Proposed Revision to Standard Review Plan Section 15.0, “Introduction-Transient and Accident Analyses”
On August 2, 2023, the U.S. Nuclear Regulatory Commission (NRC) solicited comments on Draft NUREG-0800, ``Standard Review Plan for the Review of Safety Analysis Reports for Nuclear Power Plants: LWR Edition,'' Section 15.0, Revision 4, ``IntroductionTransient and Accident Analyses.'' The public comment period closed on October 2, 2023. The NRC has decided to reopen the public comment period for this document for 30 days to allow more time for members of the public to develop and submit comments.
Regulatory Framework for Fusion Systems
The U.S. Nuclear Regulatory Commission (NRC) is considering amending its byproduct material regulations to establish a regulatory framework for fusion systems. The NRC is making available preliminary proposed rule language for a limited-scope, technology-inclusive framework that will be added to NRC's regulations in the Code of Federal Regulations. The NRC plans to hold public meetings in October and November 2023, to promote understanding of the preliminary proposed rule and facilitate transparency in its public rulemaking process.
Monthly Notice; Applications and Amendments to Facility Operating Licenses and Combined Licenses Involving No Significant Hazards Considerations
Pursuant to section 189.a.(2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular monthly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration (NSHC), notwithstanding the pendency before the Commission of a request for a hearing from any person.
NuScale Power, LLC, Carbon Free Power Project, LLC, Carbon Free Power Project
The U.S. Nuclear Regulatory Commission (NRC) is providing notice that an uncontested hearing will be held on the Carbon Free Power Project (CFPP), LLC limited work authorization (LWA) application that proposes certain early construction activities at the CFPP site located in the Idaho National Laboratory complex, near Idaho Falls, Idaho, at a time and place to be set in the future by the Commission or by a designated Atomic Safety and Licensing Board; a further notice of hearing, providing such information, will be issued in the future. This notice also provides the public an opportunity to request a hearing and petition for leave to intervene with respect to that application. The NRC staff is currently conducting a detailed technical review of the LWA application. If the NRC issues a LWA, the applicant, CFPP, would be authorized to conduct certain early construction activities at its proposed small modular reactor site in accordance with the provisions of the limited work authorization. Because the LWA application contains Sensitive Unclassified Non-Safeguards Information (SUNSI), this notice includes an order imposing procedures to obtain access to SUNSI for contention preparation.
List of Approved Spent Fuel Storage Casks: TN Americas LLC Standardized NUHOMS® Horizontal Modular Storage System for Irradiated Nuclear Fuel, Certificate of Compliance No. 1004, Renewed Amendment No. 18
The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its spent fuel regulations by revising the TN Americas, LLC (TN) Standardized NUHOMS[supreg] Horizontal Modular Storage System for Irradiated Nuclear Fuel listing within the ``List of approved spent fuel storage casks'' to include Renewed Amendment No. 18 to Certificate of Compliance No. 1004. Because this amendment was submitted subsequent to the renewal of the TN Americas, LLC Standardized NUHOMS Horizontal Modular Storage System for Irradiated Nuclear Fuel Certificate of Compliance No. 1004 and, therefore, subject to the Aging Management Program requirements of the renewed certificate, NRC is referring to it as ``Renewed Amendment No. 18.'' Renewed Amendment No. 18 amends the certificate of compliance to provide an improved basket design, revise technical specifications, and incorporate administrative controls during short duration independent spent fuel storage installation handling operations. The amendment also includes a change to the horizontal storage module concrete to allow use of a blended Portland cement that meets the requirements of American Society for Testing and Materials standards.

