Notice is hereby given that effective with this publication two NAD 83-based OCS Provisional OPDs that represent the Island of Oahu and surrounding Federal waters are now available. BOEM, in accordance with its authority and responsibility under Title 43, Code of Federal Regulations, has created provisional versions of the basic record used for the description of renewable energy, mineral, and oil and gas lease sales in the geographic areas they represent. These provisional OPDs represent the approximate locations of the Submerged Lands Act (3 nautical mile), Limit of ``8(g) Zone'' (6 nautical mile), and National Marine Sanctuary boundaries. The provisional OPDs are for informational purposes only and will be superseded by official versions.

BOEM will complete the evaluation process for all bids received in this sale by July 18, 2013. This action is necessary due to resource limitations resulting from sequestration. BOEM is unable to pay overtime to expedite the bid review process, including the incorporation of increased volumes of reprocessed proprietary datasets used by bidders to formulate their bid submittals.

BOEM has prepared a revised environmental assessment (EA) considering the reasonably foreseeable environmental and socioeconomic impacts of issuing renewable energy leases and subsequent site characterization activities (geophysical, geotechnical, archaeological, and biological surveys needed to develop specific project proposals on those leases) in an identified Wind Energy Area (WEA) on the OCS offshore Rhode Island (RI) and Massachusetts (MA). The revised EA also considers the reasonably foreseeable impacts associated with the approval of site assessment activities (including the installation and operation of meteorological towers and buoys) on the leases that may be issued in the identified WEA. As a result of the analysis in the revised EA, BOEM issued a Finding of No Significant Impact (FONSI). The FONSI concluded that the reasonably foreseeable impacts associated with the preferred alternative would not significantly impact the environment; therefore, the preparation of an environmental impact statement (EIS) is not required. This document is the Final Sale Notice (FSN) for the sale of two commercial wind energy leases on the Outer Continental Shelf (OCS) offshore Rhode Island and Massachusetts, pursuant to BOEM's regulations at 30 CFR 585.216. BOEM is offering Lease OCS-A 0486 (North Lease Area) and Lease OCS-A 0487 (South Lease Area) for sale simultaneously using a multiple factor auction format. The two lease areas together comprise the Rhode Island and Massachusetts Wind Energy Area (WEA) announced on February 24, 2012, (see ``Areas Offered for Leasing'' below for a description of the WEA and lease areas). The two lease areas are identical to those announced in the Proposed Sale Notice (PSN) for Commercial Leasing for Wind Power on the Outer Continental Shelf (OCS) Offshore Rhode Island and Massachusetts, which was published on December 3, 2012, in the Federal Register with a 60-day public comment period (77 FR 71612). This FSN contains information pertaining to the areas available for leasing, lease provisions and conditions, auction details, the lease form, criteria for evaluating competing bids, award procedures, appeal procedures, and lease execution. The issuance of the leases resulting from this lease sale would not constitute an approval of project-specific plans to develop offshore wind energy. Such plans, expected to be submitted by successful lessees, will be subject to subsequent environmental and public review prior to a decision to proceed with development.
Outer Continental Shelf (OCS) Geological and Geophysical Exploration Activities in the Gulf of Mexico

Pursuant to the regulations implementing (National Environmental Policy Act) (NEPA), and subject to available funding, BOEM is announcing the intent to prepare a Programmatic Environmental Impact Statement (PEIS) to evaluate potential environmental effects of multiple geological and geophysical (G&G) activities in OCS waters of the Gulf of Mexico (GOM), extending from the coastline to the seaward boundary of the Exclusive Economic Zone (EEZ), including the GOM OCS. The PEIS will be prepared cooperatively with NMFS to serve as the requisite environmental analysis under NEPA for the National Marine Fisheries Service's (NMFS) Marine Mammal Protection Act (MMPA) rulemaking governing authorization for unintentional marine mammal takes during G&G activities in GOM waters. It will also provide information for future decisions regarding Outer Continental Shelf Lands Act (OCSLA) permit and MMPA authorization actions, in addition to informing consultations under the Endangered Species Act (ESA), Magnuson-Stevens Fishery Conservation and Management Act (MSFCMA), and other statutes. By this document, BOEM announces: The intention to prepare a PEIS; commencement of the scoping process under NEPA; a request for public comment on the scope of the PEIS; times, dates and locations for public scoping meetings; and a request for other Federal Agencies, and State, Tribal, and local governments to consider becoming cooperating agencies in the preparation of the PEIS.

This proposed rule would amend the timing requirements for submitting a Site Assessment Plan (SAP) or General Activities Plan (GAP) pursuant to the regulations governing renewable energy and alternate uses of existing facilities on the Outer Continental Shelf (OCS). Under this proposed rule, all OCS renewable energy leases and grants will have a preliminary term of 12 months in which a lessee or grantee must submit a SAP or a GAP. BOEM is taking this action because the current regulations provide timing requirements for submission of SAPs and GAPs that have proven to be impractical.

