This rulemaking proposes changes to implement provisions of the National Defense Authorization Act for Fiscal Year 2017 (NDAA-17) to continue TRICARE program coverage for certain members of the National Guard and their dependents during certain disaster response duty. This applies discretionary authority broadened by NDAA-17 to propose expansion of the TRICARE Reserve and Guard Family Benefits program to all families of Reserve Component (RC) members on active duty for more than 30 days, except for the families of RC members performing active Guard and Reserve (AGR) duty for a period of 180 consecutive days or more. This rulemaking also proposes to expand both early eligibility TRICARE coverage and Transitional Assistance Management Program (TAMP) coverage to RC members on active duty for some pre-planned missions.

This notice describes the adoption of Medicare's Home Health Value-Based Purchasing (HHVBP) adjustments for reimbursement under TRICARE's Home Health Prospective Payment System (HH PPS). In recognition that the Defense Health Agency (DHA) strongly supports the implementation of value-based incentive programs, in accordance with Section 705(a) of National Defense Authorization Act (NDAA) for Fiscal Year 2017, the adoption of this model establishes a new value-based initiative within the TRICARE program, based on Medicare's similar pilot. In the Medicare HHVBP model, the Centers for Medicare and Medicaid Services (CMS) determines a payment adjustment up to the maximum percentage, upward or downward, based on the Home Health Agency's (HHA) Total Performance Score (TPS). As a result, the model incentivizes quality improvements and encourages efficiency. States selected for participation in the Medicare HHVBP model include Arizona, Florida, Iowa, Maryland, Massachusetts, Nebraska, North Carolina, Tennessee, and Washington. CMS cannot release HHVBP adjustment factors to TRICARE, so Home Health Agencies (HHAs) in the participating states will be required to send their annual payment adjustment reports to the applicable TRICARE contractors prior to January 1 each year. Failure to submit the required payment adjustment documentation would result in full application of the negative adjustment factor for the calendar year. This requirement allows TRICARE to mirror Medicare's HHVBP payment adjustments. The TRICARE HHVBP model will only apply to Medicare- certified HHAs in the nine participating states. Specialized HHAs that qualify for corporate services provider status but are not Medicare- certified will continue to be reimbursed under the CHAMPUS Maximum Allowable Charge (CMAC) system and will not be subject to the TRICARE HHVBP model.

On September 4, 2019, DHS published two documents in the Federal Register related to the implementation of the REAL ID Modification for Freely Associated States Act: A final rule implementing the REAL ID Modification for Freely Associated States Act, and a notice designating an unexpired foreign passport and valid Form I-94 (Arrival-Departure Record) as acceptable identity documentation for purposes of obtaining a REAL ID driver's license or identification card for eligible citizens of the Freely Associated States. The text of footnote 9, which was included in the final rule, was overtaken by the notice published on the same date. Through this correction, the text of footnote 9 is being revised.

National Industrial Security Program

This final rule removes the DoD's regulations on the National Industrial Security Program (NISP) regarding industrial security procedures and practices related to foreign ownership, control, or influence (FOCI) for U.S. Government activities. The interim final rule currently in effect is duplicative and obsolete. The Director of the National Archives and Records Administration's (NARA) Information Security Oversight Office (ISOO) is responsible for implementing and monitoring Executive Branch implementation of the NISP, and DoD's rule duplicates an amendment to the NARA rule on the same subject.

In accordance with the Privacy Act of 1974, the Department of Transportation proposes to issue a new Department of Transportation system of records titled, ``Department of Transportation Federal Motor Carrier Safety Administration-011Military Under 21 Pilot Program System of Records.'' FMCSA is required by Section 5404 of the Fixing America's Surface Transportation Act, 2015 (FAST Act), to conduct a pilot program to allow 18- to 20-year-old persons with military driving experience to operate CMVs in interstate commerce. The pilot program seeks to determine the safety benefits or risks posed by military service members aged 18, 19, and 20 with specialized training in heavy vehicle operations operating a freight-carrying CMV in interstate commerce as compared to current entry-level commercial motor vehicle drivers aged 21-24 when operating a freight-carrying CMV in interstate commerce. The goal of this pilot program is to determine whether the group of under-21 military CDL holders operating in interstate commerce have similar or better safety performance outcomes than the 21-24 year old entry level drivers operating in interstate commerce. The information collected as part of the pilot program is necessary to: (1) Determine the eligibility of drivers to participate in the pilot program; (2) effectively implement and monitor the pilot program, given that participating under-21 military drivers will be participating with an exemption; (3) contact drivers if necessary throughout the pilot program (e.g., for follow-on questions or clarification on data), and (4) to conduct analysis on the safety performance of the participating drivers and make safety decisions accordingly. Specific details concerning eligibility for pilot program participation were previously published at 81 FR 56745 (September 21, 2016); 83 FR 31631 (July 6, 2018); and 83 FR 60950 (November 27, 2018). Pursuant to 49 U.S.C. 31315(c)(3) and 49 CFR 381.515, the FMCSA Administrator has the authority to immediately revoke the participation of a motor carrier, CMV, or driver in the Under 21 Military Pilot Program for failure to comply with the program's terms and conditions. This final rule implements the REAL ID Act Modification for Freely Associated States Act by amending the regulatory definition of ``temporary lawful status.'' With this change, citizens of the Freely Associated States residing in the United States are eligible for full- term REAL ID licenses and identification cards, provided they satisfy the other requirements of the REAL ID Act and regulations.
