Electronic Submission of Mariner Course Completion Data

The Coast Guard proposes to require Coast Guard-approved training providers to electronically submit student course completion data to the Coast Guard within 5 business days of completing a Coast Guard-approved course. The National Maritime Center would use this information to validate mariner course completion as part of an application for a Merchant Mariner Credential. In addition, the Coast Guard proposes to replace gendered titles for certain officer and rating endorsements in keeping with Coast Guard policy of using gender- neutral language. We expect these proposed changes to lessen the probability of credentials being issued to mariners who have not met the professional requirements for their endorsements and to appropriately conform terms that should be gender-neutral.

The Coast Guard will enforce various safety zones for maritime events in the Captain of the Port Sault Sainte Marie Zone. Enforcement of these safety zones is necessary to protect the safety of life and property on the navigable waters immediately prior to, during, and immediately after this event. During the aforementioned period, the Coast Guard will enforce restrictions upon, and control movement of, vessels in a specified area immediately prior to, during, and immediately after events. During each enforcement period, vessels must stay out of the established safety zone and may only enter with permission from the designated representative of the Captain of the Port Sault Sainte Marie.

This action is necessary to provide for the safety of life, property, and the environment during the planned construction of each facility's monopile type foundation and subsequent installation of the WTGs turbines and ESP platform from June 15, 2023, to May 31, 2024. When enforced, only attending vessels and those vessels specifically authorized by the First Coast Guard District Commander, or a designated representative, are permitted to enter or remain in the temporary safety zones. The Coast Guard is amending its Risk Group A facility regulations so that their provisions to implement Transportation Worker Identification Credential (TWIC) electronic inspection requirements by May 8, 2023, is changed to May 8, 2026. This will revise our regulations to conform with recently passed legislation. The James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (Authorization Act) was enacted December 23, 2022. A provision within the Authorization Act directs the Secretary of Homeland Security to not implement TWIC reader regulations for certain facilities before May 8, 2026. This conforming amendment will have no substantive effect. Controlling statutory authority already nullifies the May 8, 2023, implementing dates in our regulations. We note there is a separate ongoing rulemaking to address whether the implementation date should remain May 8, 2026, or be moved to a later date. The Authorization Act was enacted after the Coast Guard published the proposed rule for that separate rulemaking.
