Record of Decision for the Cape Wind Energy Project; Secretary of the Interior's Response to Comments From the Advisory Council on Historic Preservation on the Cape Wind Energy Project
In accordance with the regulations implementing the National Environmental Policy Act of 1969 (NEPA), the MMS is announcing the availability of the ROD for the Cape Wind Energy Project (the Project). The ROD for the Project records the decisions that the MMS reached to select the Preferred Alternative at Horseshoe Shoal in Nantucket Sound described in its Final Environmental Impact Statement (January 2009). After careful consideration of all the concerns expressed during the lengthy review and consultation process and thorough analyses of the many factors involved, the Secretary approved the ROD finding that the public benefits weigh in favor of approving the Cape Wind Project at the Horseshoe Shoal location. The MMS will offer a commercial lease to Cape Wind Associates, LLC (CWA) in response to CWA's application. The CWA's rights to construct and operate the Project pursuant to the lease are subject to construction and operation approvals from the MMS. The Secretary of the Interior (the Secretary) and the Director of the MMS co-signed the ROD for the Project on April 28, 2010.

For gas produced from Indian tribal leases on the Uintah and Ouray Reservation (Reservation) in Utah, the Minerals Management Service (MMS) is terminating the exclusion from valuation under the regulations at 30 CFR 206.172, based on a request by the Ute Indian Tribe of the Uintah and Ouray Reservation.

Outer Continental Shelf (OCS) Mid-Atlantic Proposed Oil and Gas Lease Sale 220
This Notice serves to cancel scoping meetings and to postpone the comment period on scoping for Sale 220 until further notice. Three public scoping meetings that had been scheduled on May 12, 25, and 27, in the Federal Register (Vol. 75, No. 82, page 22623) to solicit information to assist MMS in preparing an EIS to evaluate potential environmental effects of proposed Lease Sale 220 are hereby cancelled. Also, the public scoping meeting scheduled for May 12, 2010, in Norfolk, Virginia, to solicit public input on both Sale 220 and the Geological & Geophysical Programmatic EIS on the Mid- and South Atlantic OCS (G&G PEIS) is hereby cancelled. This Notice does not affect the public scoping period for the G&G PEIS. The scoping period for that PEIS ends on May 17, 2010 (see 75 FR 16830).
Notice on Outer Continental Shelf Oil and Gas Lease Sales
Pursuant to the authority vested in the Director of the Minerals Management Service by the joint bidding provisions of 30 CFR 256.41, each entity within one of the following groups shall be restricted from bidding with any entity in any other of the following groups at Outer Continental Shelf oil and gas lease sales to be held during the bidding period May 1, 2010, through October 31, 2010. The List of Restricted Joint Bidders published in the Federal Register on November 23, 2009, covered the period November 1, 2009, through April 30, 2010.
Environmental Assessment Prepared for Proposed Cape Wind Energy Project in Nantucket Sound, Offshore Massachusetts
The MMS, in accordance with regulations implementing the National Environmental Policy Act (NEPA), announces the availability of an EA and FONNSI for the Cape Wind Energy Project proposed for Nantucket Sound, offshore Massachusetts. On January 16, 2009, the MMS announced the release of the Final Environmental Impact Statement (FEIS) for the Cape Wind Energy Project. The FEIS assessed the physical, biological, and social/human impacts of the proposed project and 13 alternatives, including a no-action alternative (i.e., the project is not built), and proposed mitigation.
Outer Continental Shelf (OCS) Mid-Atlantic Proposed Oil and Gas Lease Sale 220 and Geological and Geophysical Exploration (G&G) on the Mid- and South Atlantic OCS
This Notice serves to announce two actions, including: (1) The reopening of the public scoping period for proposed Lease Sale 220 in the Mid-Atlantic Planning Area for an additional 45 days and providing notice of the public scoping meeting dates and locations for this proposed sale; and (2) announcing an additional and separate scoping meeting on May 12, 2010, in Norfolk, Virginia which will solicit public input on both the proposed Lease Sale 220 and the G&G PEIS on the Mid- and South Atlantic OCS. This Notice does not extend the public scoping period for the G&G PEIS on the Mid- and South Atlantic OCS. The scoping period for that PEIS ends on May 17, 2010 (see 75 FR 16830).
Update of Revised and Reaffirmed Documents Incorporated by Reference
This final rule incorporates 21 revised editions and 17 reaffirmed editions of documents previously incorporated by reference in regulations governing oil and gas and sulphur operations in the Outer Continental Shelf. Additionally, this final rule will rectify an incorrect reference to American Petroleum Institute (API) 510. The revised and reaffirmed editions of these documents will ensure that lessees use the best and safest technologies available while operating in the Outer Continental Shelf.
Major Portion Prices and Due Date for Additional Royalty Payments on Indian Gas Production in Designated Areas Not Associated With an Index Zone
Final regulations for valuing gas produced from Indian leases, published August 10, 1999, require MMS to determine major portion prices and notify industry by publishing the prices in the Federal Register. The regulations also require MMS to publish a due date for industry to pay additional royalties based on the major portion prices. This notice provides major portion prices for the 12 months of calendar year 2008.

