The FHWA is extending the deadline and comment period for a notice of funding availability (NOFA), which was published on December 3, 2009, at 74 FR 63497. The original comment period is set to close on December 31, 2009. The extension is based on concern expressed by DOT stakeholders that the December 31 closing date does not provide sufficient time for submission of the solicited Letter of Interest and a subsequent comprehensive response to the docket. The FHWA agrees that the deadline and the comment period should be extended. Therefore, the closing date for submission of Letters of Interest and comments is extended to March 1, 2010, which will provide others interested in commenting additional time to prepare the Letter of Interest, and submit responses to the docket.

On February 17, 2009, the President of the United States signed the American Recovery and Reinvestment Act of 2009 (the ``Recovery Act'') to, among other purposes, (1) preserve and create jobs and promote economic recovery, (2) invest in transportation infrastructure that will provide long-term economic benefits, and (3) assist those most affected by the current economic downturn. The Recovery Act appropriated $1.5 billion of discretionary grant funds to be awarded by the Department of Transportation (the ``Department'') for capital investments in surface transportation infrastructure. The Department is referring to these grants as ``Grants for Transportation Investment Generating Economic Recovery'' or ``TIGER Discretionary Grants.'' This notice requests that applications for TIGER Discretionary Grants be submitted by September 15, 2009, from State and local governments, including U.S. territories, tribal governments, transit agencies, port authorities, other political subdivisions of State or local governments, and multi-State or multi- jurisdictional applicants (``Eligible Applicants''). One major component of the Congestion Initiative is the Urban Partnership Agreement (``UPA''). The purpose of this Notice is to solicit proposals by metropolitan areas to enter into UPAs with the Department in order to demonstrate strategies with a combined track record of effectiveness in reducing traffic congestion. To support congestion-reducing strategies adopted by the Department's urban partners (``Urban Partners''), the Department expects to utilize discretionary funding available under the Department's Intelligent Transportation System Operational Testing to Mitigate Congestion Program (the ``ITS-OTMC Program''), its Value Pricing Pilot Program (the ``VPP Program''), and other discretionary grant, lending and credit support programs administered by the Department. In addition, to the maximum extent possible, the Department will support its Urban Partners with regulatory flexibility and dedicated expertise and personnel. This Notice is the first of three solicitations to be issued by the Department in connection with the Congestion Initiative. The Department reserves the right to solicit, and is actively soliciting, by means other than this Notice, certain metropolitan areas that the Department has determined, on a preliminary basis, to be candidates for UPAs. This final rule revises delegations of authority to carry out the Federal hazardous material transportation law, as amended by the Hazardous Materials Transportation Safety and Security Reauthorization Act of 2005 (Title VII of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users or ``SAFETEA-LU''), and in accordance with the Norman Y. Mineta Research and Special Programs Improvement Act, Public Law 108-426, 118 Stat. 2423 (November 30, 2004) (Mineta Act) that were previously published in 71 FR 30828 (May 31, 2006). This final rule also adds delegations of authority to the Federal Motor Carrier Safety Administration (FMCSA) and the Research and Innovative Technology Administration (RITA) to carry out certain provisions of SAFETEA-LU.

Section 11143 of Title XI of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users amends the Internal Revenue Code by creating a new class of tax-exempt facility bonds for qualified highway and surface freight transfer facilities. The law limits the total amount of such bonds to $15 billion and directs the Secretary of Transportation to allocate this amount among qualified facilities. This notice solicits requests for such allocations from interested entities that meet the statutory requirements. The Department also requests comments from the public that it may consider in its application of the authority provided by Section 11143.

Protection of Sensitive Security Information; Technical Amendment

OST and TSA are revising their regulations governing the protection of sensitive security information (SSI) to remove an unintended limitation on parties that have a need to know such information. Specifically, this rule removes the limiting words ``aviation or maritime'' from 49 CFR 15.11 and 49 CFR 1520.11 in order to clearly permit the sharing of vulnerability assessments and other documents properly designated as SSI with covered persons who meet the need to know requirements regardless of mode of transportation.
