Atlantic Highly Migratory Species; Electronic Dealer Reporting System Workshop

On June 28, 2011, NMFS published a proposed rule that considered requiring, among other things, Federal Atlantic swordfish, shark, and tunas dealers (except for dealers reporting Atlantic bluefin tuna) to report commercially-harvested Atlantic sharks, swordfish, and bigeye, albacore, yellowfin, and skipjack (BAYS) tunas through one centralized electronic reporting system. This electronic reporting system will allow dealers to submit Atlantic sharks, swordfish, and BAYS tuna data on a more real-time basis and more efficiently, which will reduce duplicative data submissions from different regions. We proposed to delay the effective date of the electronic reporting requirements until 2013 in order to give sufficient time for dealers to adjust to implementation of the new system and the additional requirements. On December 14, 2011, we conducted an initial training workshop in the Caribbean area in order to introduce the new reporting system to HMS dealers. In this notice, we announce the date and location for additional training workshops in the Caribbean, Gulf of Mexico and Atlantic regions in order to continue introducing HMS dealers to the new electronic system.

This workshop notice originally published on June 4, 2012. The August 16, 2012, workshop will be held from 12 p.m. to 4 p.m. at LaQuinta Inn & Suites, 28332 SW Freeway 59, Rosenberg, TX 77471. The July and September workshop dates remain unchanged. Atlantic Shark Identification workshops are mandatory for Atlantic Shark Dealer permit holders or their proxies. On June 3, 2011, the National Institute of Standards and Technology (NIST) held a public meeting on its campus to explore the feasibility of establishing a NIST/Industry Consortium on Neutron Metrology for Soft Materials Manufacturing. The notice stated the membership fees would be on the order of Twenty Thousand ($20,000) per year. The initial term of the consortium was intended to be three years. As a result of the October 3, 2011, public meeting, revisions have been made to the membership fee structure and the initial period of time for the consortium. Also, the consortium is open to a limited number of for-profit and not-for-profit institutions.

This final rule modifies the regulations implementing the Northeast (NE) Multispecies Fishery Management Plan (FMP) to allow vessels issued a Federal skate permit and a Skate Bait Letter of Authorization to fish for skates in a portion of southern New England (SNE) from July 1 through October 31 of each year, outside of the NE multispecies days-at-sea (DAS) program. This action allows vessels to harvest skates in a manner that is consistent with the bycatch reduction objectives of the NE Multispecies FMP.

NMFS announces the receipt of an application for an exempted fishing permit (EFP) from Dr. Chris Koenig (Florida State University) and Dr. Chris Stallings (University of South Florida). If granted, the EFP would authorize the applicants to use trained for-hire fishermen to be able to temporarily possess goliath grouper for non-lethal sampling during the course of their normal fishing activities. This non-lethal sampling would include measuring, tagging, and removing a portion of the goliath grouper dorsal fin rays before releasing the live fish. The intent of this study is to provide regional age structure of recovering goliath grouper populations for fish stock assessments.

NMFS proposes a change in the Mid-Atlantic Fishery Management Council's risk policy regarding stocks without an overfishing limit. The current risk policy does not allow increases of the acceptable biological catch for stocks that do not have an overfishing limit derived from the stock assessment. The modification will allow increases of the acceptable biological catch for stocks that have stable or increasing trends in abundance, and for which there is robust scientific information to suggest that an increased acceptable biological catch will not lead to overfishing.

Proposed Modification to Regulation Concerning the Use of Market Economy Input Prices in Nonmarket Economy Proceedings

The Department of Commerce (``Department'') proposes to modify its regulation which states that the Department normally will use the price that a nonmarket economy (``NME'') producer pays to a market economy supplier when a factor of production is purchased from a market economy supplier and paid for in market economy currency, in the calculation of normal value (``NV'') in antidumping proceedings involving NME countries. The rule, if adopted, would establish (1) a requirement that the input at issue be produced in one or more market economy countries, and (2) a revised threshold requiring that ``substantially all'' of an input be purchased from one or more market economy suppliers before the Department would use the purchase price paid to value the entire factor of production. Through this proposed modification, the Department is announcing its proposed definition of ``substantially all'' to be 85 percent of the total purchased volume of the particular input. The Department invites public comment on this proposed change.

