Proposed Information Collection: Beachgoer and Vessel Surveys
In compliance with the Paperwork Reduction Act, the Bureau of Ocean Energy Management (BOEM) will ask the Office of Management and Budget (OMB) to approve a collection of information to support ocean observation planning and management on public lands and waters. The respondents will be recreationists visiting public and private Gulf Coast beaches, and coastal and offshore vessel (boat) operators in the Gulf of Mexico region. The BOEM invites public comments on this proposed collection. A Federal agency may not conduct or sponsor, and a person is not required to respond to, a collection of information unless it displays a currently valid OMB control number.
Atlantic Wind Lease Sale 6 for Commercial Leasing for Wind Power on the Outer Continental Shelf Offshore New York-Final Sale Notice; Correction
On Monday, October 31, 2016, the Bureau of Ocean Energy Management (BOEM) published the Atlantic Wind Lease Sale 6 (ATLW-6) for Commercial Leasing for Wind Power on the Outer Continental Shelf Offshore New YorkFinal Sale Notice (FSN) in the Federal Register (81 FR 75429). The FSN announced that BOEM will offer for lease an identified area offshore New York, and provided details regarding the terms of Lease OCS-A 0512 and the forthcoming auction. This Notice corrects a statement in the FSN describing the rental rate for the project easement associated with the lease, to ensure consistency with the rental rate for the project easement as specified in Addendum ``D'' to the lease.

Notice of Availability of the 2017-2022 Outer Continental Shelf Oil and Gas Leasing Proposed Final Program
The Bureau of Ocean Energy Management (BOEM) is announcing the availability of the 2017-2022 Outer Continental Shelf (OCS) Oil and Gas Leasing Proposed Final Program (``Proposed Final Program'' or ``PFP''). This proposal is the last of three proposals for the 2017-2022 OCS Oil and Gas Leasing Program that will succeed the current, 2012-2017 Program. The PFP provides information and analyses to inform the Secretary of the Interior's (Secretary) decision on the size, timing, and location of leasing in the 2017-2022 Program. Section 18 of the OCS Lands Act (43 U.S.C. 1344) specifies a multi-step process of consultation and analysis that must be completed before the Secretary may approve a new OCS Oil and Gas Leasing Program, commonly known as the Five-Year Program. The required steps following this notice include a minimum 60-day period after the submission of the PFP to the President and Congress before the Secretary may approve the 2017-2022 Program. Concurrently with this notice, and pursuant to the National Environmental Policy Act (NEPA), BOEM is publishing a Notice of Availability (NOA) of the Final Programmatic Environmental Impact Statement (PEIS) for the 2017-2022 Program.
Final Programmatic Environmental Impact Statement for the 2017-2022 Outer Continental Shelf (OCS) Oil and Gas Leasing Program
BOEM announces the availability of the Final 2017-2022 OCS Oil and Gas Leasing Program Programmatic Environmental Impact Statement (Programmatic EIS) to inform the 2017-2022 Proposed Final Program. The Final Programmatic EIS provides a discussion of potential impacts of the proposed action, provides an analysis of reasonable alternatives to the proposed action, and recognizes BOEM's preferred alternative. Under Council on Environmental Quality (CEQ) regulations at 40 CFR 1506.10(b)(2), the Secretary of the Interior will not finalize the 2017-2022 OCS Oil and Gas Leasing Program until at least 30 days after publication of the Final Programmatic EIS.
Notice on Outer Continental Shelf Oil and Gas Lease Sales
Pursuant to the joint bidding provisions of 30 CFR 556.511 556.515, the Director of the Bureau of Ocean Energy Management is publishing a List of Restricted Joint Bidders. Each entity within one of the following groups is restricted from bidding with any entity in any of the other following groups at Outer Continental Shelf oil and gas lease sales to be held during the bidding period November 1, 2016, through April 30, 2017. This List of Restricted Joint Bidders will cover the period November 1, 2016, through April 30, 2017, and replace the prior list published on May 17, 2016, which covered the period of May 1, 2016, through October 31, 2016.
