Privacy Act of 1974: Republication of Notice of Systems of Records
In accordance with 5 U.S.C. 552a(e)(4), the Tennessee Valley Authority (TVA) is republishing in full a notice of the existence and character of each TVA system of records. TVA is deleting TVA-10 (Employee Statement of Employment and Financial Interests), TVA-15 (Land Between The Lakes, Hunter Records), and TVA-30 (Land Between The Lakes, Mailing Lists). These programs have ended or have been transferred to other agencies. TVA is renaming the following systems: TVA-6, from Employee Accident Information to Work Injury Illness System; TVA-19, from Consultant and Personal Service Contractor Records to Consultant and Contractor Records; TVA-21, from Nuclear Assurance Personnel Records to Nuclear Quality Assurance Personnel Records; TVA-29, from Electricity Use, Rate, and Service Study Records to Energy Program Participant Records; and TVA-38, from Wholesale and Retail Data Files to Wholesale, Retail, and Emergency Data Files. These systems are being renamed to better reflect the contents of the systems. TVA is adding one new routine use to all systems. TVA is also adding new routine uses to TVA-6, Work Injury Illness System, and TVA- 38, Wholesale, Retail, and Emergency Data Files. TVA is removing a routine use from TVA-2, Personnel Files, TVA-9, Health Records, and TVA-11, Payroll Records. TVA is revising the routine uses for TVA-5, Discrimination Complaint Files, and TVA-26, Retirement System Records. TVA is also correcting minor typographical and stylistic errors in previously existing notices and has updated those notices to reflect current organizational structure. Also, updates are being made to show any changes to system locations; managers and addresses; categories of individuals and records; procedures and practices for storing, retrieving, accessing, retaining, and disposing of records.
Meeting of the TVA Regional Resource Stewardship Council
The TVA Regional Resource Stewardship Council (RRSC) will hold a meeting on October 9 and October 10, 2008, to obtain views and advice on the topic of TVA's Commercial and Dispersed Recreation Strategy and its Violations & Encroachments Strategy. The RRSC was established to advise TVA on its natural resource stewardship activities. Notice of this meeting is given under the Federal Advisory Committee Act, 5 U.S.C. App. 2, (FACA). Final Environmental Impact Statement-Rutherford-Williamson-Davidson Power Supply Improvement Project
This notice is provided in accordance with the Council on Environmental Quality's regulations (40 CFR parts 1500 to 1508) and TVA's procedures implementing the National Environmental Policy Act. TVA has decided to implement the preferred alternative identified in its Final Environmental Impact Statement (EIS), Rutherford-Williamson- Davidson Power Supply Improvement Project. In implementing Alternative 2, TVA has decided to construct and operate the new 500-kV Rutherford Substation, the 27-mile 500-kV transmission line between TVAs 500-kV Maury Substation and the new Rutherford Substation, the new 9-mile 161-kV transmission line between the new Rutherford Substation and Middle Tennessee Electric Membership Corporations (MTEMC) Almaville Substation, and the new 15-mile 161-kV transmission line between the new Rutherford Substation and MTEMCs Christiana Substation.
Environmental Impact Statement-Douglas and Nolichucky Reservoirs Land Management Plan, Tennessee

The Tennessee Valley Authority (``TVA'') is publishing as a final rule a regulation governing access to TVA information and records in connection with legal proceedings in which neither the United States nor TVA is a party. This final rule establishes guidelines for use in determining whether TVA employees will provide testimony or records relating to their official duties. It also establishes procedures for requesters to follow when making demands on or requests to a TVA employee for official documents or to provide testimony. This final rule standardizes TVA's past practices, promotes uniformity in decisions, conserves the ability of TVA to conduct official business, preserves its employee resources, protects confidential information, provides guidance to requestors, minimizes involvement in matters unrelated to TVA's mission and programs, avoids wasteful allocation of agency resources, and avoids spending public time and money for private purpose.

