Public Hearing and Commission Meeting
The Susquehanna River Basin Commission will hold a public hearing as part of its regular business meeting on December 15, 2011, in Wilkes-Barre, Pennsylvania. At the public hearing, the Commission will consider: (1) The rescission of three docket approvals; (2) action on certain water resources projects; and (3) a request for partial fee waiver from SWEPI LP. Actions Taken at September 15, 2011, Meeting
As part of its regular business meeting held on September 15, 2011, in Milford, New York, the Commission convened a public hearing, at which it took the following actions: (1) Approved settlements involving two water resources projects; (2) approved or tabled the applications of certain water resources projects, including two involving diversions of water into the Susquehanna River Basin and one involving a diversion of water out of the Susquehanna River Basin; and (3) rescinded approval for one water resources project.

Actions Taken at June 23, 2011, Meeting
As part of its regular business meeting held on June 23, 2011, in North East, Maryland, the Commission convened a public hearing, at which it took the following actions: (1) Approved settlement involving one water resources project; (2) approved and tabled the applications of certain water resources projects, including six involving diversions of water into the Susquehanna River Basin; (3) rescinded approval for two water resources projects; (4) denied an administrative appeal by Allegheny Defense Project on three diversions into the Susquehanna River Basin from the Ohio River Basin approved by the Commission at its March 2011 meeting; (5) amended its Regulatory Program Fee Schedule to take effect on July 1, 2011; and (6) amended its comprehensive plan.
Review and Approval of Projects
This document contains proposed rules that would amend the project review regulations of the Susquehanna River Basin Commission (Commission) to: Include definitions for new terms that are used in the proposed rulemaking; provide for administrative approval of interbasin transfers of flowback and production fluids between drilling pad sites that are isolated from the waters of the basin; provide for administrative approval of out-of-basin transfers of flowback or produced fluids from a Commission approved hydrocarbon development project to an out-of-basin treatment or disposal facility; insert language authorizing ``renewal'' of expiring approvals, including Approvals by Rule (ABRs); delete specific references to geologic formations that may be the subject of natural gas development using hydrofracture stimulation and replace with a generic category ``unconventional natural gas development;'' broaden the scope of ABRs issued to include hydrocarbon development of any kind utilizing the waters of the basin, not just unconventional natural gas well development; memorialize the current practice of requiring post- hydrofracture reporting; standardize at 15 years the term of ABR approvals for both gas and non-gas projects; and provide further procedures for the approval of water sources utilized at projects subject to the ABR process.

Pursuant to authority set forth in the Susquehanna River Basin Compact, Pub. L. 91-575, 84 Stat. 1509 et seq., Article 3, Section 3.10(3); and at 18 CFR 806.4(a)(8) and 806.5, the Executive Director has issued a determination regarding the requirement for review and approval of natural gas well development projects targeting the Antes, Burket, Geneseo, Mandata, Middlesex, Needmore, or Rhinestreet shale formations.
