North American Free-Trade Agreement, Article 1904; NAFTA Panel Reviews; Request for Panel Review
On May 1, 2006, Corn Products International, Inc. And Casco, Inc./Canada Starch Operating Company, Inc; filed a First Request for Panel Review with the Canadian Section of the NAFTA Secretariat pursuant to Article 1904 of the North American Free Trade Agreement. Panel review was requested of the final dumping and countervailing duty determinations made by the Canada Border Services Agency, respecting Unprocessed Grain Corn, excluding Seed Corn (for Reproductive Purposes), Sweet Corn, and Popping Corn, Originating in or Exported from the United States of America. Second and third requests were received on May 1, 2006 from Maple Leaf Foods Inc. and its Affiliates; and Commercial Alcohols Inc. This determination was published in the Canada Gazette, Part I, (Vol. 140, No. 13, pp. 673) on April 1, 2006. The NAFTA Secretariat has assigned Case Number CDA-USA-2006-1904-01 to this request.
Silicomanganese from Brazil, Ukraine, and the People's Republic of China; Five-year Sunset Reviews of Antidumping Duty Orders; Final Results
On January 3, 2006, the Department of Commerce (the Department) initiated sunset reviews of the antidumping duty orders on silicomanganese from Brazil, Ukraine, and the People's Republic of China pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act). On the basis of the notice of intent to participate and adequate substantive responses filed on behalf of the sole domestic interested party and inadequate responses from respondent interested parties, the Department conducted expedited sunset reviews. As a result of these sunset reviews, the Department finds that revocation of the antidumping duty orders would be likely to lead to continuation or recurrence of dumping and the magnitude of the margins likely to prevail is set forth in the section entitled ``Final Results of Reviews.''
Carbazole Violet Pigment 23 from India: Notice of Rescission of Antidumping Duty New Shipper Review
In response to a request from Gharda Chemicals, Ltd., on January 27, 2006, the Department of Commerce published in the Federal Register a notice announcing the initiation of a new shipper review of the antidumping duty order on carbazole violet pigment 23 from India covering the period December 1, 2004, through November 30, 2005. On April 21, 2006, Gharda Chemicals, Ltd., withdrew its request for a new shipper review and, therefore, we are rescinding this review.
Wooden Bedroom Furniture from the People's Republic of China: Notice of Initiation and Preliminary Results of Changed Circumstances Review, and Intent to Revoke Order in Part
On February 2, 2006, and in an amendment on March 16, 2006, the Department of Commerce (the ``Department'') received a request on behalf of the petitioners, the American Furniture Manufacturers Committee for Legal Trade and its individual members (the ``AFMC'') for a changed circumstances review and a request to revoke in part the antidumping duty (``AD'') order on wooden bedroom furniture from the People's Republic of China with respect to jewelry armoires that have at least one side door, whether or not the door is lined with felt or felt-like material. In its February 2, 2006, submission, AFMC stated that it no longer has any interest in antidumping relief from imports of such jewelry armoires with respect to the subject merchandise defined in the ``Scope of the Review'' section below. Interested parties are invited to comment on these preliminary results.
Brake Rotors From the People's Republic of China: Preliminary Results and Partial Rescission of the 2004/2005 Administrative Review and Preliminary Notice of Intent To Rescind the 2004/2005 New Shipper Review
The Department of Commerce (``the Department'') is currently conducting the 2004/2005 administrative review and the 2004/2005 new shipper review of the antidumping duty order on brake rotors from the People's Republic of China (``PRC''). We preliminarily determine that sales have been made below normal value (``NV'') with respect to certain exporters who participated fully and are entitled to a separate rate in the administrative review. We also have preliminarily determined that the single sale made by the new shipper, Shanxi Zhongding Auto Parts Co., Ltd.(``SZAP''), was not bona fide. If these preliminary results are adopted in our final results of these reviews, we will instruct U.S. Customs and Border Protection (``CBP'') to assess antidumping duties on entries of subject merchandise during the period of review (``POR'') for which the importer-specific assessment rates are above de minimis. Interested parties are invited to comment on these preliminary results. We will issue the final results no later than 120 days from the date of publication of this notice.
