This notice presents the Record of Decision (ROD) regarding the Natural Resources Conservation Service (NRCS) implementation for a Water Management Project located in White County, Arkansas, that provides agricultural water for irrigation, and the enhancement of fish and wildlife habitat. NRCS prepared a Final Plan/Environmental Impact Statement (FPEIS) in cooperation with the Little Red River Regional Irrigation Water District. A Notice of Availability (NOA) of the Little Red River Irrigation Project FPEIS was published in the Federal Register on May 26, 2006, and all agencies and persons on the FPEIS distribution list were notified individually as well. Printed and CD- ROM versions of the FPEIS were made available and delivered to all those who requested. This Decision Notice summarizes the environmental, social, and economic impacts of the Little Red River Irrigation Project alternatives identified in the FPEIS that were considered in making this decision, and explains why NRCS selected the Preferred AlternativeConservation/Surface Source AlternativeCanals and Pipelines (Alternative 4) for providing supplemental irrigation water and better utilizing the existing water resources while improving the overall environmental quality of the project area.

This rule amends Marketing Orders Nos. 916 and 917 (orders), which regulate the handling of nectarines and peaches grown in California. The amendments are based on those proposed by the Nectarine Administrative Committee (NAC), the Peach Commodity Committee (PCC), and the Control Committee (part of M.O. No. 917) (Committees), which are responsible for local administration of orders 916 and 917. The amendments to order 917 only apply to peaches. The amendments would: update definitions for ``handle'', ``grower'', and add a definition for ``pure grower'' to both orders; increase committee membership of the NAC from eight to thirteen members and modify sections of order 916 to conform to the increased membership; eliminate the Shippers Advisory Committee in order 916; allow the Control Committee under order 917 to be suspended if the provisions of one commodity are suspended and transfer applicable duties and responsibilities to the remaining Commodity Committee; authorize interest and late payment charges on assessments paid late in both orders; and other related amendments. With the exception of the proposal to allow the Peach Commodity Committee to borrow funds, all of the proposals were favored by nectarine and peach growers in a mail referendum, held March 6 through 24, 2006. The amendments are intended to streamline and improve the administration, operation, and functioning of the orders.

Chronic Wasting Disease Herd Certification Program and Interstate Movement of Farmed or Captive Deer, Elk, and Moose

We are establishing a herd certification program to eliminate chronic wasting disease (CWD) from farmed or captive cervids in the United States. Participating deer, elk, and moose herds will have to follow program requirements for animal identification, testing, herd management, and movement of animals into and from herds. After 5 years of enrollment with no evidence of chronic wasting disease, a herd may be granted ``Certified'' status. Owners of herds may enroll in a State program that we have determined has requirements equivalent to the Federal program, or may enroll directly in the Federal program if no State program exists. We are also establishing interstate movement requirements to prevent the interstate movement of deer, elk, and moose that pose a risk of spreading CWD. These actions will help to eliminate CWD from the farmed or captive deer, elk, and moose herds in the United States.

We are amending the gypsy moth regulations by removing restrictions on the interstate movement of wood chips, which do not pose a risk of containing gypsy moth egg masses, and by adding restrictions on the movement and importation of bark and bark products, which pose a risk of containing gypsy moth egg masses. In addition, we are extending by 2 months the period during which regulated articles originating outside of any generally infested area must be safeguarded from infestation in order to be eligible for interstate movement directly through any generally infested area without a certificate or permit. These changes are necessary to update the provisions in the regulations to ensure consistent actions by the Animal and Plant Health Inspection Service, our cooperators, and industry in order to limit the artificial spread of gypsy moth.
Asian Longhorned Beetle; Removal of Quarantined Area in Illinois

We are amending the Asian longhorned beetle regulations by removing the Oz Park area in Cook County, IL, from the list of quarantined areas and removing restrictions on the interstate movement of regulated articles from those areas. We have determined that the Asian longhorned beetle no longer presents a risk of spread from that area and that the quarantine and restrictions are no longer necessary. With this change, there are no longer any areas in Illinois that are quarantined because of the Asian longhorned beetle.

Notice is hereby given that the USDA, Forest Service will prepare an Environmental Impact Statement (EIS) for a proposal by Crown Resources Corporation (Crown) to access their private lands and unpatented mining claims on National Forest System lands, and to utilize their unpatented mining claims for mining related facilities. The purpose of the EIS will be to evaluate a range of reasonable alternatives for this proposal and take public comment on the analysis. The proposed project will comply with the direction in the December 1989 Okanogan National Forest Land and Resource Management Plan (Forest Plan), as amended. The Forest Plan provides the overall guidance for management of National Forest System lands included in this proposal. Scoping on this project was initiated in the Spring of 2005. After preparation and circulation of a preliminary Environmental Assessment on the project, the Forest Service has decided to prepare an Environmental Impact Statement, as provided for in the Council on Environmental Quality's Regulations for Implementing the Procedural Provisions of the National Environmental Policy Act (40 CFR 1501.4(c)). The Forest Service is giving notice of this analysis so that interested and affected individuals are aware of how they may participate and contribute to the final decision.

This rule suspends the continuing assessment rate established for the Area No. 3 Colorado Potato Administrative Committee (Committee) for the 2006-2007 and subsequent fiscal periods. The Committee, which locally administers the marketing order regulating the handling of potatoes grown in Northern Colorado, made this recommendation for the purpose of lowering the monetary reserve to a level consistent with program requirements. The fiscal period begins July 1 and ends June 30. The assessment rate will remain suspended until an appropriate rate is reinstated.

The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim final rule that suspends the container regulations prescribed under the Washington apricot marketing order for the 2006 shipping season only. The marketing order regulates the handling of fresh apricots grown in designated counties in the State of Washington, and is administered locally by the Washington Apricot Marketing Committee (Committee). This relaxation of the regulations provides the apricot industry with increased marketing flexibility by allowing handlers to pack and ship apricots in any size, shape, or type of container. The Committee recommended a temporary suspension of the container regulations so that it can thoroughly evaluate the impact the relaxation has on the apricot industry prior to taking any action for subsequent seasons.

The amended provisions will replace the Crop Revenue Coverage (CRC), Income Protection (IP), Indexed Income Protection (IIP), and the Revenue Assurance (RA) plans of insurance. The intended effect of this action is to offer producers a choice of revenue protection (protection against loss of revenue caused by low prices, low yields or a combination of both) or yield protection (protection for production losses only) within one Basic Provisions and the applicable Crop Provisions to reduce the amount of information producers must read to determine the best risk management tool for their operation and to improve the prevented planting and other provisions to better meet the needs of insured producers. The changes will apply for the 2009 and succeeding crop years.

The extension is necessary to complete collection of baseline data on the economic, social, and cultural contributions of livestock owners in northern New Mexico. The information provided by this study will help the Forest Service administer grazing permits more effectively to better meet the needs of grazing permittees in northern New Mexico. The information will also be used for purposes of public education.

This final rule makes technical changes to the regulations governing the National School Lunch Program, the Special Milk Program for Children, the School Breakfast Program, the Summer Food Service Program, the Child and Adult Care Food Program and State Administrative Expense Funds. The United States Department of Agriculture (USDA), Food and Nutrition Service (FNS) is revising its grants management regulations to bring these entitlement programs and their funds under the same regulations that already apply to nonentitlement programs, and to identify exceptions to these general rules that apply only to entitlement programs. This final rule is intended to update FNS program regulations, reflecting the revision of USDA's grants management regulations which brought entitlement programs under the same regulations that already applied to nonentitlement programs. In addition, this final rule also revises references to procurement and audit procedures in FNS's program regulations.
