Consumer Product Safety Commission 2009 – Federal Register Recent Federal Regulation Documents

The Consumer Product Safety Commission (``Commission'') is issuing a final rule under section 104(d) of the Consumer Product Safety Improvement Act of 2008 (``CPSIA''). In accordance with that section, the final rule requires each manufacturer of a durable infant or toddler product to: provide a postage-paid consumer registration form with each product; keep records of consumers who register their products with the manufacturer; and permanently place the manufacturer's name and contact information, model name and number, and the date of manufacture on each such product. The final rule specifies the text and format for the registration form and establishes requirements for registration through the internet.

The Consumer Product Safety Commission (``CPSC'' or ``Commission'') is announcing its decision to revise the terms of its stay of enforcement of certain testing and certification provisions of section 14 of the Consumer Product Safety Act (``CPSA'') as amended by section 102(a) of the Consumer Product Safety Improvement Act of 2008 (``CPSIA'').\1\ On February 9, 2009, the Commission announced a stay of enforcement that would remain in effect until February 10, 2010, at which time the Commission would vote to terminate the stay. Through this notice, the Commission announces changes to the stay including when the stay will lift as to certain testing and certification requirements and how the testing and certification requirements will be implemented or otherwise become effective with regard to specific products subject to the testing and certification requirements of the CPSIA.

The Commission is extending its comment period to receive information regarding the advance notice of proposed rulemaking concerning Recreational Off-Highway Vehicles (ROVs). The Commission received two letters requesting an extension of the comment period, one from three manufacturers and distributors of Multi-Purpose Off-Highway Utility Vehicles, and the other from a trade association. The letters each requested that the comment period be extended 60 days from the date certain information was received by the companies or became publicly available. The Commission has decided to extend the comment period 75 days after the original comment period of December 28, 2009.

Section 14(c) of the Consumer Product Safety Act authorizes the Consumer Product Safety Commission (``Commission'' or ``CPSC'') to require, through rulemaking, labels for a consumer product that would identify the date and place of manufacture of the product, cohort information (batch, run number, or other identifying characteristic), and the manufacturer of the product. 15 U.S.C. 2063(c). This notice requests comments and information about such a rulemaking with regard to drywall.

As required by the Paperwork Reduction Act of 1995 (PRA)(44 U.S.C. Chapter 35), the Consumer Product Safety Commission requests comments on a proposed extension of approval of a collection of information from persons who have been involved in or have witnessed incidents associated with consumer products. The Commission will consider all comments received in response to this notice before requesting an extension of approval of this collection of information from the Office of Management and Budget.

The Consumer Product Safety Commission published a notice in the Federal Register of November 13, 2009, announcing an upcoming workshop on product testing. The document contained an incorrect telephone number.

As required by the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Consumer Product Safety Commission (CPSC or Commission) requests comments on a proposed extension of approval of a collection of information from persons who may voluntarily register and participate in a Consumer Opinion Forum posted on the CPSC Web site, https://www.cpsc.gov. The Commission will consider all comments received in response to this notice before requesting an extension of this collection of information from the Office of Management and Budget.

As required by the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Consumer Product Safety Commission (Commission) requests comments on a proposed request for extension of approval of a collection of information from manufacturers and importers of clothing, and textiles and related materials intended for use in clothing. This collection of information is required in regulations implementing the Standard for the Flammability of Clothing Textiles (16 CFR Part 1610) and the Standard for the Flammability of Vinyl Plastic Film (16 CFR Part 1611). These regulations establish requirements for testing and recordkeeping for manufacturers and importers who furnish guaranties for products subject to the flammability standards for clothing textiles and vinyl plastic film. The Commission will consider all comments received in response to this notice before requesting an extension of approval of this collection of information from the Office of Management and Budget (OMB).

As required by the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Consumer Product Safety Commission (``CPSC'' or ``Commission'') requests comments on a proposed collection of information regarding a form that will be used to identify third party conformity assessment bodies that meet the requirements to test for compliance to specified children's product safety rules. Third party conformity assessment bodies found to meet the requirements will be listed on the CPSC Web site. The Commission will consider all comments received in response to this notice before requesting approval of this collection of information from the Office of Management and Budget.

The Consumer Product Safety Commission (Commission) will conduct a public hearing to receive views from all interested parties on Section 212 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), Establishment of a Public Consumer Product Safety Incident Database. Participation by members of the public is invited. Oral presentations concerning the Commission's implementation of Section 212 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), Establishment of a Public Consumer Product Safety Incident Database, will become part of the public record.

Chapter 35), the Consumer Product Safety Commission (Commission) announces that it has submitted to the Office of Management and Budget (OMB) a request for extension of approval of a collection of information associated with the Commission's safety standard for automatic residential garage door operators.

Pursuant to the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Consumer Product Safety Commission (Commission) announces that it has submitted to the Office of Management and Budget (OMB) a request for extension of approval of a collection of information associated with the Commission's safety standard for electrically operated toys and children's articles.

Pursuant to the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Consumer Product Safety Commission (Commission) announces that it has submitted to the Office of Management and Budget (OMB) a request for extension of approval of a collection of information associated with the Commission's safety standard for walk- behind power lawn mowers.

It is the policy of the Commission to publish settlements which it provisionally accepts under the Consumer Product Safety Act in the Federal Register in accordance with the terms of 16 CFR 1118.20(e). Published below is a provisionally accepted Settlement Agreement with Maran, Inc., containing a civil penalty of $50,000.00.
