Civil Penalties
Pursuant to notices published on January 30, 2017 and March 28, 2017, the effective date of the rule entitled ``Civil Penalties,'' published in the Federal Register on December 28, 2016, at 81 FR 95489, was temporarily delayed until June 26, 2017 (82 FR 8694; 82 FR 15302). This action temporarily delays the effective date of that rule for 14 additional days.
Nissan North America, Inc., Receipt of Petition for Decision of Inconsequential Noncompliance
Nissan North America, Inc. (Nissan), has determined that certain model year (MY) 2016-2017 Nissan Titan Crew Cab motor vehicles do not fully comply with Federal Motor Vehicle Safety Standard (FMVSS) No. 201, Occupant Protection in Interior Impact. Nissan filed a noncompliance report dated April 24, 2017. Nissan also petitioned NHTSA on May 16, 2017, for a decision that the subject noncompliance is inconsequential as it relates to motor vehicle safety.
Spartan Motors USA, Inc., Grant of Petition for Decision of Inconsequential Noncompliance
Spartan Motors USA, Inc. (Spartan), has determined that certain model year (MY) 2017 Spartan Emergency Response Metro Star motor vehicles do not fully comply with Federal Motor Vehicle Safety Standard (FMVSS) No. 120, Tire selection and rims and motor home/ recreation vehicle trailer load carrying capacity information for motor vehicles with a GVWR of more than 4,536 kilograms (10,000 pounds). Spartan filed a noncompliance information report dated December 6, 2016. Spartan also petitioned NHTSA on January 4, 2017, for a decision that the subject noncompliance is inconsequential as it relates to motor vehicle safety.

Before a Federal agency can collect certain information from the public, it must receive approval from the Office of Management and Budget (OMB). Under procedures established by the Paperwork Reduction Act of 1995, before seeking OMB approval, Federal agencies must solicit public comment on proposed collections of information. Volkswagen Group of America, Inc., Grant of Petition for Decision of Inconsequential Noncompliance
Volkswagen Group of America, Inc. (Volkswagen), has determined that certain model year (MY) 2016 Volkswagen eGolf motor vehicles do not fully comply with Federal Motor Vehicle Safety Standard (FMVSS) No. 108, Lamps, reflective devices and associated equipment. Volkswagen filed a noncompliance report dated September 16, 2016. Volkswagen then petitioned NHTSA on September 16, 2016, for a decision that the subject noncompliance is inconsequential as it relates to motor vehicle safety.
Federal Motor Vehicle Safety Standards; Minimum Sound Requirements for Hybrid and Electric Vehicles
In accordance with the Presidential directive as expressed in the memorandum of January 20, 2017, from the Assistant to the President and Chief of Staff, entitled ``Regulatory Freeze Pending Review,'' this action temporarily delays until September 5, 2017, the effective date of the final rule titled ``Federal Motor Vehicle Safety Standards; Minimum Sound Requirements for Hybrid and Electric Vehicles,'' initially scheduled to become effective on February 13, 2017.
Cooper Tire & Rubber Company, Receipt of Petition for Decision of Inconsequential Noncompliance
Cooper Tire & Rubber Company (Cooper), has determined that certain Cooper Mastercraft Courser HSX Tour brand tubeless radial tires do not fully comply with Federal Motor Vehicle Safety Standard (FMVSS) No. 139, New Pneumatic Radial Tires for Light Vehicles. Cooper filed a noncompliance report dated April 12, 2017. Cooper also petitioned NHTSA on April 12, 2017, for a decision that the subject noncompliance is inconsequential as it relates to motor vehicle safety.
Arconic Wheel and Transportation Products, Receipt of Petition for Decision of Inconsequential Noncompliance
Arconic Wheel and Transportation Products, a business division of Arconic, Inc., formerly known as Alcoa, Inc. Alcoa, Inc. filed a noncompliance information report dated November 21, 2016. Arconic then petitioned NHTSA on December 5, 2016, for a decision that the subject noncompliance is inconsequential as it relates to motor vehicle safety.
