Privacy Act of 1974; System of Records
In accordance with the Privacy Act of 1974, the Office of the Secretary is establishing a new system of records titled, "Catch a Serial Offender (CATCH) Program Records," DoD-0024. This system of records covers DoD's maintenance of records used to collect and compare adult sexual assault reports for the purpose of identifying alleged serial sexual assault offenders. Additionally, DoD is issuing a notice of proposed rulemaking, which proposes to exempt this system of records from certain provisions of the Privacy Act, elsewhere in this issue of the Federal Register.
Privacy Act of 1974; Implementation
The Department of Defense (Department or DoD) is giving concurrent notice of a new system of records pursuant to the Privacy Act of 1974 for the DoD-0024, "Catch a Serial Offender (CATCH) Program Records," system of records and this proposed rulemaking. In this proposed rulemaking, the Department proposes to exempt portions of this system of records from certain provisions of the Privacy Act to avoid interference during the conduct of criminal, civil, or administrative actions or investigations; and to protect the identity of confidential sources incident involving adult sexual assault allegations.

This document corrects technical and typographical errors in the final rule that appeared in the April 15, 2024 issue of the Federal Register entitled, "Patient Protection and Affordable Care Act, HHS Notice of Benefit and Payment Parameters for 2025; Updating Section 1332 Waiver Public Notice Procedures; Medicaid; Consumer Operated and Oriented Plan (CO-OP) Program; and Basic Health Program." The effective date of the final rule was June 4, 2024.
Notice of Availability of Draft Environmental Impact Statement for the Enhanced Integrated Air and Missile Defense System on Guam
The MDA, as the lead agency, announces the availability of the Draft Environmental Impact Statement (EIS) (EISX-007-20-MDA-1725955966) for the proposed construction, deployment, and operation and maintenance of an Enhanced Integrated Air and Missile Defense (EIAMD) System on Guam (Proposed Action). The United States Army (USA), the United States Navy (USNAV), the United States Air Force (USAF), and the Federal Aviation Administration (FAA) are cooperating agencies on this Draft EIS. The Draft EIS was prepared in accordance with the National Environmental Policy Act of 1969 (NEPA); the Council on Environmental Quality Regulations for Implementing the Procedural Provisions of NEPA; and the agency implementing procedures of MDA, USA, USNAV, USAF, and FAA. The Draft EIS also supports compliance with the National Historic Preservation Act of 1966 (NHPA) and its implementing regulations.
Periodic Revisions to Denied Boarding Compensation and Domestic Baggage Liability Limits
This final rule, in accordance with existing regulation, raises the liability limits for denied boarding compensation that U.S. and foreign air carriers may impose from the current figures of $775 and $1,550 to $1,075 and $2,150. Also, in accordance with existing regulation, this final rule raises the liability limit U.S. carriers may impose for mishandled baggage in domestic air transportation from the current amount of $3,800 to $4,700.
National Environmental Policy Act Implementing Procedures for the Bureau of Land Management (516 DM 11)

Electronic Signatures, Forms and Storage for Drug and Alcohol Testing Records
The Department of Transportation (DOT or Department) proposes to amend its regulations for conducting workplace drug and alcohol testing for the federally regulated transportation industry to allow, but not require, electronic signatures on documents required to be created and utilized under the regulations, the use of electronic versions of forms, and the electronic storage of forms and data. The regulatory changes would apply to DOT-regulated employers and their contractors ("service agents") who administer their DOT-regulated drug and alcohol testing programs. Currently, employers and their service agents must use, sign and store paper documents exclusively, unless the employer is utilizing a laboratory's electronic Federal Drug Testing Custody and Control Form (electronic CCF) system that has been approved by the Department of Health and Human Services (HHS). DOT is required by statute to amend its regulations to authorize, to the extent practicable, the use of electronic signatures or digital signatures executed to electronic forms instead of traditional handwritten signatures executed on paper forms. This rulemaking also responds to an April 2, 2020, petition for rulemaking from DISA Global Solutions, Inc. (DISA), requesting that DOT regulations be amended to allow the use of an electronic version of the alcohol testing form (ATF) for DOT-authorized alcohol testing. The proposed regulatory amendments are expected to provide additional flexibility and reduced costs for the industry while maintaining the integrity and confidentiality requirements of the drug and alcohol testing regulations. In addition, DOT proposes to amend the Pipeline and Hazardous Materials Safety Administration (PHMSA) regulation for conformity and to make other miscellaneous technical changes and corrections.
Cybersecurity Maturity Model Certification (CMMC) Program
With this final rule, DoD establishes the Cybersecurity Maturity Model Certification (CMMC) Program in order to verify contractors have implemented required security measures necessary to safeguard Federal Contract Information (FCI) and Controlled Unclassified Information (CUI). The mechanisms discussed in this rule will allow the Department to confirm a defense contractor or subcontractor has implemented the security requirements for a specified CMMC level and is maintaining that status (meaning level and assessment type) across the contract period of performance. This rule will be updated as needed, using the appropriate rulemaking process, to address evolving cybersecurity standards, requirements, threats, and other relevant changes.
Findings of Research Misconduct
Findings of research misconduct have been made against Bret Rutherford, M.D. (Respondent), who was formerly a Research Psychiatrist, New York State Psychiatric Institute (NYSPI). Respondent engaged in research misconduct in research supported by U.S. Public Health Service (PHS) funds, specifically National Institute of Mental Health (NIMH), National Institutes of Health (NIH), grants R01 MH102293 and R61/R33 MH110029. The administrative actions, including debarment for a period of three (3) years followed by supervision for a period of three (3) years, were implemented beginning on September 27, 2024, and are detailed below.