Stainless Steel Butt-Weld Pipe Fittings from Italy, Malaysia, and the Philippines; Final Results of the Expedited Five-year (“Sunset”) Reviews of Antidumping Duty Orders
On January 3, 2006, the Department of Commerce (the Department) initiated sunset reviews of the antidumping duty orders on stainless steel butt-weld pipe fittings (butt-weld pipe fittings) from Italy, Malaysia, and the Philippines pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act). On the basis of a notice of intent to participate and an adequate substantive response filed on behalf of domestic interested parties, and no response from respondent interested parties, the Department conducted expedited (120-day) sunset reviews of these antidumping duty orders. As a result of these sunset reviews, the Department finds that revocation of the antidumping duty orders would be likely to lead to continuation or recurrence of dumping at the levels identified below in the ``Final Results of Review'' section of this notice.
Certain Large Diameter Carbon and Alloy Seamless Standard, Line, and Pressure Pipe from Japan and Certain Small Diameter Carbon and Alloy Seamless Standard, Line, and Pressure Pipe from Japan and Romania: Continuation of Antidumping Duty Orders
As a result of the determinations by the Department of Commerce (the Department) and the International Trade Commission (ITC) that revocation of the antidumping duty orders on certain large diameter carbon and alloy seamless standard, line and pressure pipe from Japan and (Large Diameter SSLPP), and certain small diameter carbon and alloy seamless standard, line and pressure pipe (Small Diameter SSLPP) from Japan and Romania would be likely to lead to continuation or recurrence of dumping and of material injury to an industry in the United States within a reasonably foreseeable time, the Department is publishing notice of the continuation of these antidumping duty orders.
Certain Steel Concrete Reinforcing Bars from Turkey; Preliminary Results and Partial Rescission of Antidumping Duty Administrative Review
In response to a request by the petitioners and four producers/exporters of the subject merchandise, the Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on certain steel concrete reinforcing bars (rebar) from Turkey. This review covers 15 producers/exporters of the subject merchandise to the United States. This is the seventh period of review (POR), covering April 1, 2004, through March 31, 2005. We have preliminarily determined that 11 of the producers/exporters have made sales below normal value (NV). If these preliminary results are adopted in the final results of this review, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties on all appropriate entries. On January 23, 2006, we rescinded the review with respect to ICDAS Celik Enerji Tersane ve Ulasim Sanayi, A.S. (ICDAS) based on the Department's determination in the prior administrative review to revoke ICDAS from the order. In addition, we have preliminarily determined to rescind the review with respect to 18 companies because either: (1) These companies had no shipments of subject merchandise during the POR; or (2) the questionnaires sent to these companies were returned to the Department because of undeliverable addresses. We invite interested parties to comment on these preliminary results. Parties who wish to submit comments in this proceeding are requested to submit with each argument: (1) a statement of the issue; and (2) a brief summary of the argument.
Freshwater Crawfish Tail Meat From the People's Republic of China: Initiation of Antidumping Duty New Shipper Reviews
The Department of Commerce (``Department'') has received timely requests to conduct new shipper reviews of the antidumping duty order on freshwater crawfish tail meat from the People's Republic of China (``PRC''). In accordance with 19 CFR 351.214(d), we are initiating reviews for Nanjing Merry Trading Co., Ltd. (Nanjing Merry), Leping Lotai Foods Co., Ltd. (Leping Lotai), and Weishan Hongrun Aquatic Food Co., Ltd. (Weishan Hongrun).
Notice of Final Results of Antidumping Duty Changed-Circumstances Review: Ball Bearings and Parts Thereof from Japan
On March 23, 2006, the Department of Commerce (the Department) published a notice of initiation and the preliminary results of its changed-circumstances review of the antidumping duty order on ball bearings and parts thereof from Japan in which it preliminarily determined that JTEKT Corporation is the successor-in-interest to Koyo Seiko Company, Ltd., and that, as such, JTEKT is entitled to the cash- deposit rate of Koyo Seiko Company, Ltd., with respect to entries of subject merchandise. We gave interested parties the opportunity to comment on our preliminary results. We received no comments. Therefore, for these final results, the Department is adopting its preliminary determination that JTEKT Corporation is the successor-in-interest to Koyo Seiko Company, Ltd.
Certain Frozen Warmwater Shrimp from the People's Republic of China: Notice of Postponement of Time Limits for New Shipper Antidumping Duty Reviews in Conjunction with Administrative Review
On April 14, 2006, in accordance with 19 C.F.R. 351.214(j)(3), Hai Li Aquatic Co., Ltd. Zhao An, Fujian (``Hai Li'') agreed to waive the time limits in section 351.214(i) of the Department of Commerce's (``the Department'') regulations so that the Department may conduct the new shipper review of certain frozen warmwater shrimp from the People's Republic of China (``PRC''), for the period July 16, 2004, through January 31, 2006, concurrently with the administrative review for the same period. Therefore, pursuant to Hai Li's request, and in accordance with the Department's regulations, we will conduct the administrative and new shipper review concurrently.