The U.S. Nuclear Regulatory Commission (NRC) is considering an application for the renewal of Facility Operating License No. NPF-58, which authorizes Energy Harbor Nuclear Corp. (Energy Harbor, the applicant), doing business as Energy Harbor Nuclear Generation LLC, to operate Perry Nuclear Power Plant (PNPP), Unit 1. The renewed license would authorize the applicant to operate PNPP for an additional 20 years beyond the period specified in the current license. The current operating license for PNPP expires on November 7, 2026.
Consideration of Current Operating Issues and Licensing Actions in License Renewal
The U.S. Nuclear Regulatory Commission (NRC) is issuing Revision 1 to Regulatory Issue Summary (RIS) 2014-06, ``Consideration of Current Operating Issues and Licensing Actions in License Renewal.'' Revision 1 to RIS 2014-06 provides information to the addressees on how the NRC considers current operating issues in the license renewal review under NRC regulations. This RIS is intended for all holders of operating licenses and combined licenses for nuclear power reactors, except those who have permanently ceased operations and have certified that fuel has been permanently removed from the reactor vessel. NRC regulations identify the technical information that must be submitted in a license renewal application to enable the NRC staff to make a determination that the license may be renewed. Pursuant to the regulations, an applicant is required to demonstrate that the effects of aging on the functionality of structures and components subject to an aging management review will be adequately managed; the consideration of recent operating experience is an important aspect of that demonstration. In addition, as required by NRC regulations, license renewal applicants need to update their applications with new information related to any current licensing basis changes during the NRC application review that could impact aging management of structures and components.

The U.S. Nuclear Regulatory Commission (NRC) is issuing a Confirmatory Order (Order) to American Centrifuge Operating, LLC (ACO, the licensee), as a result of a successful alternative dispute resolution mediation session completed on June 27, 2023. The commitments outlined in the Order were made as part of a settlement agreement concerning apparent violations by ACO for failing to meet NRC regulatory requirements related to protection of classified information. Details regarding the apparent violations contain security-related information and are therefore documented in a non- public version of the Order. The Order is effective upon issuance.

List of Approved Spent Fuel Storage Casks: NAC Multi-Purpose Canister (NAC-MPC) System, Certificate of Compliance No. 1025, Renewal of Initial Certificate and Amendment Numbers 1 Through 8
The U.S. Nuclear Regulatory Commission (NRC) is confirming the effective date of October 17, 2023, for the direct final rule that was published in the Federal Register on August 3, 2023. This direct final rule amended the spent fuel storage regulations by revising the NAC Multi-Purpose Canister (NAC-MPC) System listing within the ``List of approved spent fuel storage casks'' to renew, for 40 years, the initial certificate and Amendment Nos. 1 through 8 of Certificate of Compliance No. 1025. The renewal of the initial certificate and Amendment Nos. 1 through 8 revises the certificate of compliance's conditions and technical specifications to address aging management activities related to the structures, systems, and components important to safety of the dry storage system to ensure that these will maintain their intended functions during the period of extended storage operations.

Northern States Power Company; Prairie Island Independent Spent Fuel Storage Installation
The U.S. Nuclear Regulatory Commission (NRC, the Commission) has received a license amendment application from Northern States Power Company (NSPM) for an amendment to Materials License No. SNM-2506 for the Prairie Island Independent Spent Fuel Storage Installation (PI ISFSI) located in Welch, Minnesota. The amendment request seeks to revise the technical specifications (TS) for the PI ISFSI. NSPM proposes to allow use of a Code alternative as an option to the requirements of the 2004 Edition through 2006 Addenda of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel (B&PV) Code, Section III, Division 1, Subsection NB, Paragraph NB-5130, by revising the TS to add the Code alternative to TS section 4.4, table 4.4-1, TN-40HT ASME Code Exceptions.
Increased Enrichment of Conventional and Accident Tolerant Fuel Designs for Light-Water Reactors
The U.S. Nuclear Regulatory Commission (NRC) is requesting comments on a regulatory basis to support a rulemaking to amend the NRC's regulations related to the use of conventional and accident tolerant light-water reactor fuel designs. The NRC's goal is to establish effective and efficient licensing of applications using fuels enriched to greater than 5.0 and less than 20.0 weight percent uranium- 235. The NRC will hold a public meeting to promote a full understanding of the planned rulemaking and facilitate public comment on the regulatory basis.
Draft Regulatory Guide: Guidance for a Technology-Inclusive Content-of-Application Methodology To Inform the Licensing Basis and Content of Applications for Licenses, Certifications, and Approvals for Non-Light-Water Reactors
The U.S. Nuclear Regulatory Commission (NRC) is soliciting public comment on Appendix B and conforming changes to other parts of its draft Regulatory Guide (DG), DG-1404, Revision 1 ``Guidance for a Technology-Inclusive Content-of-Application Methodology to Inform the Licensing Basis and Content of Applications for Licenses, Certifications, and Approvals for Non-Light-Water Reactors.'' On May 25, 2023, the NRC published Revision 0 to DG-1404 requesting public comment, and on June 28, 2023, the NRC extended the public comment period to August 10, 2023. Since then, and consistent with item 1 in Appendix A to DG-1404, Revision 0, the NRC completed its development of Appendix B and revised DG-1404 (i.e., Revision 1) to include this appendix and made conforming changes to other parts of the document. Appendix B provides additional guidance for the scope, level of detail, elements, and plant representation for a probabilistic risk assessment (PRA) supporting a Licensing Modernization Project (LMP)-based construction permit application.

