Designation of Areas for Air Quality Planning Purposes; Ohio; Redesignation of the Ohio Portion of the Steubenville Sulfur Dioxide Nonattainment Area
In accordance with the Clean Air Act (CAA), the Environmental Protection Agency (EPA) is redesignating the Ohio portion of the Steubenville Ohio-West Virginia interstate sulfur dioxide (SO2) nonattainment area (Steubenville nonattainment area) from nonattainment to attainment. EPA is also approving Ohio's maintenance plan. Emissions of SO2 in the area have been reduced and the air quality in the nonattainment area is currently well below the 2010 SO2 national ambient air quality standard (NAAQS).
Community Right-to-Know; Corrections to Toxics Release Inventory (TRI) Reporting Requirements
EPA is proposing corrections to existing regulatory language for the Toxics Release Inventory (TRI) Program. EPA is proposing corrections that will update identifiers, formulas, and names for certain TRI-listed chemicals and updates to the text that identifies which chemicals the 0.1 percent de minimis concentration applies to in order to remedy a cross-reference to a no-longer-accurate Occupational Safety and Health Administration (OSHA) regulatory citation. These proposed corrections maintain previous regulatory actions and do not alter existing reporting requirements or impact compliance burdens or costs.
North Dakota: Codification and Incorporation by Reference of Approved State Underground Storage Tank Program
This rule codifies in the regulations the prior approval of North Dakota's underground storage tank program and incorporates by reference approved provisions of the State's regulations. The Environmental Protection Agency (EPA) uses the regulations entitled, ``Approved Underground Storage Tank Programs,'' to provide notification of the approval status of State programs and to incorporate by reference into the Code of Federal Regulations (CFR) those provisions of the State's regulations that are approved and that the EPA will enforce under the Resource Conservation and Recovery Act (RCRA). The EPA previously provided notification and opportunity for comments on the Agency's decisions to approve the North Dakota underground storage tank program, and the EPA is not reopening the decisions, nor requesting comments, on the approval of the North Dakota program, as published in the Federal Register documents specified in Section I.C of this document.

Proposed Baseline Approval of the Remote-Handled Transuranic Waste Characterization Program Implemented at the Department of Energy's Sandia National Laboratories
The EPA is proposing to approve SNL's remote-handled transuranic waste characterization program based on the inspections conducted on June 24-25, 2014, and the offsite document review conducted April-July 2019. Until the Agency finalizes its baseline approval decision, the Carlsbad Field Office may not recertify SNL's waste characterization program and the site may not ship transuranic waste to the WIPP for disposal.
Air Plan Approval; Vermont; Reasonably Available Control Technology for the 2008 and 2015 Ozone Standards
The Environmental Protection Agency (EPA) is approving State Implementation Plan (SIP) revisions submitted by the State of Vermont. The SIP revision consists of a demonstration that Vermont meets the requirements of reasonably available control technology (RACT) for the two precursors for ground-level ozone, oxides of nitrogen (NOX) and volatile organic compounds (VOCs), set forth by the Clean Air Act (CAA or Act) with respect to the 2008 and 2015 ozone National Ambient Air Quality Standards (NAAQSs or standards). This action is being taken under the Clean Air Act.
Air Plan Approval; Connecticut; Regional Haze Five Year Progress Report
The Environmental Protection Agency (EPA) is approving the Connecticut Regional Haze 5-Year Progress Report submitted as a State Implementation Plan (SIP) revision on June 30, 2015. This revision addresses the requirements of the Clean Air Act and its implementing regulations that States submit periodic reports describing progress toward reasonable progress goals established for regional haze and a determination of adequacy of the State's existing regional haze SIP. Connecticut's progress report notes that Connecticut has made substantial progress toward the emissions reduction expected for the first regional planning period and that visibility in the Federal Class I areas affected by emission from Connecticut is improving and has already met the applicable reasonable progress goals for 2018. The EPA is approving Connecticut's determination that the State's regional haze SIP is adequate to meet these reasonable progress goals for the first implementation period, which extends through 2018, and requires no substantive revision at this time.

