Comprehensive Review of the Military Justice System

The Secretary of Defense directed the General Counsel of the Department of Defense (the General Counsel) to conduct a comprehensive review of the military justice system. To carry out the review, the General Counsel established the Military Justice Review Group (MJRG). The MJRG's review is focused on the structure and operation of the Uniform Code of Military Justice (UCMJ) and the Manual for Courts- Martial (MCM). The General Counsel invites members of the public to suggest areas for review by the MJRG concerning both substantive military law and military justice procedures, as well as submit specific proposals to amend the UCMJ and the MCM. Please provide supporting rationale for any proposed changes.

In accordance with the Privacy Act of 1974, the Department of Homeland Security proposes to update and reissue a current Department of Homeland Security system of records titled, ``Department of Homeland Security/National Protection and Programs Directorate002 Chemical Facility Anti-Terrorism Standards Personnel Surety Program System of Records.'' This system of records allows the Department of Homeland Security/National Protection and Programs Directorate to collect and maintain records on individualsfacility personnel and unescorted visitorswho have or are seeking access to restricted areas and critical assets at high-risk chemical facilities and compare this information to the Terrorist Screening Database, the terrorist watchlist maintained by the Federal Bureau of Investigation's Terrorist Screening Center. As a result of a biennial review of this system and changes to the Chemical Facility Anti-Terrorism Standards Personnel Surety Program, the Department of Homeland Security/National Protection and Programs Directorate is updating this system of records notice to include a new category of record and routine use. Administrative updates are being made globally to better align the description of the program with other CFATS Personnel Surety Program documentation. Additionally, the Department of Homeland Security is concurrently issuing a Final Rule to exempt this system of records from certain provisions of the Privacy Act, elsewhere in the Federal Register. This notice also includes non-substantive changes to simplify the formatting and text of the previously published notice. This updated system will be included in the Department of Homeland Security's inventory of record systems.

The Department of Defense (DoD) is publishing this final rule to implement new policy, responsibilities, and procedures for the operation of voluntary education programs within DoD. The new policies discussed in the rule include the following: All educational institutions providing education programs through the DoD Tuition Assistance (TA) Program will provide meaningful information to students about the financial cost and attendance at an institution so military students can make informed decisions on where to attend school; not use unfair, deceptive, and abusive recruiting practices; and provide academic and student support services to Service members and their families. New criteria are created to strengthen existing procedures for access to DoD installations by educational institutions. An annual review and notification process is required if there are changes made to the uniform semester-hour (or equivalent) TA caps and annual TA ceilings. Military Departments will be required to provide their Service members with a joint services transcript (JST). The DoD Postsecondary Education Complaint System is implemented for Service members, spouses, and adult family members to register student complaints. The Military Departments are authorized to establish Service-specific TA eligibility criteria and management controls. The requirement to sign a new DoD Voluntary Education Partnership Memorandum of Understanding (MOU) for all participating educational institutions will be effective 60 days following the publication of this final rule in the Federal Register. Additionally, educational institutions with a current DoD Voluntary Education Partnership MOU that have initiated their application for Title IV eligibility with the Department of Education will have 18 months following the publication of this final rule in the Federal Register to successfully meet the Title IV requirement. New applicants will be required to meet the Title IV requirement before signing a DoD Voluntary Education Partnership MOU.

Pilot Program for the Temporary Exchange of Information Technology Personnel

This part assigns responsibilities and provides procedures for implementing a Pilot Program for the Temporary Exchange of Information Technology Personnel, known as the Information Technology Exchange Program pilot. This Pilot is envisioned to promote the interchange of DoD and private sector IT professionals to enhance skills and competencies. Given the changing workforce dynamics in the IT field, DoD needs to take advantage of these types of professional development programs to proactively position itself to keep pace with the changes in technology. The ITEP pilot will serve the public good by enhancing the DoD IT workforce skills to protect and defend our nation. The ITEP Pilot expired September 31, 2013. Congress has extended the expiration date to September 30, 2018, and the reporting requirements through 2018. This final rule makes amendments to the current DoD ITEP regulation to update these dates.

The purpose of this notification is to inform users of an upcoming event related to the Global Positioning System (GPS) satellite constellation. U.S. Air Force Space Command will begin providing pre- operational, Civil Navigation Message (CNAV) populated L2C and L5 signals beginning April 28, 2014 in a 2-phase plan, as previously highlighted in a Department of Transportation notice that published in the Federal Register on March 5, 2014 (79 FR 12563-12564). Based on the response to the March 5, 2014 notice, and extensive discussion and cooperation between the Office of the Secretary of Defense (OSD) and the Department of Transportation, OSD has approved a modification to U.S. Air Force Space Command's planned implementation of CNAV. The public should consider these broadcasts to be ``use at one's own risk,'' since a fully operational command and control and signal monitoring infrastructure is not yet in place.

The Office of Inspector General is exempting a new system of records, CIG-29, entitled, ``Privacy and Civil Liberties Complaint Reporting System'' from subsections (c)(3); (d)(1), (2), (3), (4); (e)(1) and (e)(4); (G), (H), (I); and (f) of the Privacy Act, pursuant to 5 U.S.C. 552a. This direct final rule makes no substantive changes to the Office of Inspector General Privacy Program rules. These changes will allow the Department to add an exemption rule to the Office of Inspector General Privacy Program rules that will exempt applicable Department records and/or material from certain portions of the Privacy Act. This will improve the efficiency and effectiveness of DoD's program by preserving the exempt status of the applicable records and/or material when the purposes underlying the exemption(s) are valid and necessary. This rule is being published as a direct final rule as the Department of Defense does not expect to receive any adverse comments, and so a proposed rule is unnecessary.

The Office of the Secretary of Defense proposes to add a new system of records, DPFPA 03, entitled ``Pentagon Facilities Emergency and Incident Notification Records'' to its inventory of record systems subject to the Privacy Act of 1974, as amended. This system will provide an automated notification mechanism to contact PFPA employees and mission partners to provide situational awareness, facilitate recall, and to give instructions during an emergency or incident impacting the Pentagon facilities.

The Defense Travel Management Office is publishing Civilian Personnel Per Diem Bulletin Number 291. This bulletin lists revisions in the per diem rates prescribed for U.S. Government employees for official travel in Alaska, Hawaii, Puerto Rico, the Northern Mariana Islands and Possessions of the United States when applicable. AEA changes announced in Bulletin Number 194 remain in effect. Bulletin Number 291 is being published in the Federal Register to assure that travelers are paid per diem at the most current rates.
