Agency Information Collection Activities: Proposed Collection; Comment Request
The NRC invites public comment about our intention to request the OMB's approval for renewal of an existing information collection that is summarized below. We are required to publish this notice in the Federal Register under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: ``DOE/NRC Form 742, Material Balance Report and NUREG/BR-0007, Instructions for the Preparation and Distribution of Material Status Report.'' 2. Current OMB approval number: 3150-0004. 3. How often the collection is required: DOE/NRC Form 742 is submitted annually following a physical inventory of nuclear materials. 4. Who is required or asked to report: Persons licensed to possess specified quantities of special nuclear or source material. 5. The number of annual respondents: For DOE/NRC Form 742, there are approximately 360 respondents annually. 6. The number of hours needed annually to complete the requirement or request: 1,260. 7. Abstract: Each licensee authorized to possess special nuclear material totaling more than one gram of contained uranium-235, uranium- 233, or plutonium, or any combination thereof, are required to submit DOE/NRC Forms 742 and 742C. In addition, any licensee authorized to possess 1,000 kilograms of source material is required to submit DOE/ NRC Form 742. The NRC uses this information to fulfill its responsibilities as a participant in US/IAEA Safeguards Agreement and various bilateral agreements with other countries, and to satisfy its domestic safeguards responsibilities. Submit, by February 28, 2011 comments that address the following questions: 1. Is the proposed collection of information necessary for the NRC to properly perform its functions? Abstract: NRC regulations in 10 CFR part 26 prescribe requirements to establish, implement, and maintain fitness-for-duty programs at affected licensees and other entities. The objectives of these requirements are to provide reasonable assurance that persons subject to the rule are trustworthy, reliable, and not under the influence of any substance, legal or illegal, or mentally or physically impaired from any cause, which in any way could adversely affect their ability to safely and competently perform their duties. These requirements also provide reasonable assurance that the effects of fatigue and degraded alertness on individuals' abilities to safely and competently perform their duties are managed commensurate with maintaining public health and safety. The information collections required by part 26 are necessary to properly manage FFD programs and to enable effective and efficient regulatory oversight of affected licensees other entities. These licensees and other entities must perform certain tasks, maintain records, and submit reports to comply with part 26 drug and alcohol provisions and fatigue management requirements. These records and reports are necessary to enable regulatory inspection and evaluation of a licensee's or entity's compliance with NRC regulations, its FFD performance, and of any significant FFD-related event to help maintain public health and safety, promote the common defense and security, and protect the environment. Nuclear material control and accounting information is submitted in accordance with specified instructions. 6. Who will be required or asked to report: Applicants for and holders of specific NRC licenses to receive title to, own, acquire, deliver, receive, possess, use, or initially transfer special nuclear material. 7. An estimate of the number of annual responses: 1,256 (655 responses + 601 recordkeepers). 8. The estimated number of annual respondents: 372. 9. Notice of Availability of NUREG-1800, Revision 2; “Standard Review Plan for Review of License Renewal Applications for Nuclear Power Plants” and NUREG-1801, Revision 2; “Generic Aging Lessons Learned (GALL) Report”
The NRC staff is issuing the revised NUREG-1800, ``Standard Review Plan for Review of License Renewal Applications for Nuclear Power Plants'' (SRP-LR); and the revised NUREG-1801, ``Generic Aging Lessons Learned (GALL) Report.'' These revised documents describe methods acceptable to the NRC staff for implementing the license renewal rule, Title 10, of the Code of Federal Regulations Part 54 (10 CFR part 54), as well as techniques used by the NRC staff in evaluating applications for license renewals. The draft versions of these documents were issued for public comment on May 18, 2010 (75 FR 27838). The NRC staff assessment of public comments and the technical bases for changes made in the GALL Report will be issued at a later date as NUREG-1950, ``Disposition of Public Comments and Technical Bases for Changes in the License Renewal Guidance Documents NUREG-1800 and NUREG- 1801.''

Current OMB approval number: 3150-0190. 3. How often the collection is required: On occasion (as needed to pay invoices.) 4. Who is required or asked to report: Anyone conducting business with the Nuclear Regulatory Commission including licensees, applicants and individuals who are required to pay a fee for inspections and licenses. 5. The number of annual respondents: 583 (11 for NRC Form 628 and 572 for NRC Form 629 and NUREG/BR-0254). 6. Abstract: The U.S. Department of the Treasury encourages the public to pay monies owed the government through use of the Automated Clearinghouse Network and credit cards. These two methods of payment are used by licensees, applicants, and individuals to pay civil penalties, full cost licensing fees, and inspection fees to the NRC. The NRC Form 628, ``Financial EDI Authorization,'' provides an option to make electronic payment through the Automated Clearinghouse (ACH) Network and authorizes the licensee's bank to pay invoices to the NRC through the ACH. The NRC Form 628 requests the licensee's name; electronic funds transfer contact, telephone number, address, authorized signature and title. NRC Form 629, ``Authorization for Payment by Credit Card,'' is another option used to authorize payment. The credit card authorization form is used by licensees to authorize payment by credit card for license fees and for payment of fees for fingerprint cards, and solicits information that identifies the cardholder's name, address, account number, card expiration date, cards accepted, cardholder's signature, invoice number or license number. Francis Slakey on Behalf of the American Physical Society; Receipt of Petition for Rulemaking
The U.S. Nuclear Regulatory Commission (NRC or Commission) is publishing for public comment a notice of receipt of a petition for rulemaking, dated November 10, 2010, which was filed with the NRC by Francis Slakey on behalf of the American Physical Society (APS). The petition was docketed by the NRC on November 18, 2010, and has been assigned Docket No. PRM-70-9. The petitioner requests that the NRC amend its regulations regarding the domestic licensing of special nuclear material to include proliferation assessments as part of the licensing process.