The draft regulatory guidance documents consist of draft NUREG-2191, ``Generic Aging Lessons Learned for Subsequent License Renewal Report,'' Volumes 1 and 2, Revision 1 (GALL-SLR Report); draft NUREG-2192, ``Standard Review Plan for Review of Subsequent License Renewal Applications for Nuclear Power Plants,'' Revision 1 (SRP-SLR); and draft NUREG-2221, ``Technical Bases for Changes in the Subsequent License Renewal Guidance Documents, NUREG-2191, Revision 1, and NUREG-2192, Revision 1,'' Supplement 1. The public comment period was originally scheduled to close on September 11, 2023. NextEra Energy Point Beach, LLC; Point Beach Nuclear Plant, Units 1 and 2
The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption from certain portions of the acceptance criteria for emergency core cooling systems to allow the use of a risk-informed analysis to evaluate the effects of debris in containment following a loss-of-coolant accident for the Point Beach Nuclear Plant, Units 1 and 2 (Point Beach) located in Manitowoc County, Wisconsin. The exemption is in response to a request dated July 29, 2022, as supplemented by letter dated June 9, 2023, from NextEra Energy Point Beach, LLC (NextEra, the licensee).

Inflation Adjustments to the Price-Anderson Act Financial Protection Regulations
The U.S. Nuclear Regulatory Commission (NRC) is amending its regulations to adjust for inflation the maximum total and annual standard deferred premiums specified in the Price-Anderson Act. The NRC must perform this adjustment at least once during each 5-year period following August 20, 2003, as mandated by the Atomic Energy Act of 1954, as amended (AEA).
Kairos Power LLC; Notice of Hearing
The U.S. Nuclear Regulatory Commission (NRC or the Commission) will convene an evidentiary session to receive testimony and exhibits in the uncontested proceeding regarding the application from Kairos Power LLC (Kairos) for a construction permit (CP) to construct a non- power test reactor termed Hermes in Oak Ridge, Tennessee. The U.S. Nuclear Regulatory Commission (NRC, the Commission) is considering issuance of an amendment to Renewed Facility Operating License No. NPF-43, issued to DTE Electric Company, for operation of Fermi, Unit 2 (Fermi 2). The proposed amendment requests an amendment to the Fermi 2 Technical Specifications (TS) 3.7.2, to allow for a one-time extension of the Condition A Completion Time to allow repair of Division 1 Mechanical Draft Cooling Tower A and C fan pedestals while online. The proposed amendment is being requested due to an exigent circumstance pursuant to NRC regulations.
Draft NUREG: Environmental Evaluation of Accident Tolerant Fuels With Increased Enrichment and Higher Burnup Levels
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment draft NUREG-2266, ``Environmental Evaluation of Accident Tolerant Fuels with Increased Enrichment and Higher Burnup Levels.'' This study evaluates the reasonably foreseeable impacts of near-term accident tolerant fuel (ATF) technologies with increased enrichment and higher burnup levels to 8 wt% uranium-235 (U-235) and up to 80 GWd/MTU, respectively, on the uranium fuel cycle, transportation of fuel and waste, and decommissioning for light-water reactors (LWRs) (i.e., a bounding analysis).