Potential Commercial Leasing for Wind Power on the Outer Continental Shelf (OCS) Offshore New York, Request for Interest

The purpose of this public notice is to: (1) Describe the proposal submitted to BOEM by the New York Power Authority (NYPA) to acquire an OCS wind lease; (2) solicit public input regarding the proposal, its potential environmental consequences, and the use of the area in which the proposed project would be located; and (3) solicit submissions of indications of competitive interest for a commercial lease for wind energy development on the OCS offshore New York for the area identified in this notice. On September 8, 2011, BOEM received an unsolicited request from NYPA for a commercial wind lease on the OCS offshore New York. NYPA submitted its request on behalf of the ``Long Island-New York City Offshore Wind Collaborative,'' a public-private entity consisting of NYPA, the Long Island Power Authority, and Consolidated Edison Company of New York, Inc. The Collaborative's goal is to develop the proposed project to supply the Long Island and New York City region with renewable energy, consistent with New York State's and the City of New York's renewable energy initiatives. NYPA's proposed project, the ``Long Island-New York City Offshore Wind Project'', is designed to generate at least 350 megawatts (MW) of electricity from offshore wind resources, with the ability to expand generation capacity to as much as 700 MW. The project would be located approximately 11 nautical miles (nmi) south of Long Beach, New York, in water depths ranging from 60 to 120 feet. NYPA's unsolicited lease request, and an amendment filed on June 20, 2012, can be viewed at: https://www.boem.gov/Renewable-Energy- Program/State-Activities/New-York.aspx. This request for interest is published pursuant to subsection 8(p)(3) of the OCS Lands Act, as amended by section 388 of the Energy Policy Act of 2005 (EPAct) (43 U.S.C. 1337(p)(3)), and the implementing regulations at 30 CFR 585.231(b). Subsection 8(p)(3) of the OCS Lands Act requires that OCS renewable energy leases, easements, and rights- of-way be issued ``on a competitive basis unless the Secretary determines after public notice of a proposed lease, easement, or right- of-way that there is no competitive interest.'' This request for interest provides such public notice for the proposed lease area requested by NYPA and invites the submission of indications of competitive interest. BOEM will consider the responses to this public notice to determine whether competitive interest exists for the area requested by NYPA, as required by 43 U.S.C. 1337(p)(3). Parties wishing to obtain a lease for the area requested by NYPA should submit detailed and specific information as described in the section entitled, ``Required Indication of Interest Information.'' This announcement also requests that interested and affected parties comment and provide information about site conditions and multiple uses within the area identified in this notice that would be relevant to the proposed project or its impacts. Interim Policy Leasing for Renewable Energy Data Collection Facility on the Outer Continental Shelf off the Coast of Georgia

This Notice of Intent (NOI) to prepare an Environmental Assessment (EA) is being published as an initial step for the purpose of involving Federal agencies, states, tribes, local governments, and the public in the preparation of an EA. The EA will consider the environmental consequences associated with issuing a lease for an offshore data collection facility located on the Outer Continental Shelf (OCS), in accordance with applicable Department of the Interior (DOI) and Council on Environmental Quality (CEQ) regulations implementing the provisions of the National Environmental Policy Act (NEPA) of 1969 as amended (42 U.S.C. 4321 et seq.). On November 6, 2007, the Minerals Management Service, now BOEM, announced an interim policy for authorizing the issuance of leases for the installation of offshore data collection and technology testing facilities on the OCS (72 FR 62673). An applicant has submitted a lease proposal to BOEM pursuant to the interim policy and, thus, has initiated the need for an EA. On April 7, 2011, Southern Company submitted an application to lease three OCS blocks, approximately 311 nautical miles off the coast of Tybee Island, Georgia, under its original nomination submitted on July 23, 2008. The areas proposed for leasing are identified as Brunswick NH 17-02 OCS blocks numbered 6074, 6174, and 6126. The proposed lease area covers about 70 square kilometers (17,280 acres) of seafloor, and ranges from a depth of 12 meters (m) in Block 6074 to 20 m in the eastern half of Block 6126. Southern Company submitted amended project applications on May 18, 2012, and October 25, 2012, which describe additional data collection and technology testing activities to be conducted on the proposed lease. Southern Company intends to deploy a meteorological tower and/or a meteorological buoy that will measure wind speed, direction and shear, and potentially collect other environmental data during the five year lease term. BOEM intends to prepare an EA for the purpose of considering the environmental consequences associated with issuing an interim policy lease to Southern Company; this EA will consider impacts associated with the deployment and installation of a meteorological tower and/or the deployment of a meteorological buoy. At a minimum, the EA will consider the alternatives of no action (i.e., no issuance of a lease) and the issuance of a lease and approval of certain technology testing activities within the lease area, such as installation of a fixed meteorological tower and/or deployment of a meteorological buoy. With this NOI, BOEM requests comments and input from Federal, state, and local government agencies, tribal governments, and other interested parties on important environmental issues and alternatives that may be appropriate for consideration in the EA. BOEM also requests information pertaining to measures (e.g., limitations on activities based on technology, siting, or timing) that would minimize the reasonably foreseeable impacts to environmental resources and socioeconomic conditions which could result from the proposed activity. BOEM will conduct consultations with other Federal agencies, tribal governments, and affected states during the EA process.