Atlantic Wind Lease Sale 6 (ATLW-6) for Commercial Leasing for Wind Power on the Outer Continental Shelf Offshore New York-Final Sale Notice MMAA104000
This document is the Final Sale Notice (FSN) for the sale of one commercial wind energy lease on the Outer Continental Shelf (OCS) offshore New York, pursuant to 30 CFR 585.216. The Bureau of Ocean Energy Management (BOEM or ``the Bureau'') will offer Lease OCS-A 0512 for sale using a multiple-factor auction format. This FSN contains information pertaining to the area available for leasing, lease provisions and conditions, auction details, the lease form, criteria for evaluating competing bids, award procedures, appeal procedures, and lease execution. The issuance of the lease resulting from this sale would not constitute an approval of project-specific plans to develop offshore wind energy. Such plans, if submitted by the lease sale winner, would be subject to subsequent environmental and public review prior to a decision to proceed with development.
Environmental Assessment for Commercial Wind Lease Issuance and Site Assessment Activities on the Atlantic Outer Continental Shelf Offshore New York; MMAA104000
BOEM is announcing the availability of a revised environmental assessment (EA) and finding of no significant impact (FONSI) for commercial wind lease issuance, site characterization activities (geophysical, geotechnical, archaeological, and biological surveys), and site assessment activities (including the installation and operation of a meteorological tower or buoys or both a tower and buoys) on the Atlantic Outer Continental Shelf offshore New York. The revised EA provides a discussion of potential impacts of the proposed action and an analysis of reasonable alternatives to the proposed action. In accordance with the requirements of the National Environmental Policy Act (NEPA) and the Council on Environmental Quality's (CEQ) regulations implementing NEPA at 40 CFR 1500-1508, BOEM issued a FONSI supported by the analysis in the revised EA. The FONSI concluded that the reasonably foreseeable environmental impacts associated with the proposed action and alternatives, as set forth in the EA, would not significantly impact the quality of the human environment; therefore, the preparation of an environmental impact statement is not required. This notice is being published concurrently with the Final Sale Notice for the New York Wind Energy Area (WEA). Leasing of Sulfur or Oil and Gas in the Outer Continental Shelf MMAA104000
This final rule clarifies the language in one section of a final rule that the Bureau of Ocean Energy Management (BOEM) published in the Federal Register on March 30, 2016, and that became effective on May 31, 2016.
Draft Programmatic Environmental Impact Statement for Geological and Geophysical Activities on the Gulf of Mexico Outer Continental Shelf (OCS) MMAA104000
BOEM has prepared a Draft Programmatic Environmental Impact Statement (PEIS) to evaluate potential environmental effects of multiple Geological and Geophysical (G&G) activities on the Gulf of Mexico OCS. These activities include, but are not limited to, seismic surveys, sidescan-sonar surveys, electromagnetic surveys, and geological and geochemical sampling. The Draft PEIS considers G&G activities for the three program areas managed by BOEM: Oil and gas exploration and development; renewable energy; and marine minerals. This notice initiates the public review and comment period and also serves to announce public meetings on the Draft PEIS. After the public meetings and written comments on the Draft PEIS have been reviewed and considered, a Final PEIS will be prepared. A Notice of Intent (NOI) to prepare the PEIS was published in the Federal Register on May 10, 2013, and scoping comments were received during a comment period that was initially scheduled to close on June 24, 2013. The closing date of the public comment period was corrected to July 9, 2013, by publication of a Federal Register Notice on June 5, 2013.
Use of Outer Continental Shelf (OCS) Sand Resources for the Mississippi Coastal Improvements Program (MsCIP) Comprehensive Barrier Island Restoration in Hancock, Harrison, and Jackson Counties, Mississippi
BOEM is announcing the availability of the ROD that documents BOEM's decision to authorize the use of OCS sand resources by the U.S. Army Corps of Engineers (USACE) Mobile District in the MsCIP Comprehensive Barrier Island Restoration Project (Project) in Hancock, Harrison, and Jackson Counties, Mississippi. The ROD is available at BOEM's Web site at https://www.boem.gov/Non-Energy-Minerals/Marine- Minerals-Program.aspx. BOEM will enter into a Memorandum of Agreement (MOA) with the USACE and make available OCS sand for use in the MsCIP Comprehensive Barrier Island Restoration Project.

