On July 25, 2019, the Bureau of Indian Affairs (BIA) approved the Menominee Indian Tribe of Wisconsin (Tribe) Leasing Regulations under the Helping Expedite and Advance Responsible Tribal Homeownership Act of 2012 (HEARTH Act). With this approval, the Tribe is authorized to enter into agricultural, residential, business, and other authorized purposes leases without further BIA approval.

The Bureau of Indian Affairs (BIA) is proposing a change to a provision in the Tribal Transportation Program regulations affecting proposed roads that are currently in the National Tribal Transportation Facility Inventory (NTTFI). Specifically, this proposed rule would delete the requirement for Tribes to collect and submit certain data in order to keep those proposed roads in the NTTFI. This notice publishes the Delaware Nation Beverage Control Act of 2019 (Alcohol Ordinance). The Alcohol Ordinance regulates and controls the possession, sale, manufacture, and distribution of alcohol on Delaware Nation trust lands in conformity with the laws of the State of Oklahoma where applicable and necessary. Although the Alcohol Ordinance was adopted on March 5, 2019, it does not become effective until published in the Federal Register.

The Bureau of Indian Affairs (BIA) owns or has an interest in irrigation projects located on or associated with various Indian reservations throughout the United States. We are required to establish irrigation assessment rates to recover the costs to administer, operate, maintain, and rehabilitate these projects. We are notifying you that we have adjusted the irrigation assessment rates at several of our irrigation projects and facilities to reflect current costs of administration, operation, maintenance, and rehabilitation.

Under the Johnson O'Malley (JOM) Act, the Bureau of Indian Education (BIE) provides assistance, through contracts, for Indian students attending public schools and non-sectarian private schools. Congress recently updated the JOM Act with the JOM Supplemental Indian Education Program Modernization Act (JOM Modernization Act). This proposed rule would implement the JOM Act, as amended, to clarify the eligibility requirements for Indian students to receive the benefits of a JOM contract, to clarify the funding formula and process to ensure full participation of contracting parties, and to otherwise reconcile and modernize the rules to comport with the activities of the contracting parties under the Act, as amended.

This notice publishes the Kickapoo Traditional Tribe of Texas Liquor Ordinance which repeals and replaces the Kickapoo Traditional Tribe of Texas Beer and Liquor Tax Ordinance and any and all previous statutes. The Kickapoo Traditional Tribe of Texas Liquor Ordinance regulates and controls the possession, sale, manufacture, and distribution of liquor on the Kickapoo Traditional Tribe of Texas trust lands in conformity with the Federal laws and of the State of Texas where applicable and necessary. The enactment of this Ordinance will provide and important source of tax revenue for the continued operation and strengthening the Kickapoo Traditional Tribes of Texas government and the delivery of Tribal government services and, the economic viability of Tribal enterprises. Although, the Kickapoo Traditional Tribe of Texas Liquor Ordinance was adopted on October 1, 2018, it does not become effective until published in the Federal Register.

The Bureau of Indian Affairs (BIA) is announcing a two-week extension of the comment period for the Draft Environmental Impact Statement (DEIS) for the Proposed Redding Rancheria Fee-to-Trust and Casino Project, Shasta County, California. This notice advises the public that the Bureau of Indian Affairs (BIA), as lead agency, with the City of Beloit, Wisconsin Department of Transportation, Ho-Chunk Nation (Nation), and the U.S. Environmental Protection Agency (EPA) serving as cooperating agencies, intends to file a Final Environmental Impact Statement (FEIS) with the EPA in connection with the Nation's application for transfer into trust by the United States of approximately 33 acres for gaming and other purposes in the City of Beloit, Rock County, Wisconsin.

The Bureau of Indian Education (BIE) will conduct consultations on which source can provide the most applicable and accurate data for a preliminary report on the number of eligible Indian students served, or potentially served, by entities eligible for participation in the Johnson-O'Malley (JOM) Supplemental Indian Education Program. The sources under consideration are: The Bureau of the Census, the National Center for Education Statistics, or the Office of Indian Education of the Department of Education. The preliminary report will reflect an initial determination regarding the eligible Indian student count for the purposes of calculating formula allocations for programs under the JOM Act of 1934, as amended by the JOM Supplemental Indian Education Program Modernization Act (JOM Modernization Act). BIE is also interested in determining the interest of Tribes, State and local educational agencies, and Alaska Native organizations of entering into JOM contracts.

The regulations implementing the Indian Child Welfare Act provide that Indian Tribes may designate an agent other than the Tribal chairman for service of notice of proceedings under the Act. This notice includes the current list of designated Tribal agents for service of notice.