Approval of Air Quality Implementation Plans; New Jersey; Gasoline Vapor Recovery Requirements
The Environmental Protection Agency proposes to approve a revision to the New Jersey State Implementation Plan for ozone National Ambient Air Quality Standard which includes regulatory amendments relevant to the New Jersey Department of Environmental Protection's requirements for Stage I and Stage II vapor recovery systems at gasoline dispensing facilities: Upgrades to Stage I controls for tank breathing and refueling systems; decommissioning existing Stage II systems incompatible with onboard refueling vapor recovery systems on or before December 23, 2020 with a demonstration that such removal is consistent with the Clean Air Act and EPA Guidance; and allowing for continued use of existing onboard refueling vapor recovery-compatible Stage II systems if facilities maintain the systems, including compliance with required testing, to ensure proper working order. The amendments also require installation of enhanced conventional dripless nozzles and low permeation hoses as part of decommissioning existing Stage II systems or as maintenance. The intended effect of the amendments is to propose approval of New Jersey's revised vapor recovery regulations. New Jersey's comprehensive submittal also included changes in amendments for its air permitting program and t- butyl acetate emission reporting requirements, however, the EPA will be acting on these amendments under a separate action.
Air Plan Approval; AL and SC: Infrastructure Requirements for the 2015 8-Hour Ozone National Ambient Air Quality Standard
The Environmental Protection Agency (EPA) is proposing to approve portions of the Alabama and South Carolina State Implementation Plan (SIP) submissions provided on August 20, 2018 and September 7, 2018, respectively, for inclusion into their respective SIPs. This proposal pertains to the infrastructure requirements of the Clean Air Act (CAA or Act) for the 2015 8-hour ozone national ambient air quality standard (NAAQS). Whenever EPA promulgates a new or revised NAAQS, the CAA requires that each state adopt and submit a SIP for the implementation, maintenance and enforcement of each NAAQS promulgated by EPA. Alabama and South Carolina certified that their SIPs contain provisions that ensure the 2015 8-hour ozone NAAQS is implemented, enforced, and maintained in their State. EPA is proposing to determine that Alabama and South Carolina infrastructure SIP submissions satisfy certain required infrastructure elements for the 2015 8-hour ozone NAAQS.
Air Plan Approval; Alabama: Revisions to Cross-State Air Pollution Rule
The Environmental Protection Agency (EPA) is proposing to approve revisions to the Alabama State Implementation Plan (SIP), submitted by the State of Alabama, through the Alabama Department of Environmental Management (ADEM), via two letters dated August 27, 2018, and October 25, 2018. Protection of Stratospheric Ozone: Determination 35 for Significant New Alternatives Policy Program
This determination of acceptability expands the list of acceptable substitutes pursuant to the U.S. Environmental Protection Agency's (EPA) Significant New Alternatives Policy (SNAP) program. This action lists as acceptable additional substitutes for use in the refrigeration and air conditioning sector.
Air Plan Approval; Tennessee: Open Burning and Definitions Revisions for Chattanooga
The Environmental Protection Agency (EPA) is proposing to approve a revision to the Chattanooga portion of the Tennessee State Implementation Plan (SIP), provided by the State of Tennessee, through the Tennessee Department of Environment and Conservation (TDEC) from the Chattanooga/Hamilton County Air Pollution Control Bureau through a letter dated September 12, 2018. The submission revises the open burning regulations in the Chattanooga portion of the Tennessee SIP. EPA is proposing to approve the changes because they are consistent with the Clean Air Act (CAA or Act) and is also proposing to clarify its prior proposal related to the Bureau's definition of ``volatile organic compounds.''
Air Plan Approval; Iowa; Linn County; State Implementation Plan
The Environmental Protection Agency (EPA) is proposing to approve revisions to the Iowa State Implementation Plan (SIP) to include recent changes to the Linn County Code of Ordinances. The revisions include updating definitions and references to the effective dates the Federal rules were approved into the State's SIP, revising methods and procedures for performance test/stack test and continuous monitoring systems, and updating the Linn County permits program. These revisions will not adversely impact air quality and will ensure consistency between the state and federally approved rules.
Significant New Use Rules on Certain Chemical Substances (18-1)
EPA is issuing significant new use rules (SNURs) under the Toxic Substances Control Act (TSCA) for 22 chemical substances which are the subject of premanufacture notices (PMNs). The chemical substances are subject to Orders issued by EPA under TSCA. This action requires persons who intend to manufacture (defined by statute to include import) or process any of these chemical substances for an activity that is designated as a significant new use by this rule to notify EPA at least 90 days before commencing that activity. Persons may not commence manufacture or processing for the significant new use until EPA has conducted a review of the notice, made an appropriate determination on the notice, and has taken such actions as are required by that determination.

