In addition, this rule amends the Federal Aviation Administration regulations to set forth the new civil penalties established in Division V, Title I of the Consolidated Appropriations Act, 2021. The rule also corrects a rounding error in an FAA penalty.

This final rule adopts, without change, an October 22, 2020, interim final rule (IFR) amending Maritime Administration (MARAD) regulations governing admission to the United States Merchant Marine Academy (USMMA). The amendments allow the MARAD Administrator to waive the requirement for USMMA applicants to have taken the College Board's Scholastic Aptitude Test (SAT) or the American College Testing Program (ACT) examination in the event of a State or national emergency. The ability to waive SAT and ACT requirements for prospective students is necessary to address testing disruptions caused by the coronavirus disease 2019 (COVID-19) pandemic and to provide for future emergencies.
Notice of Funding Opportunity for the Maritime Administration's Port Infrastructure Development Program (PIDP) Under the Consolidated Appropriations Act, 2021

The Consolidated Appropriations Act, 2021 appropriated $230 million for the Port Infrastructure Development Program (PIDP) to make grants to improve facilities within, or outside of and directly related to operations of or an intermodal connection to, coastal seaports, inland river ports, and Great Lakes ports. This notice announces the availability of funding for grants under this program and establishes selection criteria and application requirements. The Act directed that at least $205 million of the appropriated funds shall be for grants to coastal seaports or Great Lakes ports. Additionally, the National Defense Authorization Act for Fiscal Year 2021 directed that not less than $41.4 million shall be for projects at ``Small Ports and Terminals'' meeting certain requirements described in this NOFO. Funds for the PIDP are to be awarded as discretionary grants on a competitive basis for projects that will improve the safety, efficiency, or reliability of the movement of goods into, out of, around, or within a port. All PIDP grant recipients must meet all applicable Federal requirements, including the Buy American Act. The purpose of this notice is to solicit grant applications for the PIDP.

In accordance with the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015, this final rule provides the 2020 inflation adjustment to civil penalty amounts that may be imposed for violations of certain DOT regulations. In additional, this final rule makes conforming revisions to Federal Motor Carrier Safety Administration regulations to reflect inflationary adjustments to the statutorily-mandated civil penalties for violations of Federal law.

The CSF will consist of two vessels. This Notice describes, among other things, statutory requirements to apply and to participate in the CSF, recommendations as to the form and substance of applications, and a deadline for submitting applications for vessel enrollment in the CSF program. The Maritime Administration will negotiate agreements ready for execution with the successful applicants.

By Federal Register notice of Friday, November 27, 2020, titled Notice of Availability; Notice of Virtual Public Meetings; Request for Comments, the Maritime Administration (MARAD), in coordination with the U.S. Coast Guard (USCG), announced the availability of the Draft Environmental Impact Statement (DEIS) for the Texas GulfLink LLC (GulfLink) deepwater port license application for the export of crude oil from the United States to nations abroad. Publication of this notice announced a 45-day comment period, requested public participation in the environmental impact review process, provided information on how to participate in the environmental impact review process, and announced the two virtual public meetings and an informational open house website for the DEIS. The notice advised that the comment period for Texas GulfLink would end on January 11, 2021. MARAD and USCG have determined that an extension of the public comment period to January 22, 2021 for the GulfLink application is necessary to allow the public and interested parties a full 45 days to review the application and provide written feedback to the agencies. This extension is due to delays in getting the DEIS fully posted on the project's docket at www.regulations.gov. This notice announces the extension of the comment period and new comment period end date.
