The FAA proposes to supersede Airworthiness Directive (AD) 2022-09-18, which applies to all The Boeing Company Model 707, 717, and 727 airplanes; Model DC-8, DC-9, and DC-10 airplanes; Model MD-10 and MD-11 airplanes; Model DC-9-81 (MD-81), DC-9-82 (MD-82), DC-9-83 (MD- 83), DC-9-87 (MD-87), and MD-88 airplanes; and Model MD 90-30 airplanes. AD 2022-09-18 requires revising the limitations and operating procedures sections of the existing airplane flight manual (AFM) to incorporate specific operating procedures for, depending on the airplane model, instrument landing system (ILS) approaches, non-precision approaches, ground spoiler deployment, and go-around and missed approaches, when in the presence of 5G C Band interference as identified by Notices to Air Missions (NOTAMs). Since the FAA issued AD 2022-09-18, the FAA determined that additional limitations are needed due to the continued deployment of new 5G C-Band base stations whose signals are expected to cover most of the contiguous United States at transmission frequencies between 3.7- 3.98 GHz. This proposed AD would require revising the limitations and operating procedures sections of the AFM to incorporate specific operating procedures for, depending on the airplane model, ILS approaches, non-precision approaches, ground spoiler deployment, and go-around and missed approaches, due to the presence of 5G C-Band interference. The FAA is proposing this AD to address the unsafe condition on these products.

Procedures for Transportation Workplace Drug and Alcohol Testing Programs: Addition of Oral Fluid Specimen Testing for Drugs

This final rule amends the U.S. Department of Transportation's regulated industry drug testing program to include oral fluid testing. This additional methodology for drug testing will give employers a choice that will help combat employee cheating on urine drug tests and provide a less intrusive means of achieving the safety goals of the program. In order for an employer to implement oral fluid testing under the Department's regulation, the U.S. Department of Health and Human Services will need to certify at least two laboratories for oral fluid testing, which has not yet been done. The final rule includes other provisions to update the Department's regulation and to harmonize, as needed, with the Mandatory Guidelines for Federal Workplace Drug Testing Programs using Oral Fluid established by the U.S. Department of Health and Human Services. In addition, this rule amends the FAA, FMCSA, FRA and FTA regulations to ensure consistency within the Department of Transportation and by removing or adjusting references to the word ``urine'' and/or add references to oral fluid, as well as removing or amending some definitions for conformity and to make other miscellaneous technical changes or corrections.

The FAA invites public comments from interested individuals, entities, and other parties to review four key considerations of its civil aviation noise policy, in the context of noise metrics and noise thresholds. The civil aviation noise policy sets forth how the FAA analyzes, explains, and publicly presents changes in noise exposure from aviation activity: recreational and commercial fixed wing airplanes, helicopters, commercial space transportation vehicles, unmanned aircraft systems, as well as emerging technology vehicles (newer types of vehicles that will operate in U.S. airspace). The FAA will consider how changes to the civil aviation noise policy may better inform agency decisionmaking, the types of impacts it considers in making decisions (e.g., community annoyance, certain types of adverse health impacts highly correlated with aviation noise exposure), and potential improvements to how the FAA analyzes, explains, and presents changes in exposure to civil aviation noise.

The Federal Register Notice with a 60-day comment period soliciting comments on the following collection of information was published on January 6, 2023 (88 FR 91105). The FAA proposes renewal of the collection of information related to requests made under 14 CFR part 107 to operate small Unmanned Aircraft Systems (UAS) in controlled airspace. FAA will use the collected information to make determinations whether to authorize or deny the requested operation of UAS in controlled airspace. The proposed information collection is necessary to issue such authorizations or denials consistent with the FAA's mandate to ensure safe and efficient use of national airspace. The FAA is adopting a new airworthiness directive (AD) for certain Pratt & Whitney Canada Corporation (P&WC) PW308A and PW308C model turbofan engines. This AD is prompted by a manufacturer's design review, which identified that the combustion chamber outer case (CCOC) to rear compressor case (RCC) flange bolt low cycle fatigue life was inadequate and that those flange bolts may develop cracks resulting in flange bolt fracture. This AD requires replacing all CCOC flange bolts and modifying the CCOC and inner bypass ducts. This AD also prohibits installation of certain flange bolts on any affected engine, as specified in a Transport Canada AD, which is proposed for incorporation by reference (IBR). The FAA is issuing this AD to address the unsafe condition on these products.

This proposed AD would require replacing the affected fuel pump on at least one engine before further flight and replacing all affected fuel pumps within a specified compliance time, and would also prohibit installing any affected engine onto any airplane or any affected fuel pump onto any engine, as specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference (IBR). Airworthiness Directives; Airbus SAS Airplanes

The FAA proposes to supersede Airworthiness Directive (AD) 2021-16-18, which applies to all Airbus SAS Model A330-200 Freighter, A330-200, A330-300, A330-800, A330-900, A340-200, A340-300, A340-500, and A340-600 series airplanes. AD 2021-16-18 requires repetitive inspections of certain fuel pumps for cavitation erosion, replacement if necessary, revision of the existing operator's minimum equipment list (MEL), and accomplishment of certain maintenance actions related to defueling and ground fuel transfer operations. Since the FAA issued AD 2021-16-18, new, more erosion resistant pumps were developed and the FAA determined that affected fuel pumps must be replaced with new, more erosion resistant pumps. This proposed AD would continue to require the actions in AD 2021-16-18 and would require replacement of affected parts, which would terminate the repetitive inspections, as specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference. This proposed AD would also prohibit the installation of certain affected parts. The FAA is proposing this AD to address the unsafe condition on these products.

Airworthiness Directives; Airbus Helicopters

The FAA proposes to supersede Airworthiness Directive (AD) 2021-05-03, which applies to certain Airbus Helicopters Model EC225LP helicopters. AD 2021-05-03 requires various inspections of a certain part-numbered left-hand (LH) engine fuel supply (fuel supply) hose and depending on the inspection results, reinstalling or removing the fuel supply hose from service. AD 2021-05-03 also requires installing an improved part and prohibits installing an affected fuel supply hose on any helicopter unless it is installed by following certain procedures. Since the FAA issued AD 2021-05-03, there were reports of difficulties using an adjusting tool to install the improved fuel supply hose. This proposed AD would continue to require the actions of 2021-05-03 and expand the applicability, expand the parts installation limitations, and require using an improved adjusting tool and updated procedures. This proposed AD would also update certain compliance times and clarify certain requirements. The FAA is proposing this AD to address the unsafe condition on these products.

The U.S. Department of Transportation's Federal Aviation Administration (FAA) announces the opportunity to apply for an estimated $1.5 billion in fiscal year (FY) 2023 discretionary grants under the Airport Improvement Program (AIP). The FAA awards these annually appropriated discretionary funds through the FAA's long- standing iterative, competitive grant process. Prior to the publication of this Notice of Funding Opportunity (NOFO), the FAA identified eligible applicants in its National Plan of Integrated Airport Systems (NPIAS) and compiled potentially eligible projects through the 3-year Airports Capital Improvement Plan (ACIP). Both of these processes are described in FAA Order 5090.5, ``Formulation of NPIAS and ACIP,'' which authorizes discretionary funds. The AIP funds airport capital improvements and rehabilitation projects. All discretionary grant funding is subject to appropriations, statutory requirements, and related program funding availability.