Completion and Operation of Watts Bar Nuclear Plant Unit 2, Rhea County, TN
This notice is provided in accordance with the Council on Environmental Quality's regulations (40 CFR parts 1500 to 1508) and TVA's procedures implementing the National Environmental Policy Act. On August 1, 2007, the TVA Board of Directors decided to adopt the preferred alternative identified in TVA's Final Supplemental Environmental Impact Statement (FSEIS), Completion and Operation of Watts Bar Nuclear Plant Unit 2, Rhea County, Tennessee. A Notice of Availability of the FSEIS was published in the Federal Register on June 23, 2007. Under the selected alternative, TVA has decided to meet the need for additional baseload capacity on the TVA system and maximize the use of existing assets by completing and operating Watts Bar Nuclear Plant (WBN) Unit 2. The unit would be completed as originally designed incorporating additional modifications made to its sister unit, WBN Unit 1, which has been operating since 1996. No expansion of the existing site footprint would be required to complete construction of Unit 2. TVA has prepared the FSEIS to update the extensive environmental record pertinent to the proposed action. In addition to the FSEIS, TVA conducted a detailed scoping, estimating, and planning (DSEP) study. TVA used information from the DSEP and the FSEIS to make the decision to complete construction and to operate Unit 2.
Notice of Determinations on the PURPA Standards Set Forth in the Energy Policy Act of 2005
At its meeting on August 1, 2007, in Knoxville, Tennessee, the TVA Board made its determinations on the PURPA Standards set forth in the Public Utility Regulatory Policies Act of 1978 (Pub. L. 95-617) as amended by the Energy Policy Act of 2005 (Pub. L. 109-58) (EPAct 2005). The standards considered are listed in subsections 111(d)(11)-(14) of PURPA as amended by EPAct 2005. The TVA Board considered the standards in accordance with PURPA and the objectives and requirements of the Tennessee Valley Authority Act of 1933 (TVA Act), 48 Stat. 58, as amended, 16 U.S.C. 831-831dd (2007).

Final Environmental Impact Statement-Nolichucky Reservoir Flood Remediation Project
This notice is provided in accordance with the Council on Environmental Quality's regulations (40 CFR parts 1500 to 1508) and TVA's procedures implementing the National Environmental Policy Act. TVA has decided to adopt Alternative ANo Action, the preferred alternative identified in its Final Environmental Impact Statement (EIS), Nolichucky Reservoir Flood Remediation Project. In implementing Alternative A, TVA would continue to provide updated flood level information to local agencies and individuals. This would not preclude TVA working with individual landowners to address problems in the future. TVA would take no other action to address the impacts of flooding of private land and property around Nolichucky Reservoir.

Administrative Cost Recovery
TVA is amending its administrative cost recovery regulations by eliminating cost recovery exemptions for the following: Conveyances of land pursuant to Section 4(k)(d) of the Tennessee Valley Authority Act of 1933, as amended (16 U.S.C. 831c(k)(d)); TVA phosphate land transactions; and permits and licenses for use of TVA land by distributors of TVA power. The implementation of this rule amendment will allow TVA to recover more of its administrative costs incurred in processing certain actions from those who directly benefit from the actions.

Proposed Standards on Smart Metering Interconnection, Net Metering, Fuels Sources, and Fossil Fuel Generation Efficiency
On August 17, 2006, Tennessee Valley Authority (``TVA'') published a notice (71 FR 47557) of the commencement of its consideration process for the Time-based Metering & Communications (hereinafter called ``Smart Metering''), Interconnection, and Net Metering standards promulgated by section 111(d) of the Public Utility Regulatory Policies Act of 1978 (Pub. L. 95-617) as amended by the Energy Policy Act of 2005 (Pub. L. 109-58) (hereinafter called ``PURPA''). This notice amends and supplements the August 17 notice to (1) set new deadlines related to the consideration of the three standards which were the subject of that notice and (2) inform the public of the commencement of TVA's consideration process for the two remaining standards listed in section 111(d) of PURPA, which are the Fuel Sources and Fossil Fuel Generation Efficiency standards. TVA will consider adopting all five of these standards for itself as well as for the distributors of TVA power and will consider these standards on the basis of their effect on conservation of energy, efficient use of facilities and resources, equity among electric consumers, and the objectives of the Tennessee Valley Authority Act. In addition, the Smart Metering standard will be considered in light of whether the benefits to the electric utility and its consumers are likely to exceed the costs of new metering and communications. Comments are requested from the public on whether TVA should adopt these standards or any variations on them.
Supplemental Environmental Impact Statement: Completion of Watts Bar Nuclear Plant Unit 2
This notice is provided in accordance with the Council on Environmental Quality's (CEQ) regulations (40 CFR parts 1500-1508) and TVA's procedures for implementing the National Environmental Policy Act. The Tennessee Valley Authority (TVA) will prepare a Supplemental Environmental Impact Statement (EIS) to update information and address the potential environmental impacts associated with its proposal to complete the Watts Bar Nuclear Plant (WBN) Unit 2 located in Rhea County, Tennessee. Completion of WBN Unit 2 would help address the need for additional baseload generation in the power service area of the Tennessee Valley Authority and make use of that unfinished asset.