Waste Confidence Decision Update
The U.S. Nuclear Regulatory Commission (NRC or Commission) is updating its Waste Confidence Decision of 1984 and, in a parallel rulemaking proceeding, revising its generic determinations in the NRC's regulations.
Consideration of Environmental Impacts of Temporary Storage of Spent Fuel After Cessation of Reactor Operation
The U.S. Nuclear Regulatory Commission (NRC or Commission) is revising its generic determination on the environmental impacts of storage of spent fuel at, or away from, reactor sites after the expiration of reactor operating licenses. The revisions reflect findings that the Commission has reached in an update and supplement to the 1990 Waste Confidence rulemaking proceeding published elsewhere in this issue of the Federal Register. The Commission now finds that, if necessary, spent fuel generated in any reactor can be stored safely and without significant environmental impacts for at least 60 years beyond the licensed life for operation (which may include the term of a revised or renewed license) of that reactor in a combination of storage in its spent fuel storage basin or at either onsite or offsite independent spent fuel storage installations (ISFSIs). It also finds reasonable assurance that sufficient mined geologic repository capacity will be available for disposal of spent fuel when necessary.

Advisory Committee on the Medical Uses of Isotopes: Meeting Notice
The U.S. Nuclear Regulatory Commission (NRC) will convene a teleconference meeting of the Advisory Committee on the Medical Uses of Isotopes (ACMUI) on January 5, 2011, to discuss: (1) The ACMUI reporting structure; (2) rulemaking and implementation guidance for physical protection of byproduct material; and (3) the impacts of the draft safety culture policy statement for medical licensees. Contingent upon the outcome of the January 5, 2011, the NRC will also convene a second teleconference of the ACMUI on January 12, 2011, to further discuss the ACMUI reporting structure. Requirements for Fingerprint-Based Criminal History Records Checks for Individuals Seeking Unescorted Access to Research or Test Reactors
The U.S. Nuclear Regulatory Commission (NRC) is reopening the public comment period for the proposed rule that was published on July 10, 2010. The proposed rule would amend the NRC's regulations by requiring research and test reactor licensees to obtain a fingerprint- based criminal history records check before granting any individual unescorted access to their facilities. The comment period for this proposed rule, which closed on October 4, 2010, is reopened and will remain open until January 31, 2011.
Unified Agenda of Federal Regulatory and Deregulatory Actions
The Nuclear Regulatory Commission (NRC) is publishing its semiannual regulatory agenda in accordance with Public Law 96-354, ``The Regulatory Flexibility Act,'' and Executive Order 12866, ``Regulatory Planning and Review.'' Notice of Availability of the Models for Plant-Specific Adoption of Technical Specifications Task Force Traveler TSTF-514, Revision 3, “Revise BWR Operability Requirements and Actions for RCS Leakage Instrumentation”
As part of the consolidated line item improvement process (CLIIP), the NRC is announcing the availability of the model application (with model no significant hazards consideration determination) and model safety evaluation (SE) for the plant-specific adoption of Technical Specifications Task Force (TSTF) Traveler TSTF- 514, Revision 3, ``Revise BWR [boiling water reactor] Operability Requirements and Actions for RCS [reactor coolant system] Leakage Instrumentation.'' TSTF-514, Revision 3, is available in the Agencywide Documents Access and Management System (ADAMS) under Accession Number ML103280389. The proposed changes revise the Standard Technical Specifications (STS) to define a new time limit for restoring inoperable RCS leakage detection instrumentation to operable status and establish alternate methods of monitoring RCS leakage when one or more required monitors are inoperable. Changes to the Technical Specifications (TS) Bases are included, which reflect the proposed changes and more accurately reflect the contents of the facility design bases related to the operability of the RCS leakage detection instrumentation. Advisory Committee On Reactor Safeguards; Renewal
The Advisory Committee on Reactor Safeguards was established by Section 29 of the Atomic Energy Act (AEA) of 1954, as amended. Its purpose is to provide advice to the Commission with regard to the hazards of proposed or existing reactor facilities, to review each application for a construction permit or operating license for certain facilities specified in the AEA, and such other duties as the Commission may request. The AEA as amended by PL 100-456 also specifies that the Defense Nuclear Safety Board may obtain the advice and recommendations of the ACRS. Membership on the Committee includes individuals experienced in reactor operations, management; probabilistic risk assessment; analysis of reactor accident phenomena; design of nuclear power plant structures, systems and components; materials science; and mechanical, civil, and electrical engineering. The Nuclear Regulatory Commission has determined that renewal of the charter for the ACRS until December 10, 2012 is in the public interest in connection with the statutory responsibilities assigned to the ACRS. This action is being taken in accordance with the Federal Advisory Committee Act.
Domestic Licensing of Production and Utilization Facilities; Updates to Incorporation by Reference of Regulatory Guides; Correction
This document corrects a final rule that was published in the Federal Register on October 5, 2010 (75 FR 61321). The final rule amends the U.S. Nuclear Regulatory Commission's (NRC) regulations to incorporate by reference the latest revisions of two previously incorporated regulatory guides. This document is necessary to add a line of regulatory text that was inadvertently omitted from the final rule.
