Approval and Promulgation of Plans for Designated Facilities; New Jersey; Delegation of Authority

The Environmental Protection Agency (EPA) is proposing to approve a request from the New Jersey Department of Environmental Protection (NJDEP) for the delegation of authority to implement and enforce the Federal Plan Requirements for Municipal Solid Waste (MSW) landfills that commenced construction on or before July 17, 2014, and have not been modified or reconstructed since July 17, 2014 (Federal Plan). On November 21, 2023, the NJDEP Assistant Commissioner signed a memorandum of agreement (MoA) concerning the delegation of authority of the Federal Plan to NJDEP by the EPA. Subsequently, on November 28, 2023, the MoA became effective upon the EPA Region 2 Administrator's signature. The Federal plan addresses the implementation and enforcement of the emission guidelines applicable to existing MSW landfills located in areas not covered by an approved and currently effective state plan. The Federal plan imposes emission limits and other control requirements for existing affected MSW landfills which will reduce designated pollutants. The purpose of this delegation is to transfer primary implementation and enforcement responsibilities from the EPA to NJDEP for existing sources of MSW landfills. This document informs the public of the MoA, provides a copy of the signed document, and proposes to amend regulatory text.

This draft Guidance highlights the available approaches for permitting combined sewer overflow (CSO) communities nearing completion of the projects and activities identified in their Long-Term Control Plan (LTCP). The draft Guidance summarizes options under the Clean Water Act (CWA) that are articulated in the 1994 Combined Sewer Overflow Control Policy and the option to use the EPA's 2012 Integrated Planning Framework to look holistically at future investments in controlling wastewater and stormwater discharges and improving water quality.

The Environmental Protection Agency (EPA) is approving a revision to the Missouri State Implementation Plan (SIP) related to municipal solid waste landfills in the St. Louis ozone nonattainment area. The revision to this rule includes incorporating by reference Emission Guidelines (EG) for Municipal Solid Waste (MSW) landfills. EPA is approving this SIP revision based on EPA's finding that the rule implements more stringent thresholds and do not impact the stringency of the SIP or have an adverse effect on air quality. The EPA's approval of this rule revision is being done in accordance with the requirements of the Clean Air Act (CAA).

The EPA and the States, through their designated State agencies, have determined that all appropriate response actions under CERCLA have been completed. Pursuant to the Federal Clean Air Act (CAA or the Act), the Environmental Protection Agency (EPA) is proposing to partially disapprove and partially approve State Implementation Plan (SIP) submissions from Arizona, Iowa, Kansas, New Mexico, and Tennessee regarding interstate transport for the 2015 8-hour ozone national ambient air quality standards (NAAQS). This action also proposes a Federal Implementation Plan (FIP) for Arizona, Iowa, Kansas, New Mexico, and Tennessee to address these States' obligations to eliminate significant contribution to nonattainment, or interference with maintenance, of the 2015 ozone NAAQS in other states. The FIP would require fossil fuel-fired power plants in the five states to participate in an allowance-based ozone season nitrogen oxides emissions trading program beginning in 2025. The Agency is also proposing to establish nitrogen oxides emissions limitations applicable to certain other industrial stationary sources in Arizona with a compliance year no earlier than 2027. Finally, this action also includes proposed technical corrections to the regulatory text previously promulgated to establish comparable FIP requirements for emissions sources in other states.

The Environmental Protection Agency (EPA) is amending the Toxic Substances Control Act (TSCA) regulations for polymers manufactured under the terms of the polymer exemption by extending the submission deadline for reporting. The regulations require that manufacturers (includes importers) of polymers manufactured under the terms of the exemption submit a report of manufacture or import by January 31 of the year subsequent to initial manufacture. On June 7, 2023, EPA amended the exemption reporting requirement to require that the exemption report and accompanying confidentiality claims be submitted electronically. Because EPA experienced technical difficulties with the launch of the new electronic reporting tool, EPA is extending the reporting period for 2024 from January 31 to March 31 to allow manufacturers additional time to submit their reports and accompanying claims to EPA using the electronic reporting tool.

