Targeted Populations Under Section 45D(e)(2)
This document contains proposed regulations relating to how an entity serving certain targeted populations under section 45D(e)(2) can meet the requirements to be a qualified active low-income community business. The regulations reflect changes to the law made by the American Jobs Creation Act of 2004. The regulations will affect certain taxpayers claiming the new markets tax credit. This document also provides a notice of a public hearing on these proposed regulations.

Cyfluthrin; Pesticide Tolerances
This regulation establishes, revises, or deletes tolerances for residues of cyfluthrin in or on numerous raw agricultural commodities. It also establishes tolerances for residues of beta- cyfluthrin in or on all commodities for which cyfluthrin tolerances exist. Bayer CropScience requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).
Environmental Impact Statement: Angoon Airport, Angoon, AK
The FAA announces that they will prepare an Environmental Impact Statement (EIS) to consider alternatives to and disclose the potential impacts of constructing a new land-based commercial airport near the City of Angoon. The FAA will hold public and agency scoping meetings to help identify substantive project concerns to be addressed in the EIS process. Cooperating agencies in this process include the United States Forest Service (USFS), and the United States Army Corps of Engineers (ACOE).
Notification of Request for Extension of Approval of Information Collection Activity-Notification Requirements for Sound Levels of Toy Caps
In the July 3, 2008 Federal Register (73 FR 38186), the Consumer Product Safety Commission (CPSC or Commission) published a notice in accordance with provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35) (PRA), to announce the agency's intention to seek extension of its PRA approval of information collection requirements regarding the sound levels of toy caps pursuant to 16 CFR 1500.18(a)(5). The Commission now announces that it has submitted to the Office of Management and Budget a request for extension of approval of that collection of information. The Commission received no comments. The CPSC will use the information it obtains to monitor industry efforts to reduce the sound levels of toy caps, and to ascertain which firms are currently manufacturing or importing toy caps with peak sound levels between 138 and 158 decibels.
Notice of Final Determination of Sales at Less Than Fair Value: Polyethylene Terephthalate Film, Sheet, and Strip from Thailand
On May 5, 2008, the Department of Commerce (the Department) published its preliminary determination in the investigation of sales at less than fair value of polyethylene terephthalate film, sheet, and strip (PET Film) from Thailand. See Notice of Preliminary Determination of Sales at Not Less Than Fair Value: Polyethylene Terephthalate Film, Sheet, and Strip from Thailand, 73 FR 24565 (May 5, 2008) (Preliminary Determination). The Department has determined that PET Film is being, or is likely to be, sold in the United States at less than fair value, as provided in section 735 of the Tariff Act of 1930, as amended (the Act). The final weighted-average dumping margin is listed below in the section entitled ``Final Determination of Investigation.''
Request for Nominations to the Environmental Financial Advisory Board
The U.S. Environmental Protection Agency (EPA) invites nominations of qualified candidates to be considered for appointments to fill vacancies on the Environmental Financial Advisory Board. The Board seeks to maintain diverse representation across sectors and geographic locations. Nominees should demonstrate expertise in any of the following areas: environmental economics; public utility finance and management; air pollution/climate financing; financial assurance mechanisms; financing green buildings/infrastructure; corporate finance and investment banking; commercial banking; environmental engineering; and accounting and/or auditing. Tribal and local government officials, representatives from the transportation and energy sectors, non-profit environmental/conservation groups, and environmental justice community representatives are encouraged to apply. In addition to this notice, other sources may be utilized in the solicitation of nominees. The deadline for receiving nominations is Friday, October 17, 2008. Nominees' qualifications will be assessed under the mandates of the Federal Advisory Committee Act, which requires Committees to maintain diversity across a broad range of constituencies, sectors, and groups. Nominations for membership must include a r[eacute]sum[eacute] describing the professional and educational qualifications of the nominee as well as experience. Notice of Access to EPA Library Services
EPA is enhancing access to library services for the public and Agency staff. EPA will open previously closed libraries in its National Library Network, with walk-in access for the public and EPA staff. Other library locations will expand staffing, operating hours, or services. This notice provides information regarding how members of the public can access the libraries and services beginning September 30, 2008.
Clean Water Act; Contractor Access to Information Claimed as Confidential Business Information
The Environmental Protection Agency (EPA) intends to transfer information claimed as confidential business information (CBI) collected from several industries, including health services, drinking water treatment, and airport deicing to Abt Associates and its subcontractors, to PG Environmental, LLC, and its subcontractors, and to Westat. Transfer of the information will allow the contractors and subcontractors to support EPA in the planning, development, review, and implementation of effluent limitation guidelines and standards under the Clean Water Act (CWA). The information being transferred was or will be collected, in part, under the authority of section 308 of the CWA. Interested persons may submit comments on this intended transfer of information to the address noted below.
Public Water System Supervision Program Revisions for the State of Nevada
Notice is hereby given that the State of Nevada has revised its approved Public Water System Supervision Program under the federal Safe Drinking Water Act (SDWA), 42 U.S.C. 300f et seq., pertaining to administrative penalty authority and the definition of public water system. Nevada first assumed primary enforcement authority (``primacy'') for the Public Water System Supervision Program (``PWSSP'') on March 29, 1978. EPA has determined that these revisions to the State's PWSSP are no less stringent than the corresponding Federal regulations and otherwise meet applicable SDWA primacy requirements for the PWSSP. Therefore, EPA intends to approve these revisions to the State of Nevada's approved PWSSP. Today's approval action does not extend to public water systems in Indian Country, as defined at 18 U.S.C. 1151.

