On October 26, 2006 (71 FR 62664), the Nuclear Regulatory Commission (NRC) published for public comment a proposed rule that would amend its current security regulations and would add new security requirements pertaining to nuclear power reactors. Additionally, this rulemaking includes new proposed security requirements for Category I strategic special nuclear material (SSNM) facilities for access to enhanced weapons and firearms background checks. A 75-day comment period was provided for the proposed rule that expired on January 9, 2007. The comment period for the information collection aspects of the proposed rule expired on November 27, 2006. The comment period for this rulemaking was extended on January 5, 2007 (72 FR 480) to close on February 23, 2007. In the same notice, the comment period for the information collection aspects of the rulemaking was extended to January 11, 2007. The comment period for the proposed rule has been reopened and now expires on March 26, 2007. This includes an extension to the comment period on the information collection aspects of the rulemaking to have both comment periods close on the same day.

Applications for renewal are submitted every 5 years. 4. Who is required or asked to report: Employees (including applicants for employment), contractors and consultants of NRC licensees and contractors whose activities involve access to or control over special nuclear material at either fixed sites or in transportation activities. 5. The number of annual respondents: 5 NRC licensees. 6. The number of hours needed annually to complete the requirement or request: 1.25 hours (approximately 0.25 hours annually per response). 7. Abstract: NRC regulations in 10 CFR Part 11 establish requirements for access to special nuclear material, and the criteria and procedures for resolving questions concerning the eligibility of individuals to receive special nuclear material access authorization. Personal history information which is submitted on applicants for relevant jobs is provided to the Office of Personnel Management (OPM), which conducts investigations. NRC reviews the results of these investigations and makes determinations of the eligibility of the applicants for access authorization. Proposed License Renewal Interim Staff Guidance LR-ISG-2006-02: Staff Guidance on Acceptance Review for Environmental Reports Associated With License Renewal Applications; Solicitation of Public Comment

The NRC is soliciting public comment on its Proposed License Renewal Interim Staff Guidance LR-ISG-2006-02 (LR-ISG) on the acceptance review criteria for environmental reports (ER) provided by applicants for reactor license renewal. This LR-ISG summarizes the Title 10 of the Code of Federal Regulations Part 51 (10 CFR Part 51) requirements for ERs submitted with license renewal applications (LRAs), and provides a checklist that will be used by the NRC staff to verify the completeness of these reports prior to docketing. The NRC staff issues LR-ISGs to facilitate timely implementation of the license renewal rule and to review activities associated with an LRA. Upon receiving public comments, the NRC staff will evaluate the comments and make a determination to incorporate the comments, as appropriate. Once the NRC staff completes the LR-ISG, it will issue the LR-ISG for NRC and industry use. The NRC staff will also incorporate the approved LR- ISG into the next revision of the license renewal guidance documents.

Tennessee Valley Authority; Browns Ferry Nuclear Plant; Final Environmental Assessment and Finding of No Significant Impact Related to the Proposed License Amendment To Increase the Maximum Reactor Power Level

The NRC has prepared a final Environmental Assessment (EA) of its evaluation of a request by the Tennessee Valley Authority (TVA) for license amendments to increase the maximum thermal power at Browns Ferry Nuclear Plant (BFN) from 3458 megawatts-thermal (MWt) to 3952 MWt for Units 2 and 3 and from 3293 MWt to 3952 MWt for Unit 1. These represent power increases of approximately 15 percent for BFN Units 2 and 3 and 20 percent for BFN Unit 1. As stated in the NRC staff's position paper dated February 8, 1996, on the Boiling-Water Reactor (BWR) Extended Power Uprate (EPU) Program, the NRC staff would prepare an environmental impact statement if it believes a power uprate would have a significant impact on the human environment. The NRC staff did not identify any significant impact from the information provided in the licensee's EPU applications for BFN Units 1, 2, and 3 or from the NRC staff's independent review; therefore, as required by Title 10 of the Code of Federal Regulations (10 CFR), the NRC staff is issuing this EA and Finding of No Significant Impact. The NRC published a draft EA and finding of no significant impact on the proposed action for public comment in the Federal Register on November 6, 2006 (71 FR 65009). Two sets of comments were received as discussed below. The licensee provided a comment in a letter dated December 5, 2006 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML063390663). The comment clarified that upon increasing discharge temperatures, TVA would take action to ensure that the discharge temperature would not exceed the National Pollutant Discharge Elimination System (NPDES) permit effluent limitations. The language in the EA has been modified in response to this comment. The U.S. Department of the Interior, Fish and Wildlife Service provided comments in a letter dated December 13, 2006 (ADAMS Accession No. ML063610349). In the letter, a concern is expressed about any trend toward prolonged higher temperatures and poor water quality conditions in Wheeler Reservoir as a result of the proposed licensing action. The letter indicates that this concern is being addressed by the continuing monitoring programs and data collection implemented by TVA. The letter did not identify any impact on the EA conclusions based on this concern. Therefore, the EA was not modified due to this comment letter.