On May 29, 2012, the Department of Commerce (the Department) published in the Federal Register a notice of initiation and preliminary results of the antidumping duty changed-circumstances review with intent to revoke in part the order on stainless steel bar (SSBar) from Japan (the Order).\1\ In the Initiation and Preliminary Results, we invited interested parties to comment on the preliminary determinations to exclude three products under Grades 304 and 440C, as described below, from the scope of the Order and to revoke the Order in part retroactively to February 1, 2010. The Department received no comments from interested parties. Therefore, the Department is revoking the Order in part to exclude the three products described below in New Scope Language, effective February 1, 2010.

This action corrects the final rule published on December 27, 2011, that implemented Amendment 88 to the Fishery Management Plan for Groundfish of the Gulf of Alaska. This correction clarifies that participants in the entry level trawl fishery may qualify for quota share (QS) under the Central Gulf of Alaska (GOA) Rockfish Program only in proportion to the number of years that a person made rockfish legal landings to an entry level processor in 2007, 2008, or 2009. This clarification is administrative in nature and does not change the distribution of rockfish QS to entry level trawl participants.

NMFS proposes to adjust the regulations governing the trade of tuna and tuna-like species in the North and South Atlantic Ocean to implement recommendations adopted at the 2011 meeting of the International Commission for the Conservation of Atlantic Tunas (Commission). The proposed rule would lift the trade restrictions on importing bigeye tuna from Bolivia and Georgia. Additionally, the proposed rule would make administrative changes to the section containing species-specific harmonized tariff codes in support of the International Trade Program.

On June 14, 2012, the United States Court of International Trade (the Court) issued final judgment in Home Products International, Inc. v. United States, Court No., 11-00104, sustaining the Department of Commerce's (the Department) final results of redetermination pursuant to remand.\1\ Consistent with the decision of the United States Court of Appeals for the Federal Circuit (Federal Circuit) in Timken Co., v. United States, 893 F.2d 337 (Fed. Cir. 1990) (Timken), as clarified by Diamond Sawblades Mfrs. Coalition v. United States, 626 F.3d 1374 (Fed. Cir. 2010) (Diamond Sawblades), the Department is notifying the public that the final judgment in this case is not in harmony with the Department's final results and is amending the final results of floor standing metal-top ironing tables from the People's Republic of China with respect to the margin assigned to Since Hardware (Guangzhou) Co., Ltd. (Since Hardware) covering the period August 1, 2007, through July 31, 2008.\2\
Atlantic Highly Migratory Species; Atlantic Bluefin Tuna Fisheries

NMFS closes the incidental Longline category northern area fishery for large medium and giant Atlantic bluefin tuna (BFT) for the remainder of 2012. Fishing for, retaining, possessing, or landing BFT in the Longline category northern area is prohibited for the remainder of 2012. The Longline fishery in the Northeast Distant gear restricted area (NED) remains open at this time. This action is being taken to prevent overharvest of the Longline category northern area BFT subquota.

Pursuant to provisions under the Federal Advisory Committee Act, 5 U.S.C. App., the Department of Commerce announces the reestablishment of the Renewable Energy and Energy Efficiency Advisory Committee (the Committee). The Committee shall advise the Secretary regarding the development and administration of programs and policies to expand the competitiveness of U.S. exports of renewable energy and energy efficiency goods and services, in accordance with applicable United States regulations. The Committee's work on energy efficiency will focus on technologies, services, and platforms that provide system-level energy efficiency to electricity generation, transmission, and distribution. For the purposes of this Committee, covered goods and services will not include vehicles, feedstock for biofuels, or energy efficiency as it relates to consumer goods. Non-fossil fuels that are considered renewable (e.g., liquid biofuels and pellets) are included. This notice also requests nominations for membership.

Regulation Strengthening Accountability of Attorneys and Non-Attorney Representatives Appearing Before the Department

The Department of Commerce (the Department) proposes to amend its regulations to add a subsection that strengthens the accountability of attorneys and non-attorney representatives who appear in proceedings before the Import Administration (IA). If this proposed rule is implemented, the Department will continue its long-standing practice of permitting attorneys and non-attorney representatives to appear before IA. The proposed rule provides that both attorneys and non-attorney representatives will be subject to disciplinary action for misconduct based upon good cause. The proposed rule will assist the Department in maintaining the integrity of its proceedings by deterring misconduct by those who appear before it in antidumping duty (AD) and countervailing duty (CVD) proceedings. The Department is requesting comments on the proposed rule as discussed in more detail below.
