Agency Information Collection Activities: Proposed Collection; Comment Request
The NRC is preparing a submittal to OMB for review of continued approval of information collections under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: 10 CFR part 9, Public Records. 2. Current OMB approval number: 3150-0043. 3. How often the collection is required: On occasion. 4. Who is required or asked to report: Individuals requesting access to records under the Freedom of Information or Privacy Acts, and submitters of information containing trade secrets or confidential commercial or financial information who have been notified that the NRC has made an initial determination that the information should be disclosed. 5. The number of annual respondents: 212. 6. The number of hours needed annually to complete the requirement or request: 167. 7. Abstract: 10 CFR Part 9 prescribes procedures for individuals making requests for records under the Freedom of Information Act (FOIA) or Privacy Act (PA). It contains information collection requirements for requests to waive or reduce fees for searching for and reproducing records in response to FOIA requests; appeals of denied requests; and requests for expedited processing. The information required from the public is necessary to justify requests for waivers or reductions in searching or copying fees; or to justify expedited processing. Section 9.28(b) provides that if the submitter of information designated to be trade secrets or confidential commercial or financial information objects to the disclosure, he must provide a written statement within 30 days that specifies all grounds why the information is a trade secret or commercial or financial information that is privileged or confidential. The title of the information collection: NRC Form 313, ``Application for Materials License'' and NRC Forms 313A (RSO), 313A(AMP), 313A(ANP), 313A(AUD), 313A(AUT), and 313A(AUS). 2. Current OMB approval number: 3150-0120. 3. How often the collection is required: There is a one-time submittal of the NRC Form 313 (which may include the NRC Form 313A series of forms) with information to receive a license. Once a specific license has been issued, there is a 10-year resubmittal of the NRC Form 313 (which may include the NRC Form 313A series of forms) with information for renewal of the license. Amendment requests are submitted as needed by the licensee. There is a one-time submittal for all limited specific medical use applicants of a NRC Form 313A series form to have each new individual identified as a Radiation Safety Officer (RSO), authorized medical physicist, authorized nuclear pharmacist (ANP), or authorized user or a subsequent submittal of additional information for one of these individuals to be identified with a new authorization on a limited specific medical use license. NRC Form 313A(RSO) is also used by medical broad scope licensees when identifying a new individual as an RSO or adding an additional RSO authorization for the individual. This submittal may occur when applying for a new license, amendment, or renewal. NRC Form 313A(ANP) is also used by commercial nuclear pharmacy licensees when requesting an individual be identified for the first time as ANP. This submittal may occur when applying for a new license, amendment, or renewal. 4. Who is required or asked to report: All applicants requesting a license, amendment or renewal of a license for byproduct or source material. 5. The number of annual respondents: 15,122 (2,364 NRC licensees and 12,758 Agreement State licensees). 6. The number of hours needed annually to complete the requirement or request: 65,308 (10,289 hours for NRC licensees and 55,019 hours for Agreement State licensees). 7. Abstract: Applicants must submit NRC Form 313, which may include the six forms in the 313A series, to obtain a specific license to possess, use, or distribute byproduct or source material. These six forms in the 313A series are: (1) NRC Form 313A(RSO), ``Radiation Safety Officer Training and Experience and Preceptor Attestation;'' (2) NRC Form 313A(AMP), ``Authorized Medical Physicist Training and Experience and Preceptor Attestation;'' (3) NRC Form 313A(ANP), ``Authorized Nuclear Pharmacist Training and Experience and Preceptor Attestation;'' (4) NRC Form 313A(AUD), ``Authorized User Training and Experience and Preceptor Attestation (for uses defined under 35.100, 35.200, and 35.500);'' (5) NRC Form 313A(AUT), ``Authorized User Training and Experience and Preceptor Attestation (for uses defined under 35.300);'' and (6) NRC Form 313A(AUS), ``Authorized User Training and Experience and Preceptor Attestation (for uses defined under 35.400 and 35.600).'' The information is reviewed by the NRC to determine whether the applicant is qualified by training and experience, and has equipment, facilities, and procedures which are adequate to protect the public health and safety, and minimize danger to life or property. Once a specific license has been issued, there is a 10-year resubmittal of the information for renewal of the license. 