In this document, the Department of Transportation is announcing that after careful review, and as mandated by Section 7311 of the Fixing America's Surface Transportation (FAST) Act, the Department of Transportation has reviewed the final updated Regulatory Impact Analysis (RIA) and determined that the HM-251 Final Rule's electronically controlled pneumatic (ECP) brake requirements are not economically justified. As the expected benefits do not exceed the expected costs, PHMSA and the Federal Railroad Administration (FRA) will initiate a rulemaking to rescind the necessary regulatory provisions.

On August 16, 2017, the Office of Management and Budget approved the collection of calendar year (CY) 2017 Underground Natural Gas Storage (UNGS) Facility Annual Reports. This notice includes a PHMSA proposal to use CY 2017 annual report data in the user fee rate structure for both fiscal year (FY) 2018 and 2019.

To standardize manufacturer and reconditioner approvals, PHMSA is proposing to terminate any M-number and R-number approvals that were previously issued without an expiration date. The termination of these approvals will take effect one year from the publication date of this notice. Approval holders must either show cause why their approvals should not be terminated or apply for a modification of their approval prior to the effective date to avoid termination. Once terminated, requests for reconsideration of the termination must be submitted within 20 days of the date of termination.

This notice announces both a public meeting of the Technical Pipeline Safety Standards Committee, also known as the Gas Pipeline Advisory Committee (GPAC), to discuss topics and provisions of the proposed rule titled ``Safety of Gas Transmission and Gathering Pipelines,'' and a joint meeting of the GPAC and the Technical Hazardous Liquid Pipeline Safety Standards Committee, also known as the Liquid Pipeline Advisory Committee (LPAC). The purpose of the joint meeting of the GPAC and LPAC is to discuss a variety of policy issues and topics relative to pipeline safety.

This document provides notice that PHMSA and the Federal Railroad Administration (FRA) are publishing a revised Regulatory Impact Analysis (RIA) updating the original RIA associated with the electronically controlled pneumatic (ECP) brake provision of PHMSA's May 8, 2015, Final Rule titled ``Enhanced Tank Car Standards and Operational Controls for High-Hazard Flammable Trains'' (Final Rule). The agencies are publishing the updated RIA in response to the mandate of the Fixing America's Surface Transportation (FAST) Act. The updated RIA incorporates new testing and analysis the National Academy of Sciences (NAS) reviewed, recommendations from two U.S. General Accountability Office (GAO) audits, and updates to the costs and benefits of the provision of the Final Rule based on current economic conditions. The Pipeline and Hazardous Materials Safety Administration is issuing an emergency waiver order to persons conducting operations under the direction of the Puerto Rico Public Service Commission within the Hurricane Maria emergency and disaster areas of Puerto Rico. This Waiver Order is effective September 28, 2017, and shall remain in effect for 7 days from the date of issuance.

In preparation for the International Civil Aviation Organization's (ICAO) Dangerous Goods Panel (DGP) meeting to be held October 16-October 27, 2017, in Montreal, Canada, the Federal Aviation Administration's (FAA) Office of Hazardous Materials Safety and the Pipeline and Hazardous Materials Safety Administration's (PHMSA) Office of Hazardous Materials Safety announce a public meeting.

In accordance with the Paperwork Reduction Act of 1995, PHMSA invites comments on 11 information collections pertaining to hazardous materials transportation for which PHMSA intends to request renewal from the Office of Management and Budget. On April 21, 2017, PHMSA published a notice with a 60-day comment period soliciting comments on these ICRs [82 FR 18828] under Docket No. PHMSA-2017-0018 (Notice No. 2017-01). PHMSA received one comment; however, it was outside the scope of the April 21, 2017, notice.

This notice announces a public meeting of the Voluntary Information-Sharing System (VIS) Working Group. The VIS Working Group will convene to continue the discussion on the need for, and the identification of, a voluntary information-sharing system.

The Pipeline and Hazardous Materials Safety Administration is issuing an emergency waiver order to persons conducting operations under the direction of Environmental Protection Agency Regions 2 or 4 or United States Coast Guard 7th District within the Hurricane Irma emergency and disaster areas of Florida, Puerto Rico, South Carolina, and the United States Virgin Islands. This Waiver Order is effective September 8, 2017, and shall remain in effect for 30 days from the date of issuance.

On Tuesday, November 14, 2017, PHMSA will host two public meetings. The first meeting will be led by PHMSA to gain public input on current proposals and discuss potential new work items for inclusion in the agenda of the 52nd session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) held in Geneva, Switzerland from November 27 to December 6, 2017. The second meeting will be led by the Occupational Safety and Health Administration (OSHA) to discuss proposals in preparation for the 34th session of the United Nations Sub-Committee of Experts on the Globally Harmonized System of Classification and Labelling of Chemicals (UNSCEGHS) held in Geneva, Switzerland from December 6 to 8, 2017. On January 18, 2017, PHMSA received a petition for reconsideration of its interim final rule (IFR), ``Safety of Underground Natural Gas Storage Facilities.'' This Notice informs the petitioners and other interested persons that PHMSA intends to address the issues raised by the petitioners in a final rule, which it expects to issue by January of 2018. In the interim, and for one year after the publication of a final rule, PHMSA will not issue any enforcement citations to operators for failure to meet any provisions that are non- mandatory in an American Petroleum Institute (API) Recommended Practices (RPs) RP 1170 and RP 1171 but that were converted to mandatory provisions by the IFR. Despite this stay of enforcement, PHMSA still reserves the right to exercise its other authorities, if necessary, to address any emergencies that present an imminent hazard or specific conditions that are or would be hazardous to life, property, or the environment. This Notice also informs operators of the availability of further guidance on implementation to help operators develop assessment schedules and carry out compliance programs.