The Environmental Protection Agency (EPA) is approving State Implementation Plan (SIP) revisions submitted by the State of Georgia, through the Georgia Environmental Protection Division (GA EPD) of the Department of Natural Resources, in letters dated September 19, 2006, with a clarification submitted on November 6, 2006, and July 31, 2018. EPA is approving miscellaneous changes to several Georgia rules. This action is being finalized pursuant to the Clean Air Act (CAA or Act) and its implementing regulations.
Approval and Promulgation of State Plans for Designated Facilities and Pollutants; West Virginia; Control of Emissions From Existing Municipal Solid Waste Landfills
The Environmental Protection Agency (EPA) is approving a Clean Air Act (CAA) section 111(d) plan submitted by the West Virginia Department of Environmental Protection (WVDEP). This plan was submitted to fulfill the requirements of the CAA and in response to EPA's promulgation of Emissions Guidelines and Compliance Times for municipal solid waste (MSW) landfills. The West Virginia plan establishes emission limits for existing MSW landfills, and provides for the implementation and enforcement of those limits.
Air Plan Approval; Arizona; Maricopa County Air Quality Department
The Environmental Protection Agency (EPA) is taking final action to approve revisions to the Maricopa County Air Quality Department (MCAQD) portion of the Arizona State Implementation Plan (SIP). These revisions concern emissions of volatile organic compounds (VOCs) and particulate matter (PM) from brick and structural clay products manufacturing, rubber sports ball manufacturing, and vegetable oil extraction processes. We are approving the rescission of local rules that regulate these emission sources under the Clean Air Act (CAA or the Act).
Effluent Limitations Guidelines and Standards for the Steam Electric Power Generating Point Source Category
The Environmental Protection Agency (the EPA or the Agency) is proposing a regulation to revise the technology-based effluent limitations guidelines and standards (ELGs) for the steam electric power generating point source category applicable to flue gas desulfurization (FGD) wastewater and bottom ash (BA) transport water. This proposal is estimated to save approximately $175 million dollars annually in pre-tax compliance costs and $137 million dollars annually in social costs as a result of less costly FGD wastewater technologies that could be used with the proposed relaxation of the Steam Electric Power Generating Effluent Guidelines 2015 rule (the 2015 rule) selenium limitation; less costly BA transport water technologies made possible by the proposed relaxation of the 2015 rule's zero discharge limitations; a two-year extension of compliance timeframes for meeting FGD wastewater limits, and additional proposed subcategories for both FGD wastewater and BA transport water. EPA also believes that participation in the voluntary incentive program would further reduce the pollutants that these steam electric facilities discharge in FGD wastewater by approximately 105 million pounds per year.
Air Quality Designation; FL; Redesignation of the Duval County Ozone Unclassifiable Area
On June 19, 2019, the State of Florida, through the Florida Department of Environmental Protection (FDEP), submitted a request for the Environmental Protection Agency (EPA) to redesignate the Jacksonville, Florida ozone unclassifiable area (hereinafter referred to as the ``Duval County Area'' or ``Area'') to attainment for the 2015 primary and secondary 8-hour ozone national ambient air quality standards (NAAQS). EPA now has sufficient data to determine that the Duval County Area is in attainment of the 2015 primary and secondary 8- hour ozone NAAQS. EPA is approving the State's request and redesignating the Area to attainment/unclassifiable for the 2015 primary and secondary 8-hour ozone NAAQS based upon valid, quality- assured, and certified ambient air monitoring data showing that the Area is in compliance with the 2015 primary and secondary 8-hour ozone NAAQS.

The Environmental Protection Agency (EPA) is proposing to approve State Implementation Plan (SIP) revisions submitted by the State of Utah on January 4, 2016, which include revisions to Utah's Division of Administrative Rule (DAR) R307-110-10 and maintenance plans for the Salt Lake County, Utah County, and Ogden City nonattainment areas (NAAs) for particulate matter with an aerodynamic diameter less than or equal to a nominal 10 microns (PM10), and on March 6, 2019, which include PM10 redesignation requests and supplemental information for Salt Lake County, Utah County and Ogden City. These submittals demonstrate that the Salt Lake County, Utah County and Ogden City areas have attained the PM10 National Ambient Air Quality Standards (NAAQS), request redesignation to attainment and include maintenance plans for the areas demonstrating attainment for fifteen years. Also, the EPA is proposing approval of Utah's February 27, 2017 submittal, which includes rule revisions to address our October 19, 2016 conditional approval of Utah's DAR R307- 302 revisions that were submitted May 9, 2013, May 20, 2014, and September 8, 2015. Additionally, the EPA is proposing to approve SIP revisions submitted by the State of Utah on February 15, 2019, with additional non-substantive changes submitted on July 1, 2019, August 20, 2019, and October 15, 2019, which includes revisions that are located in DAR R307-110-17 and SIP Subsections IX.H.1-2. The EPA is taking this action pursuant to section 107, 110, and 175A of the Clean Air Act (CAA or the Act).