The Environmental Protection Agency (EPA) is requesting comment on its plan to retroactively apply the approved modification of the Federal Equivalent Method (FEM) designation for the Teledyne Advanced Pollution Instrumentation Model T640 particulate matter (PM) mass monitor including the 640X option (hereafter T640 and T640X) to all of the PM with a diameter 2.5 micrometers or smaller (PM2.5) concentration data from the T640 and T640X monitors in the EPA's Air Quality System (AQS) that was reported prior to the modification. This update, which will be applied to the unmodified hourly PM2.5 concentration data in AQS using collocated ambient temperature when available, is expected to result in a much higher number of PM2.5 monitoring sites using the T640 and T640X FEM methods meeting the bias measurement quality objectives (MQOs). More details related to this update can be found in the document titled, ``Proposal to Update PM2.5 Data from T640/T640X PM Mass Monitors,'' located in the docket for this action and on the EPA's website at https://www.epa.gov/aqs/aqs-memos- monitoring-and-policy. On November 30, 2023, the Connecticut Department of Energy and Environmental Protection (CT DEEP) submitted to EPA the State's adopted regulatory amendments to the definition of ``severe non-attainment area for ozone'' for inclusion in the EPA-approved SIP and Title V Operating Permit Program. The revision is necessary to fully implement these programs based on a nonattainment reclassification to a portion of Connecticut for the 2008 ozone National Ambient Air Quality Standard. The Environmental Protection Agency (EPA or the Agency) is providing notice of our intent to redesignate portions of Westmoreland County and Cambria County, Pennsylvania, to ``nonattainment'' for the 2010 sulfur dioxide (SO2) national ambient air quality standard (NAAQS or standard). Westmoreland County is currently designated ``attainment/unclassifiable,'' and Cambria County is currently designated ``unclassifiable.'' EPA's intended redesignation of portions of these counties is based on modeled violations of the 2010 SO2 NAAQS. If the redesignation to nonattainment is finalized, the Commonwealth of Pennsylvania would be required to undertake certain planning requirements to reduce SO2 concentrations within this area, including, but not limited to, the requirement to submit within 18 months of redesignation a revision to the Pennsylvania state implementation plan (SIP) that provides for attainment of the SO2 standard as expeditiously as practicable, but no later than five years after the date of redesignation to nonattainment. Notice is hereby given that EPA has posted on our public electronic docket and internet website the intended redesignation for relevant portions of Westmoreland and Cambria counties, Pennsylvania under the 2010 SO2 NAAQS. The Agency invites the public to review and provide input on our intended redesignation during the comment period specified in the DATES section. Vestaron Corporation submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance for residues of the U1-AGTX-Ta1b-QA protein in and on all food commodities. This regulation eliminates the need to establish a maximum permissible level for residues of U1-AGTX-Ta1b-QA protein under FFDCA when used in accordance with this exemption.

The Environmental Protection Agency (EPA) has determined that pesticide products marketed in flexible packaging (e.g., pouches) 20 fluid ounces or less in size with labeling either directly recommending residential use or reasonably interpreted to permit residential use are subject to the Child Resistant Packaging (CRP) mitigation measures, regardless of acute toxicity requirements, based on the visual similarity of the packaging design to children's food products. As such, pesticide applicants and registrants must comply with CRP for this packaging type at the size limits specified when labeled for or reasonably interpreted to permit residential use and EPA will evaluate applications for new products or amendments to currently registered products submitted to EPA under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), as amended by the Pesticide Registration Improvement Act of 2022 (referred to as ``PRIA 5''). Changes to packaging to implement CRP measures on existing products must be submitted as described in this document to allow for CRP data review. Additionally, the Agency is including recommended labeling mitigation for all flexible packaging, regardless of packaging size and intended use site.

EPA has received a specific exemption renewal request from the Hawaii Department of Agriculture for use of the pesticide DQB Males (Wolbachia pipientis, DQB strain, contained in live adult Culex quinquefasciatus males), to treat up to 20,000 acres of State, Federal, and private wildlife conservation areas throughout the State of Hawaii to control Culex quinquefasciatus mosquitoes, a vector of avian malaria. The applicant proposes a new use of a microbial pesticide which has not been registered by EPA. Therefore, in accordance with the Code of Federal Regulations, EPA is soliciting public comment before making the decision whether to grant the exemption.

Definition of Hazardous Waste Applicable to Corrective Action for Releases From Solid Waste Management Units

This proposed rule would amend the definition of hazardous waste applicable to corrective action to address releases from solid waste management units at RCRA-permitted treatment, storage, and disposal facilities and make related conforming amendments, thereby providing clear regulatory authority to fully implement the Resource Conservation and Recovery Act (RCRA) statutory requirement that permitted facilities conduct corrective action to address releases not only of substances listed or identified as hazardous waste in the regulations but of any substance that meets the statutory definition of hazardous waste. The proposed rule would also provide notice of EPA's interpretation that the statutory definition of hazardous waste applies to corrective action for releases from solid waste management units at permitted and interim status facilities.
Listing of Specific PFAS as Hazardous Constituents