Notice of Availability of the Proposed Notice of Sale for the Central Gulf of Mexico Planning Area Outer Continental Shelf Oil and Gas Lease Sale 247; MMAA104000
BOEM announces the availability of the Proposed Notice of Sale (NOS) for the proposed Central Planning Area (CPA) Outer Continental Shelf (OCS) Oil and Gas Lease Sale 247 (CPA Sale 247). This Notice is published pursuant to 30 CFR 556.304(c) as a matter of information to the public. With regard to oil and gas leasing on the OCS, the Secretary of the Interior, pursuant to section 19 of the OCS Lands Act (43 U.S.C. 1331-1356a), provides affected states with the opportunity to review the Proposed NOS. The Proposed NOS sets forth the proposed terms and conditions of the sale, including minimum bids, royalty rates, and rental rates.
Outer Continental Shelf (OCS), Gulf of Mexico (GOM), Oil and Gas Lease Sales for 2018
Consistent with the regulations implementing the National Environmental Policy Act (NEPA) (42 U.S.C. 4321 et seq.), BOEM is announcing its intent to prepare a Supplemental Environmental Impact Statement (EIS) for proposed GOM Lease Sales 250 and 251 (2018 GOM Lease Sales 250 and 251 Supplemental EIS) as scheduled in the 2017-2022 OCS Oil and Gas Leasing Proposed Program (2017-2022 Proposed Program). This Notice of Intent (NOI) serves to announce the EIS scoping process for the 2018 GOM Lease Sales 250 and 251 Supplemental EIS. The 2018 GOM Lease Sales 250 and 251 Supplemental EIS will tier from the 2017-2022 GOM Multisale EIS. Section 18 of the OCS Lands Act (43 U.S.C. 1344) requires the development of an OCS oil and gas leasing program every five years. The Program sets forth a schedule of lease sales designed to best meet the Nation's energy needs. The lease sales proposed in the GOM in the 2017- 2022 Proposed Program are areawide sales encompassing both the Western and Central Planning Areas, and a portion of the Eastern Planning Area not subject to Congressional moratorium. These planning areas are located off the States of Texas, Louisiana, Mississippi, Alabama, and Florida. By proposing lease sales that offer all available GOM acreage, BOEM seeks to provide more opportunity for industry to bid on rejected, relinquished, or expired OCS lease blocks and facilitate better planning to explore resources that straddle the U.S./Mexico boundary. During the pre-lease sale process, the size of any individual lease sale could be reduced, and a smaller area offered for leasing, should circumstances warrant. For example, an individual lease sale could be focused on a single GOM Planning Area as in the 2012-2017 OCS Oil and Gas Leasing Program.
Potential Commercial Leasing for Wind Power on the Outer Continental Shelf (OCS) Offshore California-Request for Interest
The purpose of this public notice is to: (1) Describe the unsolicited proposal submitted to BOEM by Trident Winds, LLC (Trident Winds) to acquire an OCS commercial wind lease; (2) solicit submissions of indications of interest in acquiring a commercial lease for wind energy development on the OCS offshore California in the area described in this notice; and (3) solicit public input regarding the area described in this notice, the potential environmental consequences associated with wind energy development in the area, and existing and planned multiple uses of the area. On January 14, 2016, BOEM received an unsolicited request from Trident Winds for a commercial wind lease on the OCS. Trident Winds' proposed project would consist of a utility-scale floating wind energy facility offshore Morro Bay, California that would interconnect with the California electrical grid at the existing Morro Bay Power Plant. The project would be located, at its closest point, approximately 15 nautical miles (nmi) offshore Point Piedras Blancas in water depths of approximately 2,900 feet. Additional information on Trident Winds' unsolicited lease request can be viewed at https://www.boem.gov/ California/. This RFI is published pursuant to subsection 8(p)(3) of the OCS Lands Act, 43 U.S.C. 1337(p)(3), and BOEM's implementing regulations at 30 CFR part 585. Subsection 8(p)(3) of the OCS Lands Act requires that OCS renewable energy leases, easements, and rights-of-way be issued ``on a competitive basis unless the Secretary [of the Interior] determines after public notice of a proposed lease, easement, or right- of-way that there is no competitive interest.'' This RFI provides public notice for the area requested by Trident Winds (the Proposed Lease Area) that is described below in the section ``Description of the Proposed Lease Area,'' and invites the submission of indications of interest in acquiring a commercial wind lease within the Proposed Lease Area. Parties wishing to indicate competitive interest in the Proposed Lease Area should submit detailed and specific information as described in the section entitled ``Required Indication of Interest Information.'' BOEM will consider the responses to this public notice to determine whether competitive interest exists in the Proposed Lease Area. This announcement also requests that interested and affected parties comment and provide information about site conditions and any existing or planned multiple uses within the Proposed Lease Area that may be relevant to the proposed project or its potential impacts.

