Civil Monetary Penalties Annual Inflation Adjustments
As required by the Federal Civil Penalties Inflation Adjustment Act of 1990, the Federal Election Commission is adjusting for inflation the civil monetary penalties established under the Federal Election Campaign Act, the Presidential Election Campaign Fund Act, and the Presidential Primary Matching Payment Account Act. The civil monetary penalties being adjusted are those negotiated by the Commission or imposed by a court for certain statutory violations, and those imposed by the Commission for late filing of or failure to file certain reports required by the Federal Election Campaign Act. The adjusted civil monetary penalties are calculated according to a statutory formula and the adjusted amounts will apply to penalties assessed after the effective date of these rules.
Technological Modernization
The Federal Election Commission requests comment on proposed changes to its regulations to address contributions and expenditures that are made by electronic means, such as through internet-based payment processors or text messaging; to eliminate and update references to outdated technologies; and to address similar issues. The Commission has not made any final decisions about the issues and proposals presented in this rulemaking.
Internet Communication Disclaimers; Reopening of Comment Period and Notice of Hearing
On October 13, 2011, the Federal Election Commission published an Advance Notice of Proposed Rulemaking (``ANPRM'') seeking comment on whether to begin a rulemaking to revise its regulations concerning disclaimers on certain internet communications and, if so, on what changes should be made to those rules. The Commission has decided to reopen the comment period to receive additional comments in light of legal and technological developments since that notice was published. The Commission is also announcing a public hearing.
Rulemaking Petition: Political Party Rules
On June 15, 2016, the Federal Election Commission received a Petition for Rulemaking asking the Commission to revise existing rules regarding the use of federal funds to pay for certain activities of state, district, or local committees of a political party. The Commission seeks comments on this petition.
Rulemaking Petition: Implementing the Consolidated and Further Continuing Appropriations Act, 2015
The Federal Election Commission has received a Petition for Rulemaking that asks the Commission to amend its regulations to implement amendments to the Federal Election Campaign Act made by the Consolidated and Further Continuing Appropriations Act, 2015, which established certain new accounts for national party committees. The petition also asks the Commission to amend its regulations regarding convention committees. The Commission seeks comments on this petition.
Filing Dates for the Kentucky Special Election in the 1st Congressional District
Kentucky has scheduled a special general election on November 8, 2016, to fill the U.S. House of Representatives seat in the 1st Congressional District vacated by Representative Ed Whitfield. Committees required to file reports in connection with the Special General Election on November 8, 2016, shall file a 12-day Pre-General Report, and a 30-day Post-General Report.
Filing Dates for the Hawaii Special Election in the 1st Congressional District
Hawaii has scheduled a special general election on November 8, 2016, to fill the U.S. House of Representatives seat in the 1st Congressional District of the late Representative Mark Takai. Committees required to file reports in connection with the Special General Election on November 8, 2016, shall file a 12-day Pre-General Report, and a 30-day Post-General Report.
Filing Dates for the Ohio Special Democratic Primary Election in the 8th Congressional District
Ohio has scheduled a special primary election on September 13, 2016, to fill the vacancy on the November 8, 2016, general election ballot that was created by the withdrawal of the Democratic nominee Corey Foister. Committees required to file reports in connection with the Special Primary Election on September 13, 2016, shall file a 12-day Pre-Primary Report.
Disclosure of Certain Documents in Enforcement and Other Matters
The Commission is adopting a policy with respect to placing certain documents on the public record in enforcement, administrative fines, and alternative dispute resolution cases, as well as administrative matters. Committees required to file reports in connection with the Special General Election on November 8, 2016, shall file a 12-day Pre-General Report, and a 30-day Post-General Report.
