The U.S. Nuclear Regulatory Commission (NRC or the Commission) is issuing Final Interim Staff Guidance (ISG), that augments NUREG- 1537, Part 1, ``Guidelines for Preparing and Reviewing Applications for the Licensing of Non-Power Reactors: Format and Content,'' and NUREG- 1537, Part 2, ``Guidelines for Preparing and Reviewing Applications for the Licensing of Non-Power Reactors: Standard Review Plan and Acceptance Criteria.'' Parts 1 and 2 of the ISG correspond to the parts of NUREG-1537, and can be found in the NRC's Agencywide Documents Access and Management System (ADAMS) at Accession Numbers ML12156A069 and ML12156A075, respectively. The ISG provides guidance for applicants and the NRC staff related to licensing a heterogeneous or aqueous homogeneous non-power reactor as a utilization facility pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 50, ``Domestic Licensing of Production and Utilization Facilities.'' The ISG also provides guidance related to licensing a production facility for the separation of byproduct material from special nuclear material pursuant to 10 CFR Part 50. An applicant should use the guidance in Part 1 of the ISG when preparing a construction permit or operating license application. The NRC staff will use Part 2 of the ISG to review such an application. Disposition: On June 20, 2011 (76 FR 35922), the NRC published for public comment the draft ISG, ``Staff Guidance Regarding the Environmental Report for Applications to Construct and/or Operate Medical Isotope Production Facilities'' (ADAMS Accession No. ML11116A166). The NRC received 41 comments on the draft ISG, ADAMS Accession Nos. ML11216A140, ML11220A263, and ML11217A018. On October 13, 2011 (76 FR 63668), the NRC published for public comment Chapters 1-6 of the draft ISG, that augments NUREG-1537, Part 1, ``Guidelines for Preparing and Reviewing Applications for the Licensing of Non-Power Reactors: Format and Content'' (ADAMS Accession No. ML111160058), and NUREG-1537, Part 2, ``Guidelines for Preparing and Reviewing Applications for the Licensing of Non-Power Reactors: Standard Review Plan and Acceptance Criteria'' (ADAMS Accession No. ML111810010). On April 10, 2012 (77 FR 21592), the NRC published for public comment Chapters 7-18 of Part 1 of the draft ISG, ADAMS Accession No. ML111570224, and Chapters 7-18 of Part 2 of the draft ISG, ADAMS Accession No. ML111160065. The NRC received 75 comments on the draft ISG, ADAMS Accession Nos. ML11325A120, ML11325A121, ML11325A122, ML12136A120, and ML12135A181. The details of the NRC's disposition of the comments are available at ADAMS Accession No. ML12156A061. The NRC staff incorporated the comments in the final ISG, as appropriate. Congressional Review Act: In accordance with the Congressional Review Act, the NRC has determined that this action is not a major rule and has verified this determination with the Office of Information and Regulatory Affairs of the Office of Management and Budget.

The U.S. Nuclear Regulatory Commission (NRC or the Commission) is requesting public comments on draft NUREG-2152, ``Computational Fluid Dynamics Best Practice Guidelines for Dry Cask Applications.'' The draft NUREG-2152 report provides best practice guidelines for undertaking simulations used to evaluate the thermal response of dry casks. Dry cask applications include transfer, transport, and storage. First, the different sources of errors and uncertainties known to occur in numerical simulation results are listed and defined. The sources of error that can be controlled and quantified by the user are then discussed in detail, and best practice guidelines for their reduction and quantification are given. These best practice guidelines are based on available guidelines as much as possible.

In 2010, the NRC published a final rule amending its regulations concerning export and import of nuclear equipment and material. Among other things, it added the phrase ``Of U.S. origin'' to the first exclusion to the definition of ``radioactive waste''. The phrase was added to the final rule in response to a public comment on the proposed rule to clarify the exclusion. Since publication of the final rule, NRC staff has been engaged with industry in response to concerns raised regarding established industry practices and the need for guidance on implementation of the ``U.S.-origin'' exclusion.