The Environmental Protection Agency (EPA or the Agency) is proposing to amend its regulation under the Resource Conservation and Recovery Act (RCRA) by adding nine specific per-and polyfluoroalkyl substances (PFAS), their salts, and their structural isomers, to its list of hazardous constituents. These nine PFAS are perfluorooctanoic acid (PFOA), perfluorooctanesulfonic acid (PFOS), perfluorobutanesulfonic acid (PFBS), hexafluoropropylene oxide-dimer acid (HFPO-DA or GenX), perfluorononanoic acid (PFNA), perfluorohexanesulfonic acid (PFHxS), perfluorodecanoic acid (PFDA), perfluorohexanoic acid (PFHxA), and perfluorobutanoic acid (PFBA). EPA's criteria for listing substances as hazardous constituents under RCRA require that they have been shown in scientific studies to have toxic, carcinogenic, mutagenic, or teratogenic effects on humans or other life forms. EPA reviewed and evaluated key toxicity and epidemiological studies and assessments for the nine PFAS to determine whether the available data for these PFAS meet the Agency's criteria for listing substances as hazardous constituents under RCRA. Based on EPA's evaluation, the above nine PFAS, their salts, and their structural isomers meet the criteria for being listed as RCRA hazardous constituents. As a result of this proposed rule, if finalized, when corrective action requirements are imposed at a facility, these PFAS would be among the hazardous constituents expressly identified for consideration in RCRA facility assessments and, where necessary, further investigation and cleanup through the RCRA corrective action process at RCRA treatment, storage, and disposal facilities.
South Dakota: Authorization of State Hazardous Waste Management Program Revisions and Incorporation by Reference

The Environmental Protection Agency (EPA) is proposing to grant authorization to the State of South Dakota for the changes to its hazardous waste program under the Solid Waste Disposal Act, as amended, commonly referred to as the Resource Conservation and Recovery Act (RCRA). The EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the State's changes through a direct final action which can be found in the ``Rules and Regulations'' section of this Federal Register. In addition, the EPA is proposing to codify in the regulations entitled ``Approved State Hazardous Waste Management Programs,'' South Dakota's authorized hazardous waste program. The EPA will incorporate by reference into the Code of Federal Regulations (CFR) those provisions of the State regulations that are authorized and that the EPA will enforce under RCRA.

The EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the State's changes through this direct final action. The EPA uses the regulations entitled, ``Approved State Hazardous Waste Management Programs'' to provide notice of the authorization status of State programs and to incorporate by reference those provisions of State statutes and regulations that will be subject to the EPA's inspection and enforcement. This rule also codifies in the regulations the approval of South Dakota's hazardous waste management program and incorporates by reference authorized provisions of the State's regulations.
Unregulated Contaminant Monitoring Rule; Methods Request and Webinar

The U.S. Environmental Protection Agency (EPA) is requesting public input on drinking water analytical methods for emerging contaminants in drinking water, particularly those listed on the agency's Fifth Contaminant Candidate List (CCL 5), that might support monitoring under the Unregulated Contaminant Monitoring Rule. This notice describes published drinking water analytical methods and EPA drinking water methods currently in development for the CCL and other emerging contaminants, with an expectation that some of these methods will support the sixth Unregulated Contaminant Monitoring Rule (UCMR 6) and/or other future cycles of the UCMR program. The agency is also announcing a virtual public meeting (via webinar) to discuss potential approaches to developing UCMR 6. The webinar will discuss the following: drinking water analytical methods and contaminants being considered, UCMR 6 sampling design, laboratory approval, and other potential aspects of the monitoring approach. The agenda will include time for brief remarks by participants who pre- register.

Air Quality Plans; Approvals and Promulgations: California; Amador Air District; New Source Review

The Environmental Protection Agency (EPA) is taking final action to approve a permitting rule submitted as a revision to the Amador Air District (AAD or ``District'') portion of the California State Implementation Plan (SIP). This revision concerns the District's New Source Review (NSR) permitting program for new and modified sources of air pollution under part D of Title I of the Clean Air Act (CAA or ``Act''). This action will update the District's applicable SIP with a rule revised to address deficiencies identified in a previous limited disapproval action by the EPA related to the District's NSR permitting program under Part D. This final approval action permanently terminates all sanctions, sanctions clocks, and federal implementation plan clocks triggered by our January 12, 2022 limited disapproval action. This action also finalizes regulatory text to clarify that Amador County is not subject to the Federal Implementation Plan related to protection of visibility.