Approval and Promulgation of Air Quality Implementation Plans; District of Columbia; Negative Declaration for the Oil and Gas Control Techniques Guideline

Approval and Promulgation of Air Quality Implementation Plans; West Virginia; 2019 Amendments to West Virginia's Ambient Air Quality Standards
The Environmental Protection Agency (EPA) is proposing to approve a state implementation plan (SIP) revision submitted by the State of West Virginia. This revision updates the effective date of the national ambient air quality standards (NAAQS) and the associated monitoring reference and equivalent methods for those NAAQS that West Virginia incorporates by reference into its state regulations. This action is being taken under the Clean Air Act (CAA).
New Chemicals Program Implementation Under the Amended Toxic Substances Control Act (TSCA); Notice of Public Meeting
On December 10, 2019, EPA's Office of Chemical Safety and Pollution Prevention (OCSPP) will hold a public meeting to engage with interested stakeholders on the implementation of EPA's TSCA New Chemicals program, including: (1) An overview of EPA's updated ``Working Approach'' document that builds upon EPA's November 2017 ``New Chemicals Decision-Making Framework: Working Approach to Making Determinations under section 5 of TSCA''; (2) a demonstration of how EPA uses key concepts in the Working Approach to reach certain conclusions and/or make determinations under TSCA section 5(a)(3) using specific case examples; (3) an update on confidential business information (CBI) process improvements and clarifications; and (4) a discussion of EPA's ongoing efforts and progress to increase transparency. Interested stakeholders will have the opportunity at the meeting to provide their views on these topics, in addition to providing written feedback in the docket. Later in December 2019, EPA expects to announce the availability of the updated ``Working Approach'' document and provide opportunity for written public comment on the document. Feedback from the public meeting and comments received will help inform the Agency's ongoing efforts to improve policy and processes relating to the review of new chemicals under TSCA.
Pesticide Registration Review; Pesticide Dockets Opened for Review and Comment; Notice of Availability
This notice announces the availability of the EPA's preliminary work plans for the following chemicals: Pyrimethanil and saflufenacil. With this document, the EPA is opening the public comment period for registration review for these chemicals. This notice also announces the availability of EPA's draft ecological risk assessment for the pesticide pyrimethanil and opens a 60-day public comment period on the draft risk assessment. EPA is also announcing that it will not be opening a docket, nor conducting registration review for meptyldinocap.
Underground Injection Control Program; Hazardous Waste Injection Restrictions; Petition for Exemption Reissuance-Class I Hazardous Waste Injection; ExxonMobil Corporation Pasadena, Texas Facility
Notice is hereby given that a reissuance of an exemption to the Land Disposal Restrictions, under the 1984 Hazardous and Solid Waste Amendments to the Resource Conservation and Recovery Act, has been granted to ExxonMobil for two Class I hazardous waste injection wells located at their Pasadena, Texas facility. The company has adequately demonstrated to the satisfaction of the Environmental Protection Agency (EPA) by the petition reissuance application and supporting documentation that, to a reasonable degree of certainty, there will be no migration of hazardous constituents from the injection zone for as long as the waste remains hazardous. This final decision allows the underground injection by ExxonMobil of the specific restricted hazardous wastes identified in this exemption reissuance request, into Class I hazardous waste injection wells WDW-397 and 398 until December 31, 2040, unless the EPA moves to terminate this exemption. Additional conditions included in this final decision may be reviewed by contacting the EPA Region 6 Ground Water/UIC Section. There were two public comment periods for this decision because the newspaper failed to publish the first notice. They were 6/12-7/29/19 and 8/21-10/ 7/19 and no comments were received. This decision constitutes final Agency action and there is no Administrative appeal.
Air Plan Approval; California; Mojave Desert Air Quality Management District
The Environmental Protection Agency (EPA) is proposing to approve revisions to the Mojave Desert Air Quality Management District (MDAQMD) portion of the California State Implementation Plan (SIP). These revisions concern emissions of volatile organic compounds (VOCs) from organic liquid and gasoline transfer and storage operations. We are proposing to approve local rules to regulate these emission sources under the Clean Air Act (CAA or the Act). We are taking comments on this proposal and plan to follow with a final action.