4. Who is required or asked to report: All applicants requesting a license of broad scope for byproduct material and all current licensees requesting renewal of a broad scope license. 5. The number of annual respondents: All of the information collections in Part 33 are captured under OMB clearance number 3150- 0120 for NRC Form 313. 6. The number of hours needed annually to complete the requirement or request: See item 5. 7. Abstract: 10 CFR part 33 contains mandatory requirements for the issuance of a broad scope license authorizing the use of byproduct material. The subparts cover specific requirements for obtaining a license of broad scope. These requirements include equipment, facilities, personnel, and procedures adequate to protect health and minimize danger to life or property. Notice of Availability of the Environmental Impact Statement for the Reclamation of Sequoyah Fuels Corporation Site in Gore, Oklahoma, NUREG-1888
Notice is hereby given that the U.S. Nuclear Regulatory Commission (NRC) is issuing a Final Environmental Impact Statement (EIS) for the Sequoyah Fuels Corporation (SFC) license amendment application, dated January 28, 2003, and subsequently revised by letters dated February 27, 2004, and July 30, 2004, for the surface reclamation of SFC's former uranium conversion site near Gore, Oklahoma. The Final EIS also addresses the SFC license amendment application dated June 12, 2003, for groundwater corrective actions at the SFC site. The Final EIS discusses the purpose and need for SFC's proposed surface reclamation activities and groundwater corrective actions and reasonable alternatives to the proposed action, including the no-action alternative. The Final EIS also discusses the environment potentially affected by the SFC proposal, presents and compares the potential environmental impacts resulting from the proposed action and its alternatives, and identifies mitigation measures that could eliminate or lessen the potential environmental impacts. Based on the final evaluation in the Final EIS, the NRC environmental review staff has concluded that the proposed action would have small effects on the physical environment and human communities with the exception of land use, for which the impact would be moderate. This Final EIS reflects the final analysis of environmental impacts of the proposed actions and its alternatives, including the consideration of public comments received by the NRC.
Administrative Changes: NRC Region IV Address Change and Phone Number and E-mail Address Changes
The Nuclear Regulatory Commission (NRC) is amending its regulations to update the street address for its Region IV office, and to update a telephone number and e-mail address for the Office of Information Services (OIS). This document is necessary to inform the public of these changes to the NRC's regulations.
Office of New Reactors; Notice of Availability of the Final Interim Staff Guidance DC/COL-ISG-01 on Seismic Issues Associated With High Frequency Ground Motion
The NRC is issuing its Final Interim Staff Guidance (ISG) DC/ COL-ISG-01. This DC/COL-ISG provides guidance on Seismic Issues associated with High Frequency (HF) Ground Motion for Design Certification (DC) and Combined License (COL) applicants. Moreover, this COL/DC-ISG describes how the staff will review seismic issues associated with HF ground motion as addressed in DC applications and COL applications. Disposition: The draft form of the ISG was published for public comments on August 16, 2007 (ML072200566). The staff received industry comments dated September 12, 2007. This revised version incorporated changes resulting from the disposition of the industry comments and as a result of discussions at the December 20, 2007 and the February 13, 2008 meetings (ML080560592). The NRC staff issues DC/COL-ISGs to facilitate timely implementation of the current staff guidance and to facilitate activities associated with review of applications for DC and COLs by the Office of New Reactors. The NRC staff will also incorporate the approved DC/COL-ISGs into the next revision of review guidance documents used by the Office of New Reactors.
Natural Resources Defense Council; Receipt of Petition for Rulemaking
The Nuclear Regulatory Commission (NRC) has received and requests public comment on a petition for rulemaking dated March 24, 2008, filed by the Natural Resources Defense Council (petitioner). The petition was docketed by the NRC and has been assigned Docket No. PRM- 50-90. The petitioner is requesting that the NRC amend the regulations that govern domestic licensing of production and utilization facilities, and special nuclear material to establish a date when the NRC will no longer license the use or export of highly enriched uranium (HEU) except for restricted use by a few specialized facilities. The petitioner believes that the amendment is needed to protect the public from potential exposure to an improvised nuclear explosive device made with HEU and used by terrorists.
