultural Assistance. The rule implements legislation that provides funds for agricultural disaster aid for eligible producers, specifically a Crop Disaster Program (CDP) and a 2005-2007 Livestock Indemnity Program (LIP). For CDP, the program applies only to 2005, 2006, and 2007 crop producers who chose to have a Federal Crop Insurance plan of insurance or Noninsured Crop Disaster Assistance Program coverage for the year of loss and suffered damage due to a natural disaster. Eligible crops for 2007 must have been planted prior to February 28, 2007. For LIP, the program applies only to livestock producers in counties designated as a major disaster or emergency area by the President or those declared a natural disaster area by the Secretary of Agriculture. Counties designated disasters by the President may be eligible even though agricultural loss was not covered by the designation if there has been an FSA Administrator's Physical Loss Notice covering such losses. The natural disaster declarations by the Secretary or designations by President must have been issued between January 1, 2005, and February 28, 2007; that is after January 1, 2005 and before February 28, 2007. Counties contiguous to such counties will also be eligible.
Notice of Extension of Public Comment Period-Sale and Disposal of National Forest System Timber; Special Forest Products and Forest Botanical Products
The public comment period is being extended an additional 30 days for the proposed rule governing the disposal of special forest products from National Forest System lands. The original notice called for comments to be submitted by December 21, 2007 (FR 72, 59496-59506, published on Monday, October 22, 2007). As stated in the original Public Notice, special forest products include, but are not limited to, wildflowers, mushrooms, moss, nuts, seeds, tree sap, and Christmas trees. The proposed rule also formally establishes a pilot program to charge and collect fees for the harvest and sale of forest botanical products on National Forest System lands. The proposed rule is intended to facilitate sustainable harvest of special forest products and forest botanical products. Public comment is invited and will be considered in the development of the final rule.
Black Stem Rust; Addition of Rust-Resistant Varieties; Correction
We are correcting an error in the amendatory instructions in our direct final rule that added four varieties to the list of rust- resistant Berberis species or cultivars in the black stem rust quarantine and regulations. The direct final rule was published in the Federal Register on June 12, 2007 (72 FR 32165-32167, Docket No. APHIS- 2007-0072) and became effective on August 13, 2007.
Lake Tahoe Basin Federal Advisory Committee
The Lake Tahoe Basin Federal Advisory Committee will hold a meeting on January 11, 2008 at the Sierra Nevada College, 999 Tahoe Boulevard, Incline Village, NV, 89451. This Committee, established by the Secretary of Agriculture on December 15, 1998 (64 FR 2876), is chartered to provide advice to the Secretary on implementing the terms of the Federal Interagency Partnership on the Lake Tahoe Region and other matters raised by the Secretary.
Bitterroot National Forest, West Fork Ranger District; Montana; Lower West Fork Project
The USDA, Forest Service, Bitterroot National Forest, will prepare an environmental impact statement (EIS) to document the analysis and disclose the environmental impacts of the proposed Lower West Fork project. The project area is located in Ravalli County, about 15 miles southwest of Darby, Montana. The project area encompasses about 38,400 acres between the Pierce and Wheeler Creek drainages on the west side of the West Fork Bitterroot River, and the Piquett, Violet, Pine, Applebury, Steep Creek drainages on the east side of the river. The proposed Lower West Fork project would manage vegetation to reduce fuel loads and crown fire hazard in the wildland urban interface, improve forest health and resilience to disturbances, and maintain or increase shade intolerant species such as ponderosa pine and aspen. Roads will be evaluated for opportunities to reduce sedimentation and restore aquatic passage. Terraced lands will be evaluated for opportunities to restore soils. Site-specific Bitterroot Forest Plan amendments may be proposed for downed wood, snags, soils, or elk habitat effectiveness. Approximately 5,100 acres of the project area are proposed for vegetation treatments.