Regulatory Improvements to the Nuclear Materials Management and Safeguards System

The Nuclear Regulatory Commission (NRC) is proposing to amend its regulations related to licensee reporting requirements for source material and special nuclear material (SNM) to the Nuclear Materials Management and Safeguards System (NMMSS). The proposed amendments would lower the threshold of the quantities of SNM and certain source materials that require the submission of material status reports to the NMMSS. Also, the proposed amendments would make some modifications to the types of and timing of submittals of transaction reports to the NMMSS. The amendments would also require licensees to reconcile any material inventory discrepancies that NRC identifies in the NMMSS database. The proposed amendments would reduce some regulatory burden by reducing the current reporting requirements related to the export of certain source material and SNM. However, the annual reporting requirements would be new requirements for licensees who possess 350 grams or less, of SNM. These amendments are needed to improve the accuracy of the material inventory information maintained in the NMMSS.

Revision of Fee Schedules; Fee Recovery for FY 2007

The Nuclear Regulatory Commission (NRC) is proposing to amend the licensing, inspection, and annual fees charged to its applicants and licensees. The proposed amendments are necessary to implement the Omnibus Budget Reconciliation Act of 1990 (OBRA-90), as amended, which requires that the NRC recover approximately 90 percent of its budget authority in fiscal year (FY) 2007, less the amounts appropriated from the Nuclear Waste Fund (NWF), and for Waste Incidental to Reprocessing (WIR) and generic homeland security activities. Based on the FY 2007 Energy and Water Development Appropriations Bill (H.R. 5427), passed by the U.S. House of Representatives, the NRC's required fee recovery amount for the FY 2007 budget is approximately $663.7 million. After accounting for carryover and billing adjustments, the total amount to be recovered through fees is approximately $664.9 million. A final appropriation has not been enacted. Thus, the total amount that must be recovered through fees may be different once a final appropriation is enacted.

The Nuclear Regulatory Commission (NRC) is amending its regulations revising the Transnuclear, Inc., Standardized NUHOMS[reg] System listing within the ``List of Approved Spent Fuel Storage Casks'' to include Amendment No. 9 to Certificate of Compliance (CoC) Number 1004. Amendment No. 9 will modify the CoC by revising Technical Specifications 1.2.1 and 1.2.14 to add the Framatome-ANP, Version 9x9-2 fuel assemblies as approved contents for storage in the NUHOMS[reg]-61BT dry shielded canister, under the general license provisions of 10 CFR part 72.

The Nuclear Regulatory Commission (NRC) is proposing to amend its regulations revising the Transnuclear, Inc., Standardized NUHOMS[reg] System listing within the ``List of Approved Spent Fuel Storage Casks'' to include Amendment No. 9 to the Certificate of Compliance (CoC) Number 1004. Amendment No. 9 would modify the CoC by revising Technical Specifications 1.2.1 and 1.2.14 to add the Framatome-ANP, Version 9x9-2 fuel assemblies (FANP9x9-2) as approved contents for storage in the NUHOMS[reg]-61BT dry shielded canister, under the general provisions of 10 CFR part 72.