Ball Bearings and Parts Thereof from Japan and Singapore; Five-year Sunset Reviews of Antidumping Duty Orders; Final Results
On June 1, 2005, the Department of Commerce (the Department) initiated sunset reviews of the antidumping duty orders on ball bearings from Japan and Singapore. See Initiation of Five-year (Sunset) Reviews, 70 FR 31423 (June 1, 2005). On the basis of a notice of intent to participate and adequate substantive responses filed on behalf of the interested parties, the Department conducted full (240-day) sunset reviews pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act), and 19 CFR 351.218(e)(2)(i). As a result of these sunset reviews, the Department finds that revocation of the antidumping duty orders would likely lead to continuation or recurrence of dumping at the levels listed below in the section entitled ``Final Results of Reviews.'' Based on our analysis of the comments we received, we find that it is appropriate to report a more recently calculated margin to the International Trade Commission for certain respondents.

On the basis of the notice of intent to participate and adequate substantive responses filed on behalf of the domestic interested parties, and no responses from respondent interested parties, the Department conducted expedited sunset reviews. As a result of these sunset reviews, the Department finds that revocation of the antidumping duty orders would likely lead to continuation or recurrence of dumping at the levels listed below in the section entitled ``Final Results of Reviews.''
Fresh Garlic from the People's Republic of China: Final Results and Partial Rescission of Antidumping Duty Administrative Review and Final Results of New Shipper Reviews
On November 18, 2005, the Department of Commerce (``the Department'') published the preliminary results of the administrative review and the preliminary results of the new shipper reviews of the antidumping duty order on fresh garlic from the People's Republic of China. The period of review is November 1, 2003, through October 31, 2004. The administrative review covers twenty-one exporters, and the new shipper reviews cover two exporters. We invited interested parties to comment on our preliminary results. We specifically invited comments on surrogate country selection for water valuation; however, no parties submitted comments on this issue.\1\ Based on our analysis of the comments received, we have made certain changes to our calculations. The final dumping margins for these reviews are listed in the ``Final Results of the Reviews'' section below.
Honey from Argentina: Final Results, Partial Rescission of Antidumping Duty Administrative Review and Determination Not to Revoke in Part
On December 28, 2005, the Department of Commerce (the Department) published its Preliminary Results and Partial Rescission of Antidumping Duty Administrative Review and Intent Not to Revoke in Part, 70 FR 76766 (December 28, 2005) (Preliminary Results). This administrative review covers two exporters, Seylinco S.A. (Seylinco) and Asociacion de Cooperativas Argentinas (ACA), of subject merchandise to the United States during the period of review (POR) of December 1, 2003, to November 30, 2004. The petitioners involved this review are the Sioux Honey Association and the American Honey Producers Association (Petitioners). We are rescinding the review with respect to Nutrin S.A. (Nutrin), Radix S.A. (Radix), Compania Europea Americana S.A. (CEASA) and HoneyMax S.A. (HoneyMax) because these companies had no entries of subject merchandise to the United States during the period of review. We have also determined not to revoke the antidumping duty order with respect to ACA. Based on our analysis of comments received, the margin calculations for these final results do not differ from the preliminary results.
Fresh Garlic from the People's Republic of China: Preliminary Results of 2004-2005 Semi-Annual New Shipper Reviews
In response to requests from Shandong Chengshun Farm Produce Trading Company, Ltd. (``Chengshun''), Shenzhen Fanhui Import and Export Co., Ltd. (``Fanhui''), Qufu Dongbao Import and Export Trade Co., Ltd. (``Dongbao''), and Anqiu Friend Food Co., Ltd. (``Anqiu Friend''), the U.S. Department of Commerce (``the Department'') is conducting new shipper reviews of the antidumping duty order on fresh garlic from the People's Republic of China (``PRC''). The period of review (``POR'') is November 1, 2004, through April 30, 2005. We preliminarily determine that none of these companies have made sales in the United States at prices below normal value. If these preliminary results are adopted in our final results of this review, we will instruct U.S. Customs and Border Protection (``CBP'') to assess antidumping duties on entries of subject merchandise during the POR for which the importer-specific assessment rates are above de minimis. We invite interested parties to comment on these preliminary results. Parties who submit comments are requested to submit with each argument a statement of the issue and a brief summary of the argument. We will issue the final results no later than 90 days from the date of publication of this notice.