Notice of Proposed New Fee Site on the Inyo National Forest
The Inyo National Forest, White Mountain Ranger District is proposing to implement fees at a complex of three group camp sites in the White Mountains east of Bishop, California. The proposed fee structure is based on the level of services and amenities provided, cost of operation and maintenance, market assessment and public comments. Fee monies would be used to provide maintenance services, trash hauling, restroom servicing (pumping and hauling of waste), road maintenance into the sites and other direct costs. The group camp sites, known as the Cedar Flat Group Campsgrounds, were constructed in 2005 as part of a special use permit condition for a large scientific research facility. They are used primarily by colleges, universities, and other educational groups for a ``base facility'' for their geology field camps, natural history studies and other academic pursuits. They are particularly well suited for this use as they are in close proximity to the geologic areas of study. Additionally, they are in a terrain and vegetation type that allows for dispersed tent use but has a common area for (outdoor) meetings, eating and socializing. Each group site contains a concrete pad under a shade ramada for picnic tables, a developed parking area, interpretive exhibits, and group working areas. Additionally, all the sites have new sealed vault type toilets, a fire ring and dumpster type trash bins. The sites are of varying sizes and have capacities of 50, 30 and 25 campers. The larger site also has room to park a limited number of recreational vehicles. The fee for each of the sites is proposed to be set at $25 per night. Traditional use of the old group campsites, removed in 2004, has been longer stays such as two and three weeks for field studies of geology or natural history as part of an academic field camp. No other group site opportunities are available in the vicinity. These sites also have the advantage of being isolated which facilitates group use, evening lighting and later night studying and data preparation by college students, the primary users of these facilities. Funds derived from the fees would be used to provide regular maintenance services, contract trash hauling and toilet pumping.
A Business Plan To Advance Animal Disease Traceability
We are advising the public that we are making available for review and comment a Business Plan to Advance Animal Disease Traceability. The Business Plan details recommended strategies and actions to enable existing State and Federal regulated and voluntary animal health programs, industry-administered management and marketing programs, and various animal identification methods to work in harmony with the National Animal Identification System.
National Animal Identification System; User Guide and Additional Information Resources
We are advising the public that we are have prepared a revised version of the National Animal Identification System (NAIS) User Guide that was originally released in draft form in November 2006. The revised User Guide contains the most current information on how the system works and how producers may participate in the NAIS. We are making the revised User Guide available for review and comment.
Veterinary Diagnostic Services User Fees
We are amending the regulations to increase the user fees for the veterinary diagnostic services to reflect changes in our operating costs and expenses. We are also setting rates for multiple fiscal years. These actions are necessary to ensure that we recover the actual costs of providing these services. We are also providing for a reasonable balance, or reserve, in the veterinary diagnostics user fee account. The Food, Agriculture, and Conservation Act of 1990, as amended, authorizes us to set and collect these user fees.
Clearwater National Forest; Idaho; Travel Management Plan
On November 28, 2007, the USDA Forest Service announced its intent to prepare a travel planning environmental impact statement (EIS). The proposed action would designate a site-specific transportation system and prohibit indiscriminate cross-country traffic. The EIS will analyze the effects of the proposed action and alternatives. This Revised Notice is being published because the due date for scoping comments has been extended to January 11, 2008. The Clearwater National Forest invites comments and suggestions on the issues to be addressed. The agency gives notice of the National Environmental Policy Act (NEPA) analysis and decision-making process on the proposal so interested and affected members of the public may participate and contribute to the final decision.
Cash and Share Lease Provisions for Future Farm Programs
The Farm Service Agency (FSA) and the Risk Management Agency (RMA) are reopening and extending the comment period for the advance notice of proposed rulemaking, Cash and Share Lease Provisions for Future Farm Programs. The original comment period closed November 27, 2007. FSA and RMA are reopening and extending it for 30 days from the date of this notice. We will also consider any comments received from November 27, 2007 to this date of this notice. This extension responds to requests from the public to provide more time to comment.

Conservation Innovation Grants Fiscal Year 2008 Announcement of Program Funding; Catalog of Federal Domestic Assistance (CFDA) Number: 10.912
NRCS requests applications for Conservation Innovation Grants (CIG) to stimulate the development and adoption of innovative conservation approaches and technologies. Applications are accepted from all 50 States, the Caribbean Area (Puerto Rico and the Virgin Islands), and the Pacific Basin Area (Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands). NRCS anticipates that the amount available for support of this program in FY 2008 will be approximately $20 million. Funds will be awarded through a nationwide competitive grants process. There are three CIG categories available in FY 2008: Natural Resource Concerns Category, Technology Category, and the Chesapeake Bay Watershed Category. Applications are requested from eligible government or non-government organizations or individuals for competitive consideration of grant awards for projects between one and three years in duration. This notice identifies the objectives for CIG projects, the eligibility criteria for projects and associated instructions needed to apply to CIG.