On September 21, 2012 (77 FR 58591), the U.S. Nuclear Regulatory Commission (NRC or the Commission) issued Draft NUREG-1307, Revision 15, ``Report on Waste Burial Charges: Changes in Decommissioning Waste Disposal Costs at Low-Level Waste Burial Facilities,'' in the Federal Register for a 30 day public comment period. The NRC is extending the public comment period for Draft NUREG- 1307, Revision 15 from October 22, 2012, to November 15, 2012. Draft NUREG-1307, Revision 15, Draft Report for Comment incorporates updated information and expands on the NUREG-1307, Revision 14 report published in November 2010. NUREG-1307, Revision 15, also incorporates changes resulting from a reassessment of the assumptions used for the vendor waste disposal option for low-level waste.

The U.S. Nuclear Regulatory Commission (NRC or the Commission) invites public comment regarding our intention to request the OMB's approval for renewal of an existing information collection that is summarized below. We are required to publish this notice in the Federal Register under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: 10 CFR Part 71, Packaging and Transportation of Radioactive Material. 2. Current OMB approval number: 3150-0008. 3. How often the collection is required: On occasion. Application for package certification may be made at any time. Required reports are collected and evaluated on a continuous basis as events occur. 4. Who is required or asked to report: All NRC specific licensees who place byproduct, source, or special nuclear material into transportation, and all persons who wish to apply for NRC approval of package designs for use in such transportation. 5. The number of annual respondents: 250. 6. The number of hours needed annually to complete the requirement or request: 59,782 hours (54,208 hrs reporting + 5,574 recordkeeping). 7. Abstract: NRC regulations in 10 CFR Part 71 establish requirements for packaging, preparation for shipment, and transportation of licensed material, and prescribe procedures, standards, and requirements for approval by NRC of packaging and shipping procedures for fissile material and for quantities of licensed material in excess of Type A quantities. Submit, by December 17, 2012, comments that address the following questions: 1. Is the proposed collection of information necessary for the NRC to properly perform its functions? Does the information have practical utility? 2. Is the burden estimate accurate? 3. Is there a way to enhance the quality, utility, and clarity of the information to be collected? 4. The U.S. Nuclear Regulatory Commission (NRC or the Commission) received a petition for rulemaking (PRM) dated November 24, 2008, filed by Ms. Sandra Gavutis, Executive Director for C-10 Research and Education Foundation Inc. (the petitioner). The petition was docketed by the NRC and assigned Docket No. PRM-72-6. The petitioner requests that the NRC amend its regulations concerning dry cask safety, security, transferability, and longevity. The petitioner made 12 requests. The NRC is denying nine of the petitioner's requests, but will consider one request in the rulemaking process. Action on two requests is being reserved for future rulemaking determinations, as these requests are currently under consideration by the NRC. The NRC will publish another Federal Register notice to inform the public of the Commission's decision for these two requests. The docket for this PRM will remain open until action is taken on the two remaining requests.

The U.S. Nuclear Regulatory Commission (NRC or the Commission) is seeking comments on its draft ``Tribal Protocol Manual'' dated September 2012. After the Tribal Protocol Manual is issued, the NRC intends to use it as a starting point for developing a policy statement on consultation with Native American tribes. The NRC is committed to an open and collaborative regulatory environment in the development of its policies and licensing actions, and therefore is committed to meaningful consultation and coordination with Native American tribes. In addition to the request for comments on the draft Tribal Protocol Manual, the NRC also seeks suggestions on the development of the proposed tribal consultation policy statement from tribal governments and organizations, the public, and other interested parties. The questions found in section II are offered for consideration. Respondents are not limited to these questions and are encouraged to submit any comments/feedback they think would benefit the NRC in developing a tribal consultation policy statement.
