NMFS has received an application from the Lamont-Doherty Earth Observatory (Lamont-Doherty) in collaboration with the National Science Foundation (NSF), for an Incidental Harassment Authorization (Authorization) to take marine mammals, by harassment only, incidental to conducting a marine geophysical (seismic) survey in the eastern Mediterranean Sea, mid-November through December, 2015. The proposed dates for this action would be mid-November 2015 through December 31, 2015, to account for minor deviations due to logistics and weather. Per the Marine Mammal Protection Act, we are requesting comments on our proposal to issue an Authorization to Lamont-Doherty to incidentally take, by Level B harassment, of 22 species of marine mammals during the specified activity and to incidentally take by Level A harassment, of four species of marine mammals. Although considered unlikely, any Level A harassment potentially incurred would be expected to be in the form of some smaller degree of permanent hearing loss due in part to the required monitoring measures for detecting marine mammals and required mitigation measures for power downs or shut downs of the airgun array if any animal is likely to enter the Level A exclusion zone. Neither mortality nor complete deafness of marine mammals are expected to result from this survey.

In January 2011, NMFS implemented the groundfish trawl rationalization program (a catch share program) for the Pacific coast groundfish limited entry trawl fishery. The program was implemented through Amendment 20 to the Pacific Coast Groundfish Fishery Management Plan and the corresponding implementing regulations. Amendment 20 established the trawl rationalization program, which includes an Individual Fishing Quota program for limited entry trawl participants. Under current regulations, quota share (QS) permit owners must divest quota share holdings that exceed accumulation limits by November 30, 2015. This proposed action would make minor procedural modifications to the program regulations to clarify how divestiture and revocation of excess quota share could occur in November, 2015, and establish procedures applicable in the future if divestiture becomes necessary.

This action serves as a notice that NMFS, on behalf of the Secretary of Commerce (Secretary), has found that the following four stocks of Pacific salmon are subject to overfishing: Chinook salmon Columbia River Basin: Upper River Summer; Chinook salmonWashington Coast: Willapa Bay Fall Natural; Chinook salmonWashington Coast: Grays Harbor Fall; and Coho salmonWashington Coast: Hoh. In addition, NMFS has found that the North Pacific swordfish stock in the Eastern Pacific Ocean, which is jointly managed by the Pacific Fishery Management Council and the Western Pacific Fishery Management Council, is subject to overfishing. NMFS, on behalf of the Secretary, notifies the appropriate fishery management council (Council) whenever it determines that overfishing is occurring, a stock is in an overfished condition, a stock is approaching an overfished condition, or when a rebuilding plan has not resulted in adequate progress toward ending overfishing and rebuilding affected fish stocks. None of these stocks is in an overfished condition.

As a science-based services agency, the National Oceanic and Atmospheric Administration (NOAA) strives to understand and predict changes in weather, climate, oceans, and coasts, and to provide critical environmental intelligence to the American public, decision makers, and our partners. NOAA accomplishes this, in part, through the use of observations obtained through a range of systems, including satellites, ships, ground, and in-situ networks. NOAA's space-based Earth observations are both important and challenging to obtain. In recent years, the commercial sector has invested increasing amounts of capital and resources to develop new technologies, and to build, launch, and operate satellites and ground- based systems. In order to respond to an ever-growing demand for environmental information, NOAA seeks to maintain an observing enterprise that is flexible, responsive to evolving technologies, and economically sustainable, while supporting and upholding NOAA's strong commitment to public safety and the international data sharing system upon which NOAA depends for global data. This policy establishes the broad principles for the use of commercial space-based approaches for NOAA's observational requirements, and opens a pathway for new industry to join the space- based Earth observation process. As a part of this effort, and to ensure we examine potential solutions, NOAA is seeking comments, suggestions, and innovative ideas from the public on Draft NOAA Commercial Space Policy. NMFS announces the availability of the ``Draft Programmatic Environmental Assessment (DPEA) for Fisheries Research Conducted and Funded by the Northwest Fisheries Science Center (NWFSC).'' Publication of this notice begins the official public comment period for this DPEA. The purpose of the DPEA is to evaluate, in compliance with the National Environmental Policy Act (NEPA), the potential direct, indirect, and cumulative impacts of conducting and funding fisheries and ecosystem research along the U.S. West Coast, including the Northern California Large Marine Ecosystem (NCLME), Puget Sound, and the Lower Columbia River Research Area (LCRRA).