Polyethylene Terephthalate Film, Sheet, and Strip from the People's Republic of China: Final Determination of Sales at Less Than Fair Value
On May 5, 2008, the Department of Commerce (``Department'') published its preliminary determination of sales at less than fair value (``LTFV'') in the antidumping investigation of polyethylene terephthalate film, sheet, and strip (``PET Film'') from the People's Republic of China (``PRC''). The period of investigation (``POI'') is January 1, 2007, through June 30, 2007. We invited interested parties to comment on our preliminary determination of sales at LTFV. Based on our analysis of the comments we received, we have made changes to our calculation for the mandatory respondent. The final dumping margins for this investigation are listed in the ``Final Determination Margins'' section below.
Polyethylene Terephthalate Film, Sheet, and Strip from the United Arab Emirates: Final Determination of Sales at Less Than Fair Value
On May 5, 2008, the Department of Commerce (Department) published its preliminary determination of sales at less than fair value (LTFV) in the antidumping investigation of polyethylene terephthalate film, sheet and strip (PET film) from the United Arab Emirates (UAE). On August 4, 2008, the Department issued a decision memorandum concerning the targeted dumping allegation by petitioners. See Memorandum to Stephen Claeys, Deputy Assistant Secretary for Import Administration, from Barbara E. Tillman, Director, AD/CVD Operations, Office 6, Antidumping Duty Investigation of Polyethylene Terephthalate Film, Sheet, and Strip (PET Film) from the United Arab Emirates: Analysis of Petitioners' Allegation of Targeting Dumping, dated August 4, 2008 (Targeted Dumping Memorandum). In that memorandum, we found that petitioners had not provided sufficient information to warrant a targeted dumping analysis. We invited interested parties to comment on our preliminary determination of sales at LTFV and on our targeted dumping decision. Based on our analysis of the comments received, we have made changes to our calculations for the sole respondent. See ``Changes Since the Preliminary Determination'' section below. We determine that PET film from the UAE is being, or is likely to be, sold in the United States at LTFV as provided in section 735 of the Tariff Act of 1930, as amended (the Act). The final dumping margins for this investigation are listed in the ``Final Determination Margins'' section below.

Notification of Request for Extension of Approval of Information Collection Activity-Notification Requirements for Coal and Wood Burning Appliances
In the July 3, 2008 Federal Register (73 FR 38187), the Consumer Product Safety Commission (CPSC or Commission) published a notice in accordance with provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35) (PRA), to announce the agency's intention to seek extension of its PRA approval of information collection requirements regarding certain coal and wood burning appliances pursuant to 16 CFR part 1406. The Commission now announces that it has submitted to the Office of Management and Budget a request for extension of approval of that collection of information. The Commission received no comments. The CPSC will use the information it obtains to monitor industry compliance with the requirements and to reduce risks of injuries from fires associated with the installation, operation, and maintenance of the appliances that are subject to the regulation.
Consumer Price Index Adjustments of Oil Pollution Act of 1990 Limits of Liability-Vessels and Deepwater Ports
The Coast Guard proposes to increase the limits of liability for vessels and deepwater ports under the Oil Pollution Act of 1990 (OPA 90) to account for inflation. This notice also sets forth the methodology the Coast Guard proposes to use for this and future adjustments to the OPA 90 limits of liability to reflect significant increases in the Consumer Price Index (CPI). These adjustments are required by OPA 90 to preserve the deterrent effect and polluter pays principle embodied in the OPA 90 liability provisions.
Fisheries of the Exclusive Economic Zone Off Alaska; Revised Management Authority for Dark Rockfish in the Bering Sea and Aleutian Islands Management Area and the Gulf of Alaska
NMFS issues a proposed rule that would implement Amendment 73 to the Fishery Management Plan for Groundfish of the Bering Sea and Aleutian Islands Management Area and Amendment 77 to the Fishery Management Plan for Groundfish of the Gulf of Alaska (collectively, Amendments 73/77). If approved, Amendments 73/77 would remove dark rockfish (Sebastes ciliatus) from both fishery management plans (FMPs). The State of Alaska (State) would then assume management of dark rockfish catch by State-permitted vessels in the Bering Sea and Aleutian Islands Management Area and the Gulf of Alaska. This action is necessary to allow the State of Alaska to implement more responsive, regionally based management of dark rockfish than is currently possible under the FMPs. This action would improve conservation and management of dark rockfish and is intended to promote the goals and objectives of the Magnuson-Stevens Fishery Conservation and Management Act, the FMPs, and other applicable laws.

