Pursuant to the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015, this final rule provides the 2024 adjustment to the civil penalties that the agency may assess for violations of certain NTSB statutes and regulations.

The NTSB's 60-Day Notice, soliciting comments on the IC was published on May 4, 2021, and the NTSB has since revised the form in response to comments received as a result. The NTSB is issuing this 30-Day Notice, informing the public and Federal agencies to submit comments directly to the Office of Information & Regulatory Affairs (OIRA) regarding this ICR.

For consistency, the agency is updating the regulation and codifying current agency practice. These updates will provide a revised graphical representation of the seal. Additionally, the NTSB is including non- substantive technical amendments throughout part 803 due to recent internal organizational changes and a typographical error reflected in the agency's mailing address. Since publishing the notice of proposed rulemaking (NPRM), no comments have been received.
Authority of NTSB in Railroad, Pipeline, and Hazardous Materials Investigations
The National Transportation Safety Board (NTSB) is publishing this advance notice of proposed rulemaking (ANPRM) to seek public feedback on whether it should define the term ``substantial property damage'' as it relates to the agency's authority to investigate railroad accidents. Neither the agency's statute nor the regulation currently defines this term, thus, the NTSB seeks comments on whether defining ``substantial property damage'' would better clarify the scope of regulatory coverage for its railroad investigations. The issues raised in the comments submitted in response to this ANPRM will inform whether and how the NTSB will define this term in its regulation.

Privacy Act of 1974; System of Records
The National Transportation Safety Board (NTSB) proposes adding a new system of records to its inventory of system of records: Data Analytics Records. Subject to the Privacy Act of 1974, the agency proposes this new system for individually identifying information gathered or created from existing systems of records maintained by the NTSB, other NTSB records, and other governmental sources supporting NTSB operations. The new system will be used, primarily through data analytics techniques, to improve processes by enhancing data-driven decision-making, analyzing mission costs, managing resources, and otherwise assisting the NTSB in the performance of its statutory and regulatory duties, or in participating in Federal agency audits or other studies.
Internal Personnel Rules and Practices of the NTSB
The NTSB previously issued an interim final rule (IFR), soliciting comments on its Internal Personnel Rules and Practices. The NTSB received one comment as a result and is issuing a final rule, adopting the IFR with disposition of comment.
Information Collection: Generic Clearance for the Collection of Qualitative Feedback on Agency Service Delivery
Under the Paperwork Reduction Act (PRA) of 1995, the NTSB invites public comment on the agency's intent to submit to the Office of Management and Budget (OMB) an Information Collection Request (ICR), seeking Generic Clearance for a new collection. Specifically, the NTSB intends to seek OMB approval on generic clearance for qualitative feedback on agency service delivery.

With no comments received, the NTSB is issuing this 30-Day Notice, informing the public and Federal agencies to submit comments directly to the Office of Information & Regulatory Affairs (OIRA) regarding this ICR.

Internal Personnel Rules and Practices of the NTSB; Corrections
This document corrects the wording reflected in various sections in part 801 as a result of the amendatory language in the interim final rule (IFR) published in the Federal Register (FR) on October 4, 2021. The IFR amended part 801, in pertinent part, by revising all references to ``public reading room'' to read ``electronic reading room''. Consequently, that revision resulted in needless repetition of ``electronic reading room'' in several part 801 regulations. This correction amends the affected regulations to reflect the agency's original intent.

Office of the Managing Director: Strategic Management Program, Fiscal Year 2022-2026 Strategic Plan
This notice is in accordance with OMB Circular A-11, section 210.3 (b), Consultation and Outreach, which requires the NTSB to solicit comments on the proposed strategic plan to be published by February 2022. All interested parties are invited to submit comments regarding this proposed strategic plan. As background, the NTSB's 2020- 2024 strategic plan was published in December 2019. This proposed document updates that plan, incorporating revised and expanded goals and objectives for the continuation of the 2020-2024 plan. We continued evaluating baseline performance metrics for the three goals. Some goals have been adjusted to reflect results from the previous plan's activities. These expanded strategic objectives help measure the agency's overall success. Commercial Space Investigations
For transparency of the agency's commercial space safety investigative authority, the NTSB is proposing adding Subpart F for Commercial Space Investigations to supplement its Investigation Procedures. By codifying its investigative role in commercial space transportation, the NTSB anticipates that Subpart F will enhance transportation safety by enabling the agency to carry out its statutory mission of conducting safety investigations, identifying necessary corrective actions, and preventing future space transportation accidents and incidents.
Privacy Act of 1974; System of Records
The National Transportation Safety Board (NTSB) proposes adding a new system of records to its inventory of system of records: Religious Accommodation Request Records. Subject to the Privacy Act of 1974, the agency proposes this new system for reasonable accommodations from prospective, current, and former NTSB employees who request or receive accommodations for sincerely held religious beliefs, practices, or observances.

Internal Personnel Rules and Practices of the NTSB
The National Transportation Safety Board (NTSB) is amending its Internal Personnel Rules and Practices to reflect that the agency is closing its ``public reference room'' and will now make qualifying records electronically available. Moreover, the agency will remove an outdated paragraph describing a particular category of exempted records under the Freedom of Information Act (FOIA): internal matters of a relatively trivial nature that have no significant public interest, and predominately internal matters that the release would risk circumvention of a statute or agency regulation. The revisions to the NTSB FOIA regulation are being issued as an interim final rule to ensure that an updated regulations is in place as soon as practicable to implement the Supreme Court decision.
Amendment to the Definition of Unmanned Aircraft Accident
The National Transportation Safety Board (NTSB) proposes amending the definition of ``Unmanned aircraft accident'' by removing the weight-based requirement and replacing it with an airworthiness certificate or airworthiness approval requirement. The weight threshold is no longer an appropriate criterion because unmanned aircraft systems (UAS) under 300 lbs. are operating in high-risk environments, such as beyond line-of-sight and over populated areas. The proposed definition will allow the NTSB to be notified of and quickly respond to UAS events with safety significance.