BOEM is publishing this Notice of Intent To Prepare an Environmental Assessment (EA) for the purpose of involving Federal agencies, states, tribes, local governments, offshore wind energy developers, and the public in the Department of the Interior's (DOI) ``Smart from the Start'' wind energy initiative offshore North Carolina. The ``Smart from the Start'' wind energy initiative is designed to identify areas that appear to be suitable for wind energy leasing on the OCS, known as Wind Energy Areas (WEAs) and to obtain public and expert input that will inform DOI's decisionmaking with regard to issuing leases and approving site assessment activities in these areas, in accordance with applicable DOI regulations and the Council on Environmental Quality (CEQ) regulations implementing the provisions of the National Environmental Policy Act (NEPA) of 1969 as amended (42 U.S.C. 4321 et seq.). The ``Smart from the Start'' initiative involves coordinated environmental studies, large-scale planning processes, and expedited review procedures within these areas to achieve an efficient and responsible renewable energy leasing process. In consultation with other Federal agencies and the BOEM North Carolina Intergovernmental Renewable Energy Task Force, BOEM has identified three areas under consideration for potential future wind energy leasing offshore North Carolina (Call Areas). These Call Areas are identified in the document entitled, Commercial Leasing for Wind Power on the Outer Continental Shelf Offshore North Carolina-Call for Information and Nominations (Call), which is being published concurrently with this Notice. The publication of a Call is the first public step in BOEM's offshore wind planning process for North Carolina, and additional opportunities for public involvement are required before any commercial wind leases would be issued. A commercial lease gives the lessee the exclusive right to subsequently seek BOEM approval for the development of the leasehold. The lease does not grant the lessee the right to construct any facilities; rather, the lease grants the lessee the right to use the leased area to develop its plans, which BOEM must approve before the lessee can move on to the next stage of the process. See 30 CFR 585.600 and 585.601. BOEM intends to prepare an EA, which is the subject of this Notice, that will consider the environmental consequences associated with the possible future issuance of commercial wind leases and approving site assessment activities on those leases (within all or some of these Call Areas). BOEM is seeking public input regarding the identification of the alternatives to be considered in the EA, as well as the environmental and/or socioeconomic issues to be analyzed. Furthermore, section 106 of the National Historic Preservation Act (16 U.S.C. 470f) and its implementing regulations at 36 CFR 800 require Federal agencies to consider the effects of their actions on historic properties, and afford the Advisory Council on Historic Properties an opportunity to comment (36 CFR 800.1). Therefore, BOEM will conduct Section 106 review for the issuance of leases and approval of site assessment activities within some or all of the Call Areas, in coordination with its environmental review. As part of this Section 106 review, BOEM will initiate consultation with state historic preservation officer, tribal officials, and others. With the publication of this Notice, BOEM is reaching out to the general public for comments regarding the identification of historic properties or potential effects to historic properties from leasing and site assessment activities in the Call Areas. BOEM Form 0009 would be used to issue Outer Continental Shelf (OCS) renewable energy right-of-way (ROW) grants in order to streamline this process and increase efficiency and consistency for applicants. As defined by BOEM regulations at 30 CFR Part 585, an ROW grant is an authorization issued for use of a portion of the OCS for the construction and use of a cable or pipeline for the purpose of gathering, transmitting, distributing, or otherwise transporting electricity or other energy product generated or produced from renewable energy, but does not constitute a project easement. The ability of an ROW grantee to install such a cable or pipeline and operate such activities would be subject to the applicable approvals specified in 30 CFR Part 585. Statoil NA's proposed project, ``Hywind Maine,'' would consist of four 3-megawatt (MW) wind turbine generators (WTG) configured for a total of 12-MW in water depths greater than 100 meters and be located approximately 12 nautical miles (nmi) off the coast of Maine. The objective of the proposed Hywind Maine Project is to demonstrate the commercial potential of the existing floating offshore Hywind technology, while responding to a corresponding Request for Proposals (RFP) issued by the Maine Public Utilities Commission. This request for interest is published pursuant to subsection 8(p)(3) of the OCS Lands Act, as amended by section 388 of the Energy Policy Act of 2005 (EPAct) (43 U.S.C. 1337(p)(3)), and the implementing regulations at 30 CFR part 585.231(b). Subsection 8(p)(3) of the OCS Lands Act requires that OCS renewable energy leases, easements, and rights-of-way (ROWs) be issued ``on a competitive basis unless the Secretary determines after public notice of a proposed lease, easement, or right-of-way that there is no competitive interest.'' This request for interest provides such public notice for the proposed lease area requested by Statoil NA and invites the submission of indications of competitive interest. BOEM will consider the responses to this public notice to determine whether competitive interest exists for the area requested by Statoil NA, as required by 43 U.S.C. 1337(p)(3). The Bureau of Ocean Energy Management published a notice that appeared for Public Inspection on July 23, 2012 and published in the Federal Register July 24, 2012. It contained a typographical mistake. This document corrects the error.