The Secretary of Commerce issued an Export Trade Certificate of Review to Aires Group, Ltd., on July 10, 1984. Because this Certificate Holder has failed to file an annual report as required by law, the Secretary is revoking the certificate. Notice of Preliminary Results of Antidumping Duty New Shipper Review: Certain Welded Carbon Steel Pipe and Tube from Turkey
In response to a request by the respondent, Toscelik Profil ve Sac Endustrisi A.S., Toscelik Metal Ticaret A.S., and its affiliated export trading company, Tosyali Dis Ticaret A.S., (collectively, ``Toscelik''), the Department of Commerce (``the Department'') is conducting a new shipper review of the antidumping duty order on certain welded carbon steel pipe and tube (``welded pipe and tube'') from Turkey. This review covers one producer/exporter of the subject merchandise, Toscelik. We preliminarily determine that Toscelik did not make sales below normal value (``NV''). If these preliminary results are adopted in our final results, we will instruct U.S. Customs and Border Protection (``CBP'') to assess antidumping duties based on the difference between the export price (``EP'') and the NV.
Stainless Steel Sheet and Strip in Coils From Japan; Final Rescission of Antidumping Duty Administrative Review
On February 13, 2006, the Department of Commerce (the Department) published in the Federal Register a notice announcing the preliminary rescission of the administrative review of the antidumping duty order on stainless steel sheet and strip in coils (SSSSC) from Japan. See Stainless Steel Sheet and Strip in Coils from Japan: Preliminary Rescission of Antidumping Duty Administrative Review, 71 FR 7522 (February 13, 2006) (Preliminary Rescission). The period of review (POR) is July 1, 2004, to June 30, 2005. We are rescinding this review because there were no entries of SSSSC for consumption in the United States during the POR that are subject to review.
Notice of Scope Rulings
The Department of Commerce (the Department) hereby publishes a list of scope rulings completed between January 1, 2006, and March 31, 2006. In conjunction with this list, the Department is also publishing a list of requests for scope rulings and anticircumvention determinations pending as of March 31, 2006. We intend to publish future lists after the close of the next calendar quarter.

The Department of Commerce (``the Department'') has received a request to conduct a new shipper review of the countervailing duty (``CVD'') order on certain welded carbon steel standard pipe from Turkey. In accordance with section 751(a)(2)(B) of the Tariff Act of 1930, as amended (``the Act''), and 19 CFR 351.214, we are initiating a CVD new shipper review for Tos[ccedil]elik Profil ve Sac Endustrisi A.S. Initiation of Five-Year (“Sunset”) Reviews
In accordance with section 751(c) of the Tariff Act of 1930, as amended (``the Act''), the Department of Commerce (``the Department'') is automatically initiating a five-year (``Sunset Review'') of the antidumping duty order listed below. The International Trade Commission (``the Commission'') is publishing concurrently with this notice its notice of Institution of Five-Year Review which covers these same order.
Initiation of Antidumping and Countervailing Duty Administrative Reviews
The Department of Commerce (the Department) has received requests to conduct administrative reviews of various antidumping and countervailing duty orders and findings with March anniversary dates. In accordance with the Department's regulations, we are initiating those administrative reviews. The Department also received requests to revoke in part one antidumping duty order and three countervailing duty orders.
Partial Rescission of Antidumping Duty Administrative Review: Certain Hot-Rolled Carbon Steel Flat Products from Thailand
In response to a request by United States Steel Corporation (petitioner) and Nucor Corporation (Nucor), a domestic interested party, the U.S. Department of Commerce (the Department) initiated an administrative review of the antidumping duty order on certain hot- rolled carbon steel flat products from Thailand with respect to Sahaviriya Steel Industries Public Company Limited (SSI) and Nakornthai Strip Mill Public Co., Ltd. (NSM).\1\ No other interested party requested a review with respect to SSI. The period of review is November 1, 2004, through October 31, 2005. On March 22, 2006, petitioner and Nucor withdrew their request for an administrative review of SSI. Accordingly, the Department is now rescinding the administrative review of SSI, while continuing the review with respect to NSM.
Hand Trucks and Certain Parts Thereof from The People's Republic of China: Notice of Decision of the Court of International Trade Not in Harmony
On March 8, 2006, the United States Court of International Trade (``Court'') sustained the final remand determination made by the Department of Commerce (``the Department'') pursuant to the Court's remand of the scope of the antidumping duty order on hand trucks from the People's Republic of China (``PRC''). See Vertex International, Inc., v. United States, Ct. No. 05-00272, Slip Op. 06-35 (Ct. Int'l Trade March 8, 2006) (``Vertex II''). This case arises out of the Department's Antidumping Duty Order on Hand Trucks and Certain Parts Thereof from the People's Republic of China, 69 FR 70122 (December 2, 2004) (``Order''). The final judgment in this case was not in harmony with the Department's February 2005 Final Scope Ruling.
