On Monday, November 6, 2023, the DoD published a notice announcing a partially closed meeting of the Defense Business Board (``the Board'') on November 14 and 15, 2023. Subsequent to publication of the notice, DoD is making changes to the meeting agenda. The amended meeting agenda is included in this notice.

The Secretary issues this amendment pursuant to section 319F-3 of the Public Health Service Act to amend the Declaration for Countermeasures against Marburgvirus and/or Marburg Disease to cover both Ebolaviruses and Marburgviruses and republishes the declaration, as amended. The amended republished Declaration clarifies that the disease threat includes Ebolaviruses and Marburgviruses, updates the title of the Declaration, expands the Covered Countermeasures, and extends the effective time period.

This proposed rule includes payment parameters and provisions related to the HHS-operated risk adjustment program, as well as 2025 user fee rates for issuers offering qualified health plans (QHPs) through Federally-facilitated Exchanges (FFEs) and State-based Exchanges on the Federal platform (SBE-FPs). This proposed rule also includes proposed requirements related to the auto re-enrollment hierarchy; essential health benefits; failure to file and reconcile; non-standardized plan option limits and an exceptions process; standardized plan options; special enrollment periods (SEPs); direct enrollment (DE) entities; Insurance Affordability Program enrollment eligibility verification process; requirements for agents, brokers, web-brokers, and DE entities assisting Exchange consumers; network adequacy; public notice procedures for section 1332 waivers; prescription drug benefits; updates to the Consumer Operated and Oriented Plan (CO-OP) Program; State flexibility on the financial methodology used for Medicaid eligibility determinations for non- modified adjusted gross income (MAGI) populations; and State flexibility on the effective date of coverage in the Basic Health Program (BHP). The U.S. Department of the Interior, on behalf of the U.S. Global Change Research Program (USGCRP), is soliciting nominations for authors and scientific/technical inputs for the First National Nature Assessment (NNA1). Refer to the NNA1 Draft Prospectus for further information on the scope, topics, and overarching themes for the report. NNA1 will adhere to the Global Change Research Act, Information Quality Act, and Evidence Act requirements for quality, transparency, and accessibility as appropriate for a Highly Influential Scientific Assessment. NNA1 will also adhere to USGCRP standards and guidelines requiring it to be a policy-neutral and policy-relevant product.

Comments are invited on: whether the proposed collection of information is necessary for the proper performance of the functions of the agency, including whether the information shall have practical utility; the accuracy of the agency's estimate of the burden of the proposed information collection; ways to enhance the quality, utility, and clarity of the information to be collected; and ways to minimize the burden of the information collection on respondents, including through the use of automated collection techniques or other forms of information technology.

In accordance with the Paperwork Reduction Act of 1995, we, the Indian Arts and Crafts Board (IACB) are proposing to renew an information collection with revisions.

This proposed rule would revise the Medicare Advantage (Part C), Medicare Prescription Drug Benefit (Part D), Medicare cost plan, and Programs of All-Inclusive Care for the Elderly (PACE) regulations to implement changes related to Star Ratings, marketing and communications, agent/broker compensation, health equity, dual eligible special needs plans (D-SNPs), utilization management, network adequacy, and other programmatic areas. This proposed rule also includes proposals to codify existing sub-regulatory guidance in the Part C and Part D programs.

In accordance with the Paperwork Reduction Act of 1995, this notice announces DOT's intention to reinstate an Office of Management and Budget (OMB) Control Number 2105-0576, ``U.S. Department of Transportation Service Animal Air Transportation Form,'' and to seek comment on formatting and clarifying amendments to this form. The Department also seeks to reinstate its ``U.S. Department of Transportation Service Animal Relief Attestation Form''; no amendments have been made to this form. The subject information collections are related to a requirement in the Code of Federal Regulations (CFR) that permits airlines to collect service animal documentation from passengers with a disability traveling by air with a service animal.

The DoD postponed the Homeland Defense Radar-Hawaii (HDR-H) in 2019, and no funds have been appropriated for the program since fiscal year 2022. The DoD is not moving forward with the HDR-H. As such, the MDA is terminating preparation of the Environmental Impact Statement (EIS) for the construction and operation of an HDR-H.

This proposed rule would implement the provision of the 21st Century Cures Act specifying that a health care provider determined by the HHS Inspector General to have committed information blocking shall be referred to the appropriate agency to be subject to appropriate disincentives set forth through notice and comment rulemaking. In particular, this rulemaking would establish for such health care providers a set of appropriate disincentives using authorities under applicable Federal law.
