Black Lung Benefits Act: Medical Benefit Payments
This final rule revises the regulations under the Black Lung Benefits Act (BLBA or Act) governing the payment of medical benefits and maintains the level of care available to miners. The final rule establishes methods for determining the amounts that the Black Lung Disability Trust Fund (Trust Fund) will pay for covered medical services and treatments provided to entitled miners. The Department based the rule on payment formulas that the Centers for Medicare & Medicaid Services (CMS) uses to determine payments under the Medicare program, which are similar to the formulas used by other programs that the Office of Workers' Compensation Programs (OWCP) administers. The Department is adopting these payment formulas for the black lung program because they more accurately reflect prevailing community rates for authorized treatments and services than do the internally-derived payment formulas that OWCP currently uses. In addition, the final rule eliminates two obsolete provisions.
Longshore and Harbor Workers' Compensation Act: Maximum and Minimum Compensation Rates
This final rule contains regulations implementing the Longshore and Harbor Workers' Compensation Act's provisions on maximum and minimum amounts of compensation payable. These regulations clarify how the Department interprets and applies these provisions in accordance with several court decisions to ensure injured workers are compensated properly and insurers and employers are aware of their responsibilities. In addition, the rule implements the Act's annual compensation-adjustment mechanism for permanent total disability compensation and death benefits.
DFEC Claims Identity Solution
The Office of Workers' Compensation Programs (OWCP) administers the Federal Employees' Compensation Act (FECA). In this capacity, OWCP's Division of Federal Employees' Compensation (DFEC) routinely responds to a myriad of written and telephonic inquiries. Claims staff issue written correspondence when developing and adjudicating a claim, and when terminating, reducing, or suspending compensation entitlement. Because of security and safety concerns expressed by our employees, DFEC is proposing to change its longstanding procedure of placing employee names on correspondence and all decisions in FECA cases. A similar change would be applied to oral communications. To fulfill this requirement, the Division proposes to implement new pseudonym procedures by August 2018.

Department of Labor Federal Civil Penalties Inflation Adjustment Act Annual Adjustments for 2018
The U.S. Department of Labor (Department) is publishing this final rule to adjust for inflation the civil monetary penalties assessed or enforced in its regulations, pursuant to the Federal Civil Penalties Inflation Adjustment Act of 1990 as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (Inflation Adjustment Act). The Inflation Adjustment Act requires the Department to annually adjust its civil money penalty levels for inflation no later than January 15 of each year. The Inflation Adjustment Act provides that agencies shall adjust civil monetary penalties notwithstanding Section 553 of the Administrative Procedure Act (APA). Additionally, the Inflation Adjustment Act provides a cost- of-living formula for adjustment of the civil penalties. Accordingly, this final rule sets forth the Department's 2018 annual adjustments for inflation to its civil monetary penalties.
