Federal Acquisition Regulation; FAR Case 2005-036, Definition of Cost or Pricing Data
The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) are cosponsoring a public meeting to discuss the proposed Federal Acquisition Regulation (FAR) rule 2005-036 on cost or pricing data. The rule would revise the definition of ``cost or pricing data''; change the term ``information other than cost or pricing data'' to ``data other than certified cost or pricing data''; add a definition of ``certified cost or pricing data'' to make the terms and definitions consistent with 10 U.S.C. 2306(a) and 41 U.S.C. 254(b) and more understandable to the general reader; change terminology throughout the FAR; and clarify the need to obtain data other than certified cost or pricing data when there is no other means to determine fair and reasonable pricing during price analysis. The proposed rule was published in the Federal Register at 72 FR 20092 on April 23, 2007. The Councils are now seeking additional views before finalizing the proposed rule. A public meeting will be held on November 15, 2007, from 9:00 a.m. to 1:00 p.m. EST, in the General Services Administration Building Auditorium, 1800 F Street, NW, Washington, DC, 20405. The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) are proposing to amend the Federal Acquisition Regulation (FAR) to implement the Governmentwide Enterprise Software Licensing Program, also known as SmartBUY. This action is necessary to comply with Office of Management and Budget Memorandum M-04-08, Maximizing Use of SmartBuy and Avoiding Duplication of Agency Activities with the President's 24 E-Gov Initiatives, dated February 25, 2004. By leveraging the Federal Government Enterprise Software Licensing Program, the Government will achieve the maximum cost savings and favorable terms and conditions for acquiring software and software maintenance. This rule impacts contracting officers and other acquisition officials responsible for reviewing the terms, conditions, and prices for the acquisition of commercial software and software maintenance.

Privacy Act of 1974; Privacy Act System of Records
Each Federal agency is required by the Privacy Act of 1974 to publish a description of the systems of records it maintains containing personal information when a system is substantially revised, deleted, or created. In this notice, NASA provides the required information for a new system of records on users of NASA's Earth Observation System Data and Information System (EOSDIS). The EOSDIS is a system that processes, archives and distributes NASA's Earth science data, the bulk of which consists of satellite observations from EOS missions and data products derived from them. User information is gathered and maintained by this SOR to establish voluntary user accounts that enable distribution to the users, upon their request, data from Goddard Space Flight Center or one of the eight (8) Distributed Active Archive Centers (DAACs) across the United States.

This notice is issued in accordance with 35 U.S.C. 209(c)(1) and 37 CFR 404.7(a)(1)(i). NASA hereby gives notice of its intent to grant an exclusive license in the United States to practice the inventions described and claimed in U.S. Patent No. 6,745,942 B1 and U.S. Patent No. 7,017,812 B1 to QI3 Corporation, DBA Quest Integrated., having its principal place of business in Kent, Washington. The patent rights in this invention have been assigned to the United States of America as represented by the Administrator of the National Aeronautics and Space Administration. The prospective exclusive license will comply with the terms and conditions of 35 U.S.C. 209 and 37 CFR 404.7. Pursuant to the provisions of the Privacy Act of 1974 (5 U.S.C. 552a), the National Aeronautics and Space Administration is issuing public notice of its proposal to combine four of its existing systems of into one new system of records, NASA 10ORIS Occupational Radiation Information System. This system of records combines GRC 22ORER Glenn Research Center Occupational Radiation Exposure Records, GSFC 51RSCR Goddard Space Flight Center Radiation Safety Committee Records, KSC 76RTES Kennedy Space Center Radiation Training and Experience Summary, and KSC 76XRAD Kennedy Space Center Occupational External Radiation Exposure History for Nuclear Regulatory Commission Licenses. It further expands the system of records to locations and subsystem managers at other NASA installations, and adds greater clarification of categories of individuals covered by the system, categories of records in the system, routine uses, and storage practices. This notice also further elaborates procedures of safeguarding the records, and of their retention and disposal.

Notice is hereby given that NASA is amending the standard appendices that it regularly publishes with the Agency's systems of records under the Privacy Act of 1974. This new routine use enables the Agency to quickly and effectively respond to a breach of personally identifiable information through disclosure of information regarding the breach to those individuals affected by it, as well as to persons and entities in a position to cooperate, either by assisting in notification to affected individuals or playing a role in preventing or minimizing harms from the breach.

The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed on a final rule amending the Federal Acquisition Regulation (FAR) in order to be consistent with the Lobbying Disclosure Act of 1995 and the Office of Management and Budget (OMB) Interim Final Guidance, and to improve clarity of the regulation through improved use of plain language and compliance with FAR drafting conventions.

This document is issued under the joint authority of the Secretary of Defense, the Administrator of General Services and the Administrator of the National Aeronautics and Space Administration. This Small Entity Compliance Guide has been prepared in accordance with Section 212 of the Small Business Regulatory Enforcement Fairness Act of 1996. It consists of a summary of rules appearing in Federal Acquisition Circular (FAC) 2005- 19 which amend the FAR. An asterisk (*) next to a rule indicates that a regulatory flexibility analysis has been prepared. Interested parties may obtain further information regarding these rules by referring to FAC 2005-19 which precedes this document.