Commercial Leasing for Wind Power on the Outer Continental Shelf (OCS) Offshore Delaware-Request for Interest (RFI)
The Minerals Management Service (MMS) invites submissions describing interest in obtaining one or more commercial leases for the construction of a wind energy project(s) on the OCS offshore Delaware. The MMS will use responses to this RFI to enable MMS to gauge specific interest in commercial development of OCS wind resources in the area described, as required by 43 U.S.C. 1337(p)(3). Parties wishing to obtain a commercial lease for a wind energy project should submit detailed and specific information as described below in the section entitled, ``Required Indication of Interest Information.'' Also, with this announcement the MMS invites all interested and affected parties to comment and provide informationincluding information on environmental issues and concernsthat will be useful in the consideration of the area of interest for commercial wind energy leases.

Notice of Availability of the Proposed Notice of Sale (NOS) for Outer Continental Shelf (OCS) Oil and Gas Lease Sale 215 in the Western Planning Area (WPA) in the Gulf of Mexico (GOM)
The MMS announces the availability of the proposed NOS for proposed Sale 215 in the WPA. This Notice is published pursuant to 30 CFR 256.29(c) as a matter of information to the public. With regard to oil and gas leasing on the OCS, the Secretary of the Interior, pursuant to section 19 of the OCS Lands Act, provides the affected states the opportunity to review the proposed Notice. The proposed Notice sets forth the proposed terms and conditions of the sale, including minimum bids, royalty rates, and rentals.
Geological and Geophysical Exploration (G&G) on the Mid- and South Atlantic Outer Continental Shelf (OCS)
Pursuant to the regulations implementing the procedural provisions of the National Environmental Policy Act of 1969, as amended (42 U.S.C. 4321 et seq. (1988)) (NEPA), MMS will reopen the comment period for a period of 45 days from the date of this Federal Register notice. Public scoping meetings will be held during this 45-day period to solicit information that will be used to prepare a PEIS to evaluate potential environmental effects of multiple G&G activities on the Atlantic OCS. These activities are associated with Atlantic OCS siting for renewable energy projects, oil and gas exploration, and marine minerals extraction; these activities could take place over a period of several years. The purpose of the scoping meetings will be to receive comments on the scope of the PEIS, identify significant resources and issues to be analyzed in the PEIS, and identify possible alternatives to the proposed action.

On Wednesday, March 17, 2010, the Minerals Management Service (MMS) will open and publicly announce bids received for blocks offered in CPA Oil and Gas Lease Sale 213, pursuant to the OCS Lands Act (43 U.S.C. 1331-1356, as amended) and the regulations issued thereunder (30 CFR part 256). The Final NOS 213 Package contains information essential to bidders, and bidders are responsible for knowing the information within the documents contained in the Package.
Notice of Availability of the Revised Minerals Management Service Documentation of Section 106 Finding of Adverse Effect (Revised Finding) for the Proposed Cape Wind Energy Project Located on the Outer Continental Shelf (OCS) in Nantucket Sound, and the Opportunity for Public Comment
The MMS has prepared a revised version of its Section 106 Finding of Adverse Effect document related to the proposed Cape Wind Energy Project pursuant to implementing regulations for Section 106 of the National Historic Preservation Act (36 CFR Part 800). The original Finding of Adverse Effect for this project was dated January 29, 2009. The Finding of Adverse Effect is being revised in response to new information that five additional properties within the Area of Adverse Effect for the project have now been found to be eligible for inclusion in the National Register of Historic Places.

States' Decisions on Participating in Accounting and Auditing Relief for Federal Oil and Gas Marginal Properties
The Minerals Management Service (MMS) published final regulations on September 13, 2004 (69 FR 55076), codified at sections 204.200 through 204.215 of title 30 of the Code of Federal Regulations (CFR), to provide two types of accounting and auditing relief for Federal onshore or Outer Continental Shelf lease production from marginal properties. These regulations require MMS to publish in the Federal Register the decisions of the States concerned to allow or not allow one or both forms of relief allowed by the regulations. As required by the regulations, MMS provided States receiving a portion of the Federal royalties with a list of qualifying marginal Federal oil and gas properties located in the States so that each affected State could decide whether to participate in one or both relief options. For calendar year 2010, this notice provides the decisions by the States concerned to allow one or both types of relief.
Requirements for Subsurface Safety Valve Equipment
The MMS is incorporating by reference the Eleventh Edition of the American Petroleum Institute's Specification for Subsurface Safety Valve Equipment (API Spec 14A) into its regulations. The MMS is incorporating the Eleventh Edition of API Spec 14A because it updated the design validation and functional testing requirements, incorporated new design changes, and corrected ambiguous areas open to misinterpretation. These changes will ensure that lessees and operators use the best available and safest technologies while operating in the Outer Continental Shelf. The rule will also require that lessees and operators provide supporting design verification information for subsurface safety valves intended for use in high pressure high temperature environments.
Outer Continental Shelf Civil Penalties
The Outer Continental Shelf Lands Act requires the MMS to review the maximum daily civil penalty assessment for violations of regulations governing oil and gas operations in the Outer Continental Shelf at least once every 3 years. This review ensures that the maximum penalty assessment reflects any increases in the Consumer Price Index as prepared by the Bureau of Labor Statistics, U.S. Department of Labor. After conducting the required review in August 2009, the MMS determined that no adjustment is necessary at this time.