BOEM proposes to offer Lease OCS-A 0508 for sale using an ascending-bid auction. In this PSN, you will find information pertaining to the area available for leasing, proposed lease provisions and conditions, auction details, the lease form, criteria for evaluating competing bids, award procedures, appeal procedures, and lease execution. BOEM invites public comment during a 60-day comment period following publication of this notice. The issuance of the proposed lease resulting from this sale would not constitute an approval of project- specific plans to develop offshore wind energy. Such plans, expected to be submitted by the auction winner, would be subject to subsequent environmental and technical reviews prior to a decision to proceed with development. This document is also a Request for Interest (RFI), pursuant to 30 CFR 585.212, to assess if there has been a change in competitive interest in the area encompassing proposed lease OCS-A 0508 since the publication of the North Carolina Call for Information and Nominations (Call) (77 FR 74204) on December 13, 2012. If BOEM determines that competitive interest in the proposed lease area (OCS-A 0508) still exists, BOEM will proceed with the competitive process set forth in 30 CFR 585.211 through 585.225. If BOEM determines competitive interest in the proposed lease area (OCS-A 0508) no longer exists because only one potential lessee is interested in the area, BOEM may proceed with the non-competitive process set forth in 30 CFR 585.231(d)-(i) following the receipt of the acquisition fee specified in 30 CFR 585.502(a).

BOEM is extending the comment period for the Notice of Intent entitled, ``Environmental Assessment for Commercial Wind Leasing and Site Assessment Activities on the Outer Continental Shelf (OCS) Offshore the Island of Oahu, Hawaii,'' which appeared in the Federal Register on June 24, 2016, (81 FR 41334). The Environmental Assessment will address environmental impacts and socioeconomic effects related to the issuance of future commercial wind energy leases and approval of site assessment activities on those leases offshore the island of Oahu, Hawaii. The comment period has been extended an additional 30 days to September 7, 2016.
Western Gulf of Mexico Planning Area (WPA) Outer Continental Shelf (OCS) Oil and Gas Lease Sale 248 (WPA Sale 248); MMAA104000
On Wednesday, August 24, 2016, the Bureau of Ocean Energy Management (BOEM) will open and publicly announce bids for blocks offered in the Western Gulf of Mexico Planning Area (WPA) Lease Sale 248 (WPA Sale 248), in accordance with the provisions of the Outer Continental Shelf Lands Act (OCSLA) (43 U.S.C. 1331-1356, as amended) and the implementing regulations issued pursuant thereto (30 CFR parts 550 and 556). The WPA Sale 248 Final Notice of Sale (NOS) Package (Final NOS Package) contains information essential to potential bidders. Bidders are charged with knowing the contents of the documents contained in the Final NOS Package. Date and Time: Bid opening for WPA Sale 248 will begin at 9:00 a.m. on Wednesday, August 24, 2016. All times referred to in this document are local time in New Orleans, unless otherwise specified. Location: There will be a change in the bid opening process for this sale. Bid opening will still occur at the Mercedes-Benz Superdome, 1500 Sugarbowl Drive, New Orleans, Louisiana 70112, but the bid opening at the Superdome facility will not be open to the public. Instead, the bid opening will be available for the public to view in real-time on BOEM's Web site at www.boem.gov via video live-streaming beginning at 9:00 a.m. on the day of the sale. The use of live-streaming to announce bids is being implemented to provide greater access to a wider national and international audience while ensuring the security of BOEM staff. BOEM is announcing the availability of the Draft Environmental Impact Statement (EIS) for the proposed Cook Inlet Outer Continental Shelf Oil and Gas Lease Sale 244. This notice marks the start of the public review and comment period and serves to announce public hearings on the Draft EIS. After the public hearings and written comments on the Draft EIS have been reviewed and considered, a Final EIS will be prepared. The proposed action addressed in this Draft EIS is to conduct an oil and gas lease sale on portions of the Cook Inlet Outer Continental Shelf (OCS) Planning Area. Lease Sale 244 would provide qualified bidders the opportunity to bid on OCS blocks in Cook Inlet to gain conditional rights to explore, develop, and produce oil and natural gas. The Draft EIS analyzes the potential direct, indirect, and cumulative environmental impacts of the proposed lease sale on the physical, biological, and human environments in the Cook Inlet area. The EIS describes a hypothetical scenario of exploration, development, production, and decommissioning activities that could result from the proposed lease sale, and analyzes the potential impacts of those activities on the environment.

