Agency Information Collection Activities: Suspensions Pending Appeal and Bonding
In accordance with the Paperwork Reduction Act of 1995 (``PRA''), the Office of Natural Resources Revenue (``ONRR'') is proposing to revise a currently approved information collection to expand its scope to include the mineral estate underlying Osage County, Oklahoma (``Osage Mineral Estate''). Through this revision, ONRR seeks authority to collect information related to the paperwork requirements under the Bureau of Indian Affairs' (``BIA'') proposed regulations to post a surety or bond, or demonstrate financial solvency. ONRR uses forms ONRR-4435, ONRR-4436, and ONRR-4437 as part of these information collection requirements.

Civil Penalties Inflation Adjustments
This rule revises U.S. Department of the Interior regulations implementing the Native American Graves Protection and Repatriation Act to provide for annual adjustments of civil penalties to account for inflation under the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 and Office of Management and Budget guidance. The purpose of these adjustments is to maintain the deterrent effect of civil penalties and to further the policy goals of the underlying statute.
Modifications to the Bid Adequacy Procedures for Offshore Oil and Gas Lease Sales
The Bureau of Ocean Energy Management (BOEM) announces and invites comments on its intention to change its bid adequacy procedures (BAPs), which ensure the United States receives fair market value (FMV) from Outer Continental Shelf (OCS) oil and gas lease sales. BOEM proposes to discontinue the use of both tract classification and delayed valuation methodology. Instead, BOEM proposes to use a statistical lower bound confidence interval (LBCI), at the 90 percent confidence level, as a measure of bid adequacy. BOEM is also proposing other, minor adjustments to its BAPs to clarify and streamline its processes.
Candidate Conservation Agreement With Assurances for the Fisher in Oregon; Enhancement of Survival Permit Applications; Hampton and Starker Site Plans
We, the U.S. Fish and Wildlife Service (Service), received two enhancement of survival permit (permit) applications pursuant to the Endangered Species Act (ESA). If granted, the requested permits would authorize take of the fisher (Pekania pennanti), incidental to otherwise lawful activities, if the species becomes federally listed under the ESA. These applications are associated with a template candidate conservation agreement with assurances (CCAA) developed by the Service for the conservation of the fisher. We have also prepared draft environmental action statements documenting our preliminary determination that the permit decisions may be eligible for categorical exclusion under the National Environmental Policy Act. We provide this notice to open a public comment period and invite comments from all interested parties.
Natural Resource Damages for Hazardous Substances
The Office of Restoration and Damage Assessment (ORDA) is seeking comments and suggestions from state, tribal, and federal natural resource co-trustees, other affected parties, and the interested public on revising the simplified Type A procedures in the regulations for conducting natural resource damage assessments and restoration (NRDAR) for hazardous substance releases.
Rate Adjustments for Indian Irrigation Projects
The Bureau of Indian Affairs (BIA) owns or has an interest in irrigation projects located on or associated with various Indian reservations throughout the United States. We are required to establish irrigation assessment rates to recover the costs to administer, operate, maintain, and rehabilitate these projects. The MMPA also requires that we invite public comment before issuing a permit for any activity otherwise prohibited with respect to any species.

Endangered and Threatened Wildlife and Plants; Revision to the Section 4(d) Rule for the African Elephant
We, the U.S. Fish and Wildlife Service (Service), are extending the comment period on our November 17, 2022, proposed rule to revise the rule for the African elephant (Loxodonta africana) promulgated under section 4(d) of the Endangered Species Act of 1973, as amended (ESA). We are extending the comment period for 60 days to give all interested parties an additional opportunity to comment. Comments previously submitted need not be resubmitted as they are already incorporated into the public record and will be fully considered in the proposed rule.

2023 Civil Monetary Penalty Inflation Adjustments
Pursuant to the Federal Civil Penalties Inflation Adjustment Act of 1990 (codified at 28 U.S.C. 2461 note), as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (referred to herein as the ``Inflation Adjustment Acts''), and Office of Management and Budget (``OMB'') guidance, ONRR is adjusting for inflation the civil monetary penalty (``CMP'') amounts it assesses under the Federal Oil and Gas Royalty Management Act of 1982 (``FOGRMA'').
Mining of the Osage Mineral Estate for Oil and Gas
The Bureau of Indian Affairs (BIA) proposes to revise the regulations governing leasing of the Osage Nation's mineral estate (``Osage Mineral Estate'') for oil and gas mining. The proposed rule would allow the BIA to strengthen management of the Osage Mineral Estate by updating bonding, royalty payment and reporting, production valuation and measurement, site security, and operational requirements to address changes in technology and industry standards that have occurred in the 47 years since the regulations were issued. The proposed rule would also allow the BIA to respond to recommendations made by the Office of Inspector General, U.S. Department of the Interior (OIG).

Update of the Communications Uses Program, Cost Recovery Fee Schedules and Section 512 of FLPMA for Rights-of-Way: Reopening of Comment Period
On November 7, 2022, the Bureau of Land Management (BLM) published in the Federal Register a proposed rule to enhance the communications uses program, update its cost recovery fee schedules, and add provisions governing the development and approval of operations, maintenance, and fire prevention plans and agreements for rights-of-way (ROW) for electric transmission and distribution facilities (powerlines). The BLM has determined that it is appropriate to reopen the docket until January 23, 2023, to allow for additional public comment.
Endangered and Threatened Wildlife and Plants; Initiation of 5-Year Status Reviews of Five Listed Animal and Plant Species
We, the U.S. Fish and Wildlife Service, are initiating 5-year status reviews under the Endangered Species Act, for two plant and three animal species. A 5-year status review is based on the best scientific and commercial data available at the time of the review; therefore, we are requesting submission of any such information that has become available since the last review for the species. We invite comments from the public and Federal, Tribal, State, and local governments.
Gulf of Mexico OCS Oil and Gas Lease Sales 259 and 261: Final Supplemental Environmental Impact Statement
BOEM announces the availability of a final supplemental environmental impact statement, Gulf of Mexico OCS Oil and Gas Lease Sales 259 and 261: Final Supplemental Environmental Impact Statement (GOM Lease Sales 259 and 261 SEIS). The GOM Lease Sales 259 and 261 SEIS provides an analysis of potential environmental impacts of the proposed action and four alternatives and identifies BOEM's preferred alternative.

Endangered and Threatened Wildlife and Plants; Reclassifying Fender's Blue Butterfly From Endangered to Threatened With a Section 4(d) Rule
We, the U.S. Fish and Wildlife Service (Service or USFWS), are reclassifying Fender's blue butterfly (Icaricia icarioides fenderi) from endangered to threatened under the Endangered Species Act of 1973, as amended (Act). Fender's blue butterfly is endemic to the Willamette Valley of Oregon. This action is based on our evaluation of the best available scientific and commercial information, which indicates that the species' status has improved such that it is not currently in danger of extinction throughout all or a significant portion of its range, but that it is still likely to become so in the foreseeable future. We are also finalizing a rule issued under section 4(d) of the Act that provides for the conservation of the species.