Pendimethalin; Pesticide Tolerances
This regulation establishes tolerances for combined residues of the herbicide pendimethalin, [N-(1-ethylpropyl)-3,4-dimethyl-2,6- dinitrobenzenamine], and its metabolite, 4-[(1-ethylpropyl) amino]-2- methyl-3,5-dinitrobenzyl alcohol, in or on crayfish at 0.05 parts per million (ppm), and cotton gin byproducts at 3.0 ppm. BASF Corporation requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).
Proposed Establishment of Class D and Class E Airspace; Grayling, MI
This action proposes to establish Class D airspace and Class E Surface Area airspace at Grayling Army Airfield, Grayling, MI. The establishment of an air traffic control tower has made these actions necessary for the safety of Instrument Flight Rule (IFR) operations at Grayling Army Airfield. Class D airspace will revert to a Class E2 Surface Area during periods when the control tower is not operating.

In accordance with Section 609(i)(2) of the Millennium Challenge Act of 2003, as amended (Pub. L. 108-199, Division D), the Millennium Challenge Corporation is publishing a summary, justification and the complete text of the Amendment to Millennium Challenge Compact between the United States of America, acting through the Millennium Challenge Corporation, and the Government of the Republic of Mali. Representatives of the United States Government and the Government of the Republic of Mali executed the Amendment documents on September 11, 2008.
Product Tracing Systems for Fresh Produce; Public Meetings
The Food and Drug Administration (FDA) is announcing two public meetings regarding product tracing systems for fresh produce. The purpose of the meetings is to stimulate and focus a discussion about mechanisms to enhance product tracing systems for fresh produce and to improve FDA's ability to use the information in such systems to identify the source of contamination associated with fresh produce- related outbreaks of foodborne illness. This discussion will help FDA determine what short and long term steps we should take to enhance the current tracing system.
Special Local Regulations for Marine Events; St. Leonard Creek, Patuxent River, Calvert County, MD
The Coast Guard is establishing special local regulations during the ``War of 1812 North American Grand Tactical'', a marine event to be held September 21, 2008 on the waters of St. Leonard Creek and Patuxent River, Calvert County, MD. These special local regulations are necessary to provide for the safety of life on navigable waters during the event. This action is intended to temporarily restrict vessel traffic in a portion of St. Leonard Creek and the Patuxent River during the event.

Notice of Final Flat Fee Policy for Outfitting and Guiding Land Use Fees in the Alaska Region
The Alaska Region of the Forest Service is publishing a final regional flat fee policy. The initial proposal was published in the Federal Register on September 15, 2006 (71 FR 54454). The revised policy published April 18, 2008 (73 FR 21098) differed enough from the initial proposed policy to merit public notice and comment.
Public Conduct on Bureau of Reclamation Facilities, Lands, and Waterbodies
This final rule will amend the regulations that govern public access to and conduct on Bureau of Reclamation (Reclamation) facilities, lands, and waterbodies. This action is necessary to clarify rules that are intended to maintain law and order and protect persons and property on Reclamation facilities, lands, and waterbodies. Solicitation of Input From Stakeholders Regarding the Beginning Farmer and Rancher Development Program
The Cooperative State Research, Education, and Extension Service (CSREES) is implementing a newly funded competitive grants program called the Beginning Farmer and Rancher Development Program. The Cooperative State Research, Education, and Extension Service (CSREES) is requesting stakeholder input in developing regulations for identifying and certifying institutions as Hispanic- serving Agricultural Colleges and Universities (HSACUs), which comprise a new group of cooperating educational institutions established in section 7101 of the Food, Conservation, and Energy Act of 2008 (FCEA) or Public Law 110-246. In addition, CSREES is requesting stakeholder input in developing regulations for the five new programs for HSACUs authorized under section 7129 of FCEA. By this notice, CSREES is designated to act on behalf of the Secretary of Agriculture in soliciting public comment from interested parties regarding the implementing regulations to be developed for identifying HSACUs and the new programs for HSACUs.

Safety Zone: Robert Moses Causeway Bridge State Boat Channel, Captree, NY
The Coast Guard is establishing a temporary safety zone on the navigable waters of the State Boat Channel surrounding the Robert Moses Causeway located in Captree, New York. This safety zone is necessary to protect vessels transiting the area from hazards imposed by construction barges and equipment. Entry into this zone is prohibited unless authorized by the Captain of the Port Long Island Sound, New Haven, CT.

Pacific Halibut Fisheries; Subsistence Fishing
NMFS issues a final rule to amend the subsistence fishery rules for Pacific halibut in waters in and off Alaska. These regulations are necessary to address subsistence halibut management concerns, particularly in densely populated areas. This action is intended to support the conservation and management provisions of the Northern Pacific Halibut Act of 1982.