Oil and Gas and Sulfur Operations on the Outer Continental Shelf-Requirements for Exploratory Drilling on the Arctic Outer Continental Shelf
The Department of the Interior (DOI or the Department), acting through BOEM and BSEE, is revising and adding new requirements to regulations for exploratory drilling and related operations on the Outer Continental Shelf (OCS) seaward of the State of Alaska. This final rule focuses solely on the OCS within the Beaufort Sea and Chukchi Sea Planning Areas (Arctic OCS). The Arctic region is characterized by extreme environmental conditions, geographic remoteness, and a relative lack of fixed infrastructure and existing operations. This final rule is designed to help ensure the safe, effective, and responsible exploration of Arctic OCS oil and gas resources, while protecting the marine, coastal, and human environments, and Alaska Natives' cultural traditions and access to subsistence resources.
Mid-Atlantic Regional Ocean Action Plan
The Mid-Atlantic Regional Planning Body (MidA RPB), which includes eight Federal agencies and departments, six states, two Federally-recognized Indian Tribes, and the Mid-Atlantic Fishery Management Council, is requesting public comment on its draft Mid- Atlantic Regional Ocean Action Plan (draft Plan). The MidA RPB collaboratively prepared the draft Plan, pursuant to the National Ocean Policy, to build upon and improve existing Federal, state, and tribal decision-making and planning processes in the Mid-Atlantic Region. The Department of the Interior's Bureau of Ocean Energy Management (BOEM), as lead Federal agency for the MidA RPB, is publishing this notice on behalf of the MidA RPB. The MidA RPB will consider all public comments in revising the draft Plan, and will submit a final Plan to the National Ocean Council (NOC or Council) for its concurrence.

Commercial Leasing for Wind Power on the Outer Continental Shelf Offshore the Island of Oahu, Hawaii-Call for Information and Nominations (Call)
With this Call for Information and Nominations (Call), BOEM invites the submission of information and nominations from parties interested in obtaining one or more commercial wind energy leases that would allow lessees to propose the construction of wind energy projects on the Outer Continental Shelf (OCS) \1\ offshore the island of Oahu, Hawaii. In general, the OCS is defined as 3200 nautical miles from shore. Although this announcement is not itself a leasing announcement, the area described herein as the ``Oahu Call Area,'' or portions thereof, may be made available for future leasing. BOEM will use responses to this Call to gauge specific interest in acquiring commercial wind leases in some or all of the Oahu Call Area, as required by 43 U.S.C. 1337(p)(3).