Water Quality Trading Under the National Pollutant Discharge Elimination System Program; Extension of Comment Period
The Environmental Protection Agency (EPA) issued a document in the Federal Register of September 19, 2019, requesting comments on policy approaches for addressing ``baseline'' issues in the watersheds with EPA-approved Total Maximum Daily Loads (TMDLs) where policy makers would like to pursue water quality trading as a regulatory option for National Pollutant Discharge Elimination System (NPDES) permit compliance. These policy approaches may also be of interest to stakeholders pursuing market-based water quality improvement programs outside of the NPDES permit program. This document extends the comment period for an additional 30 days, from November 18, 2019 to December 18, 2019 in response to a stakeholder request.
Notice of Public Teleconferences
The EPA's Environmental Financial Advisory Board (EFAB) will hold two public teleconferences of the EFAB Stormwater Infrastructure Finance Taskforce, a workgroup of the EFAB. The purpose of the teleconferences is to continue development of a workgroup report on the availability of public and private sources of funding for the construction, rehabilitation, and operation and maintenance of stormwater infrastructure. The EFAB workgroup is developing its report to the EPA pursuant to Section 4101 of the America's Water Infrastructure Act of 2018.
Notice of Request for Nominations of Candidates to the Environmental Financial Advisory Board
The U.S. Environmental Protection Agency (EPA) invites nominations of qualified candidates to be considered for appointment to the Environmental Financial Advisory Board (EFAB or the Board). The Board provides advice to the EPA on ways to lower the costs of, and increase investments in, environmental and public health protection. Appointments will be made by the Administrator and will be announced in June 2020.
Significant New Use Rules on Certain Chemical Substances (17-3); Technical Correction
EPA issued a final rule in the Federal Register of September 18, 2019 for 19 chemical substances that were the subject of premanufacture notices (PMNs). For the chemical substance that was the subject of PMN P-17-170, EPA made several errors when including hazard communication requirements. Certain references are inconsistent with the hazards identified for this chemical substance by EPA. This document is being issued to correct these errors.
Air Plan Approval; Illinois; Emissions Reduction Market System Sunsetting
The Environmental Protection Agency (EPA) is approving a State Implementation Plan (SIP) revision submitted by the Illinois Environmental Protection Agency (Illinois EPA) on January 11, 2019, concerning the State's Emissions Reduction Market System (ERMS) program for the Chicago ozone nonattainment area (NAA) in Illinois. The revision sunsets the ERMS program and removes 35 Illinois Administrative Code (35 IAC) Part 205, from the SIP as the ERMS program is no longer effective in providing additional emissions reductions or environmental benefit. The submittal includes a demonstration under section 110(l) of the Clean Air Act (CAA) that addresses emission impacts associated with the sunsetting of the program.
Air Plan Approval; Ohio; Second Limited Maintenance Plans for 1997 Ozone NAAQS
Pursuant to the Clean Air Act (CAA), the Environmental Protection Agency (EPA) is approving as a revision to the Ohio State Implementation Plan (SIP), the State's plan for maintaining the 1997 ozone National Ambient Air Quality Standard (NAAQS or standard) through 2028. On April 12, 2019, the Ohio Environmental Protection Agency submitted the 1997 ozone NAAQS Limited Maintenance Plan (LMP) for the Canton-Massillon (Stark County), Lima (Allen County), and Toledo (Lucas and Wood Counties) areas and the Ohio portion of the Parkersburg- Marietta [OH-WV] (Washington County), Steubenville-Weirton [OH-WV] (Jefferson County), Wheeling [OH-WV] (Belmont County), and Youngstown- Warren-Sharon [OH-PA] (Columbiana, Mahoning, and Trumbull Counties) multi-state areas. The effect of this action makes certain commitments related to maintenance of the 1997 ozone NAAQS in these areas federally enforceable as part of the Ohio SIP.
Proposed Collection; Comment Request; Information Collection for Importation of On-Highway Vehicles and Motorcycles and Nonroad Engines, Vehicles, and Equipment; EPA ICR Number 2583.02, OMB Control Number 2060-0717
The Environmental Protection Agency (EPA) is planning to submit an Information Collection Request (ICR) ``Importation of On- highway Vehicles and Motorcycles and Nonroad Engines, Vehicles, and Equipment'' to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act. Before doing so, EPA is soliciting comments on specific aspects of the proposed information collection as described below. This is a proposed extension of the current ICR, which is approved through July 31, 2020. An agency may not conduct or sponsor, and a person is not required to respond to a collection of information unless it displays a currently valid OMB control number.