Peter G. Crane; Denial of Petition for Rulemaking
The Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking (PRM-35-18) submitted by Peter G. Crane (petitioner). The petitioner requested that the NRC amend the regulations that govern medical use of byproduct material concerning release of individuals who have been treated with radiopharmaceuticals. The petitioner believes that this regulation is defective on legal and policy grounds. The petitioner requested that the patient release rule be partially revoked insofar as it allows patients to be released from radioactive isolation with more than the equivalent of 30 millicuries of radioactive iodine I-131 (I-131) in their bodies. The NRC, for the reasons described in the SUPPLEMENTARY INFORMATION of this document has determined that the issues raised in the petition do not justify a rule change.
Organization of Agreement States, Inc., Consideration of Petition in Rulemaking Process
The Nuclear Regulatory Commission (NRC) will consider the issues raised in a petition for rulemaking (PRM-34-06) submitted by Barbara Hamrick, Chair, Organization of Agreement States, Inc. (OAS) in the NRC's rulemaking process. The petitioner requested that the NRC amend its regulations to require that an individual receive at least 40 hours of radiation safety training before using sources of radiation for industrial radiography, to revise the requirements for at least two qualified individuals to be present at a temporary job site, and to clarify how many individuals are required to meet surveillance requirements. The petitioner also requested that NUREG-1556, Volume 2, be revised to reflect the proposed amendments. The NRC has determined that this petition will be considered through NRC's rulemaking process.
E. Russell Ritenour, PhD; Consideration of Petition Rulemaking Process
The Nuclear Regulatory Commission (NRC) will consider the issues raised in the petition for rulemaking submitted by E. Russell Ritenour, PhD, on behalf of the American Association of Physicists in Medicine (AAPM), in the rulemaking process. The petitioner requested that the NRC amend its regulations that address training requirements for experienced Radiation Safety Officers (RSOs) and Authorized Medical Physicists (AMPs). In its review and resolution of the petition, the NRC concluded that revisions made to the regulations in 2005 may have inadvertently affected a group of board certified professionals.
Regulation of Advanced Nuclear Power Plants; Draft Statement of Policy
The Nuclear Regulatory Commission (NRC) is considering adopting a statement of policy to improve the licensing environment for advanced nuclear power reactors to minimize complexity and uncertainty in the regulatory process. This statement would provide the Commission's policy regarding the review of, and desired characteristics associated with, advanced reactors. This policy statement would be the second revision of the policy statement titled ``Regulation of Advanced Nuclear Power Plants; Statement of Policy.'' The purpose of this revision is to update the Commission's policy statement on advanced reactors to integrate the Commission's expectations for security and preparedness with the current expectations for safety. This draft policy statement is being issued for public comment.

The number of annual responses: 35,663 (1,073 NRC responses + 3,900 NRC recordkeepers + 11,290 Agreement State responses + 19,400 Agreement State recordkeepers). 6. The number of annual respondents: Approximately 3,900 NRC general licensees and 19,400 Agreement State general licensees. 7. The number of hours needed annually to complete the requirement or request: 10,868 (1,460 hours for NRC licensees [975 hours recordkeeping and 485 hours reporting] and 9,408 hours for Agreement State licensees [4,850 hours recordkeeping and 4,558 hours reporting]. 8. Abstract: 10 CFR Part 31 establishes general licenses for the possession and use of byproduct material in certain devices and a general license for use of byproduct material. General licensees are required to keep records and submit reports identified in Part 31 in order for NRC to determine with reasonable assurance that devices are operated safely and without radiological hazard to users or the public. Office of New Reactors; Notice of Availability of the Final Interim Staff Guidance COL-ISG-02 on Financial Qualifications of Applicants
The NRC is issuing its Final Interim Staff Guidance (ISG) COL- ISG-02. This COL-ISG provides guidance on financial qualifications for and combined license (COL) applicants. This COL-ISG summarizes the requirements under Title 10 of the Code of Federal Regulations (10 CFR) Section 50.33(f)(1) for COL applicants and corrects the information provided in Section C.IV.5.1 of Regulatory Guide 1.206, ``COL Applications for Nuclear Power Plants (LWR Edition).'' The NRC staff issues ISGs to facilitate timely implementation of the current staff guidance and to facilitate activities associated with review of applications for design certifications and COLs for the Office of New Reactors. The NRC staff will also incorporate the approved DC/COL-ISGs into the next revision of the appropriate review guidance documents.
