to be used in all cases by a Class A
television station licensees seeking to

facilities of such station. The FCC Form
301–CA requires applicants to certify
compliance with certain statutory and
regulatory requirements. Detailed
instructions on the FCC Form 301–CA
provide additional information
regarding Commission rules and
policies. The FCC 301–CA application is
presented primarily in a ‘‘Yes/No’’
certification format. However, it
contains appropriate places for

submitting explanations and exhibits
where necessary or appropriate. Each
certification constitutes a material
representation. Applicants may only
mark the ‘‘Yes’’ certification when they

pertinent rule and/or policy, or where
the applicant is uncertain that the
application fully satisfies the pertinent
rule and/or policy.

fees. Cable systems that cover multiple
franchise areas having differing
franchise fees or other franchise costs,
different channel line-ups, or different
rate structures may advertise a complete
range of fees without specific
identification of the rate for each
individual area. In such circumstances,
the operator may advertise a ‘‘fee plus’’
rate that indicates the core rate plus the
range of possible additions, depending
on the particular location of the
subscriber.

Consumer Protection and Competition
Act of 1992 (‘‘Cable Act’’) requires the
Commission to publish annually a
report on average rates for basic cable
service, cable programming service, and
equipment. The report must compare
the prices charged by cable operators
subject to effective competition and
those that are not subject to effective
competition. The Annual Cable Industry
Price Survey is intended to collect the
data needed to prepare that report. The
data from these questions are needed to
complete this report.
