Approval of American Society of Mechanical Engineers' Code Cases

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations to incorporate by reference the latest revisions of three regulatory guides (RGs) approving new and revised Code Cases published by the American Society of Mechanical Engineers (ASME). This proposed action would allow nuclear power plant licensees, and applicants for construction permits (CPs), operating licenses (OLs), combined licenses (COLs), standard design certifications, standard design approvals and manufacturing licenses, to use the Code Cases listed in these RGs as alternatives to engineering standards for the construction, inservice inspection (ISI), and inservice testing (IST) of nuclear power plant components. This rulemaking also includes consideration of a petition for rulemaking (PRM), PRM-50-89, submitted by Mr. Raymond West. This rulemaking also proposes resequencing NRC's requirements governing Codes and standards in order to comply with the Office of the Federal Register's (OFR) guidelines for incorporation by reference.

The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment three draft regulatory guides (DG), DG-1230, ``Design, Fabrication and Materials Code Case Acceptability, ASME Section III''; DG-1231, ``Inservice Inspection Code Case Acceptability, ASME Section XI, Division 1''; and DG-1232, ``Operation and Maintenance code Case, Acceptability, ASME OM Code.'' The subject DGs list the Code Cases that the NRC has approved for use by applicants and licensees. Code Cases provide an acceptable voluntary alternative to the mandatory American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel (BPV) Code and Operation and Maintenance (OM) of nuclear power plant provisions approved by the NRC.

Safety Standards for Infant Walkers and Infant Swings

In accordance with section 104(b) of the Consumer Product Safety Improvement Act of 2008 (CPSIA), also known as the Danny Keysar Child Product Safety Notification Act, the U.S. Consumer Product Safety Commission (Commission or CPSC) has published consumer product safety standards for numerous durable infant or toddler products, including infant walkers and infant swings. These standards incorporated by reference the ASTM voluntary standards associated with those products, with some modifications. In August 2011, Congress enacted legislation which sets forth a process for updating standards that the Commission has issued under the authority of the CPSIA. In accordance with that process, the CPSC is publishing this direct final rule, revising the CPSC's standards for infant walkers and infant swings, to incorporate by reference more recent versions of the applicable ASTM standards.