BOEM is announcing its intent to prepare an Environmental Assessment (EA) of potential commercial wind leasing and site assessment activities on the OCS offshore the island of Oahu, Hawaii. The EA will address environmental impacts and socioeconomic effects related to the proposed action, issuance of one or more commercial wind energy leases and approval of site assessment activities on those leases. This notice serves to announce the beginning of the formal scoping process. Scoping will help identify reasonable alternatives to the proposed action, focus the analysis in the EA on potentially significant issues, and eliminate those issues that are determined to be insignificant or considered irrelevant to the analysis. BOEM will also use the scoping process to seek public comment on the full range of potential environmental impacts, including input relevant to the National Historic Preservation Act (NHPA). BOEM is announcing the availability of an Environmental Assessment (EA) for commercial wind lease issuance, site characterization activities (geophysical, geotechnical, archaeological, and biological surveys), and site assessment activities (including the installation and operation of a meteorological tower and/or buoys) on the Atlantic OCS offshore New York. The EA considers the potential impacts of the proposed action and an analysis of reasonable alternatives to the proposed action (excluding the area within two nautical miles of the traffic separation schemes, and no action). This Notice of Availability (NOA) also serves to announce the beginning of the public comment period on the EA. Atlantic Wind Lease Sale 6 (ATLW-6) for Commercial Leasing for Wind Power on the Outer Continental Shelf Offshore New York-Proposed Sale Notice
This document is the Proposed Sale Notice (PSN) for the sale of one commercial wind energy lease on the Outer Continental Shelf (OCS) offshore New York, pursuant to 30 CFR 585.216. BOEM proposes to offer Lease OCS-A 0512 for sale using an ascending bidding auction format. In this PSN, you will find information pertaining to the area available for leasing, proposed lease provisions and conditions, auction details, the lease form, criteria for evaluating competing bids, award procedures, appeal procedures, and lease execution. BOEM invites public comment during a 60-day comment period following publication of this notice. The issuance of a lease resulting from this proposed sale would not constitute an approval of project-specific plans to develop offshore wind energy resources. Such plans, expected to be submitted by the auction winner, will be subject to subsequent environmental and technical reviews prior to a decision to proceed with development.
Notice of Availability: Well Stimulation Treatments on the Pacific Outer Continental Shelf
BOEM and BSEE are announcing the availability of a Programmatic Environmental Assessment (PEA) and Finding of No Significant Impact (FONSI) for well stimulation treatments (WSTs) on the Pacific Outer Continental Shelf (OCS). This Notice of Availability (NOA) is published pursuant to implement the provisions of the National Environmental Policy Act (NEPA) of 1969, as amended. The PEA evaluates potential environmental effects of WSTs on the Pacific OCS. These activities include: fracturing WSTs (diagnostic fracture injection tests; hydraulic fracturing (e.g., frac pacs); and acid fracturing) and non-fracturing WSTs (matrix acidizing and polymer/surfactant injection). BOEM and BSEE are also issuing a FONSI supported by the analysis in the PEA. The FONSI concludes that the reasonably foreseeable environmental impacts associated with the proposed action and alternatives, as set forth in the PEA, would not significantly impact the quality of the human environment; therefore, the preparation of an Environmental Impact Statement is not required.

On March 30, 2016, the Bureau of Ocean Energy Management (BOEM) published in the Federal Register a final rule that updates and streamlines the Outer Continental Shelf (OCS) oil and gas and sulfur leasing regulations, which will become effective on May 31, 2016. BOEM wishes to clarify the language in one section of that rule. Therefore, BOEM is proposing to revise that section and give the public an opportunity to comment. The final rule was issued under Docket ID: MMS- 2007-OMM-0069, which has expired and is no longer accessible. Therefore, BOEM is utilizing a new Docket ID for this proposed rule (BOEM-2016-0031).
Air Quality Control, Reporting, and Compliance
BOEM is extending the public comment period to submit comments on the proposed rule entitled ``Air Quality Control, Reporting, and Compliance,'' which was published in the Federal Register on April 5, 2016. The original public comment period to submit comments on this rulemaking would have ended on June 6, 2016. However, BOEM has received public comments requesting an extension of the comment period. BOEM has reviewed the extension requests and has determined that a 14-day comment period extension to June 20, 2016, is appropriate. The proposed rule specified a separate, shorter period to submit comments to the Office of Management and Budget on the information collection (IC) burden in this rulemaking. That comment period ended on May 5, 2016, and will not be extended.