Wooden Bedroom Furniture from The People's Republic of China: Notice of Court Decision Not in Harmony
On April 5, 2006, the United States Court of International Trade (``Court'') sustained the final remand determination made by the Department of Commerce (``the Department'') pursuant to the Court's remand of the amended final determination of the investigation of wooden bedroom furniture from the People's Republic of China. See Guangzhou Maria Yee Furnishings Ltd., et. al. v. United States, Ct. No. 05-00065, Slip Op. 06-44 (Ct. Int'l Trade April 5, 2006) (``Maria Yee Remand II''). This case arises out of the Department's Final Determination of Sales at Less Than Fair Value: Wooden Bedroom Furniture From the People's Republic of China, 69 FR 67313 (November 17, 2004), as amended, 70 FR 329 (January 4, 2005) (``Final Determination''). The final judgment in this case was not in harmony with the Department's Final Determination.
Porcelain-on-Steel Cooking Ware from the People's Republic of China: Notice of Final Results of Antidumping Duty Administrative Review
On December 22, 2005, the Department of Commerce (``the Department'') published the preliminary results of its administrative review of the antidumping duty order on porcelain-on-steel cooking ware from the People's Republic of China (``PRC''). See Porcelain-on-Steel Cooking Ware from the People's Republic of China: Notice of Preliminary Results of Antidumping Duty Administrative Review, 70 FR 76027 (``Preliminary Results''). Based on our analysis of the record, including comments received since the preliminary results, we have made no changes to the preliminary results. Therefore, the final results do not differ from the preliminary results. See Final Results of Review section, below.
Stainless Steel Wire Rod from Italy: Notice of Final Results of Changed Circumstances Antidumping Duty Review
On March 20, 2006, the Department of Commerce (the Department) published a notice of initiation and preliminary results of its changed circumstances review of the antidumping duty order on stainless steel wire rod (SSWR) from Italy. See Notice of Initiation and Preliminary Results of Changed Circumstances Antidumping Duty Review: Stainless Steel Wire Rod from Italy, 71 FR 13964 (Mar. 20, 2006) (Preliminary Results). We have now completed that review. For these final results, as in the Preliminary Results, we determine that: 1) Acciaierie Valbruna S.p.A. (Valbruna S.p.A.) is the successor-in-interest to Acciaierie Valbruna S.r.l. (Valbruna S.r.l.) and its subsidiary Acciaierie Bolzano S.p.A. (Bolzano S.p.A.), a respondent in the less- than-fair-value investigation; and 2) merchandise from Acciaierie Valbruna S.p.A. should be excluded from the antidumping duty order.
Notice of Initiation of New Shipper Antidumping Duty Review: Stainless Steel Bar from Germany
The Department of Commerce (``the Department'') has received a request for a new shipper review of the antidumping duty order on Stainless Steel Bar (``SSB'') from Germany published on March 7, 2002 (67 FR 10382). In accordance with section 751(a)(2)(B) of the Tariff Act of 1930, as amended (``the Act''), and 19 CFR 351.214(d), we are initiating an antidumping new shipper review of Schmiedewerke Groditz GmbH (``SWG'').
Environmental Technologies Trade Advisory Committee (ETTAC)
The Environmental Technologies Trade Advisory Committee (ETTAC) will hold a plenary meeting on May 12, 2006, at the U.S. Department of Commerce, 14th Street and Constitution Avenue, NW., Washington, DC 20230, in Room 3407. The ETTAC will discuss the Asia Pacific Partnership on Clean Development and Climate, updated negotiations in the World Trade Organization's environmental goods and services trade liberalization, the Chinese market for environmental technologies, and an update on the recent Asia Pacific Environmental Technologies Trade Mission, among other administrative committee priority items. The meeting is open to the public and time will be permitted for public comment. Written comments concerning ETTAC affairs are welcome anytime before or after the meeting. Minutes will be available within 30 days of this meeting. The ETTAC is mandated by Public Law 103-392. It was created to advise the U.S. government on environmental trade policies and programs, and to help it to focus its resources on increasing the exports of the U.S. environmental industry. ETTAC operates as an advisory committee to the Secretary of Commerce and the Trade Promotion Coordinating Committee (TPCC). ETTAC was originally chartered in May of 1994. It was most recently rechartered until May 30, 2006.