Marketing Order Regulating the Handling of Spearmint Oil Produced in the Far West; Revision of the Salable Quantity and Allotment Percentage for Class 3 (Native) Spearmint Oil for the 2007-2008 Marketing Year
This rule revises the quantity of Class 3 (Native) spearmint oil that handlers may purchase from, or handle for, producers during the 2007-2008 marketing year. This rule increases the Native spearmint oil salable quantity from 1,162,336 pounds to 1,172,956 pounds, and the allotment percentage from 48 percent to 53 percent. The marketing order regulates the handling of spearmint oil produced in the Far West and is administered locally by the Spearmint Oil Administrative Committee (Committee). The Committee recommended this rule for the purpose of avoiding extreme fluctuations in supplies and prices and to help maintain stability in the Far West spearmint oil market.

Notice of Availability of Draft San Juan Land Management Plan and Draft Environmental Impact Statement, Colorado
In accordance with the National Environmental Policy Act of 1969 (NEPA, 42 U.S.C. 4321 et seq.), the Forest and Rangeland Renewable Resources Planning Act of 1974 (RPA), as amended by the National Forest Management Act of 1976, (NFMA, Sec. 6, 16 U.S.C. 1600.), and the Federal Land Policy and Management Act of 1976 (FLPMA, 43 U.S.C. 1701 et seq.), the Bureau of Land Management (BLM) San Juan Field Office and San Juan National Forest, U.S. Forest Service (USFS) has prepared a Draft Land Management Plan/Draft Environmental Impact Statement (DLMP/ DEIS) for the public and National Forest System Lands under their jurisdiction and by this notice is announcing the opening of the comment period. The BLM San Juan Field Office and San Juan National Forest are managed under Service First. The San Juan Public Lands Center (SJPLC) is the joint USFS/BLM Service First Office responsible for the management of these public lands. Service First is a partnership strategy to provide better customer service and be more cost effective in the delivery of those services to users of the public lands in southwest Colorado. This notice also meets BLM requirements in 43 CFR part 1610, 7-2(b) concerning potential Areas of Critical Environmental Concern (ACECs).
Sweet Cherries Grown in Designated Counties in Washington; Section 610 Review
This action summarizes the results under the criteria contained in section 610 of the Regulatory Flexibility Act (RFA), of an Agricultural Marketing Service (AMS) review of Marketing Order No. 923, regulating the handling of sweet cherries grown in designated counties in Washington. AMS has determined that the marketing order should be continued.
Request for an Extension and Revision to a Currently Approved Information Collection
In accordance with the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), this notice announces the Agricultural Marketing Service's (AMS) intention to request approval from the Office of Management and Budget, for an extension of and revision to the currently approved information collection for Recordkeeping Requirements for Certified Applicators of Federally Restricted Use Pesticides (7 CFR part 110).

We are amending our Agricultural Quarantine and Inspection Services user fee regulations to update an address that appears in several places. We are also making several nonsubstantive changes to the Veterinary Services user fee regulations to correct errors and to clarify the services covered by certain existing user fees. These changes, which do not affect any existing fees, are necessary to ensure that the user fee regulations are up to date and to ensure their clarity.
Gypsy Moth Regulations; Updates and Clarifications
We are amending the gypsy moth regulations by making editorial and nonsubstantive changes to several terms and providing necessary updates throughout the regulations. These actions will improve the clarity and consistency of the regulations while continuing to provide protection against the artificial spread of gypsy moth into noninfested areas of the United States.
Monsanto Company; Availability of Petition and Environmental Assessment for Determination of Nonregulated Status for Corn Genetically Engineered for Insect Resistance
We are advising the public that the Animal and Plant Health Inspection Service has received a petition from the Monsanto Company seeking a determination of nonregulated status for insect-resistant corn derived from a transformation event designated as MON 89034. The petition has been submitted in accordance with our regulations concerning the introduction of certain genetically engineered organisms and products. In accordance with those regulations, we are soliciting comments on whether this genetically engineered corn is or could be a plant pest. We are also making available for public comment a draft environmental assessment for the proposed determination of nonregulated status.