Outer Continental Shelf (OCS), Gulf of Mexico, Oil and Gas Lease Sales for 2017-2022 MMAA104000
BOEM is announcing the availability of a Draft EIS for Gulf of Mexico OCS oil and gas lease sales tentatively scheduled from 2017-2022 (2017-2022 Gulf of Mexico Multisale Draft EIS or Draft Environmental Impact Statement). BOEM proposes to conduct 10 region-wide Gulf of Mexico oil and gas lease sales during this five-year period that are tentatively scheduled in the Proposed 2017-2022 OCS Oil and Gas Leasing Program (Five-Year Program). BOEM announces the availability of the Proposed Notice of Sale (NOS) for the proposed Western Planning Area (WPA) Outer Continental Shelf (OCS) Oil and Gas Lease Sale 248 (WPA Sale 248). This Notice is published pursuant to 30 CFR 556.29(c) as a matter of information to the public. With regard to oil and gas leasing on the OCS, the Secretary of the Interior, pursuant to section 19 of the OCS Lands Act, provides affected States the opportunity to review the Proposed NOS. The Proposed NOS sets forth the proposed terms and conditions of the sale, including minimum bids, royalty rates, and rental rates.
Air Quality Control, Reporting, and Compliance
This proposed rule would amend existing BOEM regulations related to air quality measurement, evaluation, and control with respect to oil, gas, and sulphur operations on the Outer Continental Shelf (OCS) of the United States (U.S.), in the Central and Western Gulf of Mexico (GOM) and the area offshore the North Slope Borough of the State of Alaska, as part of the BOEM approval process for offshore oil and gas exploration and development plans, right-of-use and easement (RUE), pipeline rights-of-way (ROW), and lease term pipeline applications. The proposed rule would: (1) Fulfill BOEM's statutory responsibility under section 5(a)(8) of Outer Continental Shelf Lands Act (OCSLA) by addressing all relevant criteria and major precursor air pollutants and by cross-referencing BOEM standards and benchmarks for those pollutants to those of the United States Environmental Protection Agency (USEPA); (2) change the manner in which lessees would evaluate and model vessel emissions attributed to OCS facilities; (3) change the methods for measuring and evaluating air emissions including measuring their impacts over State submerged lands; (4) provide a process by which exemption thresholds are established and updated; (5) change the circumstances when emission reduction measure(s) (ERM), including Best Available Control Technology (BACT), are required, and establish new criteria for the application of ERM; (6) formalize requirements for the consolidation of emissions from multiple facilities; (7) consistent with BOEM's existing regulatory authority, articulate a schedule and requirements for ensuring that all plans, including those previously approved, will remain compliant on an ongoing basis with these updated regulations; and (8) include an air quality component in the submission of RUE, ROW, and lease term pipeline applications. Key policy changes include the following: (1) Aligning the list of pollutants that are subject to an air quality review with the current National Ambient Air Quality Standards (NAAQS) and cross-referencing the ambient air quality standards and benchmarks (AAQSB) for those pollutants to those of the USEPA; (2) formalizing the concept and application of the term ``attributed emissions;'' (3) changing the locations where air emissions will be measured and evaluated; and (4) modifying the process by which exemption thresholds are established and updated. This rulemaking would be the first major re-write of the OCS air quality regulations in 35 years.

Leasing of Sulfur or Oil and Gas in the Outer Continental Shelf
This final rule updates and streamlines the existing Outer Continental Shelf (OCS) leasing regulations and clarifies implementation of the Federal Oil and Gas Royalty Simplification and Fairness Act of 1996, which amended the Federal Oil and Gas Royalty Management Act of 1982 (FOGRMA). The final rule reorganizes leasing requirements to more effectively communicate the leasing process as it has evolved over the years. The final rule makes changes to regulations which relate to the oil, gas, and sulfur leasing requirements. The final rule does not, however, include substantive changes to regulations which relate to bonding, which will be the subject of a separate new proposed rulemaking.
Negotiated Noncompetitive Leasing for the Use of Sand, Gravel, and Shell Resources on the Outer Continental Shelf
This rule proposes regulations to address the use of Outer Continental Shelf (OCS) sand, gravel and shell resources for shore protection, beach restoration, or coastal wetlands restoration projects by Federal, State, or local government agencies, or use in construction projects authorized by or funded in whole or in part by the Federal Government. The proposed rule describes the negotiated noncompetitive agreement process for qualifying projects and codifies new and existing procedures.

Pursuant to the National Environmental Policy Act (NEPA), BOEM announces the availability of the OCS Oil and Gas Leasing Program 2017- 2022 Draft Programmatic Environmental Impact Statement (Programmatic EIS) prepared by BOEM to support the Proposed OCS Oil and Gas Leasing Program for 2017-2022.
